 </subsection></section><section commented="no" id="HA3B4906A16FF406084E681B1133C83D2"><enum>2.</enum><header>Modification to annual determination of staffing shortages in Veterans Health Administration</header><text display-inline="no-display-inline">Section 7412(a) of title 38, United States Code, is amended—</text> <paragraph id="HCAEDD07B26A347B5BF0036100EE4DF1A"><enum>(1)</enum><text>by striking <quote>the five occupations</quote> and inserting <quote>at a minimum, the five clinical occupations and the five nonclinical occupations</quote>; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF4B7BC579A714B179244EC82BCA4DD81"><enum>(2)</enum><text>by striking <quote>throughout the Department</quote> and inserting <quote>with respect to each medical center of the Department,</quote>.</text> </paragraph></section><section id="H781393ED306642F79708902AD89E282F"><enum>3.</enum><header>Establishment of Department of Veterans Affairs Executive Management Fellowship Program</header> <subsection id="H39D37A70E79746A3A0BB2D5198EF5CAC"><enum>(a)</enum><header>Fellowship program</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/7">Chapter 7</external-xref> of title 38, United States Code, is amended by adding at the end the following new subchapter:</text>
				<quoted-block display-inline="no-display-inline" id="HAA547C3820B746388C253DE7424D3544" style="USC">
					<subchapter id="H41F67279CB2C4C89831F2E995DD02BF6"><enum>III</enum><header>Executive Management Fellowship Program</header>
						<section id="HB0106BC3B5B14536B6C41A4F6C32B98A"><enum>741.</enum><header>Executive Management Fellowship Program</header>
 <subsection id="H6B9BE02035CB4A68880234866031237D"><enum>(a)</enum><header>Fellowship program</header><text display-inline="yes-display-inline">There is in the Department an Executive Management Fellowship Program. The purpose of the program shall be to provide—</text>
 <paragraph id="HCE6310176EA5427593D07D605C538743"><enum>(1)</enum><text>eligible employees of the Veterans Benefits Administration and the Veterans Health Administration with training and experience in the private sector; and</text>
 </paragraph><paragraph commented="no" id="H834F2D6405C9421A80E8AF27D97B0C22"><enum>(2)</enum><text>eligible employees of a private-sector entity with training and experience in the Department of Veterans Affairs.</text>
 </paragraph></subsection><subsection id="HAD986C2644FD489784C09F318A7F1259"><enum>(b)</enum><header>Fellowship</header><paragraph commented="no" display-inline="yes-display-inline" id="H021559FC42B64D41AD44B13ED675F908"><enum>(1)</enum><text>A fellowship provided under this section is a 1-year fellowship during which—</text> <subparagraph id="HE41C79AC2D2C42E3A5AB0D70469C5988" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to a Department participant, the participant receives training and experience at a private-sector entity that is engaged in the administration and delivery of health care or other services similar to the benefits administered by the Secretary; and</text>
 </subparagraph><subparagraph commented="no" id="HD927DE5CD144444EA3E1FB4494699350" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to a private-sector participant, the participant receives training and experience at the Veterans Benefits Administration or the Veterans Health Administration.</text>
 </subparagraph></paragraph><paragraph id="H438DA83B055741238D7E97F77EDD6B5E" indent="up1"><enum>(2)</enum><text>The Secretary shall enter into such agreements with private-sector entities as are necessary to carry out this section.</text>
 </paragraph></subsection><subsection id="H710243778DC94A8DB0AB8AC3C21B14D6"><enum>(c)</enum><header>Selection of recipients</header><paragraph commented="no" display-inline="yes-display-inline" id="HF98B889DFBD14D929E1CD9D1D80D8787"><enum>(1)</enum><text>In August of each year, the Secretary shall select—</text> <subparagraph id="HA7782732B94D41DFBC8BF81A96CB5C35" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">not fewer than 18 and not more than 30 eligible employees of the Veterans Benefits Administration and the Veterans Health Administration to receive a fellowship under this section; and</text>
 </subparagraph><subparagraph commented="no" id="H5999B0A717414861A42729F6AFF3FA03" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">not fewer than 18 and not more than 30 eligible employees of private-sector entities to receive a fellowship under this section.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HACAE2E31DDBB45198755CAAAA50A6238" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">To the extent practicable, the Secretary shall select eligible employees under subparagraphs (A) and (B) of paragraph (1) from among eligible employees who are veterans in a manner that is reflective of the demographics of the veteran population of the United States and that whenever practicable provides a preference to such employees who represent or service rural areas.</text>
