 <subsection id="HE563F288D5A4498D8C80965296DDBC38"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Title VIII Nursing Workforce Reauthorization Act of 2018</short-title></quote>.</text> </subsection><subsection id="HF35AFEC6DCEC4D0F897CCC8884633C77"><enum>(b)</enum><header>Table of contents</header><text display-inline="yes-display-inline">The table of contents of this Act is as follows:</text>

			</subsection></section><section id="H39F9ADB11B7C4C8AB282488931015CB4"><enum>2.</enum><header>General provisions</header>
 <subsection id="HC41BEFCC370C410792D311DCAE4D94D3"><enum>(a)</enum><header>Application</header><text>Section 802(c) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/296a">42 U.S.C. 296a(c)</external-xref>) is amended by striking <quote>shall address relevant national nursing needs that the project will meet</quote> and inserting <quote>shall address relevant national nursing needs that the project will address and how the project aligns with the national nursing service goals referred to in section 806(a)</quote>.</text>
 </subsection><subsection id="H9FF4089525D2444EA8B97C04057773A4"><enum>(b)</enum><header>Use of funds</header><text>Section 803 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/296b">42 U.S.C. 296b</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HFA1E64D509834DF9A3C1089752F8A7FD" style="OLC">
 <subsection id="HBCEBB57B88944F3390940E3955765AEA"><enum>(c)</enum><header>Supplement not supplant</header><text display-inline="yes-display-inline">Funds awarded as a grant under this title for a project or activity shall be used to supplement, not supplant, the non-Federal funds that would otherwise be made available for such project or activity.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H00609D77B7B64732B6B46B8457D04686"><enum>(c)</enum><header>Generally applicable provisions</header><text display-inline="yes-display-inline">Section 806 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/296e">42 U.S.C. 296e</external-xref>) is amended—</text> <paragraph id="H5EA8E1AAF841494B90448595639C850E"><enum>(1)</enum><text>in subsection (b), by amending paragraph (2) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H79F457B397184BB8BF1D9C38E65554D7" style="OLC">
 <paragraph id="HAC423151A0F545C89E51887D4B46A243"><enum>(2)</enum><header>Evaluations</header><text>The Secretary shall establish procedures to ensure the annual evaluation of programs and projects operated by recipients of grants under this title. Such procedures shall ensure that continued funding for such programs and projects will be conditioned upon the submission of—</text>
 <subparagraph commented="no" id="HB1E733A748314F33AF69BEFA29F1A0E0"><enum>(A)</enum><text>data demonstrating that satisfactory progress has been made by the program or project in meeting the performance outcome standards (as described in section 802) of such program or project; and</text>
 </subparagraph><subparagraph commented="no" id="H8BA561BCAC9C4621AD8C620BDB1FE568"><enum>(B)</enum><text>a detailed description of activities conducted by such program or project to meet such performance outcome standards.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HC4EDA41EB7654640ABDDAFAAED871117"><enum>(2)</enum><text>in subsection (e)(2), by inserting <quote>, and have relevant expertise and experience</quote> after <quote>who are not officers or employees of the Federal Government</quote>; and</text> </paragraph><paragraph id="HA5848C3F1864456DAD1DEC39921CA933"><enum>(3)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H43CF616B2B3046E8881D011E15940C62" style="OLC">
 <subsection commented="no" id="H3B215EA68A154E8DA6938E1D54405E38"><enum>(i)</enum><header>Annual report on nursing workforce programs</header><text>Annually, the Secretary shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate, and the Committee on Energy and Commerce of the House of Representatives, a report containing an assessment of the programs and activities of the Department of Health and Human Services related to enhancing the nursing workforce, including the extent to which programs and activities under this title meet identified goals and performance measures developed for the respective programs and activities.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection></section><section id="HD5B639659E654122AEF081A659398AAB"><enum>3.</enum><header>Nurse practitioners, nurse midwives, nurse anesthetists, and other advanced education nurses</header><text display-inline="no-display-inline">Section 811 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/296j">42 U.S.C. 296j</external-xref>) is amended—</text> <paragraph id="HE8A799A2C4CD4A9189DC1595C3701035"><enum>(1)</enum><text>in subsection (b)—</text>
