		<official-title display="yes">To prohibit or suspend certain health care providers from providing non-Department of Veterans
			 Affairs health care services to veterans, and for other purposes.</official-title>

 <section commented="no" display-inline="no-display-inline" id="id8AED6C10BE8545FEA2B72496AF951535" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Acquiring Community Care Expect Safe Services Act of 2017</short-title></quote> or the <quote><short-title>Veterans ACCESS Act</short-title></quote>.</text> </section><section commented="no" display-inline="no-display-inline" id="id70316CC019A943DABC6E595D45C2BCFA" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Prevention of certain health care providers from providing non-Department health care services to veterans</header> <subsection commented="no" display-inline="no-display-inline" id="id30468119e5c4445fb66c3790a41c18cb"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">On and after the date that is one year after the date of the enactment of this Act, the Secretary of Veterans Affairs shall deny or revoke the eligibility of a health care provider to provide non-Department health care services to veterans if the Secretary determines that the health care provider—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id58fae5297e7c4b2a896dbb929cee8c38"><enum>(1)</enum><text display-inline="yes-display-inline">was removed from employment with the Department of Veterans Affairs due to conduct that violated a policy of the Department relating to the delivery of safe and appropriate health care;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1c2e861f15274e6d9d301b3b5e8a6c2e"><enum>(2)</enum><text display-inline="yes-display-inline">violated the requirements of a medical license of the health care provider;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id80cc4cb58ba34801ae88109ae5f854a2"><enum>(3)</enum><text display-inline="yes-display-inline">had a Department credential revoked and the grounds for such revocation impacts the ability of the health care provider to deliver safe and appropriate health care; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idab7cdf30ad864acf82393cc7552c86c5"><enum>(4)</enum><text display-inline="yes-display-inline">violated a law for which a term of imprisonment of more than one year may be imposed.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id44276e3f349e43b8806e90892897027b"><enum>(b)</enum><header display-inline="yes-display-inline">Permissive action</header><text display-inline="yes-display-inline">On and after the date that is one year after the date of the enactment of this Act, the Secretary may deny, revoke, or suspend the eligibility of a health care provider to provide non-Department health care services if the Secretary has reasonable belief that such action is necessary to immediately protect the health, safety, or welfare of veterans and—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id52BC7E67992D4EE1948D51AA02FF0E41"><enum>(1)</enum><text display-inline="yes-display-inline">the health care provider is under investigation by the medical licensing board of a State in which the health care provider is licensed or practices;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0FD8DB2692BF45D4AA983D9731965647"><enum>(2)</enum><text display-inline="yes-display-inline">the health care provider has entered into a settlement agreement for a disciplinary charge relating to the practice of medicine by the health care provider; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2F1F7E90208F465C935C8500348672C0"><enum>(3)</enum><text display-inline="yes-display-inline">the Secretary otherwise determines that such action is appropriate under the circumstances.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id243CC9CD0C5B46C0BC497AE4D38AA0C2"><enum>(c)</enum><header display-inline="yes-display-inline">Suspension</header><text display-inline="yes-display-inline">The Secretary shall suspend the eligibility of a health care provider to provide non-Department health care services to veterans if the health care provider is suspended from serving as a health care provider of the Department.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="idbe3d9bbb6cde4c558b77670daacfde96"><enum>(d)</enum><header display-inline="yes-display-inline">Initial review of Department employment</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, with respect to each health care provider providing non-Department health care services, the Secretary shall review the status of each such health care provider as an employee of the Department and the history of employment of each such health care provider with the Department to determine whether the health care provider is described in any of subsections (a) through (c).</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id49b188500e754215b1c17c6b976bfb16"><enum>(e)</enum><header display-inline="yes-display-inline">Comptroller General report</header><text display-inline="yes-display-inline">Not later than two years after the date of the enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on the implementation by the Secretary of this section, including the following:</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id7c49a618e4a2488ebf17008f17795cc4"><enum>(1)</enum><text display-inline="yes-display-inline">The aggregate number of health care providers denied or suspended under this section from participation in providing non-Department health care services.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4f573fa8b5e247ab9166fe83690de1b1"><enum>(2)</enum><text display-inline="yes-display-inline">An evaluation of any impact on access to health care for patients or staffing shortages in programs of the Department providing non-Department health care services.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1eadf1ed1c5c42669d4fd8f336b44bca"><enum>(3)</enum><text display-inline="yes-display-inline">An explanation of the coordination of the Department with the medical licensing boards of States in implementing this section, the amount of involvement of such boards in such implementation, and efforts by the Department to address any concerns raised by such boards with respect to such implementation.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida1feb863cea84b9899ea8fb90b697118"><enum>(4)</enum><text display-inline="yes-display-inline">Such recommendations as the Comptroller General considers appropriate regarding harmonizing eligibility criteria between health care providers of the Department and health care providers eligible to provide non-Department health care services.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id64010ee42e254738ab9179eed583c705"><enum>(f)</enum><header display-inline="yes-display-inline">Non-Department health care services defined</header><text display-inline="yes-display-inline">In this section, the term <term>non-Department health care services</term> means services—</text> <paragraph commented="no" display-inline="no-display-inline" id="id5888cfc293d447b795322ac2ec8b049f"><enum>(1)</enum><text display-inline="yes-display-inline">provided under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code, at non-Department facilities (as defined in section 1701 of such title);</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf7cb978891b34e4f8152fe84a209e37e"><enum>(2)</enum><text display-inline="yes-display-inline">provided under section 101 of the Veterans Access, Choice, and Accountability Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/146">Public Law 113–146</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/1701">38 U.S.C. 1701</external-xref> note);</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id949efa50b9104b24ad62113ecb5cdf2d"><enum>(3)</enum><text display-inline="yes-display-inline">purchased through the Medical Community Care account of the Department; or</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id70be8d9f71c740b49971244197d71eaa"><enum>(4)</enum><text display-inline="yes-display-inline">purchased with amounts deposited in the Veterans Choice Fund under section 802 of the<pagebreak></pagebreak> Veterans Access, Choice, and Accountability Act of 2014.</text>