 </paragraph></subsection><subsection id="HFCEAF8C8D33443B499AAE17F9EE4CBF6"><enum>(d)</enum><header>Eligible employees</header><text>For the purposes of this section, an eligible employee is—</text> <paragraph id="H813E65970260400DBB555AB9EA43B6FF"><enum>(1)</enum><text>with respect to an employee of the Veterans Benefits Administration or the Veterans Health Administration, an employee who—</text>
 <subparagraph display-inline="no-display-inline" id="H2F083938619F424D9360943B913F5835"><enum>(A)</enum><text display-inline="yes-display-inline">is compensated at a rate of basic pay not less than the minimum rate of basic pay payable for grade GS–14 of the General Schedule and not more than either the minimum rate of basic pay payable to a member of the Senior Executive Service under section 5382 of title 5 or the minimum rate of basic pay payable pursuant to chapter 74 of this title, as the case may be;</text>
 </subparagraph><subparagraph display-inline="no-display-inline" id="H5D03A090DC9C456380E0951FE0BD99DC"><enum>(B)</enum><text>enters into an agreement with the Secretary under subsection (e); and</text> </subparagraph><subparagraph display-inline="no-display-inline" id="H61DDACA7EC1C4C4095F67127157CED5D"><enum>(C)</enum><text display-inline="yes-display-inline">submits to the Secretary an application containing such information and assurances as the Secretary may require; and</text>
 </subparagraph></paragraph><paragraph id="HF8C77FC289C542F8AB8E0BA9C7AA3498"><enum>(2)</enum><text>with respect to an employee of a private-sector entity, an employee who—</text> <subparagraph commented="no" id="H6D9B32D4D7A54FB9832C28A5AAAF5A6C"><enum>(A)</enum><text display-inline="yes-display-inline">is employed in a position whose duties and responsibilities are commensurate with an employee of the Department described in paragraph (1);</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H71C9C66618D743E891814D94E213C8B7"><enum>(B)</enum><text>enters into an agreement with the Secretary under subsection (e); and</text> </subparagraph><subparagraph display-inline="no-display-inline" id="H3037B305D32041529C7C1975FF7652B8"><enum>(C)</enum><text display-inline="yes-display-inline">submits to the Secretary an application containing such information and assurances as the Secretary may require.</text>
 </subparagraph></paragraph></subsection><subsection id="H0AF4492E385247558CF4AEA7D2638E64"><enum>(e)</enum><header>Agreements</header><paragraph commented="no" display-inline="yes-display-inline" id="H251382ABE0244F08A2A13214914D06AB"><enum>(1)</enum><text>An agreement between the Secretary and a Department participant shall be in writing, shall be signed by the participant, and shall include the following provisions:</text>
 <subparagraph id="H7FE4718974664E8E9CC7D8C17DD9350B" indent="up1"><enum>(A)</enum><text>The Secretary’s agreement to provide the participant with a fellowship under this section.</text> </subparagraph><subparagraph id="H7443D4B453434F9C98FC6A0B42F605C5" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The participant’s agreement—</text>
 <clause id="H6CE49BC43E184BCF88FAFC614050C24B"><enum>(i)</enum><text>to accept the fellowship;</text> </clause><clause id="H5E78A3DCEC9A44AE898F9810B33A7723"><enum>(ii)</enum><text>after completion of the fellowship, to serve as a full-time employee in the Veterans Benefits Administration or the Veterans Health Administration for at least 2 years as specified in the agreement; and</text>
 </clause><clause id="H15137DEEFE9C4D368133CF0B0F1B8D78"><enum>(iii)</enum><text display-inline="yes-display-inline">that, during the 2-year period beginning on the last day of the fellowship, the participant will not accept employment in the same industry as the industry of the private-sector entity at which the participant accepts the fellowship.</text>
 </clause></subparagraph><subparagraph id="HF5E3CF0403E1446495E1CFD3C2CF8F18" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">A provision that any financial obligation of the United States arising out of an agreement entered into under this subchapter, and any obligation of the participant which is conditioned on such agreement, is contingent upon funds being appropriated.</text>
 </subparagraph><subparagraph id="H98101821BD8A40AEB7F510C8055E3F1F" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">A statement of the damages to which the United States is entitled under this subchapter for the participant’s breach of the agreement.</text>
 </subparagraph><subparagraph id="HAB69B68C4C84418591A4D5B72DDEF6C3" indent="up1"><enum>(E)</enum><text>Such other terms as the Secretary determines are required to be included in the agreement.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC47B61EC2AB54A979D6AA80659EBD8A8" indent="up1"><enum>(2)</enum><text>An agreement between the Secretary and a private-sector participant shall be in writing, shall be signed by the participant, and shall include the following provisions:</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H33259FA8F3E34B17B9990AC450E62B6E"><enum>(A)</enum><text display-inline="yes-display-inline">The Secretary’s agreement to provide the participant with a fellowship under this section.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2A13C52AC92A4362AFF3EE1EB58A41C8"><enum>(B)</enum><text display-inline="yes-display-inline">The participant’s agreement to accept the fellowship.