 <text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Veterans Health Administration Reform Act of 2017</short-title></quote>.</text>

Sense of Congress regarding reforms at the Veterans Health Administration.</toc-entry> </toc> </subsection></section><section id="idA13640E7D2C848E9BC90DBE3E4767635"><enum>2.</enum><header>Establishment of Care in the Community Program</header> <subsection id="idF2386A63CAE34A489F4FE5517FA269A8"><enum>(a)</enum><header>Establishment of program</header> <paragraph commented="no" display-inline="no-display-inline" id="idECAAC46D27924464B25EE35023F30C1F"><enum>(1)</enum><header>In general</header><text>Section 1703 of title 38, United States Code, is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="idE7C50303712C4D629C7DA3E623C9F3DE" style="USC">
						<section id="id7B2021EDAD0C42A2B2DCB433E11810A3"><enum>1703.</enum><header>Care in the Community Program</header>
 <subsection id="id62087C3075FD4CC0BA8F77AC5898A465"><enum>(a)</enum><header>In general</header><paragraph commented="no" display-inline="yes-display-inline" id="id91D2B2CDAF894DAD969A27A72B70A025"><enum>(1)</enum><text>The Secretary may furnish care and services described in subsection (c) to eligible veterans described in subsection (b) from non-Department health care providers through the use of Veterans Care Agreements under section 1703A of this title, arrangements under subsection (d), or under any other law administered by the Secretary. The furnishing of care and services under this section may be referred to as the <quote>Care in the Community Program</quote>.</text>
 </paragraph><paragraph id="id2D002AA57F1644589442E1040279EE46" indent="up1"><enum>(2)</enum><text>For purposes of this section, care or services <term>furnished by</term> the Secretary means that the Secretary authorizes the care or services and pays for the care or services.</text>
 </paragraph><paragraph id="id21A1929D50114BC69EE630DA6739E285" indent="up1"><enum>(3)</enum><text>An eligible veteran may elect to decline to receive care or services furnished under this section and instead receive such care or services at a medical facility of the Department.</text>
 </paragraph></subsection><subsection id="idFB6C5FFC85EC469292E69A2E42EDB8ED"><enum>(b)</enum><header>Eligible veterans</header><paragraph commented="no" display-inline="yes-display-inline" id="idA614BEDC4CA744EFB96E5E35FD1B03CD"><enum>(1)</enum><text>A veteran is an eligible veteran for purposes of this section if the veteran is enrolled in the system of annual patient enrollment established and operated under section 1705 of this title and one or more of the following conditions apply:</text>
 <subparagraph id="idDB931B1AADDE4A9EB35A99EB0ABCD5BC" indent="up1"><enum>(A)</enum><text>The Secretary determines that it is in the clinical best interest of the veteran to access care or services outside of the Department.</text>
 </subparagraph><subparagraph id="id77e353c5974a40a4bd043066df3c5a85" indent="up1"><enum>(B)</enum><text>The veteran would experience an undue burden if the veteran seeks care or services from the Department.</text>
 </subparagraph><subparagraph id="id95129caafe3743ef884af696605f89c7" indent="up1"><enum>(C)</enum><text>It is not economical for the Department to provide the veteran the care or services that the veteran needs.</text>
 </subparagraph></paragraph><paragraph id="idB03D109BB08744228EA583AC91FBD1A1" indent="up1"><enum>(2)</enum><text>A determination by the Secretary under paragraph (1)(A) shall include an assessment of factors relating to the medical or clinical condition of the veteran and the timeliness of the Department in providing the care or services required by the veteran.</text>
 </paragraph><paragraph id="idD191BD5FFD1F4C719812F663501935DF" indent="up1"><enum>(3)</enum><text>For purposes of paragraph (1)(B), an undue burden—</text> <subparagraph id="id3F127AAB8B634A87B642C2F1D876F009"><enum>(A)</enum><text>means—</text>
 <clause id="id53451484EDEF48CF80059BCDDB625106"><enum>(i)</enum><text>an excessive driving distance, geographical challenges, or environmental factors impede the access of the veteran to care or services from the Department; or</text>
 </clause><clause id="idA9C24CE212A04FC5B8DBEFF1888A7DA2"><enum>(ii)</enum><text>the care or services sought by the veteran are not provided by a medical facility of the Department that is reasonably accessible to the veteran; and</text>
 </clause></subparagraph><subparagraph id="idCBDD3F14CD3C41CBA96559B029091A70"><enum>(B)</enum><text>may include other circumstances as determined by the Secretary upon assessing—</text> <clause id="id9144D0E6721E4191BD0537C873000DE3"><enum>(i)</enum><text>the nature or complexity of the care or services that the veteran requires;</text>
 </clause><clause id="id9B837F193D5C4CFB93E48D1E95824FD4"><enum>(ii)</enum><text>the frequency with which the veteran requires such care or services; and</text> </clause><clause id="id79EC67FB76D64F8FB9AAD2887F024D0E"><enum>(iii)</enum><text>the need for an attendant to provide required aid or physical assistance to the veteran for the veteran to travel to a medical facility of the Department.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="id7B65AE03EC5347E4BACD23E042CDA140"><enum>(c)</enum><header>Care and services described</header><text>Care and services described in this subsection are the following:</text> <paragraph id="id184D53553A9940B7B7F8D8DA4E163F5C"><enum>(1)</enum><text>Hospital care.</text>
 </paragraph><paragraph id="idA16473C837CF4286B4D34391CCBE9993"><enum>(2)</enum><text>Medical services.</text> </paragraph><paragraph id="id1445ECDB8001460E869CCD9C781BA30C"><enum>(3)</enum><text>Diagnostic care.</text>
 </paragraph><paragraph id="id03FF7D1B19CF4C7BA70CFA887AE38036"><enum>(4)</enum><text>With respect to veterans described in section 1712(a)(1)(F) of this title, outpatient dental services and treatment and related dental appliances.</text>
 </paragraph><paragraph id="id8F648CAEB7B94F0A925442942653296B"><enum>(5)</enum><text>Such other care or services as determined by the Secretary.</text> </paragraph></subsection><subsection id="idBA028FB0F3A04DB5AF5FE785CDA16B43"><enum>(d)</enum><header>Arrangements</header><paragraph commented="no" display-inline="yes-display-inline" id="idBA3F55EA48B9434BB4CDDD6BE4866009"><enum>(1)</enum><text>The Secretary may provide care and services under this section through arrangements described in paragraph (2).</text>
 </paragraph><paragraph id="id7379CDD451084ED88A25AE2890A57C16" indent="up1"><enum>(2)</enum><text>Arrangements described in this paragraph are the following:</text> <subparagraph id="id5F1B66EDC72D44F4883D67BCA9779AEC"><enum>(A)</enum><text>Health care coordination and sharing activities with the Department of Defense under section 8111 of this title.</text>
 </subparagraph><subparagraph id="id489A5D4ADC12418B8FAA3C61DE8809B7"><enum>(B)</enum><text>Arrangements under section 8153 of this title.</text> </subparagraph><subparagraph id="idE635635EE2184EDFBDA0ECDDAB694110"><enum>(C)</enum><text>Arrangements between the Secretary and the Director of the Indian Health Service.</text>
 </subparagraph><subparagraph id="idCDC0938508EF4D7FBF26BB563634C005"><enum>(D)</enum><text>Agreements under section 1745 of this title.</text> </subparagraph><subparagraph id="id4f117ae615f3449f8f0a51f2cc87dd5f"><enum>(E)</enum><text>Agreements with Federally-qualified health centers (as defined in section 1905(l)(2)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(l)(2)(B)</external-xref>)).</text>
 </subparagraph></paragraph><paragraph id="idFDA5EAF9C257484F8E09BB2F44F98AE4" indent="up1"><enum>(3)</enum><text>Nothing in this section may be construed to modify the way the Department, other Federal agencies, and States determine responsibility for payment under arrangements described in paragraph (2).</text>
 </paragraph></subsection><subsection id="idf71d1faaa2fd44ca9b4b09e7552ea626"><enum>(e)</enum><header>Prohibition on collection of payment</header><text>A health care provider that provides care or services under this section shall agree not to recover or collect payment from—</text>
 <paragraph id="id8DFB79A6A033406EAF0CE3E2A329F7D6"><enum>(1)</enum><text>an eligible veteran in connection with care or services furnished under this section; or</text> </paragraph><paragraph id="idE72B767EA5E947A29CDB68945BDECBFB"><enum>(2)</enum><text>a health-plan contract or other third party on behalf of the eligible veteran in connection with such care or services.</text>
