		<official-title>To authorize the United States Postal Service to inspect the contents of certain suspicious
			 packages  for illicit materials without a warrant.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Search Now, Inspect for Fentanyl Act of 2018</short-title></quote> or the <quote><short-title>SNIFF Act</short-title></quote>.</text>
 </section><section id="id2CBF38F250C143CBA8B79C2BB41FD1B2"><enum>2.</enum><header>Authority of United States Postal Service to inspect certain suspicious packages</header><text display-inline="no-display-inline">Section 404 of title 39, United States Code, is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id7206A679AE0E482FB2B8796329566B5A" style="USC"> <subsection id="idEA368731928F4507A2071B1A205EDFF9"><enum>(f)</enum><header>Authority To inspect certain suspicious packages</header> <paragraph id="id51606F1F7B35494BB6298C5A725E5962"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text>
 <subparagraph id="idBF881FC6249A4F22BEDB2874A64E7747"><enum>(A)</enum><text>the term <term>covered package</term> means a package that—</text> <clause id="id07D68B47B8744A539006F188A407F0C7"><enum>(i)</enum><text>originated outside the United States; and</text>
 </clause><clause id="id94749FEB673B4B04BD86B73D904A2444"><enum>(ii)</enum><text>is addressed to a location within the United States;</text> </clause></subparagraph><subparagraph id="idFBFAF73107CF47F1B42036CA47CF3E39"><enum>(B)</enum><text>the term <term>qualified employee</term> means an employee of the Postal Service who has been properly trained to inspect the contents of covered packages; and</text>
 </subparagraph><subparagraph id="id54CE6D438AE64700AEC9DED6BB96257A"><enum>(C)</enum><text>the term <term>United States</term> includes any territory or possession of the United States.</text> </subparagraph></paragraph><paragraph id="id79357550A3EB48ECB9544462CE2342B2"><enum>(2)</enum><header>Authority</header> <subparagraph id="idB6670015DC85478CB972068FCF9212F1"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), and notwithstanding subsection (c), if a qualified employee acting in his or her official capacity at an international service center that processes inbound international mail has probable cause to believe that a covered package contains illicit materials, including matter that is nonmailable under section 3001, the employee shall, without obtaining a search warrant, inspect the contents of the covered package.</text>
 </subparagraph><subparagraph id="idDA1223F3F79B45D89CF53FAE54E9BE91"><enum>(B)</enum><header>Safety exception</header><text>The requirement under subparagraph (A) shall not apply with respect to a covered package if a qualified employee believes that inspecting the contents of the covered package would pose a risk of personal injury to the employee or other individuals.</text>
 </subparagraph></paragraph><paragraph id="id61AF338096984D789B6C25584A118F88"><enum>(3)</enum><header>Rules of construction</header><text>Nothing in paragraph (2) shall be construed to authorize—</text> <subparagraph id="id6A672CC8D68143B19F2ED9FCCB526017"><enum>(A)</enum><text>any employee of the Postal Service to inspect a covered package, after the package has entered the domestic distribution network, without obtaining a search warrant; or</text>
 </subparagraph><subparagraph id="idCD77129C8080499EB8E86859CACA7B05"><enum>(B)</enum><text>any person to read correspondence contained in a covered package without obtaining a search warrant.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