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC7DDA7F38D46408B9B3CE96F4D9EFEC8"><enum>(C)</enum><text>Such other terms as the Secretary determines are required to be included in the agreement.</text> </subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H5621EFA14D82464C992192921D83EBA4"><enum>(f)</enum><header>Treatment of recipients</header><paragraph commented="no" display-inline="yes-display-inline" id="H4188BD5397A24313B6D7F555594C6F13"><enum>(1)</enum><text>A Department participant shall be considered an employee of the Department for all purposes, including for purposes of receiving a salary and benefits, and shall remain eligible for all promotion and incentive programs otherwise available to such an employee.</text>
 </paragraph><paragraph commented="no" id="H85E25C9E2C30422DB24C33D9669733BA" indent="up1"><enum>(2)</enum><text>A private-sector participant shall be considered an employee of the private-sector entity that employs the participant for all purposes, including for purposes of receiving a salary and benefits, and during the fellowship shall be treated as a contractor of the Department.</text>
 </paragraph></subsection><subsection display-inline="no-display-inline" id="HC2CFE856B1AC4FBB834AEA6BEB2F1225"><enum>(g)</enum><header>Reports</header><paragraph commented="no" display-inline="yes-display-inline" id="id48D204831DD24214AB9F1E12A5E157A4"><enum>(1)</enum><text display-inline="yes-display-inline">Not later than 60 days after completing a fellowship under this section, a recipient of the fellowship shall submit to the Secretary a report on the fellowship.</text>
 </paragraph><paragraph display-inline="no-display-inline" id="idC464DC42A15243DA9CC2AC1551BD8444" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Each such report shall describe the duties of the recipient during the fellowship and any recommendations of the recipient for the application by the Secretary of industry processes, technologies, and best practices.</text>
 </paragraph><paragraph display-inline="no-display-inline" id="id5C624C9660E447B5850D912DB0383620" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Not later than 7 days after receiving each such report, the Secretary shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives such report without change.</text>
 </paragraph></subsection><subsection commented="no" id="H18E5A0957315454AB0E95252551848D0"><enum>(h)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HB2A8CBB858414BDC846B26CAF78689AD"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>Department participant</term> means an employee of the Veterans Benefits Administration or the Veterans Health Administration who is participating in the fellowship under this section.</text>
 </paragraph><paragraph id="H0614AA4B9C714452BAD5DBBFAA3EB360"><enum>(2)</enum><text>The term <term>private-sector entity</term> includes an entity operating under a public-private partnership.</text> </paragraph><paragraph id="H5878975E313E42C9982C54078AFDAA9F"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>private-sector participant</term> means an employee of a private-sector entity who is participating in the fellowship under this section.</text></paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HA54C9FA87A88454CA1A02A679B7FB72E"><enum>(b)</enum><header>Deadline for implementation</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretary of Veterans Affairs shall implement the Executive Management Fellowship Program required under section 741 of title 38, United States Code, as added by subsection (a).</text>
 </subsection><subsection id="H3EB77DD2E3FD48569A98ADF9DE15305D"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/7">chapter 7</external-xref> of title 38, United States Code, is amended by adding at the end the following new items:</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="HADEF49C72B9E4673B8EA3C0155276934"><enum>4.</enum><header display-inline="yes-display-inline">Accountability of leaders for managing the Department of Veterans Affairs</header>
 <subsection commented="no" display-inline="no-display-inline" id="H273DE3E1946943CA8C261DA644077336"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/7">chapter 7</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/717">section 717</external-xref> the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H29166194DC604830B6AFD363A13CAD2F" style="USC">
					<section commented="no" display-inline="no-display-inline" id="HADBCAE81A4FA4BA8951F3DFDBAAA68F1"><enum>719.</enum><header>Annual performance plan for political appointees</header>
 <subsection commented="no" display-inline="no-display-inline" id="HD9D15C7E21074DFABCBACFBF041AE16D"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall conduct an annual performance plan for each political appointee of the Department that is similar to the annual performance plan conducted for an employee of the Department who is appointed as a career appointee (as that term is defined in section 3132(a) of title 5) within the Senior Executive Service at the Department.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H6CADA414C6984648B8FB34A6119A0253"><enum>(b)</enum><header>Elements of plan</header><text>Each annual performance plan conducted under subsection (a) with respect to a political appointee of the Department shall include an assessment of whether the appointee is meeting the following goals:</text>