 </paragraph></subsection><subsection id="id5002d17b1d8649a2af872b710e213d6d"><enum>(f)</enum><header>Electronic waiting list for care at Department facilities</header><paragraph commented="no" display-inline="yes-display-inline" id="id479AF30C640C4F7FA5F202A993B0C088"><enum>(1)</enum><text>If an eligible veteran seeks care or services under this section, the Secretary shall provide the veteran an opportunity to be included on an electronic waiting list maintained by the Department for an appointment for care or services described in subsection (c) at a medical facility of the Department.</text>
 </paragraph><paragraph id="id144847CF6627444C9AA187591977CBC6" indent="up1"><enum>(2)</enum><text>The electronic waiting list maintained under paragraph (1) shall allow access by each eligible veteran via www.myhealth.va.gov or any successor website (or other digital channel) for the following purposes:</text>
 <subparagraph id="id7d678598aed24b78986d4f8d53782d9e"><enum>(A)</enum><text>To determine the place of such eligible veteran on the waiting list.</text> </subparagraph><subparagraph id="id6919cfec971a41e18fee365f5a1470db"><enum>(B)</enum><text>To determine the average length of time an individual spends on the waiting list, disaggregated by medical facility of the Department and type of care or service needed, for purposes of allowing such eligible veteran to make an informed election to receive care or services under this section or at a medical facility of the Department.</text>
 </subparagraph></paragraph></subsection><subsection id="id488e44cd6e8547dcb3846ce43a626ff0"><enum>(g)</enum><header>Information on availability of care</header><text>The Secretary shall provide information to a veteran about the availability of care and services under this section in the following circumstances:</text>
 <paragraph id="id4601ccb0febe42f9a6747904e6e2dc72"><enum>(1)</enum><text>When the veteran enrolls in the system of annual patient enrollment established and operated under section 1705 of this title.</text>
 </paragraph><paragraph id="id4f4fa9cf478b43d986fa2fda5dab7f21"><enum>(2)</enum><text>When the veteran attempts to schedule an appointment for the receipt of care or services described in subsection (c) from the Department but is unable to schedule an appointment within the wait-time goals of the Veterans Health Administration for the furnishing of such care or services.</text>
 </paragraph><paragraph id="id01f0025dc52043129e8ad145a7d226a9"><enum>(3)</enum><text>When the veteran becomes eligible for care or services under this section under subparagraph (A), (B), or (C) of subsection (b)(1).</text>
 </paragraph></subsection><subsection id="id139ccbe1d977433b93bb97595ed827dc"><enum>(h)</enum><header>Follow-Up care</header><text>In carrying out this section, the Secretary shall ensure that, at the election of an eligible veteran who receives care or services from a health care provider in an episode of care under this section, the veteran receives such care or services from such health care provider through the completion of the episode of care (but for a period not exceeding one year), including all specialty and ancillary services deemed necessary as part of the treatment recommended in the course of such care or services.</text>
 </subsection><subsection id="id5803460c0a83498195020bc753c014a0"><enum>(i)</enum><header>Cost sharing</header><paragraph commented="no" display-inline="yes-display-inline" id="id9386BCA992BA479EBDE015D42A4B14F2"><enum>(1)</enum><text>The Secretary shall require an eligible veteran to pay a copayment for the receipt of care or services under this section only if such eligible veteran would be required to pay a copayment for the receipt of such care or services at a medical facility of the Department or from a health care provider of the Department.</text>
 </paragraph><paragraph id="idCA965CE52BE14613824A1A9EF04CC896" indent="up1"><enum>(2)</enum><text>The amount of a copayment charged under paragraph (1) may not exceed the amount of the copayment that would be payable by such eligible veteran for the receipt of such care or services at a medical facility of the Department or from a health care provider of the Department.</text>
 </paragraph></subsection><subsection id="id678C06EF85DA4D2D9A6877A40F84DC67"><enum>(j)</enum><header>Administration of program</header><paragraph commented="no" display-inline="yes-display-inline" id="id10DBF62589D044B38654FDC0CCCD3D18"><enum>(1)</enum><text>The Non-VA Care Coordination Program of the Department, working jointly with the Chief Business Office of the Department, shall administer the Care in the Community Program under this section.</text>
 </paragraph><paragraph id="id670D27C4DB0B4B6D8943B11B07D97126" indent="up1"><enum>(2)</enum><text>Administration of the Care in the Community Program shall include the following:</text> <subparagraph id="idD4E25B3EE89D49E08A22BF404577F0AA"><enum>(A)</enum><text>Ensuring that an eligible veteran receives an appointment for care or services under this section within—</text>
 <clause id="idE1A1EADF7C7F42A7913591718FE57B62"><enum>(i)</enum><text>the wait-time goals of the Veterans Health Administration; or</text> </clause><clause id="idE577123C34CB4F8B9214C9D65104ACC3"><enum>(ii)</enum><text>the period that a health care provider of the veteran at the Department determines the care or services are needed.</text>
 </clause></subparagraph><subparagraph id="id7AAF88BC0BD146DD9E8CCD7DB3606F1D"><enum>(B)</enum><text>Ensuring that the Secretary, including any contractors of the Secretary, pay health care providers on time.</text>
 </subparagraph><subparagraph id="idC1C9CAF942A3462EA7C28D7369E76198"><enum>(C)</enum><text>Ensuring that medical information of an eligible veteran who receives care or services under this section is sent to the health care provider of the veteran at the Department.</text>
 </subparagraph><subparagraph id="id0507D63BECC24139AFE46633DB6A4DB8"><enum>(D)</enum><text>Ensuring that the Secretary has information regarding any other health insurance of an eligible veteran.</text>
 </subparagraph></paragraph><paragraph id="idA193ED1D97AC49B4992BD4146E331A5E" indent="up1"><enum>(3)</enum><text>The Secretary shall ensure that the Non-VA Care Coordination Program of the Department and the Chief Business Office of the Department are working together effectively and efficiently throughout the process of furnishing care under this section.</text>
 </paragraph><paragraph id="id97555B509BCB42BF9C29D78B5D1E1E1F" indent="up1"><enum>(4)</enum><text>The Secretary shall notify the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives if any functions under this subsection require alteration or realignment.</text>
 </paragraph></subsection><subsection id="id2F62F57A08A0450E9E516E093EA4987B"><enum>(k)</enum><header>Payment of claims</header><paragraph commented="no" display-inline="yes-display-inline" id="idE797F1469C33476CB8719ABF037227ED"><enum>(1)</enum><text>The Secretary shall ensure that all payments of claims under this section comply with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/39">chapter 39</external-xref> of title 31 (commonly referred to as the <quote>Prompt Payment Act</quote>) and the requirements of this subsection. If there is a conflict between the requirements of the Prompt Payment Act and the requirements of this subsection, the Secretary shall comply with the requirements of this subsection.</text>
 </paragraph><paragraph id="ida5e84082259e47cf9feeef8bd43744b1" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idEA0F6E9DE78F462A9A4F15AA68F161EA"><enum>(A)</enum><text>Payment by the Secretary of claims under this section shall be issued, mailed, or otherwise transmitted with respect to not less than 95 percent of all such claims within 30 days after the date on which the claim is received, if—</text>
 <clause id="idca4dfac2b5fa4429b9f216b1495bbcc3" indent="up1"><enum>(i)</enum><text>the claim is a clean claim; and</text> </clause><clause id="id34b84ad07dce42448357ff1fce22b8c5" indent="up1"><enum>(ii)</enum><text>the claim is not one for which payment is made on a periodic interim payment basis.</text>
 </clause></subparagraph><subparagraph id="id7965a2f1208a4c6db4bb09e03447cc35" indent="up1"><enum>(B)</enum><text>In this paragraph, the term <term>clean claim</term> means a claim that has no defect or impropriety (including any lack of any required substantiating documentation) or particular circumstance requiring special treatment that prevents timely payment from being made on the claim under this section.</text>
