			 annual report to Congress relating to the use of official time by
			 employees of the Department of Veterans Affairs, to limit the instances in
			 which official time may be granted for certain purposes to employees of
			 the Department, and for other purposes.</official-title></form>

 <section id="H441CB641DA2D4475A0A626AE000C55F9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans, Employees, and Taxpayers Protection Act of 2017</short-title></quote> or the <quote><short-title>VET Protection Act of 2017</short-title></quote>.</text> </section><section id="H39F92B9943AA43D8A10B88524BFE95E9" section-type="subsequent-section"><enum>2.</enum><header>Labor management in Department of Veterans Affairs</header> <subsection id="HC1720087E7A74DFBA49BEA1E7DFF9307"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/7">Chapter 7</external-xref> of title 38, United States Code, is amended by adding at the end the following new subchapter:</text>
				<quoted-block display-inline="no-display-inline" id="HF032BB49882D40DB93140819A7B0D193" style="USC">
					<subchapter id="HEFC9C88EFD8342E4AECD82D4475707D2"><enum>IV</enum><header>Labor management</header>
						<section id="H37DB433901A84E9F9719A8F558D43D91"><enum>751.</enum><header>Records on use of official time</header>
 <subsection id="H06EFF67CC5C94D9BBA0F9A78500AF63F"><enum>(a)</enum><header>Tracking of official time</header><text display-inline="yes-display-inline">The Secretary shall track the use of official time by employees of the Department of Veterans Affairs in a manner that accounts for such time accurately and to a specific degree without the use of estimates or ranges of time.</text>
 </subsection><subsection id="HF2D091356F2D45CBA30C909152AF1398"><enum>(b)</enum><header>Annual report</header><paragraph commented="no" display-inline="yes-display-inline" id="H4C215CF2AA9145F2A3F9E03496EF0618"><enum>(1)</enum><text display-inline="yes-display-inline">Not later than December 31 of each year, the Secretary shall submit to the Office of Personnel Management and the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives a report on the use of official time by employees of the Department during the most recently ended fiscal year.</text>
 </paragraph><paragraph id="H20C49BB0FB6246708A6F444FD8DF036B" indent="up1"><enum>(2)</enum><text>Each report under paragraph (1) shall include, with respect to the fiscal year covered by the report, the following information:</text>
 <subparagraph id="H32F508D5735B45479CF0B26D6D69B073"><enum>(A)</enum><text>The total amount of official time granted to employees.</text> </subparagraph><subparagraph commented="no" id="H93D1A7798C5547B3A4A387D50940A805"><enum>(B)</enum><text display-inline="yes-display-inline">The total amount of official time expended and the amount of official time expended per employee for term negotiations, mid-term negotiations, general labor-management relations, and dispute resolution.</text>
 </subparagraph><subparagraph id="HFEFBF897F05245A9A59E994D2692E007"><enum>(C)</enum><text>The specific types of activities or purposes for which official time was granted, and the impact which the granting of such official time for such activities or purposes had on the operations of the Department.</text>
 </subparagraph><subparagraph id="H52A948A1AE4943348D3066D8AF55A1DE"><enum>(D)</enum><text>The total number of employees to whom official time was granted, and, of that total, the number who were not engaged in any activities or purposes except activities or purposes involving the use of official time.</text>
 </subparagraph><subparagraph id="H563EB088EACF444AA1C79D11A0F23B0A"><enum>(E)</enum><text display-inline="yes-display-inline">The total annual salary, job title, and amount of official time afforded to any employee.</text> </subparagraph><subparagraph id="H24E9F7984D1848A6A1A0C3FCBA931E1B"><enum>(F)</enum><text display-inline="yes-display-inline">A description of any room or space designated at the Department where official time activities will be conducted, including the square footage of any such room or space.</text>
 </subparagraph></paragraph></subsection><subsection id="HD107169FDFEF426D9CA7F1F387D30534"><enum>(c)</enum><header>Official time defined</header><text display-inline="yes-display-inline">In this section, the term <term>official time</term> means any period—</text> <paragraph id="H492AF335965E44848993664AC18FE463"><enum>(1)</enum><text>which may be granted to an employee under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/71">chapter 71</external-xref> of title 5 (including a collective bargaining agreement entered into under such chapter) or chapter 74 of this title to perform representational or consultative functions; and</text>