 <paragraph id="HEE53AF1D4D024A37B906C4144030FB80"><enum>(1)</enum><text>Recruiting, selecting, and retaining well-qualified individuals for employment at the Department.</text> </paragraph><paragraph id="H3473892199A741CCA4D87A47C3050510"><enum>(2)</enum><text>Engaging and motivating employees.</text>
 </paragraph><paragraph id="HE62A57CB85D948A99C85EA249C3E4F93"><enum>(3)</enum><text>Training and developing employees and preparing those employees for future leadership roles within the Department.</text>
 </paragraph><paragraph id="H2BBF321783A64A8E8EE0A6C2D8063B1E"><enum>(4)</enum><text>Holding each employee of the Department that is a manager accountable for addressing issues relating to performance, in particular issues relating to the performance of employees that report to the manager.</text>
 </paragraph></subsection><subsection id="H71CC653166E040BAA6502A3C30E5C404"><enum>(c)</enum><header>Definition of political appointee</header><text>In this section, the term <term>political appointee</term> means an employee of the Department who holds—</text> <paragraph id="H6D64DF9AA2A44334B6A43E6720D08397"><enum>(1)</enum><text display-inline="yes-display-inline">a position which has been excepted from the competitive service by reason of its confidential, policy-determining, policy-making, or policy-advocating character; or</text>
 </paragraph><paragraph id="HCC93B580E462408F82A3A632693B50D4"><enum>(2)</enum><text display-inline="yes-display-inline">a position in the Senior Executive Service as a noncareer appointee (as such term is defined in section 3132(a) of title 5).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="HB32BB3FCB9E544B08C15C7035D19206F"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of chapter 7 of such title is amended by inserting after the item relating to section 717 the following new item:</text>
				<quoted-block id="H218777C499224D85B43C9CCEF15BC9AF" style="USC"><toc><toc-entry idref="HADBCAE81A4FA4BA8951F3DFDBAAA68F1" level="section">719. Annual performance plan for political appointees.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HD683CF07C4F548FD8B9012AF03B91CD0"><enum>5.</enum><header>Reemployment of former employees at Department of Veterans Affairs</header>
 <subsection id="H42A1BC09ED514212AE6463BF086284B5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding sections 3309 through 3318 of title 5, United States Code, the Secretary of Veterans Affairs may noncompetitively appoint a qualified former career or career conditional employee to any position within the competitive service at the Department of Veterans Affairs that is one grade or equivalent higher than the grade or equivalent of the position at the Department most recently occupied by the employee.</text>
 </subsection><subsection display-inline="no-display-inline" id="HCEFF6B8D64A34CB689DEDC49912036CC"><enum>(b)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Secretary may not appoint a qualified former employee to a position that is more than one grade (or equivalent) higher than the position at the Department most recently occupied by the employee.</text>
 </subsection><subsection id="H1C4AC61CB37E459EA0B7A02943B8A903"><enum>(c)</enum><header>Definition of qualified former employee</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>qualified former employee</term> means any individual who—</text> <paragraph id="H856B1B90274A445184CF31C044AD9E38"><enum>(1)</enum><text>formerly occupied any career or career conditional position at the Department of Veterans Affairs within 2 years before applying for reemployment at the Department;</text>
 </paragraph><paragraph id="H2A652FBFF3A74BD0B849F14790F0C62A"><enum>(2)</enum><text>voluntarily left such position, or was subject to a reduction in force, and had a satisfactory performance record while occupying such position; and</text>
 </paragraph><paragraph id="H403FAFE1494A4C54BA995D5341A43F7C"><enum>(3)</enum><text>since leaving such position has maintained licensing requirements, related to the position, if any, and gained skill, knowledge, or other factors related to the position.</text>
				</paragraph></subsection></section><section id="H0A744A71831E490F984F4632AB88360D" section-type="subsequent-section"><enum>6.</enum><header>Recruiting database at Department of Veterans Affairs</header>
 <subsection id="H0C963B9223C74519B668EF1F1E27A252"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall establish a single database that lists—</text> <paragraph id="HB3785153FA4643BBBE28192D884FB3C0"><enum>(1)</enum><text display-inline="yes-display-inline">each vacant position in the Department of Veterans Affairs that the Secretary determines is critical to the mission of the Department, difficult to fill, or both; and</text>
