			 detention and their conditions, to solve and prevent violent crimes and
			 other crimes, to exonerate the innocent, to prevent DNA analysis backlogs,
			 and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
 <section commented="no" display-inline="no-display-inline" id="H5179C803035C4B4298A0159651C75168" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rapid DNA Act of 2017</short-title></quote>.</text> </section><section commented="no" display-inline="no-display-inline" id="H8022571016D84EE49C2502BF70D3FF70" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Rapid DNA instruments</header> <subsection commented="no" display-inline="no-display-inline" id="H0362F69C8A9E41AFB93926809B806D8B"><enum>(a)</enum><header display-inline="yes-display-inline">Standards</header><text display-inline="yes-display-inline">Section 210303(a) of the DNA Identification Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/14131">42 U.S.C. 14131(a)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H3C03318223EA41E09293E00BC0D2FC4A" style="OLC">
 <paragraph commented="no" display-inline="no-display-inline" id="H30A973DFB96E4CC4B1DFD7F0A4FB2DF2"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H0CDE1A49B48E4C1490AF6D6CD4BC6863"><enum>(A)</enum><text display-inline="yes-display-inline">In addition to issuing standards as provided in paragraphs (1) through (4), the Director of the Federal Bureau of Investigation shall issue standards and procedures for the use of Rapid DNA instruments and resulting DNA analyses.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H61A9C9C0170E4723BAFDDCCF8D448D33" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">In this Act, the term <quote>Rapid DNA instruments</quote> means instrumentation that carries out a fully automated process to derive a DNA analysis from a DNA sample.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="HD57E4BBB367E431084269992AA63B5D8"><enum>(b)</enum><header display-inline="yes-display-inline">Index</header><text display-inline="yes-display-inline">Paragraph (2) of section 210304(b) of the DNA Identification Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/14132">42 U.S.C. 14132(b)(2)</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H921BA3C143A9471390077E4BFFD53CC1" style="OLC">
 <paragraph commented="no" display-inline="no-display-inline" id="HA297CBD86B834D51B2053A36E0EBACD9"><enum>(2)</enum><text display-inline="yes-display-inline">prepared by—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HCD9C4CA0D0BD43DD85940C6405748EE7"><enum>(A)</enum><text display-inline="yes-display-inline">laboratories that—</text>
 <clause commented="no" display-inline="no-display-inline" id="HEDCD7144566140D784764075AB60E9AC"><enum>(i)</enum><text display-inline="yes-display-inline">have been accredited by a nonprofit professional association of persons actively involved in forensic science that is nationally recognized within the forensic science community; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="HDA8E8BB7AC95481CBE56CFA6DADD162C"><enum>(ii)</enum><text display-inline="yes-display-inline">undergo external audits, not less than once every 2 years, that demonstrate compliance with standards established by the Director of the Federal Bureau of Investigation; or</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H04F6A6D5F458489D81DA9716EA93C37F"><enum>(B)</enum><text display-inline="yes-display-inline">criminal justice agencies using Rapid DNA instruments approved by the Director of the Federal Bureau of Investigation in compliance with the standards and procedures issued by the Director under section 210303(a)(5); and</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H34F13A41751C44AAB38C3ABEDAC34A70" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Conforming amendments relating to collection of DNA identification information</header>
 <subsection commented="no" display-inline="no-display-inline" id="id834E2CF1728741039493007A6F87B392"><enum>(a)</enum><header display-inline="yes-display-inline">From certain Federal offenders</header><text display-inline="yes-display-inline">Section 3 of the DNA Analysis Backlog Elimination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/14135a">42 U.S.C. 14135a</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="id0094B6CC18E949CA96B4EA7486C0F14F"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b), by adding at the end the following: <quote>The Director of the Federal Bureau of Investigation may waive the requirements under this subsection if DNA samples are analyzed by means of Rapid DNA instruments and the results are included in CODIS.</quote>; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id96E0901B797144EABB0675214658D40F"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c), by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idAB758148A84E46DDAD20848482B406A2" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="id63871470B4AD4E5B818E76B4C56ABC33"><enum>(3)</enum><text display-inline="yes-display-inline">The term <quote>Rapid DNA instruments</quote> means instrumentation that carries out a fully automated process to derive a DNA analysis from a DNA sample.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF42335E758E64157BFC2674AC6928396"><enum>(b)</enum><header display-inline="yes-display-inline">From certain District of Columbia offenders</header><text display-inline="yes-display-inline">Section 4 of the DNA Analysis Backlog Elimination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/14135b">42 U.S.C. 14135b</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="id5A98675F8EAF4929B1C13FFEFA989F67"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b), by adding at the end the following: <quote>The Director of the Federal Bureau of Investigation may waive the requirements under this subsection if DNA samples are analyzed by means of Rapid DNA instruments and the results are included in CODIS.</quote>; and</text>