 <subparagraph id="H02953FB8B8F64ADA96CC49F54ECFF15C"><enum>(A)</enum><text>by striking <quote>R.N./Master’s</quote> and inserting <quote>R.N./graduate</quote>; and</text> </subparagraph><subparagraph id="H0160FA061D4743D79CDD77A6CCD41BBC"><enum>(B)</enum><text>by inserting <quote>clinical nurse leaders,</quote> before <quote>or public health nurses</quote>;</text>
 </subparagraph></paragraph><paragraph id="H4989F44D90DF4A1B9FAFC72F74A18EC1"><enum>(2)</enum><text>by redesignating subsections (f) and (g) as subsections (g) and (h), respectively;</text> </paragraph><paragraph id="H54A0130098FE453893269F5C1EEC5468"><enum>(3)</enum><text>by inserting after subsection (e) the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HA9AD0E978326491FB73D9E0FF4B8AE6E" style="OLC">
 <subsection id="H97A763CE28B044C1B3D68728565DF83F"><enum>(f)</enum><header>Authorized clinical nurse specialist programs</header><text display-inline="yes-display-inline">Clinical nurse specialist programs eligible for support under this section are education programs that—</text>
 <paragraph id="H4907E751E06F49A3A2A7767FDB9025A7"><enum>(1)</enum><text>provide registered nurses with full-time clinical nurse specialist education; and</text> </paragraph><paragraph id="H4495C58C86494B69994226F92D7C8950"><enum>(2)</enum><text>have as their objective the education of clinical nurse specialists who will upon completion of such a program be qualified to effectively provide care through the wellness and illness continuum to inpatients and outpatients experiencing acute and chronic illness.</text></paragraph></subsection><after-quoted-block>; and </after-quoted-block></quoted-block>
 </paragraph><paragraph id="H2B502627146442FE8CB7040F94B3FB95"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H732D20B598A140E3962EA0EA3C08037B" style="OLC"> <subsection id="H50CF088047B44B55ABB5F90C3DD27460"><enum>(i)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $74,581,000 for each of fiscal years 2019 through 2023.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="HD933F09BBBE64A54BDBB9C45A13377CA"><enum>4.</enum><header>Increasing nursing workforce diversity</header><text display-inline="no-display-inline">Section 821 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/296m">42 U.S.C. 296m</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HC47A0DF77A86439DA6666D334A9B501D" style="OLC">
 <subsection id="H44FD3D54477D42758F85A04DEE024815"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section $17,343,000 for each of fiscal years 2019 through 2023.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H3F2074C8402F48E2B9840C6C486C1A75"><enum>5.</enum><header>Strengthening capacity for basic nurse education and practice</header>
 <subsection id="H4D5B7FFCF2BB4C9CBB3DBDF901152B7E"><enum>(a)</enum><header>Nurse education, practice, quality, and retention grants</header><text display-inline="yes-display-inline">Section 831 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/296p">42 U.S.C. 296p</external-xref>) is amended—</text> <paragraph id="HE323DD9A50BD467AA2328469F5F60D7F"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">and quality</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">quality, and retention</header-in-text></quote>;</text>
 </paragraph><paragraph id="HEB67AB6A17EC4FF8A680697DBF4F0EF6"><enum>(2)</enum><text>in subsection (b), by amending paragraph (2) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HC43F4025CD4E4FB6B815A119FAF428AB" style="OLC"> <paragraph id="H5F1FCF1E93344CEF8ED52B23D5E3BFCB"><enum>(2)</enum><text display-inline="yes-display-inline">providing care for underserved populations and high-risk groups, which may include the elderly, individuals with HIV/AIDS, individuals with mental health or substance use disorders, individuals who are homeless, and victims and survivors of domestic violence;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H2CE2878E5D1A4081BF3E5A596ACF909C"><enum>(3)</enum><text>in subsection (c), by amending paragraph (1) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H261BFD3165F14A5EA795D3E1650A5B56" style="OLC"> <paragraph id="H0386E49A82CD451F8FADD558EC987F7E"><enum>(1)</enum><header>Grants for career ladder programs</header><text display-inline="yes-display-inline">The Secretary may award grants to and enter into contracts with eligible entities for programs—</text>