 </subparagraph></paragraph><paragraph id="idb7a5619fb4f9483786965ff85e13b425" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id80CDE0D11EDB49BE99E5B2A64743EF9E"><enum>(A)</enum><text>The Secretary is the primary payer for all care or services furnished under this section.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEFF05A5814DD43E9BC346B5DAFAD261F" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The Secretary may recover or collect reasonable charges for care or services furnished under this section from a third party pursuant to section 1729 of this title or any other provision of law that would permit the Secretary to recover or collect the cost of care furnished at a facility of the Department or under the laws administered by the Secretary.</text>
 </subparagraph></paragraph></subsection><subsection id="idea8a393412b24c57aa4c022fd34d0d10"><enum>(l)</enum><header>Online portal</header><text>The Secretary shall establish an online portal that health care providers participating in the Care in the Community Program may use as follows:</text>
 <paragraph id="id42b45bceccb74e6892dee631edf64899"><enum>(1)</enum><text>To submit medical information with respect to eligible veterans furnished care or services under this section.</text>
 </paragraph><paragraph id="idbc1a471c6d014d09a22dab9e4ed077ac"><enum>(2)</enum><text>To file claims for payment for care or services furnished under this section.</text> </paragraph><paragraph id="idb290311444b5452bbb49dc6860500d9a"><enum>(3)</enum><text>To monitor the status of payment of claims under this section, including whether or not the claim was approved or rejected.</text>
 </paragraph><paragraph id="id49d3cc4d59344b679be93339b6ba9a00"><enum>(4)</enum><text>To determine whether the Secretary requires additional information before processing the claim.</text> </paragraph></subsection><subsection id="id0c65fc0ffece4ea0946c5eb806c514c8"><enum>(m)</enum><header>Annual report on contract care</header><paragraph commented="no" display-inline="yes-display-inline" id="idD21A1C64C4E2400C92DBA461D84C2D6C"><enum>(1)</enum><text>Not later than April 1 each year, the Secretary shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on health care contracted for under the laws administered by the Secretary, including under the Care in the Community Program.</text>
 </paragraph><paragraph id="id9C983439643041B5A42791B30A02AEB9" indent="up1"><enum>(2)</enum><text>Each report submitted under paragraph (1) shall—</text> <subparagraph id="idA83FF99ED7C649ECA72EE63BDC8A0F9F"><enum>(A)</enum><text>describe the use by the Secretary of Veterans Care Agreements under section 1703A of this title, arrangements under subsection (e), and other contracts or agreements for health care under this section or any other law administered by the Secretary;</text>
 </subparagraph><subparagraph id="idBF5DC182717C4F898AAC79EB206ADFBB"><enum>(B)</enum><text>state the number of such agreements, arrangements, or contracts entered into and the costs of such agreements, arrangements, or contracts, disaggregated by medical center of the Department; and</text>
 </subparagraph><subparagraph id="idE0A495B9A93D4714A70D64E1A05FFC8D"><enum>(C)</enum><text>include an assessment by the Central Office of the Veterans Health Administration of the efforts of such office to coordinate such agreements, arrangements, or contracts.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3C900525CC2C473D884FBDFB782098F4"><enum>(n)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section or section 1703A of this title shall be construed to prevent the Secretary from entering into regional or national contracts to provide prescription medication, dialysis treatment, prosthetics, and such other care or services under this section as the Secretary considers appropriate.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id940F04F17D664CAC95B353934A08A98F"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 17 of such title is amended by striking the item related to section 1703 and inserting the following new item:</text>

				</paragraph><paragraph id="id7d9a40d068584c469483bf4ff0330262"><enum>(3)</enum><header>Report on development and implementation of online portal</header>
 <subparagraph id="id62bd1588ad1646d2b98177c258662708"><enum>(A)</enum><header>In general</header><text>Not later than December 31, 2017, the Under Secretary for Health of the Department of Veterans Affairs shall submit to Congress a report on the development and implementation by the Department of Veterans Affairs of the online portal established under subsection (m) of section 1703 of title 38, United States Code, as added by paragraph (1), for the processing of claims by health care providers under the Care in the Community Program under such section.</text>
 </subparagraph><subparagraph id="id92D3EB6E72DB4620B2E2DB84315C17C8"><enum>(B)</enum><header>Elements</header><text>The report required by subparagraph (A) shall include the following:</text> <clause commented="no" display-inline="no-display-inline" id="id10A30396329147D9A655F1FDEFC753B2"><enum>(i)</enum><text display-inline="yes-display-inline">A detailed schedule for developing and implementing the online portal described in subparagraph (A).</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idA30D7D1D0C624DAE9F6123CDE4EF1C9A"><enum>(ii)</enum><text>An assessment of whether the online portal includes the following elements:</text> <subclause id="id4152f824ae524b4c90837c67777704ec"><enum>(I)</enum><text>Automatic adjudication of claims.</text>
 </subclause><subclause id="id9b2450013d5f453e8919272d4ba630cc"><enum>(II)</enum><text>Automated entry of authorizations for care or services.</text> </subclause><subclause id="idf974ba7c0242404593f96874c9b6fc0c"><enum>(III)</enum><text>A mechanism by which health care providers can electronically submit medical records, including health care providers that a veteran may have seen without authorization from the Department.</text>
 </subclause><subclause id="id92984a4f926b4995adafb6bf0a3d9be2"><enum>(IV)</enum><text>A web-based portal for health care providers to check the status of their claims.</text> </subclause></clause><clause id="ida77e81e1444c41418a2bb4c5e9969870"><enum>(iii)</enum><text>Estimated costs for developing and implementing each aspect of the online portal.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idEC25C85378DD489FBA1A2B27D70FF0EA"><enum>(iv)</enum><text>Performance goals, measures, and interim milestones that the Under Secretary for Health will use to evaluate progress, hold staff accountable for achieving desired results, and report to stakeholders on the impact of the online portal in modernizing the claims processing system of the Department.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="id1B7915FE6AE94E66AD5588721AFB5696"><enum>(b)</enum><header>Conforming amendments</header>
 <paragraph id="id5a0b6b62c7cd4a45817dc95f399fdf60"><enum>(1)</enum><header>Dental care</header><text>Section 1712(a)(3) of title 38, United States Code, is amended, in paragraph (3), by striking <quote>under clause (1), (2), or (5) of section 1703(a) of this title</quote> and inserting <quote>under section 1703 of this title</quote>.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7018ad563e104651896eee1fe44bc54e"><enum>(2)</enum><header>Readjustment counseling</header><text>Section 1712A(e)(1) of such title is amended by striking <quote>sections 1703(a)(2) and 1710(a)(1)(B) of this title</quote> and inserting <quote>sections 1703 and 1710(a)(1)(B) of this title</quote>.</text>
				</paragraph><paragraph id="idd263d84a31ad4fa488c5a4572dad75d3"><enum>(3)</enum><header>Conforming repeal of superseded authority</header>
 <subparagraph id="id0fbe31767cf6440e8d4df593ad19c040"><enum>(A)</enum><header>In general</header><text>Section 101 of the Veterans Access, Choice, and Accountability Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/146">Public Law 113–146</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/1701">38 U.S.C. 1701</external-xref> note) is repealed.</text>

 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5fb2734fff7e40b6b8504dbe0fd29229"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 74 of such title is amended by striking the item relating to section 7409.</text>
				</paragraph></subsection></section><section id="idfb5e4c62f18845b88d5220fff67d4642"><enum>3.</enum><header>Authorization of provider agreements under Care in the Community Program</header>
 <subsection id="id25d1cdd1dff44cb6aa116bfe3fe1c800"><enum>(a)</enum><header>In general</header><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/1703">section 1703</external-xref> the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="id9CFC7D61EDB447E8951A047D9E749578" style="USC">
					<section id="ide89384570eea4b22a134b29e82fe6be2"><enum>1703A.</enum><header>Care in the Community Program: provider agreements</header>
