	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
 <section id="id0912fdc6-9b14-4a0f-bd22-40077e577f88" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border Security Technology Accountability Act of 2017</short-title></quote>.</text> </section><section id="H599910663A8C41CF8A64C622802515BC"><enum>2.</enum><header>Border security technology accountability</header> <subsection id="HB8EE84E535714E1EA6F883F0351CB35D"><enum>(a)</enum><header>In general</header><text>Subtitle C of title IV of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/231">6 U.S.C. 231</external-xref> et seq.) is amended by adding at the end the following:</text>

					<section id="HF39CC231EB3F412884E87EFCABF444CF"><enum>434.</enum><header>Border security technology program management</header>
 <subsection id="H0065F47B5F4B4AD1B2560A0E732CA59A"><enum>(a)</enum><header>Planning documentation</header><text>For each border security technology acquisition program of the Department that is determined to be a major acquisition program, the Secretary shall—</text>
 <paragraph id="H753A171ABEFF423EA335F19862611D79"><enum>(1)</enum><text>ensure that each such program has a written acquisition program baseline approved by the relevant acquisition decision authority;</text>
 </paragraph><paragraph id="H7AA14F21FD93415394AA7046D6D05963"><enum>(2)</enum><text>document that each such program is meeting cost, schedule, and performance thresholds as specified in such baseline, in compliance with relevant departmental acquisition policies and the Federal Acquisition Regulation; and</text>
 </paragraph><paragraph id="HD54FDFC59C0D423C933573626A46745B"><enum>(3)</enum><text>have a plan for meeting program implementation objectives by managing contractor performance.</text> </paragraph></subsection><subsection id="H457B3B0F2E4041548C2D98EB8176A288"><enum>(b)</enum><header>Adherence to standards</header><text>The Secretary, acting through the Under Secretary for Management and the Commissioner of U.S. Customs and Border Protection, shall ensure that border security technology acquisition program managers who are responsible for carrying out this section adhere to relevant internal control standards identified by the Comptroller General of the United States. The Commissioner shall provide information, as needed, to assist the Under Secretary in monitoring proper program management of border security technology acquisition programs under this section.</text>
 </subsection><subsection id="H914E3F0486E34218998BE993D1D3029B"><enum>(c)</enum><header>Plan</header><text display-inline="yes-display-inline">The Secretary, acting through the Under Secretary for Management, and in coordination with the Under Secretary for Science and Technology and the Commissioner of U.S. Customs and Border Protection, shall submit a plan to the appropriate congressional committees for testing and evaluation, and the use of independent verification and validation resources, for border security technology so that new border security technologies are evaluated through a series of assessments, processes, and audits to ensure—</text>
 <paragraph id="id841229EBD4AE4E7D90C56B6213784A88"><enum>(1)</enum><text display-inline="yes-display-inline">compliance with relevant departmental acquisition policies and the Federal Acquisition Regulation; and</text>
 </paragraph><paragraph id="id1EB18ADB63C844D3A04195A9D6C5C7A7"><enum>(2)</enum><text display-inline="yes-display-inline">the effectiveness of taxpayer dollars.</text> </paragraph></subsection><subsection id="HC4F0EE6CDBB246209C2A489ADDC3C8B9"><enum>(d)</enum><header>Major acquisition program defined</header><text display-inline="yes-display-inline">In this section, the term <term>major acquisition program</term> means a Department acquisition program that is estimated by the Secretary to require an eventual total expenditure of at least $300,000,000 (based on fiscal year 2017 constant dollars) over its life cycle cost.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H000CA14DB1224CC796820AB2C2B14529"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents of the Homeland Security Act of 2002 is amended by inserting after the item relating to section 433 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H619770BF68184E3DB2D218A6944EBA67" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 434. Border security technology program management.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection></section><section id="HD8B226E3A6BA4E49B224219255A22E87"><enum>3.</enum><header>Prohibition on additional authorization of appropriations</header><text display-inline="no-display-inline">No additional funds are authorized to be appropriated to carry out this Act or the amendments made by this Act. This Act and such amendments shall be carried out using amounts otherwise available for such purposes.</text></section></legis-body><endorsement><action-date>April 16, 2018</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