 </paragraph><paragraph id="H26AD2D772E4C4172973AAA72610E1C67"><enum>(2)</enum><text display-inline="yes-display-inline">each vacant position in the Department of Veterans Affairs for a mental health professional.</text> </paragraph></subsection><subsection id="H35A7DDD0877B439D92711FFD3138EAD6"><enum>(b)</enum><header>Qualified applicant</header><text>If the Secretary determines that an applicant for a vacant position listed in the database established under subsection (a) is qualified for such position but does not select the applicant for such position, the Secretary, at the election of the applicant, may consider the applicant for other similar vacant positions listed in the database for which the applicant is qualified.</text>
 </subsection><subsection display-inline="no-display-inline" id="H1FC12C0974F74D0D8E338EE2E69D6AF0"><enum>(c)</enum><header>Prolonged vacancies</header><text>If the Secretary does not fill a vacant position listed in the database established under subsection (a) after a period determined appropriate by the Secretary, the Secretary—</text>
 <paragraph id="HD679735BBACF420D9FC79DE7C8354BA0"><enum>(1)</enum><text>may ensure that applicants described in subsection (b) are considered for such position; and</text> </paragraph><paragraph id="H4D08AD4B6EAE41448788CBEEC3B11D17"><enum>(2)</enum><text>may use the database established under subsection (a) to assist in filling such position.</text>
 </paragraph></subsection><subsection id="HA8B5C3462D744F0CA52BE363B25C1096"><enum>(d)</enum><header>Report</header><text>Not later than one year after the date of the enactment of this Act, the Secretary shall submit to Congress a report on the use and efficacy of the database established under subsection (a).</text>
			</subsection></section><section id="H4EDFC982F2724DBCABFD85066BD98354"><enum>7.</enum><header>Training for human resources professionals of Veterans Health Administration on recruitment and
			 retention</header>
 <subsection id="HDCFC51D538DE40639359BD1321D0895A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall provide to human resources professionals of the Veterans Health Administration training on how to best recruit and retain employees of the Veterans Health Administration, including with respect to any recruitment and retention matters that are unique to the Veterans Health Administration pursuant to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/74">chapter 74</external-xref> of title 38, United States Code, or other provisions of law.</text>
 </subsection><subsection id="id74785261AD6B4259B7F1CD426437DFD1"><enum>(b)</enum><header>Virtual training</header><text display-inline="yes-display-inline">Training provided under this section shall be provided virtually.</text> </subsection><subsection id="HAAB6625129854031BCB9E4C55E3E2C14"><enum>(c)</enum><header>Amount of training</header><text display-inline="yes-display-inline">The Secretary shall ensure that each human resources professional of the Veterans Health Administration receives the training described in subsection (a)—</text>
 <paragraph id="H76CF1BD1C2144BDBBC278B4E0208D762"><enum>(1)</enum><text>as soon as practicable after being hired by the Secretary as a human resources professional; and</text> </paragraph><paragraph id="H4891D9770D5B45EEB6F930F6860C7D92"><enum>(2)</enum><text>annually thereafter.</text>
 </paragraph></subsection><subsection id="H26C9346EA35442EEA1211D32B063CD6E"><enum>(d)</enum><header>Certification</header><text>The Secretary shall require that each human resources professional of the Veterans Health Administration, upon the completion of the training described in subsection (a), certifies that the professional received the training and understands the information provided by the training.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H82AED9878036471B961963FDD8AA0DAC"><enum>(e)</enum><header>Annual report</header><text>Not less frequently than annually, the Secretary shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on the training described in subsection (a), including the cost of providing such training and the number of human resources professionals who received such training during the year covered by the report.</text>
 </subsection></section><section commented="no" display-inline="no-display-inline" id="HF531E80349304780ABE17FC8654A5C58"><enum>8.</enum><header display-inline="yes-display-inline">Promotional opportunities for technical experts at Department of Veterans Affairs</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Veterans Affairs shall establish a promotional track system for employees of the Department of Veterans Affairs that the Secretary determines are technical experts pursuant to regulations prescribed by the Secretary for purposes of carrying out this section. Such system shall—</text>
 <paragraph id="HAB393E2F884746929EBFC79B3FD11F7F"><enum>(1)</enum><text>provide any such employee the opportunity to advance within the Department without being required to transition to a management position; and</text>
 </paragraph><paragraph id="H3CBF35C179564E1F95E74EDB879A4AF5"><enum>(2)</enum><text>for purposes of achieving career advancement—</text> <subparagraph id="H615FB6466EB145789EA2B7ABD131B918"><enum>(A)</enum><text>provide for the establishment of new positions within the Department; and</text>
