			 certain veterans who served in Korea, and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H6168B96A29EA4AEFBE20CB1B452C6C6C" style="OLC">
 <section id="H35CAE1B0997D4A738351199ECED94813" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fairness for Korean DMZ Veterans Act of 2017</short-title></quote>.</text> </section><section id="HD49015CD72EF4F2FAE7D3F26BA63FA60" section-type="subsequent-section"><enum>2.</enum><header>Presumption of herbicide exposure for certain veterans who served in Korea</header> <subsection id="H989C144D95F047CDB4A84F1FF5EBB18E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/11">Chapter 11</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/1116">section 1116</external-xref> the following new section:</text>

					<section id="H44704B6587144AB784DE7A47D84C2286"><enum>1116A.</enum><header>Presumption of herbicide exposure for certain veterans who served in Korea</header>
 <subsection id="H14C397929D0A4769A00217465818C37E"><enum>(a)</enum><header>Presumption of service-Connection</header><paragraph commented="no" display-inline="yes-display-inline" id="HF5194AC25B764ED192A8561902EA0BE7"><enum>(1)</enum><text>For the purposes of section 1110 of this title, and subject to section 1113 of this title, a disease specified in subsection (b) that becomes manifest as specified in that subsection in a veteran described in paragraph (2) shall be considered to have been incurred or aggravated in the line of duty in the active military, naval, or air service, notwithstanding that there is no record of evidence of such disease during the period of such service.</text>
 </paragraph><paragraph id="H3B98ACDC61BC4EEEB7B529D23A2EEDCC" indent="up1"><enum>(2)</enum><text>A veteran described in this paragraph is a veteran who, during active military, naval, or air service, served in or near the Korean demilitarized zone (DMZ), during the period beginning on September 1, 1967, and ending on August 31, 1971.</text>
 </paragraph></subsection><subsection id="H77EB372FDE134F5BBAF92972CD67C539"><enum>(b)</enum><header>Diseases</header><text>A disease specified in this subsection is—</text> <paragraph id="H084336BD70CB42C0B6D490F0A12E6425"><enum>(1)</enum><text>a disease specified in paragraph (2) of subsection (a) of section 1116 of this title that becomes manifest as specified in that paragraph; or</text>
 </paragraph><paragraph id="HD4EA0B727BA240A2B96361CA48BA09F7"><enum>(2)</enum><text>any additional disease that—</text> <subparagraph id="HDA22AD39D9174C86A7605C6967EF0F93"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary determines in regulations warrants a presumption of service-connection by reason of having positive association with exposure to an herbicide agent; and</text>
 </subparagraph><subparagraph id="H7323E9FA2AAE4AB1AD419BC4BE3B672E"><enum>(B)</enum><text display-inline="yes-display-inline">becomes manifest within any period prescribed in such regulations.</text> </subparagraph></paragraph></subsection><subsection id="H67AA2B20A50B4328831240B13F462FE5"><enum>(c)</enum><header>Herbicide agent</header><text>For purposes of this section, the term <term>herbicide agent</term> has the meaning given such term in section 1821(d) of this title.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H30DA95B7BED04F5DBDF223758882E42B"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 1116 the following new item:</text>
