	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prove It Act of 2017</short-title></quote>.</text>
		</section><section id="id8F89745AAA91493995ECF4FF1E445A08"><enum>2.</enum><header>Review procedures related to the certification</header>
 <subsection id="id9773FEDA1A6F45E5BEFDD6F3B6115AA7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 605(b) of title 5, United States Code, is amended—</text> <paragraph id="idEBAF908A3AAB4C56B418D42A48001BEC"><enum>(1)</enum><text>by inserting <quote>(1)</quote> before <quote>Sections 603</quote>;</text>
 </paragraph><paragraph id="id2ADCD5B145F64243A741C640817D9E80"><enum>(2)</enum><text>in paragraph (1), as so designated—</text> <subparagraph id="idF482B449CF624C8BADE2A4A25305E32B"><enum>(A)</enum><text>by striking <quote>the preceding sentence</quote> and inserting <quote>this subsection</quote>; and</text>
 </subparagraph><subparagraph id="idDAAB97DFB4E14D84BBD050E4D0A8C533"><enum>(B)</enum><text>by striking <quote>statement to the Chief Counsel for Advocacy of the Small Business Administration</quote> and inserting <quote>statement providing the factual basis to the Chief Counsel for Advocacy of the Small Business Administration (in this subsection referred to as the <term>Chief Counsel</term>)</quote>; and</text>
 </subparagraph></paragraph><paragraph id="id4BAA65BEF6C141E982F396E47F23BC4C"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id936D3D6949A74E20A3D4D9A773C2B4BE" style="OLC"> <paragraph id="idB77E4968DD374863937B3C05F540E205" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id55C42B8BAA634A8EB9B7FA478619237C"><enum>(A)</enum><text>If the Chief Counsel disagrees with a certification and statement providing the factual basis for the certification published in the Federal Register under paragraph (1) with respect to a proposed rule, the Chief Counsel may, not later than 14 days after the date on which the statement and factual basis were published in the Federal Register, submit to the head of the Federal agency proposing the rule a letter (in this subsection referred to as an <term>advisement letter</term>) advising the head of the Federal agency to—</text>
 <clause id="idE30711998E84489FBE9C4B4B03F48545" indent="up1"><enum>(i)</enum><text>review the certification and the detailed statement submitted by the Chief Counsel under subparagraph (B); and</text>
 </clause><clause id="id09807D9ECF494D9998E13B71428E1CF1" indent="up1"><enum>(ii)</enum><text>reconsider the certification.</text>
 </clause></subparagraph><subparagraph id="id99CE8B47DFFC402683E21EC8499FA34C" indent="up1"><enum>(B)</enum><text>An advisement letter submitted by the Chief Counsel under subparagraph (A) shall—</text>
 <clause id="id924F59203EF1447D86F70EEF73346EB2"><enum>(i)</enum><text>include a detailed statement of why the Chief Counsel disagreed with the certification or the statement providing the factual basis received under paragraph (1); and</text>
 </clause><clause id="id324431CA509A4760A34722EE3031156D"><enum>(ii)</enum><text>be published on the website of the Office of Advocacy of the Small Business Administration.</text>
 </clause></subparagraph><subparagraph id="idDF96725533BF4643B67081D773361D5F" indent="up1"><enum>(C)</enum><text>Not later than 7 days after the date on which the head of a Federal agency receives an advisement letter under subparagraph (A) with respect to a proposed rule, the head of the Federal agency shall—</text>
 <clause id="idB476E88CC5324ED8AF108580A652F705"><enum>(i)</enum><text>publish in the Federal Register and on the website of the Federal agency an acknowledgment of receipt of the advisement letter;</text>
 </clause><clause id="id1E7661369EFA43D28E296CBE676CC1D6"><enum>(ii)</enum><text>allow the public comment period for the rule to remain open for a period of not less than 30 days; and</text>
 </clause><clause id="id74948546CBAE412199B320278376EE0A"><enum>(iii)</enum><text>if, during the 30-day period described in clause (ii), the head of the Federal agency determines that the certification and statement providing the factual basis should be modified, shorten or eliminate the 30-day period.</text>
 </clause></subparagraph><subparagraph commented="no" id="id7BECBCDB0746453D877D2AF59AB9DA1C" indent="up1"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="idE5158C3257B54CB18245376ED227317E"><enum>(i)</enum><text>Not later than 30 days after the date on which the Chief Counsel submits to the head of a Federal agency an advisement letter under subparagraph (A), the Federal agency shall submit to the Chief Counsel and publish in the Federal Register and on the website of the Federal agency the results of the review and reconsideration.</text>
 </clause><clause commented="no" id="idD383D808D1954B99A404659CE7BB3211" indent="up1"><enum>(ii)</enum><text>If, after conducting the review and reconsideration under subparagraph (A), the head of the Federal agency determines—</text>
 <subclause commented="no" id="idC5D8CA79A4254E65B66A40D8A9DA9E9D"><enum>(I)</enum><text>that there was not a sufficient factual basis to support the certification, the Federal agency shall perform and publish in the Federal Register an initial regulatory flexibility analysis under section 603, with an opportunity for public comment, before promulgating the final rule;</text>
 </subclause><subclause commented="no" id="id812F3D8EFFB24E2F94375600F4EDDD8F"><enum>(II)</enum><text>that the certification was appropriate but the factual basis was inadequate to support the certification, the Federal agency shall revise the factual basis to support the certification; or</text>
 </subclause><subclause commented="no" id="idECBBFBF1717E4DDD97464048DA81D619"><enum>(III)</enum><text>that the certification was appropriate and the factual basis was adequate to support the certification, the Federal agency may continue with the rule making.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection></section><section id="idb945edf64a0440ea90dc589b312dd66d"><enum>3.</enum><header>Judicial review</header><text display-inline="no-display-inline">Section 611(a) of title 5, United States Code, is amended—</text> <paragraph id="id0ac476a6fedb4e8992d7017f0877d8df"><enum>(1)</enum><text>in paragraph (1), by striking <quote>605(b)</quote> and inserting <quote>605(b)(1)</quote>; and</text>
 </paragraph><paragraph id="id826f961676d344e4835b9f53b405543a"><enum>(2)</enum><text>in paragraph (2), by striking <quote>605(b)</quote> and inserting <quote>605(b)(1)</quote>.</text></paragraph></section></legis-body></bill>