 </paragraph><paragraph id="H0270BF7E9BB34E9B9B630B0B47BEBAA7"><enum>(2)</enum><text>during which the employee would otherwise be in a duty status.</text> </paragraph></subsection></section><section commented="no" id="H9877738D10AB4B6BB31F1C6B74150240"><enum>752.</enum><header>Limitations on use of official time for certain purposes and individuals</header> <subsection commented="no" id="H2A66390FC22D41F9B3BF6DE271E1FEBF"><enum>(a)</enum><header>Political activities and lobbying</header><text display-inline="yes-display-inline">Notwithstanding section 7131 of title 5 or any other provision of law, any employee of the Department may not use official time to carry out political activities or activities relating to lobbying.</text>
 </subsection><subsection commented="no" id="H0E776F7C21DE47CE972529B0DB01D75F"><enum>(b)</enum><header>Prohibition on use of official time by certain employees</header><text display-inline="yes-display-inline">The following employees of the Department may not use official time for any purpose:</text> <paragraph id="H5005A82F40134AEFAF0F8644A7B39AE1"><enum>(1)</enum><text>Any employee appointed under section 7401(1) of this title.</text>
 </paragraph><paragraph id="H00D1CCFA544F43A592726FF23148EFC8"><enum>(2)</enum><text>Any employee with an annual rate of basic pay equal to or greater than $100,000.</text> </paragraph><paragraph id="HD3C231F7146E4A919F60C55E21631D6E"><enum>(3)</enum><text>Any employee who is serving a probationary period.</text>
 </paragraph></subsection><subsection id="H63EC3143BAC24953A97154AFB64E6A60"><enum>(c)</enum><header>Limitation on all employees</header><text display-inline="yes-display-inline">Any employee of the Department not covered by subsection (b) may spend no more than 25 percent of the time such employee would otherwise be in a duty status on official time.</text>
 </subsection><subsection id="H51AA8518B4514320B250BBD839F97E9B"><enum>(d)</enum><header>Official time defined</header><text display-inline="yes-display-inline">In this section, the term <term>official time</term> has the meaning given such term in section 751(c) of this title.</text> </subsection></section><section commented="no" id="H11F47E9E941345F1B5EDD4A9D57B0330"><enum>753.</enum><header>Termination of collection of dues</header><text display-inline="no-display-inline">Notwithstanding section 7115 of title 5, any exclusive bargaining agreement entered into pursuant to chapter 71 of such title by the Department shall provide that an employee of the Department may terminate a voluntary allotment for the payment of dues at any time. Any deductions for dues made pursuant to such allotment shall cease beginning on the first pay period after the termination is made.</text></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" id="HEC9F95C3FA704CB39F66DD986D748786"><enum>(b)</enum><header>Applicability</header><text>Sections 752 and 753 of title 38, United States Code, as added by subsection (a), shall apply with respect to any collective bargaining agreement entered into before, on, or after the date of enactment of this Act.</text>
 </subsection><subsection id="H72CA6EC88AA043428F54F8C99F49C851"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H09A19BB4410047338B3E236AE32700E9" style="USC"><toc regeneration="no-regeneration"><toc-entry level="subchapter">Subchapter IV—LABOR MANAGEMENT</toc-entry><toc-entry idref="H37DB433901A84E9F9719A8F558D43D91" level="section">751. Records on use of official time.</toc-entry><toc-entry idref="H9877738D10AB4B6BB31F1C6B74150240" level="section">752. Limitations on use of official time for certain purposes and individuals.</toc-entry><toc-entry idref="H11F47E9E941345F1B5EDD4A9D57B0330" level="section">753. Termination of collection of dues.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section display-inline="no-display-inline" id="H162140848BD243A39EF797A8B4247E81" section-type="subsequent-section"><enum>3.</enum><header>Required probationary period for new employees of Department of Veterans Affairs</header>
			<subsection id="H3088AFA81BA84A30B531E6DA484508C2"><enum>(a)</enum><header>Probationary period</header>
 <paragraph id="HA664FA588D194516B488BC2C24B63B6B"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/7">Chapter 7</external-xref> of title 38, United States Code, is further amended by inserting after section 717 the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="H0F9524A809BD4A568A6455EB6D98D4AF" style="USC">
						<section id="HF8D56254D50144D09DBB1D1E534188B8"><enum>718.</enum><header>Probationary period for employees </header>