 <subparagraph id="H8969C34DB8FE41C790CE39B215D6CFCE"><enum>(A)</enum><text>to promote career advancement for—</text> <clause id="HC240B2809E5449B8A29BC8259239A881"><enum>(i)</enum><text>nursing personnel in a variety of training settings, cross training or specialty training among diverse population groups, and the advancement of individuals, including to become professional registered nurses, advanced practice registered nurses, and nurses with graduate nursing education; and</text>
 </clause><clause id="HAA6F25555D8C4CB6B6B6BCD422781BC3"><enum>(ii)</enum><text>individuals, including licensed practical nurses, licensed vocational nurses, certified nurse assistants, and diploma degree or associate degree nurses, to become baccalaureate-prepared registered nurses or nurses with graduate nursing education;</text>
 </clause></subparagraph><subparagraph id="H6574B46418AE49D182295C4B849672E9"><enum>(B)</enum><text>to assist individuals in obtaining education and training required to enter the nursing profession and advance within such profession, such as by providing career counseling and mentoring; and</text>
 </subparagraph><subparagraph id="HA28CE1AB75AE403793961303FD30A561"><enum>(C)</enum><text>to develop and implement internships, accredited fellowships, and accredited residency programs in collaboration with one or more accredited schools of nursing to encourage mentoring and development of specialties.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H71EE78A5691D4E06999BD93FB15AA406"><enum>(4)</enum><text>by striking subsection (e) (relating to preference);</text> </paragraph><paragraph id="H9F40D13459304B78891F2985E04DEDC4"><enum>(5)</enum><text>by redesignating subsections (f) through (h) as subsections (e) and (g), respectively;</text>
 </paragraph><paragraph id="H5F981C2EFE54471FA0B2673FF060B939"><enum>(6)</enum><text display-inline="yes-display-inline">in subsection (e), as so redesignated, by striking <quote>The Secretary shall submit to the Congress before the end of each fiscal year a</quote> and inserting <quote>As part of the report on nursing workforce programs described in section 806(i), the Secretary shall</quote>;</text>
 </paragraph><paragraph id="H482CB2283E834BD6A395E46742C3962B"><enum>(7)</enum><text>by amending subsection (f), as redesignated by paragraph (5), to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H9DED63E1297644EF87B2DA0CCFC1FCBA" style="OLC"> <subsection id="H329E3CE5739947D98440FFE39F22E6EB"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section:</text>
 <paragraph id="HDFB9F7E22482409B9B549F6FF967AA4D"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> includes an accredited school of nursing, a health care facility, a partnership of such a school and facility, a federally qualified health center, or a nurse-managed health clinic.</text>
 </paragraph><paragraph id="HF82683FEB1394CF7BAB4226FF7293851"><enum>(2)</enum><header>Nurse-managed health clinic</header><text>The term <term>nurse-managed health clinic</term> means a nurse-practice arrangement, managed by advanced practice nurses, that provides primary care or wellness services to underserved or vulnerable populations that is associated with a school, college, university or department of nursing, federally qualified health center, or independent nonprofit health or social services agency.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H4FFF8EE5CBA444EC8B560A0501C157BF"><enum>(8)</enum><text>in subsection (g), as redesignated by paragraph (5), by striking <quote>such sums as may be necessary for each of fiscal years 2010 through 2014</quote> and inserting <quote>$41,913,000 for each of fiscal years 2019 through 2023</quote>.</text> </paragraph></subsection><subsection id="H8CC5D4EB136241D39F180E97AF6F9A9E"><enum>(b)</enum><header>Nurse retention grants</header><text>Section 831A of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/296p-1">42 U.S.C. 296p–1</external-xref>) is repealed.</text>
			</subsection></section><section id="H9BBAB0F44F3642ABBE20E3E7A18077D7"><enum>6.</enum><header>Student loans</header>