 </subparagraph><subparagraph id="HADBE5668DAAD41289A4EFC9D10DF7687"><enum>(B)</enum><text>notwithstanding any other provision of law, provide for increases in pay for any such employee.</text> </subparagraph></paragraph></section><section display-inline="no-display-inline" id="H6226582CF67F442E824CE7A095713C81" section-type="subsequent-section"><enum>9.</enum><header>Comptroller General of the United States assessment of succession planning at Department of Veterans Affairs</header> <subsection id="idbd94ffe09fe44315b7f7b8e138d0edf0"><enum>(a)</enum><header>Assessment</header> <paragraph id="id3D4D347DD0D04E7D91901B6D31F16B26"><enum>(1)</enum><header>In general</header><text>The Comptroller General of the United States shall assess the extent to which key succession planning policies and guidance at the Department of Veterans Affairs, including the Veterans Health Administration, the Veterans Benefits Administration, and the National Cemetery Administration, are consistent with leading practices for succession and workforce planning identified by Comptroller General.</text>
 </paragraph><paragraph id="id4254401DA87E461DAB2AADBCD8B9F545"><enum>(2)</enum><header>Additional matters</header><text>In carrying out the assessment required by paragraph (1), the Comptroller General may assess such other matters as the Comptroller General considers appropriate.</text>
 </paragraph></subsection><subsection id="idfcd1b3115ce0470fa9fd280b8344dd2a"><enum>(b)</enum><header>Report</header><text>Not later than 2 years after the date of the enactment of this Act, the Comptroller General shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives a report on the assessment carried out under subsection (a).</text>
 </subsection><subsection id="id9ab8704d5d10462ca048422f21307180"><enum>(c)</enum><header>Sense of Congress on study on compliance with policies and guidance</header><text>It is the sense of Congress that—</text> <paragraph id="id74FBA184C14649648A53DE7F051098A0"><enum>(1)</enum><text>the Comptroller General should conduct a study to examine the extent to which a sampling of installations of the Department of Veterans Affairs are complying with policies and guidance of the Department, as well as applicable leading practices; and</text>
 </paragraph><paragraph id="id0AB2E6200E43439BBCBA2C8BB5174AEF"><enum>(2)</enum><text>the scope and timeframe of a study conducted as described in paragraph (1) may be dependent upon the findings of the Comptroller General with respect to the assessment carried out under subsection (a).</text>
				</paragraph></subsection></section><section id="HECBC8423FB504D3D820F16043BFF312B"><enum>10.</enum><header>Employment of students and recent graduates by Department of Veterans Affairs</header>
 <subsection id="H5004F26D8433403E8CB155A94F547CA4"><enum>(a)</enum><header>In general</header><text>The Secretary of Veterans Affairs shall prescribe regulations to allow for excepted service appointments of students and recent graduates leading to conversion to career or career conditional employment of a student or recent graduate of a qualifying educational institution, as defined by the Department.</text>
 </subsection><subsection id="H2ABED1FCBAAF4437ACE2636A1D7D88E7"><enum>(b)</enum><header>Applicability</header><text>The conversion authority described in subsection (a) shall be applicable to individuals in good standing who—</text>
 <paragraph id="H4721EBCF6B484591865F85B03A490C39"><enum>(1)</enum><text>are employed in a qualifying internship or fellowship program at the Department;</text> </paragraph><paragraph id="H3A15009E7E184FB8BC0B700F6E653FFE"><enum>(2)</enum><text>are employed in the Department in a volunteer capacity and performing substantive duties comparable to those of individuals in internship or fellowship programs and meet the required number of hours for conversion;</text>
 </paragraph><paragraph id="H999DCAC2BEC441D1853FBB09C6CF7F4F"><enum>(3)</enum><text>are employed in the Department under a contract or agreement with an external nonprofit organization and performing substantive duties comparable to those of individuals in internship or fellowship programs;</text>
 </paragraph><paragraph id="HC3FFBECFFC9B4B45BC8D5FFE6EC4C57B"><enum>(4)</enum><text>have received educational assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/33">chapter 33</external-xref> of title 38, United States Code; or</text> </paragraph><paragraph id="HC018D6360B5F468DAB1B57A73A7A5F8C"><enum>(5)</enum><text display-inline="yes-display-inline">graduated from a qualifying educational institution, as defined by the Department, and have not reached 30 years of age.</text>
 </paragraph></subsection><subsection id="H6F6242D11A2D49009ADB82C83734C9D8"><enum>(c)</enum><header>Uniformity</header><text>For the purposes of paragraphs (2) and (3) of subsection (b), hours of work performed by an individual employed shall be considered equal to those performed by an individual employed in a qualifying internship or fellowship program by the Department.</text>
			</subsection></section><section id="HEB54E58F6ACD4500BA185F51C7686034"><enum>11.</enum><header>Exit surveys at Department of Veterans Affairs</header>