 <subsection id="id82f615fb6fe441869d9ac981c773d447"><enum>(a)</enum><header>Agreements To Furnish Care</header><text>The Secretary may furnish care and services under the Care in the Community Program under section 1703 of this title by entering into agreements under this section with eligible providers that are certified under subsection (c).</text>
 </subsection><subsection id="id1b397007031249b0969bc4da60ab3fa1"><enum>(b)</enum><header>Eligible providers</header><text>For purposes of this section, an eligible provider is one of the following:</text> <paragraph id="idc59d457d3ddb4a35b419610ab2e5642a"><enum>(1)</enum><text>A provider of services that has enrolled and entered into a provider agreement under section 1866(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395cc">42 U.S.C. 1395cc(a)</external-xref>).</text>
 </paragraph><paragraph id="idEAD8097B45A2482EAF7C542A9AF6FA69"><enum>(2)</enum><text>A physician or supplier that has enrolled and entered into a participation agreement under section 1842(h) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395u">42 U.S.C. 1395u(h)</external-xref>).</text>
 </paragraph><paragraph id="id8e486664caa44a87882ef30379441dd2"><enum>(3)</enum><text>A provider of items and services receiving payment under a State plan under title XIX of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.) or a waiver of such a plan.</text>
 </paragraph><paragraph id="idf98565a7b3f24e799fbd326f72e42980"><enum>(4)</enum><text>A provider that is—</text> <subparagraph id="id36FC4C85593A4817BEAD6DD825B96586"><enum>(A)</enum><text>an Aging and Disability Resource Center, an area agency on aging, or a State agency (as defined in section 102 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3002">42 U.S.C. 3002</external-xref>)); or</text>
 </subparagraph><subparagraph id="id50371691863146F4A880E6D599194414"><enum>(B)</enum><text>a center for independent living (as defined in section 702 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/796a">29 U.S.C. 796a</external-xref>)).</text>
 </subparagraph></paragraph><paragraph id="id4eecc6ae596e4308b2079c8834076c6d"><enum>(5)</enum><text>Such other health care providers as the Secretary considers appropriate for purposes of this section.</text>
 </paragraph></subsection><subsection id="id7377beb599c64b5a9cad0fa9fdc64c52"><enum>(c)</enum><header>Certification of eligible providers</header><text>The Secretary shall establish a process for the certification of eligible providers under this section.</text>
						</subsection><subsection id="idE1E4F9E2EDBD4635A08D1FB4C4461169"><enum>(d)</enum><header>Rates for care and services</header><paragraph commented="no" display-inline="yes-display-inline" id="idBB9F42295156448CABCBB42A2AC77139"><enum>(1)</enum>
 <text>Except as otherwise provided in this subsection, an eligible provider that enters into an agreement under this section to provide care or services under section 1703 of this title shall agree to accept as payment in full for such care or services an amount equal to the rate paid by the United States to a provider of services (as defined in section 1861(u) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(u)</external-xref>)) or a supplier (as defined in section 1861(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(d)</external-xref>)) under the Medicare program under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et seq.) for the same care or services.</text>
 </paragraph><paragraph commented="no" id="idF8EEB60670974394B2ED885F209CF6B8" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idB6C83B32E6A9409FA2D88320FD5A8A25"><enum>(A)</enum><text>A higher rate than the rate paid by the United States as described in paragraph (1) may be negotiated with respect to the furnishing of care or services to a veteran who resides in a highly rural area.</text>
 </subparagraph><subparagraph commented="no" id="id3AB6BF20C9EB4B5A92776C9F0AF219C6" indent="up1"><enum>(B)</enum><text>In this paragraph, the term <term>highly rural area</term> means an area located in a county that has fewer than seven individuals residing in that county per square mile.</text>
 </subparagraph></paragraph><paragraph id="id0DD064464A7D4FC6B74BA424545D6CA1" indent="up1"><enum>(3)</enum><text>With respect to furnishing care or services under this subsection in Alaska, the Alaska Fee Schedule of the Department of Veterans Affairs shall be followed, except for when another payment agreement, including a contract or provider agreement, is in place.</text>
 </paragraph><paragraph id="id34712B5D424B4460AABDF50726CCA838" indent="up1"><enum>(4)</enum><text>With respect to furnishing care or services under this subsection in a State with an All-Payer Model Agreement under section 1814(b)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395f">42 U.S.C. 1395f(b)(3)</external-xref>) that became effective on January 1, 2014, the Medicare payment rates under subparagraph (A) shall be calculated based on the payment rates under such agreement.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5BEC85F8114A42F8B7181A8EABAE6B2B" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">With respect to furnishing care or services under this subsection for which there is not a rate paid under the Medicare program as described in paragraph (1), such as dental care, obstetrics and gynecology, and other services, the rate paid for such care or services shall be determined by the Secretary.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id66018422085D4B27B21473FED2F3E09D" indent="up1"><enum>(6)</enum><text>In determining rates and making payments under this subsection, the Secretary may conduct pilot programs on alternative payment systems similar to those used under the Medicare program, including the Merit-based Incentive Payment System under section 1848(q) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4(q)</external-xref>) and alternative payment models (as defined in section 1833(z)(3)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(z)(3)(C)</external-xref>)).</text>
 </paragraph><paragraph commented="no" id="id501E21BB726E40128E3AB1783C416C1A" indent="up1"><enum>(7)</enum><text>If a higher rate than the rate specified in paragraph (1) is determined under this subsection, the Secretary shall notify the Centers for Medicare &amp; Medicaid Services regarding such higher rate.</text>
 </paragraph></subsection><subsection id="id02d6b8bb19664b3c819040af6a8907a9"><enum>(e)</enum><header>Treatment of certain laws</header><paragraph commented="no" display-inline="yes-display-inline" id="idCFCC3E3604D64CE8ADD49BC4B5F16BBC"><enum>(1)</enum><text>An agreement under this section may be entered into without regard to any contracting law that would require the Secretary to use competitive procedures in selecting the party with which to enter into the agreement.</text>
 </paragraph><paragraph id="id163565353B874737AE1520852BB6208E" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idFFBB7DC273494A26857F32BE5B91D3AF"><enum>(A)</enum><text>Except as provided in subparagraph (B) and unless otherwise provided in this section or regulations prescribed pursuant to this section, an eligible provider that enters into an agreement under this section is not subject to, in the carrying out of the agreement, any contracting law that an eligible provider described in subsection (b)(1), (b)(2), or (b)(3) is not subject to under the original Medicare fee-for-service program under parts A and B of title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et seq.) or the Medicaid program under title XIX of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.).</text>
 </subparagraph><subparagraph id="id60FC3030B9BB49C99CBB0C66019BCE5D" indent="up1"><enum>(B)</enum><text>The exclusion under subparagraph (A) does not apply to laws regarding integrity, ethics, fraud, or that subject a person to civil or criminal penalties.</text>
 </subparagraph></paragraph><paragraph id="id0E533DB54D974E34A9E5C7941875A6D1" indent="up1"><enum>(3)</enum><text>Title VII of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e</external-xref> et seq.) shall apply with respect to an eligible provider that enters into an agreement under this section to the same extent as such title applies with respect to the eligible provider in providing care or services through an agreement or arrangement other than under this section.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="iddeb24b40e17c43d98815bcf696ea3d81"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 17 of such title is amended by inserting after the item related to section 1703 the following new item:</text>
				<quoted-block display-inline="no-display-inline" id="id231F46E4F6B14596A5F13D6A5245A906" style="OLC"><toc><toc-entry bold="off" level="section">1703A. Care in the Community Program: provider agreements.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="id217928ed0f74415d9c887b6f0df68161"><enum>4.</enum><header>Expansion of reimbursement of  veterans for emergency treatment and urgent care</header>
