			 2014 to include certain veterans seeking mental health care, and for other
			 purposes.</official-title></form>
	<legis-body>
 <section id="id5B2A9D10EF3C46BBA8E785F328DB0E01" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prioritizing Veterans Access to Mental Health Care Act of 2017</short-title></quote>.</text> </section><section id="id28E2F4A37A07481C83F0FCC0B3862662"><enum>2.</enum><header>Expansion of eligibility of certain veterans seeking mental health care for health care from non-Department of Veterans Affairs entities</header> <subsection id="id7652C221B3B248CC9B5FB714D2594981"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 101(b)(2) of the Veterans Access, Choice, and Accountability Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/146">Public Law 113–146</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/1701">38 U.S.C. 1701</external-xref> note) is amended—</text>
 <paragraph id="idD29AF09D90DA4A4B863F667FF4B2A461"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (C)(ii), by striking <quote>; or</quote> and inserting a semicolon;</text> </paragraph><paragraph id="id651A0C99B1EF47AC9A06E28ED4CFB6D1"><enum>(2)</enum><text>in subparagraph (D)(ii)(II)(dd), by striking the period at the end and inserting <quote>; or</quote>; and</text>
 </paragraph><paragraph id="id8FEB1565FF4F4DDA8E3E144349B3B5B8"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block display-inline="no-display-inline" id="idCB64DC405FBC4ABEB2BFC4870C1B8C0F" style="OLC"> <subparagraph id="idB268A2269569434889C58B26F84E881C"><enum>(E)</enum><text>provides a statement in writing that the veteran seeks mental health care from the Department and has not received timely and adequate mental health care through a facility or health care provider of the Department.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idEF49AC83DEDF4855BD682481402F995E"><enum>(b)</enum><header>Submission of statement in writing</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id8FB95E08D2A042B19CD6B384D3AEBD88"><enum>(1)</enum><header>In general</header><text>In providing for a statement in writing under subparagraph (E) of section 101(b)(2) of the Veterans Access, Choice, and Accountability Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/146">Public Law 113–146</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/1701">38 U.S.C. 1701</external-xref> note), as added by subsection (a), the Secretary of Veterans Affairs shall develop procedures for the submission by veterans of such statement—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idD0055441BF0241CC941FA888EC0F90A3"><enum>(A)</enum><text>electronically, through the primary Internet website of the Department of Veterans Affairs that is available to the public; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id726656BC4F36465BAB99800E5CE19B22"><enum>(B)</enum><text>in person or by fax to the Non-VA Care Communication Office of each medical facility of the Department.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8C7CA06AB4CD40B4BD2FB999DEF3F191"><enum>(2)</enum><header>Components of statement</header><text>The Secretary shall require that any veteran that submits a statement in writing described in paragraph (1) include the following:</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id8A5C3B28A10C4A93AE1426A0A8EEB057"><enum>(A)</enum><text>The earliest date that the Department provided to the veteran for an appointment for the receipt of mental health care through a facility or health care provider of the Department, or, if no date was provided, an indication that no appointment date was provided.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2D16407F79E441FCB27DB546F6A096F4"><enum>(B)</enum><text>The earliest date of an appointment of the veteran for the receipt of mental health care that was offered by a non-Department health care provider, if applicable.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0D7CAD9C91C64839A5E80B977ABA7886"><enum>(C)</enum><text>A certification by the veteran that the veteran cannot reasonably wait for an appointment for mental health care through a facility or health care provider of the Department.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id12D2FC7F23D44E8CA897DD80C3815B89"><enum>(D)</enum><text>Feedback by the veteran with respect to the timeliness and adequacy of mental health care furnished by the Department.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id23B65BA41B644035932D2281A6833BDD"><enum>(3)</enum><header>Receipt of statement</header><text>Upon the receipt by the Department of a statement in writing described in paragraph (1) by a veteran, the Secretary shall provide a confirmation to the veteran that the Secretary has received the statement in writing—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idE6457084708A4AD98CA2EF42B830844E"><enum>(A)</enum><text>in the form of an immediate automated confirmation, if the statement in writing was submitted electronically; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBE5575C06DEC425EAA5DDF8644B0AB89"><enum>(B)</enum><text>in the form of an immediate written confirmation, if the statement in writing was submitted in person or by fax.</text>
 </subparagraph></paragraph></subsection><subsection id="idD954CC05F05E4121A569D9F432BA98AF"><enum>(c)</enum><header>Conforming amendment</header><text>Section 101(q)(2)(A) of the Veterans Access, Choice, and Accountability Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/146">Public Law 113–146</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/1701">38 U.S.C. 1701</external-xref> note) is amended—</text>
 <paragraph id="id42798727C09A40319378F17DEFB25401"><enum>(1)</enum><text>in clause (iii), by striking <quote>; and</quote> and inserting a semicolon;</text> </paragraph><paragraph id="idD16C04A7F1334EDD9CF667428CD29CE0"><enum>(2)</enum><text>in clause (iv), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph id="idDD47D3127B5A440EADA4FEFC20667852"><enum>(3)</enum><text>by adding at the end the following new clause:</text> <quoted-block display-inline="no-display-inline" id="id935ECFD5267F4F06A09BB96886EC021E" style="OLC"> <clause id="idDCCA9F4AFABB4098B2382B52D11C3A43"><enum>(v)</enum><text>eligible veterans described in subsection (b)(2)(E).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="id1BECAC9580E045F1A6724C61E6BA3D87"><enum>3.</enum><header>Prioritization of hiring incentives to address need for health professionals at Department of
 Veterans Affairs</header><text display-inline="no-display-inline">In carrying out hiring incentives for health professionals at the Department of Veterans Affairs, including the Department of Veterans Affairs Health Professionals Educational Assistance Program under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/76">chapter 76</external-xref> of title 38, United States Code, the Secretary of Veterans Affairs shall give priority to those health professionals for which there is the greatest need in the Department, such as psychiatrists, psychologists, and other mental health care providers.</text>
 </section><section id="idC836170F558A45FFAD879BA327D40BD3"><enum>4.</enum><header>Source of amounts</header><text display-inline="no-display-inline">Such sums as may be necessary to carry out this Act and the amendments made by this Act shall be derived from amounts appropriated under section 801 of the Veterans Access, Choice, and Accountability Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/146">Public Law 113–146</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/1701">38 U.S.C. 1701</external-xref> note).</text>
 </section><section commented="no" id="id8DE0BB3BB9764B38A2DC876DA1F7D14E"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect on the date that is 90 days after the date of the enactment of this Act.</text></section></legis-body></bill>