			<subsection id="HD38DB512C8DB472FA08E5D0EB60948B2"><enum>(a)</enum><header>Exit surveys required</header>
 <paragraph id="idBCAC3DB5354145B089B153D5811CB015"><enum>(1)</enum><header>In general</header><text>The Secretary of Veterans Affairs shall develop and carry out a standardized exit survey to be voluntarily completed by career and noncareer employees and executives of the Department of Veterans Affairs who voluntarily separate from the Department.</text>
 </paragraph><paragraph id="idC8FF36F6FA874D92A34293AE1FB52F0F"><enum>(2)</enum><header>Consultation</header><text>Such exit survey shall be developed in consultation with an appropriate non-Department entity with experience developing such surveys.</text>
 </paragraph></subsection><subsection id="H923BF56DECE34FE0B114F0D4E190CEC3"><enum>(b)</enum><header>Survey content</header><text>The survey shall include, at a minimum, the following:</text> <paragraph id="HF2B35EDE7F9A42A7ABCF32722A75D6BB"><enum>(1)</enum><text>Reasons for leaving the Department.</text>
 </paragraph><paragraph id="HB79CBE2446D246378C07A3FE9A9062A5"><enum>(2)</enum><text>Efforts made by the supervisor of the employee to retain the individual.</text> </paragraph><paragraph id="HB5BC37D5070C404F96A7285B4EBDE91D"><enum>(3)</enum><text>The extent of job satisfaction and engagement during the employment.</text>
 </paragraph><paragraph id="H121212FB35184933BECFDE0168216341"><enum>(4)</enum><text>The intent of employee to either remain employed within the Federal Government or to leave employment with the Federal Government.</text>
 </paragraph><paragraph id="H12EDBD77E835406EA2B16A0564D11D0C"><enum>(5)</enum><text>Such other matters as the Secretary determines appropriate.</text> </paragraph></subsection><subsection id="HDCBDD45B77354BCEA0256586F84B281A"><enum>(c)</enum><header>Anonymity of survey content</header><text>The Secretary shall ensure that data collected under subsection (a)—</text>
 <paragraph id="id3A8341BCAC30462CA53A5937B93837D6"><enum>(1)</enum><text>is anonymized, including through the use of a location that allows for privacy;</text>
 </paragraph><paragraph id="id881E2411D0544807A9F480B6C6D114C8"><enum>(2)</enum><text>is not directly visible by another employee; and</text>
 </paragraph><paragraph id="id791B5DF93DD44811BDFBF416F33DAFE9"><enum>(3)</enum><text>does not require the departing employee to input any personally identifiable data.</text>
 </paragraph></subsection><subsection id="HAEC782812DC54446B8374BBC2D9704E0"><enum>(d)</enum><header>Sharing of survey data</header><text>The Secretary shall ensure that the results of the survey required by subsection (a) are—</text> <paragraph id="id0A762321876F4A3DA0ABE19612212734"><enum>(1)</enum><text>aggregated at the Veterans Integrated Service Network level; and</text>
 </paragraph><paragraph id="id87DBA9F8EDFD48DF8507129475B1917C"><enum>(2)</enum><text>shared on an annual basis with directors and managers of facilities of the Department and the Veterans Integrated Service Networks.</text>
				</paragraph></subsection><subsection id="HD6CF345610574C42ABA7919BC2F75D34"><enum>(e)</enum><header>Annual report</header>
 <paragraph id="id0F0F0E05C72D4F6DAD7662F0FB7B9031"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act and not less frequently than once each year thereafter, the Secretary shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives a report containing the aggregate results of the exit survey under subsection (a) covering the year prior to the report.</text>
 </paragraph><paragraph id="idC7C9273EA146458B8E8A37C52C4F7BF0"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">Each report submitted under paragraph (1) shall include, for the period covered by the report, the following:</text>
 <subparagraph id="H14939E9C56BD4E8C8735DE54B8BB27E7"><enum>(A)</enum><text>An analysis of the most common reasons employees choose to leave the Department.</text> </subparagraph><subparagraph id="H40FF78513501466BBB5BD4FF2F7A2561"><enum>(B)</enum><text>The steps the Secretary is taking to improve retention, particularly for mission-critical occupations.</text>
 </subparagraph><subparagraph id="H61BF66EDCD0F4D1992BC81B12572EAB7"><enum>(C)</enum><text>The demographic characteristics of employees choosing to leave the Department.</text> </subparagraph><subparagraph id="HA46014FA30164AD99EB95F56B560E33D"><enum>(D)</enum><text>Any legislative barriers to improving employee retention.</text>
 </subparagraph><subparagraph id="H6D0094CE23374874A44374C1EAE44F74"><enum>(E)</enum><text>The total number of employees who voluntarily separated from the Department and the number and percentage of whom took the exit survey under subsection (a).</text>
					</subparagraph></paragraph></subsection></section><section id="HA87436384C3944AE9B9E179446564BAF"><enum>12.</enum><header>Encouragement of transition of military medical professionals into employment with Veterans Health