 <subsection id="id5eebe11688d940059a97ecb4b46de9f3"><enum>(a)</enum><header>In general</header><text>Section 1725 of title 38, United States Code, is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="idD99169D277A947AF88EBFC46C250C6F9" style="USC"> <section id="idCEEA7FE54AEC41A685706C6FCA041AC4"><enum>1725.</enum><header>Reimbursement for emergency treatment and urgent care</header> <subsection id="id7700b9e8c91b40c2bf1c21b8749a8eeb"><enum>(a)</enum><header>In general</header><paragraph commented="no" display-inline="yes-display-inline" id="id052FE41EE1914F768E8CBDB8F1D781D5"><enum>(1)</enum><text>Subject to the provisions of this section, the Secretary shall reimburse a veteran described in subsection (b) for the reasonable value of emergency treatment or urgent care furnished the veteran in a non-Department facility.</text>
 </paragraph><paragraph id="id7A1CF3EB13F44E258BD3F232F750D6CC" indent="up1"><enum>(2)</enum><text>In any case in which reimbursement of a veteran is authorized under paragraph (1), the Secretary may, in lieu of reimbursing the veteran, make payment of the reasonable value of the furnished emergency treatment or urgent care directly—</text>
 <subparagraph id="idb5aaa6de356e4f699f99a851bfb660b4"><enum>(A)</enum><text>to the hospital or other health care provider that furnished the treatment or care; or</text> </subparagraph><subparagraph id="id3f5ef9405fc24f2ea6c3ebcb843247aa"><enum>(B)</enum><text>to the person or organization that paid for such treatment or care on behalf of the veteran.</text>
 </subparagraph></paragraph></subsection><subsection id="id8b3057abeba947ea8ca36ef2eaa859ee"><enum>(b)</enum><header>Eligibility</header><text>A veteran described in this subsection is an individual who—</text> <paragraph id="id84a0cc941e0543338e20ca01b3cad3bc"><enum>(1)</enum><text>is enrolled in the patient enrollment system of the Department established and operated under section 1705 of this title; and</text>
 </paragraph><paragraph id="id070c838fea93499ba291356a81fbaae5"><enum>(2)</enum><text>has received care under this chapter during the 24-month period preceding the furnishing of the emergency treatment or urgent care for which reimbursement is sought under this section.</text>
 </paragraph></subsection><subsection id="id68a7e1f297eb416db68c992c331768b0"><enum>(c)</enum><header>Emergency transportation</header><text>Notwithstanding section 111 of this title, reimbursement of emergency treatment or urgent care under this section shall include reimbursement for the reasonable value of emergency transportation.</text>
 </subsection><subsection id="idf4831625db5b4a57a4ef3c8eae8ecfc3"><enum>(d)</enum><header>Responsibility for payment</header><text>The Secretary shall be primarily responsible for reimbursing or otherwise paying the reasonable value of emergency treatment or urgent care under this section.</text>
 </subsection><subsection id="idf450fb6b38c14bd2a2fa66ecf9963fdf"><enum>(e)</enum><header>Limitations on payment</header><paragraph commented="no" display-inline="yes-display-inline" id="id956B4AB6D4B4487A8D45D86DD6D21A30"><enum>(1)</enum><text>The Secretary, in accordance with regulations prescribed by the Secretary for purposes of this section, shall—</text>
 <subparagraph id="id7725e07173b744398ee5865681aa9791" indent="up1"><enum>(A)</enum><text>establish the maximum amount payable under subsection (a); and</text> </subparagraph><subparagraph id="id8a6cd2b705814fa68f4ff92b1df5af46" indent="up1"><enum>(B)</enum><text>delineate the circumstances under which such payments may be made, including such requirements on requesting reimbursement as the Secretary may establish.</text>
 </subparagraph></paragraph><paragraph id="idb384d385f15049deaedcc12360873545" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id96A0A9BA188D4D42BBDA8DC250E90CDD"><enum>(A)</enum><text>Payment by the Secretary under this section on behalf of a veteran to a provider of emergency treatment or urgent care shall, unless rejected and refunded by the provider within 30 days of receipt—</text>
 <clause id="id3AB50FABD5B14A8F9DE67279545F0F76" indent="up1"><enum>(i)</enum><text>constitute payment in full for the emergency treatment or urgent care provided; and</text> </clause><clause id="id779BE65558B84321BBEA009080ADC9BE" indent="up1"><enum>(ii)</enum><text>extinguish any liability on the part of the veteran for that treatment or care.</text>
 </clause></subparagraph><subparagraph id="idB906FEFADD7B4508B471664E6902C43D" indent="up1"><enum>(B)</enum><text>Neither the absence of a contract or agreement between the Secretary and a provider of emergency treatment or urgent care nor any provision of a contract, agreement, or assignment to the contrary shall operate to modify, limit, or negate the requirements of subparagraph (A).</text>
 </subparagraph><subparagraph id="idd3fdfbfdd3ac47d5aed58f6f109ff32f" indent="up1"><enum>(C)</enum><text>A provider of emergency treatment or urgent care may not seek to recover from any third party the cost of emergency treatment or urgent care for which the provider has received payment from the Secretary under this section.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" id="id109c87a4dce54266bb647cd37a197594"><enum>(f)</enum><header>Recovery</header><text>The United States has the right to recover or collect reasonable charges for emergency treatment or urgent care furnished under this section in accordance with the provisions of section 1729 of this title.</text>
 </subsection><subsection id="id3F05992E5C1442DEAD7D4DE3F96BA1C5"><enum>(g)</enum><header>Cost sharing</header><paragraph commented="no" display-inline="yes-display-inline" id="idCB9A2678E3AF4B16A0A9E1778B21731B"><enum>(1)</enum><text>The Secretary shall require a veteran to pay a copayment for the receipt of emergency treatment or urgent care under this section only if such veteran would be required to pay a copayment for the receipt of such treatment or care at a medical facility of the Department or from a health care provider of the Department.</text>
 </paragraph><paragraph id="idF201E99A5CC34DD68C39CF4F0CD07346" indent="up1"><enum>(2)</enum><text>The amount of a copayment charged to a veteran under paragraph (1) may not exceed the amount of the copayment that would be payable by such veteran for the receipt of emergency treatment or urgent care at a medical facility of the Department or from a health care provider of the Department.</text>
 </paragraph></subsection><subsection id="id5832edce7c2349b78731322aa665cf7d"><enum>(h)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="idb092184bbe574f61a61ab77edbfbed3a"><enum>(1)</enum><text>The term <term>emergency treatment</term> means medical care or services furnished, in the judgment of the Secretary—</text>
 <subparagraph id="id9d2baffd5e6b4298a6a0eb01784a37d6"><enum>(A)</enum><text>when such care or services are rendered in a medical emergency of such nature that a prudent layperson reasonably expects that delay in seeking immediate medical attention would be hazardous to life or health; and</text>
 </subparagraph><subparagraph id="id24763fc604cf42dbbb81f8b4f5fda531"><enum>(B)</enum><text>until—</text> <clause id="ide65c9187f1654842b8190e689b092950"><enum>(i)</enum><text>such time as the veteran can be transferred safely to a Department facility or community care provider authorized by the Secretary and such facility or provider is capable of accepting such transfer; or</text>
 </clause><clause id="id6eb12f6a616342eeb833254604d4135b"><enum>(ii)</enum><text>such time as a Department facility or community care provider authorized by the Secretary accepts such transfer if—</text>
 <subclause id="id27a979ceb30e42bbbe23cf3c501bf34e"><enum>(I)</enum><text>at the time the veteran could have been transferred safely to such a facility or provider, no such facility or provider agreed to accept such transfer; and</text>
 </subclause><subclause id="iddd42fa4d0efe41f58c51041404e72992"><enum>(II)</enum><text>the non-Department facility in which such medical care or services was furnished made and documented reasonable attempts to transfer the veteran to a Department facility or community care provider.</text>
 </subclause></clause></subparagraph></paragraph><paragraph id="idf1725aa9def74659a1e54d13b4cc590b"><enum>(2)</enum><text>The term <term>health-plan contract</term> includes any of the following:</text> <subparagraph id="ide5487335bce64c8781fd5518c18d7e6d"><enum>(A)</enum><text>An insurance policy or contract, medical or hospital service agreement, membership or subscription contract, or similar arrangement under which health services for individuals are provided or the expenses of such services are paid.</text>