 <subsection id="H589FE8A775464830A787D5D99935118A"><enum>(a)</enum><header>Loan repayment and scholarship programs</header><text display-inline="yes-display-inline">Section 846 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/297n">42 U.S.C. 297n</external-xref>) is amended—</text> <paragraph id="H472A2B0D2FA34283925C1D7DB77DF611"><enum>(1)</enum><text>in subsection (b)(1), by striking <quote>he began such practice</quote> and inserting <quote>the individual began such practice</quote>;</text>
 </paragraph><paragraph id="H15BE2DE284624D24909F70E46857398D"><enum>(2)</enum><text>in subsection (d)(1), by striking <quote>(for fiscal years 2003 and 2004) and may (for fiscal years thereafter)</quote>;</text> </paragraph><paragraph id="H4103C9BCE8F647F8891DE1022967B6EF"><enum>(3)</enum><text>in subsection (h), in the matter preceding paragraph (1), by striking <quote>Not later than</quote> through <quote>regarding</quote> and inserting <quote>The annual report on nursing workforce programs, as required by section 806(i), shall include information regarding the programs carried out under this section, including</quote>; and</text>
 </paragraph><paragraph id="H95F0AE8621E249379E34D7A3D5577B47"><enum>(4)</enum><text>in subsection (i)(1), by striking <quote>such sums as may be necessary for each of fiscal years 2003 through 2007</quote> and inserting <quote>$87,135,000 for each of fiscal years 2019 through 2023</quote>.</text> </paragraph></subsection><subsection id="H7AA1BB7741BF4AEE9ED38CD271AD874A"><enum>(b)</enum><header>Nurse faculty loan program</header><text>Section 846A of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/297n-1">42 U.S.C. 297n–1</external-xref>) is amended by striking <quote>such sums as may be necessary for each of fiscal years 2010 through 2014</quote> and inserting <quote>$28,500,000 for each of fiscal years 2019 through 2023</quote>.</text>
 </subsection></section><section id="HB6952363FD04441F804559388E39A97F"><enum>7.</enum><header>National Advisory Council on Nurse Education and Practice</header><text display-inline="no-display-inline">Section 851 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/297t">42 U.S.C. 297t</external-xref>) is amended—</text> <paragraph id="H98F827B176C44A4BB7A2F88CEAB33F8C"><enum>(1)</enum><text>in subsection (b)(1)(A)(iv), by striking <quote>and nurse anesthetists</quote> and inserting <quote>nurse anesthetists, and clinical nurse specialists</quote>;</text>
 </paragraph><paragraph id="HEA44E37CC4E440EBBB788007474975B4"><enum>(2)</enum><text>in subsection (d), by amending paragraph (3) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H1A541036AD0245A6B1A52B418C1901C1" style="OLC"> <paragraph id="HF7E06D88DDF54B1AA43417FA0C1E5137"><enum>(3)</enum><text display-inline="yes-display-inline">not later than 2 years after the date of enactment of <short-title>the Title VIII Nursing Workforce Reauthorization Act of 2018</short-title>, and every 2 years thereafter, prepare and submit to the Secretary, the Committee on Health, Education, Labor, and Pensions of the Senate, and the Committee on Energy and Commerce of the House of Representatives, a report describing the activities of the Council, including findings and recommendations made by the Council concerning the activities under this title.</text></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block>
 </paragraph><paragraph id="H0A4A1E27E21E41599474B5DC674331E7"><enum>(3)</enum><text>in subsection (g), by striking <quote>under this title</quote> and inserting <quote>for carrying out parts B, C, and D of this title</quote>.</text> </paragraph></section><section id="HA4D95236804B43109A8AE40C0F4EC92D"><enum>8.</enum><header>Other provisions</header> <subsection id="HB97E0CA263E343FFBF06E621D6BBD20F"><enum>(a)</enum><header>Public service announcements</header><text>Part G of title VIII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/297w">42 U.S.C. 297w</external-xref> et seq.) is repealed.</text>
 </subsection><subsection id="HF8B68FDF38824FC88754FC0047AF4820"><enum>(b)</enum><header>Funding</header><text display-inline="yes-display-inline">Part I of title VIII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/298d">42 U.S.C. 298d</external-xref>) is repealed.</text> </subsection></section></legis-body> <attestation><attestation-group><attestation-date chamber="House" date="20180723">Passed the House of Representatives July 23, 2018.</attestation-date><attestor display="yes">Karen L.