 Administration</header><text display-inline="no-display-inline">The Secretary of Veterans Affairs shall establish a program to encourage an individual who serves in the Armed Forces with a military occupational specialty relating to the provision of health care to seek employment with the Veterans Health Administration when the individual has been discharged or released from service in the Armed Forces or is contemplating separating from such service.</text>
		</section><section id="H380519D1A634459281647871735031A9"><enum>13.</enum><header>Plan to hire directors of medical centers of Department of Veterans Affairs</header>
 <subsection id="H002A09F937C2497585116020911DB8EF"><enum>(a)</enum><header>Plan</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall develop and implement a plan to hire highly qualified directors for each medical center of the Department of Veterans Affairs that lacks a permanent director as of the date of the plan.</text>
 </subsection><subsection id="id0C28E456D78A40CCB5579622FEF88EAD"><enum>(b)</enum><header>Priority</header><text display-inline="yes-display-inline">The Secretary shall prioritize under the plan developed under subsection (a) the hiring of directors for medical centers that have not had a permanent director for the longest periods.</text>
 </subsection><subsection id="H538CD6C6FCBE493C9EC7B398D4EA107C"><enum>(c)</enum><header>Matters included</header><text>The plan developed under subsection (a) shall include the following:</text> <paragraph id="HAEE6D5E7DD064DB8B6B6470BC78EFC15"><enum>(1)</enum><text display-inline="yes-display-inline">A deadline to hire directors of medical centers of the Department as described in such subsection.</text>
 </paragraph><paragraph id="H51136B85857E4DC6BF7FF55C9E044F62"><enum>(2)</enum><text>Identification of the possible impediments to such hiring.</text> </paragraph><paragraph id="HF889124A60054779B09A373727189DCC"><enum>(3)</enum><text>Identification of opportunities to promote and train candidates from within the Department to senior executive positions in the Department, including as directors of medical centers.</text>
 </paragraph></subsection><subsection id="HE5CBA7EB2BE041E998C55C855D5DF559"><enum>(d)</enum><header>Submittal of plan</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Secretary shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives the plan developed under subsection (a).</text>
 </subsection><subsection id="H5697877E99BA4B4C95470E36E4FD6E8C"><enum>(e)</enum><header>Semiannual reports</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, and not later than the end of each 180-day period thereafter until January 1, 2018, the Secretary shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report containing a list of each medical center of the Department that lacks a permanent director as of the date of the report.</text>
			</subsection></section><section id="H7DAF65FACCD84BAD9F5AE51AB53A8BC1" section-type="subsequent-section"><enum>14.</enum><header>Recruitment of physicians in Department of Veterans Affairs</header>
 <subsection id="H9E27C10602CF4B8DBFD7DF2AA6CA5936"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 7402(b)(1) of title 38, United States Code, is amended—</text> <paragraph id="H44C93F75772242EBAEDB5C7A7BA10B46"><enum>(1)</enum><text>in the matter preceding subparagraph (A), by inserting <quote>or to be offered a contingent appointment to such a position,</quote> after <quote>position,</quote>; and</text>
 </paragraph><paragraph id="HB8D8C7A5CF8E443CA1BC157CC4687CFC"><enum>(2)</enum><text>by striking subparagraph (B) and inserting the following new subparagraph (B):</text> <quoted-block display-inline="no-display-inline" id="HD62186EE48F1477BAB85C821B31DF571" style="USC"> <subparagraph id="H3C308A958A73471A83C46BC5D7E87088" indent="up1"><enum>(B)</enum> <clause commented="no" display-inline="yes-display-inline" id="HE768FEA9082F45CD8089C26591138821"><enum>(i)</enum><text display-inline="yes-display-inline">have completed a residency program satisfactory to the Secretary, or</text>
 </clause><clause id="H23F9FA79E49A48D9B02CC71D241FDBA1" indent="up1"><enum>(ii)</enum><text>with respect to an offer for a contingent appointment upon the completion of a post-graduate training program, complete such a residency program by not later than two years after the date of such offer, and</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HEA6CCB7B0FC7423989591690364F97E1"><enum>(b)</enum><header>Oversight of graduate medical education programs</header><text>The Secretary of Veterans Affairs shall—</text> <paragraph id="H2F3A665DE40F461A83F441C81225C5BF"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that a recruiter or other similar official of each Veterans Integrated Service Network visits, not less frequently than annually, each allopathic and osteopathic teaching institution with a graduate medical education program within the Network to recruit individuals to be appointed to positions in the Veterans Health Administration; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H90BB5FED7AAF42B5A1A0EB8C3354CB02"><enum>(2)</enum><text>not less frequently than annually, submit to Congress a report on the implementation of paragraph (1), including the success of recruitment efforts under such paragraph.</text></paragraph></subsection></section></legis-body></bill>