 </subparagraph><subparagraph id="idfccf92e8273c4630896ff5f63eb01c79"><enum>(B)</enum><text>An insurance program described in section 1811 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395c">42 U.S.C. 1395c</external-xref>) or established by section 1831 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395j">42 U.S.C. 1395j</external-xref>).</text>
 </subparagraph><subparagraph id="idf5a82849114b4c19a4f4eaa0c0e80331"><enum>(C)</enum><text>A State plan for medical assistance approved under title XIX of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.).</text> </subparagraph><subparagraph id="id0346329109c34d77aabaeb2b9e19ca3e"><enum>(D)</enum><text>A workers’ compensation law or plan described in section 1729(a)(2)(A) of this title.</text>
 </subparagraph></paragraph><paragraph id="id9c152b41df484fd88c7ed279fa25e1e1"><enum>(3)</enum><text>The term <term>third party</term> means any of the following:</text> <subparagraph id="id632ea881c3d346b2b192b443fb635775"><enum>(A)</enum><text>A Federal entity.</text>
 </subparagraph><subparagraph id="id4f962acf1d044c40a1348783ede0bb68"><enum>(B)</enum><text>A State or political subdivision of a State.</text> </subparagraph><subparagraph id="id8f0797ab4c0e408d9ca389bcdfc1c8ab"><enum>(C)</enum><text>An employer or an employer's insurance carrier.</text>
 </subparagraph><subparagraph id="id256e2930766c4b74bf50f621a894fa66"><enum>(D)</enum><text>An automobile accident reparations insurance carrier.</text> </subparagraph><subparagraph id="id904c12b084cf4ed9b57b8e93d5271d36"><enum>(E)</enum><text>A person or entity obligated to provide, or to pay the expenses of, health services under a health-plan contract.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id52991B3BFA96401A8310AB67355101EB"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>urgent care</term> shall have the meaning given that term by the Secretary in regulations prescribed by the Secretary for purposes of this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="idA5AE3358AEB2452ABEEBA1E3AAC51318"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 17 is amended by striking the item relating to section 1725 and inserting the following new item:</text>
				<quoted-block id="id0c945bd1-0d0a-4eb0-b934-24707cbf8ff7" style="USC"><toc><toc-entry idref="idCEEA7FE54AEC41A685706C6FCA041AC4" level="section">1725. Reimbursement for emergency treatment and urgent care.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>

 </paragraph><paragraph id="id113ae800ea7a4883b1f87cb80b35007c"><enum>(2)</enum><header>Health care of family members of veterans stationed at Camp Lejeune, North Carolina</header><text>Section 1787(b)(3) is amended by striking <quote>(as defined in section 1725(f) of this title)</quote> and inserting <quote>(as defined in section 1725(h) of this title)</quote>.</text> </paragraph></subsection><subsection id="id0f7db5f7452c439c865b153ae300e253"><enum>(e)</enum><header>Regulations</header><text>Not later than 270 days after the date of the enactment of this Act, the Secretary shall prescribe regulations to carry out the amendments made by this section.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id992F0F45C12A4CBA8F05B8D8C4724E63"><enum>(f)</enum><header>Effective date</header><text>The amendments made by this section shall take effect one year after the date of the enactment of this Act.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="idA58E684E08F44CFEB58222EA5A54E168"><enum>5.</enum><header>Memorandum of understanding between Department of Veterans Affairs and Centers for Medicare &amp; Medicaid Services</header>
 <subsection commented="no" display-inline="no-display-inline" id="id0473CAFD8430488280F1AC2970E4A6B4"><enum>(a)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the Secretary of Veterans Affairs should ensure that a veteran who is enrolled in Medicare or Medicaid, is eligible for care or services under the Care in the Community Program under section 1703 of title 38, United States Code, as amended by section 2(a)(1), and seeks care or services for a non-service-connected disability or condition, knows that the veteran may use his or her benefits under Medicare or Medicaid before the Secretary authorizes the use of funds of the Department of Veterans Affairs.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id28C0123DC960400E86BADEB6BD6E6226"><enum>(b)</enum><header>Purpose</header><text>The purpose of this section is to facilitate coordination and communication between the Department of Veterans Affairs and the Centers for Medicare &amp; Medicaid Services for the benefit of veterans in the receipt of health care.</text>
			</subsection><subsection id="id469890ecbcc44b46925bd00d6850354b"><enum>(c)</enum><header>Memorandum of understanding</header>
 <paragraph id="id0052AC030F0546BBA2219F60EF8C655C"><enum>(1)</enum><header>In general</header><text>The Secretary of Veterans Affairs and the Administrator of the Centers for Medicare &amp; Medicaid Services shall enter into a memorandum of understanding regarding the coordination of care between the Department of Veterans Affairs and the Centers for Medicare &amp; Medicaid Services.</text>
				</paragraph><paragraph id="id52d734e3153a45f9b88a75b0aeaeeef1"><enum>(2)</enum><header>Referral of patients</header>
 <subparagraph id="id24EE91FCB84D40BE9EBB6B5575F3342A"><enum>(A)</enum><header>In general</header><text>The memorandum of understanding under paragraph (1) shall permit health care providers of the Department of Veterans Affairs to refer veterans eligible for benefits under Medicare or Medicaid to non-Department health care providers in the community to use the Medicare or Medicaid benefits of such veterans.</text>
 </subparagraph><subparagraph id="id1B9F8EC746F045B7B34A41FD34C484AB"><enum>(B)</enum><header>Treatment of referral</header><text>Referral of a veteran under subparagraph (A) does not authorize the Secretary of Veterans Affairs—</text> <clause id="id8ECF91BF7A5F4B789920197F6C7A295D"><enum>(i)</enum><text>to use funds of the Department of Veterans Affairs to conduct the referral or pay for care or services furnished pursuant to such a referral; or</text>
 </clause><clause id="id1148A47C4D8546D58573BD3D59C4B66A"><enum>(ii)</enum><text>to furnish care or services to the veteran under the Care in the Community Program under section 1703 of title 38, United States Code, as amended by section 2(a)(1).</text>
 </clause></subparagraph></paragraph><paragraph id="idbd92d4c6b85c464f86591290a3eeccc1"><enum>(3)</enum><header>Sharing of information</header><text>As part of the memorandum of understanding under paragraph (1), the Secretary and the Administrator shall agree to share information in connection with the coordination of care under such memorandum, including by establishing a mechanism to share patient information.</text>
				</paragraph><paragraph id="id2f55c69b3e4a4f63857348f762abda0d"><enum>(4)</enum><header>Technical assistance for Care in the Community Program</header>
 <subparagraph id="id47E561A19F3A411DB4B48FB2319BFE27"><enum>(A)</enum><header>In general</header><text>As part of the memorandum of understanding under paragraph (1), the Administrator may provide technical assistance to the Secretary regarding the development of a program for non-Department health care providers to submit claims for reimbursement electronically under the Care in the Community Program under section 1703 of title 38, United States Code, as amended by section 2(a)(1).</text>
 </subparagraph><subparagraph id="idCC461BE8B97D48C088034153A5073323"><enum>(B)</enum><header>Interoperability and safety of information</header><text>In providing technical assistance under subparagraph (A), the Administrator shall provide advice regarding interoperability and methods for safeguarding the security of patient information.</text>
 </subparagraph><subparagraph id="id3CD8FEE603774A4C8DACFEC17E402F44"><enum>(C)</enum><header>Use of assistance</header><text>The Secretary shall use any technical assistance provided under subparagraph (A) in the development of a web-based self-service portal for non-Department health care providers to be used under subsection (l) of section 1703 of title 38, United States Code, as amended by section 2(a)(1).</text>
					</subparagraph></paragraph></subsection><subsection id="id7bd6a3ba90434758b31a6d1f5e194b65"><enum>(d)</enum><header>Education program</header>
