		<official-title>To prohibit the use of official time for labor organizing activities by employees of the Department
			 of Veterans Affairs unless all veterans seeking hospital care or medical
			 services from the Department are able to schedule their appointments
			 within the wait-time goals of the Veterans Health Administration, and for
			 other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Serve Veterans First Act of 2017</short-title></quote>.</text>
		</section><section id="id40BD7DAB7F10441996A238B860D351DF"><enum>2.</enum><header>Temporary prohibition on use of official time by employees of Department of Veterans Affairs for
			 labor organizing activities</header>
 <subsection id="id969E3B90037443A0AF43904E2CBAE0C7"><enum>(a)</enum><header>Temporary prohibition</header><text>Notwithstanding section 7131 of title 5, United States Code, no employee of the Department of Veterans Affairs may use official time for any purpose relating to a labor organization—</text>
 <paragraph id="id83A5FB7EB8224579AD567FD851502239"><enum>(1)</enum><text>before any determination has been made under subsection (b); or</text> </paragraph><paragraph id="idE8236A4B71E847C096EC2B559EA250C3"><enum>(2)</enum><text>if the most recent determination made under subsection (b) was that a veteran attempted to schedule an appointment for the receipt of hospital care or a medical service under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code, but was unable to schedule the appointment within the wait-time goals of the Veterans Health Administration for the furnishing of such care or service.</text>
				</paragraph></subsection><subsection id="id869627DCCA32428C89BF4821C2A8F406"><enum>(b)</enum><header>Determinations</header>
 <paragraph id="id0A6B5C023E754A15A87CBE04279719A2"><enum>(1)</enum><header>Annual determinations</header><text>At the end of each calendar year, the Inspector General of the Department shall determine whether any veteran attempted, during such year, to schedule an appointment for the receipt of hospital care or a medical service under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code, but was unable to schedule the appointment within the wait-time goals of the Veterans Health Administration for the furnishing of such care or service.</text>
 </paragraph><paragraph id="id300146D571744ADFAED4059AB4D23342"><enum>(2)</enum><header>Investigations and subsequent determinations</header><text>The Inspector General of the Department—</text> <subparagraph id="idC3C4EB1E271F46BB9D8A3C6D4D461497"><enum>(A)</enum><text>shall investigate each report the Inspector General receives of the case of an attempt by a veteran to schedule an appointment for the receipt of hospital care or a medical service under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code, in which the veteran was unable to schedule the appointment within the wait-time goals of the Veterans Health Administration for the furnishing of such care or service; and</text>
 </subparagraph><subparagraph id="idB7E3B2986DE8457E80C09707F458F72D"><enum>(B)</enum><text>may, pursuant to an investigation carried out under subparagraph (A), determine that a veteran attempted to schedule an appointment for the receipt of hospital care or a medical service under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code, but was unable to schedule the appointment within the wait-time goals of the Veterans Health Administration for the furnishing of such care or service.</text>
 </subparagraph></paragraph></subsection><subsection id="idf8122559c72147e4b3af8dbedcf5fc80"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id188CFD2A32EA459A9439F2467C417FDC"><enum>(1)</enum><header>Official time</header><text>The term <term>official time</term> means any period of time—</text>
 <subparagraph id="id51ad2786e6934d59acc11fa96159b17a"><enum>(A)</enum><text>which may be granted to an employee under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/71">chapter 71</external-xref> of title 5, United States Code, including a collective bargaining agreement entered into under such chapter, or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/74">chapter 74</external-xref> of title 38, United States Code, to perform representational or consultative functions; and</text>
 </subparagraph><subparagraph id="id6aa137ed48c34f2f93c176308d7bf718"><enum>(B)</enum><text>during which the employee would otherwise be in a duty status.</text> </subparagraph></paragraph><paragraph id="idD35D102A1E764778BEE34E1542E65257"><enum>(2)</enum><header>Wait-time goals of the Veterans Health Administration</header><text>The term <term>wait-time goals of the Veterans Health Administration</term> means not more than 30 days from the date on which a veteran requests an appointment for hospital care or medical services from the Department of Veterans Affairs.</text>