 <subsection id="H979DCE79DA77428C8A25AFD31B65D91E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding sections 3321 and 3393(d) of title 5, the appointment of a covered employee shall become final only after such employee has served a probationary period of two years.</text>
 </subsection><subsection id="H3A01195C417C4845992EAC112C4BD5EF"><enum>(b)</enum><header>Covered employees</header><text>For purposes of this section, a covered employee is—</text> <paragraph id="HBFFC28604666454BBE7BC86FB3B5263A"><enum>(1)</enum><text>any individual—</text>
 <subparagraph id="H32D9683C9C0E4A0B85ADB7806F31BE41"><enum>(A)</enum><text>appointed to a permanent position within the competitive service at the Department; or</text> </subparagraph><subparagraph id="H63D783BE064D442A905FB17D3AE8047C"><enum>(B)</enum><text>appointed as a career appointee (as defined in section 3132(a) of title 5) within the Senior Executive Service at the Department; and</text>
 </subparagraph></paragraph><paragraph id="H20B1DC7A9F8545B49450BED31D30AC35"><enum>(2)</enum><text display-inline="yes-display-inline">not an individual with a probationary period prescribed by section 7403 of this title.</text>
 </paragraph></subsection><subsection id="H9E594D000A404D069D2874CD239B485B"><enum>(c)</enum><header>Permanent hires</header><text display-inline="yes-display-inline">Not later than 90 days before the expiration of a covered employee’s probationary period under subsection (a), the supervisor of the employee shall determine whether the appointment becomes final based on regulations prescribed for such purpose by the Secretary.</text>
 </subsection><subsection id="HC68FD44B77614D729026536F13827673"><enum>(d)</enum><header>Application</header><text>With respect to any individual described in subsection (b)(1)(A) and to whom this section applies, sections 7501(1) and 7511(a)(1)(A)(ii) of title 5 shall be applied to such individual by substituting <quote>completed 2 years</quote> for <quote>completed 1 year</quote> in each instance it appears.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HAEBC56131CD9474684DD4606283B8077"><enum>(2)</enum><header>Clerical and conforming amendments</header>
 <subparagraph id="H0EEA1475A0E840898614DAB1F00B47FC"><enum>(A)</enum><header>Clerical</header><text>The table of sections at the beginning of such chapter, as amended by section 2, is further amended by inserting after the item relating to section 717 the following new item:</text>
						<quoted-block display-inline="no-display-inline" id="H9C1F26E2B6764067AA94162FA3F5DA69" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">718. Probationary period for employees.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="H8F972AB577D946B1A9666B215938174B"><enum>(B)</enum><header>Conforming</header><text>Title 5, United States Code, is amended—</text> <clause id="H7472FB9D532C4841B177A8E1CA65FF02"><enum>(i)</enum><text>in section 3321(c)—</text>
 <subclause id="H6D26A915955242CBAF000EA7DA05D8EB"><enum>(I)</enum><text>by striking <quote>Service, or</quote> and inserting <quote>Service,</quote>; and</text> </subclause><subclause id="H25C281AF478B4801BFF787E5F8D66032"><enum>(II)</enum><text>by inserting at the end before the period the following: <quote>, or any individual covered by section 718 of title 38</quote>;</text>
 </subclause></clause><clause id="HEF518E61540543A980431BCAE4607B77"><enum>(ii)</enum><text>in section 3393(d), by inserting at the end before the period the following: <quote>or section 718 of title 38</quote>;</text> </clause><clause id="H742C087A6A2546B89C5101BEF7A27F66"><enum>(iii)</enum><text display-inline="yes-display-inline">in sections 7501(1) and 7511(a)(1)(A)(ii), by inserting <quote>or section 718 of title 38</quote> after <quote>title 10</quote> in each instance it appears; and</text>
 </clause><clause id="HBE3B29D22A864AE5B410A484F535127D"><enum>(iv)</enum><text>in section 7541(1)(A)—</text> <subclause id="HD9022DF7689E4E24BE08F63393A0BAC8"><enum>(I)</enum><text>by striking <quote>title or</quote> and inserting <quote>title,</quote>; and</text>
 </subclause><subclause id="H55378FE1DE7442659883102E5494E46D"><enum>(II)</enum><text display-inline="yes-display-inline">by inserting at the end before the semicolon the following: <quote>, or section 718 of title 38</quote>.</text> </subclause></clause></subparagraph></paragraph></subsection><subsection id="H52831D043DC3425C80A13408784FB125"><enum>(b)</enum><header>Application</header><text>Section 718 of title 38, United States Code, as added by subsection (a)(1), shall apply to any covered employee (as that term is defined in subsection (b) of such section, as so added) appointed after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