 <paragraph id="id24C789445D9646AFABE1AFC0F1F6CCFE"><enum>(1)</enum><header>In general</header><text>The Secretary of Veterans Affairs and the Administrator of the Centers for Medicare &amp; Medicaid Services shall jointly develop and administer an education program to inform veterans how their benefits from the Department of Veterans Affairs are separate from and interact with their benefits under Medicare or Medicaid.</text>
 </paragraph><paragraph id="id92FA74FA049F49ACAD3115632FC6022E"><enum>(2)</enum><header>Elements of program</header><text>The education program under paragraph (1) shall—</text> <subparagraph id="idC032D6A89354414B867BABA11ED461EA"><enum>(A)</enum><text>assist veterans in making informed decisions about when to use benefits from the Department and when to use benefits under Medicare or Medicaid;</text>
 </subparagraph><subparagraph id="id8084AB1A24234ABC90C1C27F7E2224B9"><enum>(B)</enum><text>provide information on which services require referrals from the Department and which services require no referral; and</text>
 </subparagraph><subparagraph id="idEF662898558040ED8F5A570142496CA2"><enum>(C)</enum><text>explain any financial costs that may be required to receive care, including copayments under Medicare or from the Department.</text>
 </subparagraph></paragraph><paragraph id="idD2441A3EF1DA40948D9A69E63C908AE0"><enum>(3)</enum><header>Use of memorandum of understanding</header><text>The education program under paragraph (1) may be implemented pursuant to the memorandum of understanding under subsection (c).</text>
 </paragraph></subsection><subsection id="id109002a174aa4ac2891d83f65829c97d"><enum>(e)</enum><header>Rule of construction</header><text>This section may not be construed to authorize or require the Secretary of Veterans Affairs to reimburse the Administrator of the Centers for Medicare &amp; Medicaid Services for health care services or for the Administrator to reimburse the Secretary for such services.</text>
 </subsection><subsection id="id2DB96E70D1DD4629A5189F61D6D5FA80"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id665A3313AA2A4816AA9606C4FE684734"><enum>(1)</enum><header>Medicaid</header><text>The term <term>Medicaid</term> means the Medicaid program under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.).</text>
 </paragraph><paragraph id="id43642C2D4B5B4EB7ACF85FA06E0C9659"><enum>(2)</enum><header>Medicare</header><text>The term <term>Medicare</term> means the Medicare program under title XVIII of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et seq.).</text> </paragraph><paragraph id="id9236223BC07F45E5A23D41B9FFEF668F"><enum>(3)</enum><header>Non-service-connected</header><text>The term <term>non-service-connected</term> has the meaning given that term in section 101 of title 38, United States Code.</text>
				</paragraph></subsection></section><section id="id4cfab6cf4ef74006b00341cc601fd1ad"><enum>6.</enum><header>Education program on health care options from Department of Veterans Affairs</header>
 <subsection id="id2CE85F56FEFE4BAA88EA130DC2BBCB92"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall develop and administer an education program that teaches veterans about their health care options through the Department of Veterans Affairs.</text>
 </subsection><subsection id="id7D50469637034075ADE1467C081F4A84"><enum>(b)</enum><header>Elements</header><text display-inline="yes-display-inline">The program under subsection (a) shall—</text> <paragraph id="id2f2da7b1ee1146a68906ce7ac0bdcf04"><enum>(1)</enum><text>teach veterans about—</text>
 <subparagraph id="idA73872FE583C42E281259AB0BF2884E1"><enum>(A)</enum><text>eligibility criteria for care from the Department set forth under section 1710 of title 38, United States Code;</text>
 </subparagraph><subparagraph id="idC1A9661FC0FB46258EC2F997154F9CB8"><enum>(B)</enum><text>priority groups for enrollment in the system of annual patient enrollment under section 1705(a) of such title; and</text>
 </subparagraph><subparagraph id="id813E442B6BE049958E1C7C8FFB2B0230"><enum>(C)</enum><text>the copayments and other financial obligations, if any, required of certain individuals for certain services;</text>
 </subparagraph></paragraph><paragraph id="id7f5fb5ae23fb4ea389c1eb7b30e19840"><enum>(2)</enum><text>teach veterans about the interaction between health insurance (including private insurance, Medicare, Medicaid, the TRICARE program, and other forms of insurance) and health care from the Department; and</text>
 </paragraph><paragraph id="id07c55134a7b64d13a55230d037d2b2f7"><enum>(3)</enum><text>provide veterans information on what to do when they have a complaint about health care received from the Department (whether about the doctor, the Department, or any other type of complaint).</text>
 </paragraph></subsection><subsection id="id2D25162E8A714B49B7F8B4EF1E5C2BC7"><enum>(c)</enum><header>Inclusion of information from education program on Medicare and Medicaid</header><text>The education program under this section shall include information from the education program under section 6(d).</text>
 </subsection><subsection id="id2f94589a8b2a45f7a98756766c33c765"><enum>(d)</enum><header>Accessibility</header><text>In developing the education program under this section, the Secretary shall ensure that materials under such program are accessible to veterans who may not have access to the Internet.</text>
 </subsection><subsection id="idF9D77D84F9C845C1924397B10E7C9667"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id892B295D26154467A0D763335E6956CE"><enum>(1)</enum><header>Medicaid</header><text>The term <term>Medicaid</term> means the Medicaid program under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2B814CE265DD42B5971C53B55035E9F3"><enum>(2)</enum><header>Medicare</header><text>The term <term>Medicare</term> means the Medicare program under title XVIII of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et seq.).</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD4C0A6569DA1459DA1AA56621CE17BC0"><enum>(3)</enum><header>TRICARE program</header><text>The term <term>TRICARE program</term> has the meaning given that term in section 1072 of title 10, United States Code.</text>
				</paragraph></subsection></section><section id="id897a785c9b334366830077e5bddf4d6a"><enum>7.</enum><header>Training program for administration of Non-Department of Veterans Affairs health care</header>
 <subsection id="id373FED4FA8AD46E2BC9256220FC1A05A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall develop and implement a training program to train employees and contractors of the Department of Veterans Affairs on how to administer non-Department health care programs, including the following:</text>
 <paragraph id="id843C4D9B93234CA3970DB028B0C7B58E"><enum>(1)</enum><text>Reimbursement for non-Department emergency room and urgent care under section 1725 of title 38, United States Code.</text>
 </paragraph><paragraph id="idEE871DCCEBD94666832DDC1B752BAB06"><enum>(2)</enum><text>The Care in the Community Program under section 1703 of such title, as amended by section 2(a)(1).</text> </paragraph></subsection><subsection id="id94E31215C9BD44978B0D070802B663CC"><enum>(b)</enum><header>Inclusion of training on cooperation with Centers for Medicare &amp; Medicaid Services</header><text>The training program under subsection (a) shall include training on coordinating care between the Department and Medicare and Medicaid, including pursuant to the memorandum of understanding between the Secretary of Veterans Affairs and the Administrator of the Centers for Medicare &amp; Medicaid Services under section 6(a).</text>
 </subsection><subsection id="id3AA8019B542C46A7A0D09CABE3DF0F7A"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="idEE7958D82059462FB638F3C177D0A00B"><enum>(1)</enum><header>Medicaid</header><text>The term <term>Medicaid</term> means the Medicaid program under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD5A0325FE1FE43158542BB9328E7619C"><enum>(2)</enum><header>Medicare</header><text>The term <term>Medicare</term> means the Medicare program under title XVIII of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et seq.).</text> </paragraph></subsection></section><section id="id4b057e7f9ffb4c60ae929b1c46b3d1df"><enum>8.</enum><header>Analysis of electronic health record of Department of Veterans Affairs</header> <subsection id="id70091FF90C5F4056AEB22015ED0CB1D7"><enum>(a)</enum><header>In general</header><text>The Chief Information Officer of the Veterans Health Administration, in partnership with the Chief Information Officer of the Department of Veterans Affairs, shall conduct a comprehensive cost-benefit analysis among selecting a commercial off-the-shelf electronic health record, selecting an open source electronic health record, or continuing the in-house custom development of the VistA electronic health record currently in use by the Veterans Health Administration.</text>
 </subsection><subsection id="idBAAD25940A7740B7B37FCA2F71EC2A62"><enum>(b)</enum><header>Elements</header><text>The analysis conducted under subsection (a) shall—</text> <paragraph id="id9E5B9FC169B8447684F5F167D43DDDC9"><enum>(1)</enum><text>take into account the complexities of the computerized patient record system architecture and infrastructure of the VistA electronic health record and known issues with performance, scalability, extensibility, interoperability, and security of such health record; and</text>
 </paragraph><paragraph id="idB819FED3235C447E924B33B51140D134"><enum>(2)</enum><text>address full life-cycle costs, including development time (based on recent delivery trends), availability of development resources, maintenance and licensing costs, and infrastructure costs.</text>
				</paragraph></subsection><subsection id="id9b752b8a4ea24f338e0175a91f1d74fc"><enum>(c)</enum><header>Report</header>
 <paragraph id="idBE383AAFC71A48AA9B143F4285E81291"><enum>(1)</enum><header>Initial report</header><text>Not later than September 30, 2017, the Secretary of Veterans Affairs shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on the progress of the analysis conducted under subsection (a).</text>
 </paragraph><paragraph id="idb5aa74e65e33475fa28a94252056674d"><enum>(2)</enum><header>Final report</header><text>Not later than December 31, 2017, the Secretary shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives the results of the analysis conducted under subsection (a).</text>
				</paragraph></subsection></section><section id="id70e158faa1a843e3b6b98b4c8224e9ca"><enum>9.</enum><header>Reports assessing effectiveness of certain positions and offices of Department of Veterans Affairs</header>
			<subsection id="idC88293B873BE4F6F8B2EEE0B564758E8"><enum>(a)</enum><header>Report on CIO of Veterans Health Administration</header>
 <paragraph id="id3E4CA6ED4C814F0E8E9FE5E1D1469724"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than December 31, 2017, the Secretary of Veterans Affairs shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report assessing whether the Chief Information Officer of the Veterans Health Administration serves as an effective advocate for the information technology needs of the Department of Veterans Affairs for health care delivery.</text>
 </paragraph><paragraph id="id510100C536EC447AB87ACD18D7A9813C"><enum>(2)</enum><header>Elements</header><text display-inline="yes-display-inline">The report required by paragraph (1) shall include a description of the requirements for an effective health care management system that would advance the mission and goals of the Veterans Health Administration.</text>
 </paragraph><paragraph id="idA26328B9F7C24561AB1D41D02A1CC4CE"><enum>(3)</enum><header>Use of information</header><text display-inline="yes-display-inline">In preparing the report under paragraph (1), the Secretary shall include information from the Under Secretary for Health of the Department of Veterans Affairs and the Chief Information Officer of the Department of Veterans Affairs.</text>
				</paragraph></subsection><subsection id="id94b5a2a51d214fcbb14cd1a7372fb7d3"><enum>(b)</enum><header>Report on Office of Information and Technology</header>
 <paragraph id="id5265D66896DD49A1AC62916C6E2C4B2C"><enum>(1)</enum><header>In general</header><text>Not later than December 31, 2017, the Secretary of Veterans Affairs shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report assessing whether the Office of Information and Technology of the Department of Veterans Affairs acts as a service provider and delivers information technology capabilities and services that improve health care delivery to veterans.</text>
 </paragraph><paragraph id="idD0D3C476BC674E14BB6AEE343288DC7D"><enum>(2)</enum><header>Use of survey data</header><text>In preparing the report under paragraph (1), the Secretary shall include the results of clinician and veteran surveys assessing the quality of and satisfaction with capabilities and services of the Department.</text>
				</paragraph></subsection></section><section id="id3c89d5dccb0e4409b112438a6983770b"><enum>10.</enum><header>Sense of Congress regarding reforms at the Veterans Health Administration</header>
 <subsection id="idF9ACF34B1861425FB3730914A6BC3827"><enum>(a)</enum><header>Findings</header><text>Congress finds that section 201 of the Veterans Access, Choice, and Accountability Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/146">Public Law 113–146</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/1701">38 U.S.C. 1701</external-xref> note) required an independent assessment of the hospital care, medical services, and other health care furnished in medical facilities of the Department of Veterans Affairs. That assessment provided valuable insight into needed reforms at the Veterans Health Administration, particularly with respect to governance, operations, data and tools, and leadership.</text>
			</subsection><subsection id="id42FE65DFE1704698B2FB734B2F1372A4"><enum>(b)</enum><header>Sense of Congress</header>
 <paragraph id="id23F72841635547B789A032E2F50855A5"><enum>(1)</enum><header>In general</header><text>It is the sense of Congress that the Secretary of Veterans Affairs should take every effort to address as many of the reforms described in subsection (a) as practicable.</text>
 </paragraph><paragraph id="idC9839A9E88644B209CEB8B3F6CA2BEA1"><enum>(2)</enum><header>Elements</header><text>In making reforms described in subsection (a), it is the sense of Congress that the Secretary should do the following:</text>
 <subparagraph id="id04d7eaffdfb4453d8c063c9a57b31ba1"><enum>(A)</enum><text>Improve the overall management of the Veterans Health Administration as follows:</text> <clause id="id0a9139780b1941edb66768a3447ed0c4"><enum>(i)</enum><text>By ensuring that the Administration provides the decision making rights, authorities, and responsibilities to the lowest appropriate level. Such decision making rights, authorities, and responsibilities should be articulated by level, organization, and role, and should be standardized to the extent possible while allowing local flexibility based on local needs.</text>
 </clause><clause id="id3dde95a572fa4e608654d06a41e85fbf"><enum>(ii)</enum><text>By clarifying the roles and responsibilities of the Central Office of the Administration, the Veterans Integrated Service Networks, the medical centers of the Department, the community-based outpatient clinics of the Department, and other organizational entities, while prioritizing providing support to the field.</text>
 </clause><clause id="id496316791ac541ec999782aafdf49797"><enum>(iii)</enum><text>By reassessing all of the directed metrics and policies of the Central Office of the Administration to ensure those metrics and policies add sufficient value to patient outcomes. The Secretary should eliminate the metrics and policies that do not add sufficient value to patient outcomes.</text>
 </clause><clause id="id1a63bf9d74014117a450e88af916f766"><enum>(iv)</enum><text>By reviewing the implementation of the Patient Aligned Care Team staffing model of the Department, including by determining areas for improvement, to examine—</text>
 <subclause id="id191DD4B6DEF94F23A2CBABB7C7EE4DF2"><enum>(I)</enum><text>causes of gaps in facility benchmarks between actual, maximum, modeled, and external benchmarks; and</text>
 </subclause><subclause id="idC307472E1E874B7E8512B15AA387BB5B"><enum>(II)</enum><text>impacts on access to quality of care and appropriateness of performance standards and guidelines.</text> </subclause></clause></subparagraph><subparagraph id="idc5bcc8f3a0a5477e9a9583ecd3daba80"><enum>(B)</enum><text>Improve collaboration between the Office of Information and Technology of the Department and the Veterans Health Administration.</text>
 </subparagraph><subparagraph id="id09ce37410564407eb5d15a0d732b94a9"><enum>(C)</enum><text>Improve resource management and business processes by—</text> <clause id="ida87a765f56d849aebbfd24e25453b656"><enum>(i)</enum><text>prioritizing the use of a patient-centered demand model that forecasts resources needed by geographic location to improve access and make informed resourcing decisions; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="ided02b0f1caac41e99f912f35efde446a"><enum>(ii)</enum><text>improving coordination across patient access, clinical administration, and patient accounting functions by forming an internal committee of key revenue cycle and administrative stakeholders, standardizing the recovery processes for billing, improving third-party contracts management, and developing approaches to resolve frequently recurring denials.</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
