			 including at border security stops within United States borders, and for
			 other
			 purposes. </official-title></form>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
 titles</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Department of Homeland Security Accountability and Transparency Act</short-title></quote> or the <quote><short-title>DATA Act</short-title></quote>.</text>
 </section><section id="ide2ac88e82bf5435488d4e06d1d82753b"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="id564a1069913b4af2b65ef658e231ddb6"><enum>(1)</enum><header>Border security</header><text>The term <term>border security</term> means the prevention of unlawful entries into the United States, including entries by individuals, instruments of terrorism, narcotics, and other contraband.</text>
 </paragraph><paragraph id="id6450B5A1E9DA4325A7F4A335A3EDA658"><enum>(2)</enum><header>Checkpoint</header><text>The term <term>checkpoint</term> means a location—</text> <subparagraph id="idfef52140a7de4c2980c913d642f4e4b5"><enum>(A)</enum><text>at which vehicles or individuals traveling through the location are stopped by a law enforcement official for the purposes of enforcement of United States laws and regulations; and</text>
 </subparagraph><subparagraph id="id376f484627264f4f86cbc468f7548e35"><enum>(B)</enum><text>that is not located at a port of entry along an international border of the United States.</text> </subparagraph></paragraph><paragraph id="id978c82047aa74fc89401adbf4e4f7d6b"><enum>(3)</enum><header>Law enforcement official</header><text>The term <term>law enforcement official</term> means—</text>
 <subparagraph id="id8acca6ab51db469cbf03e242854233d9"><enum>(A)</enum><text>an officer or agent of U.S. Customs and Border Protection;</text> </subparagraph><subparagraph id="id99d1cefd32264677947dacce37ec7a16"><enum>(B)</enum><text>an officer or agent of U.S. Immigration and Customs Enforcement; or</text>
 </subparagraph><subparagraph id="id657e38cb731645718dcd139b75a7ebc4"><enum>(C)</enum><text>an officer or employee of a State, or a political subdivision of a State, who is carrying out the functions of an immigration officer pursuant to—</text>
 <clause id="id54A7978D7F164D28B3C9B898B4E12876"><enum>(i)</enum><text>an agreement entered into under section 287(g) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1357">8 U.S.C. 1357(g)</external-xref>);</text>
 </clause><clause id="id9CC7CE348E10406DA94FCD5DBD3AB068"><enum>(ii)</enum><text>authorization under title IV of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1401">19 U.S.C. 1401</external-xref> et seq.); or</text>
 </clause><clause id="idF293BCD125F34E108C9E706CB83FB390"><enum>(iii)</enum><text>any other agreement with the Department of Homeland Security, including any Federal grant program.</text> </clause></subparagraph></paragraph><paragraph id="idb3e0f72287c1479da95d21325008632d"><enum>(4)</enum><header>Patrol stop</header><text>The term <term>patrol stop</term> means search, seizure, or interrogation of a motorist, passenger, or pedestrian initiated anywhere except as part of an inspection at a port of entry or a primary inspection at a checkpoint.</text>
 </paragraph><paragraph id="id4434D35C46AB4B5D83551CB67780D731"><enum>(5)</enum><header>Primary inspection</header><text>The term <term>primary inspection</term> means an initial inspection of a vehicle or individual at a checkpoint.</text> </paragraph><paragraph id="idD54E8EBAF4B642419BE7E795D42A8F99"><enum>(6)</enum><header>Secondary inspection</header><text>The term <term>secondary inspection</term> means a further inspection of a vehicle or individual that is conducted following a primary inspection.</text>
			</paragraph></section><section id="idb0888a318824472da83c92b0b2c8b572"><enum>3.</enum><header>Data collection by law enforcement officials enforcing United States laws and regulations and
			 making border security stops</header>
 <subsection id="idaf473d21134d4522a75146ad3ffa2d24"><enum>(a)</enum><header>Requirement for data collection regarding stops and searches</header><text>A law enforcement official who initiates a patrol stop or who detains any individual beyond a brief and limited inquiry, such as a primary inspection at a checkpoint, shall record—</text>
 <paragraph id="idbfe45ce1f550431cb19937ab62ab150f"><enum>(1)</enum><text>the date, time, and location of the contact;</text> </paragraph><paragraph id="idb6febc59b5014ca9a43f3bb82419a015"><enum>(2)</enum><text>the law enforcement official’s basis for, or circumstances surrounding, the contact, including if such individual’s perceived race or ethnicity contributed to the basis for, and circumstances surrounding, the contact;</text>
 </paragraph><paragraph id="idada7d4a04802414fb87c84b0f4060a2a"><enum>(3)</enum><text>the identifying characteristics of such individual, including the individual’s perceived race, gender, ethnicity, and approximate age;</text>
 </paragraph><paragraph id="id197a81e5e1c847178ea092fb865816e7"><enum>(4)</enum><text>the duration of the stop, detention, or search, whether consent was requested and obtained for the contact, including any search;</text>
 </paragraph><paragraph id="id75f84ee23fe144739d330259f88d4cbe"><enum>(5)</enum><text>a description of any articulable facts and behavior by the individual that justify initiating the contact or probable cause to justify any search pursuant to such contact;</text>
 </paragraph><paragraph id="id12f983f0ca714bdd966d6f1e37a58f2b"><enum>(6)</enum><text>a description of any items seized during such search, including contraband or money, and a specification of the type of search conducted;</text>
 </paragraph><paragraph id="ide7015124cfa743dfa63bf3d3bff78e9a"><enum>(7)</enum><text>whether any arrest, detention, warning, or citation resulted from such contact and the basis for such action;</text>
 </paragraph><paragraph id="id67cbe40f2d33461a836d13402f555e34"><enum>(8)</enum><text>the immigration status of the individual, if obtained during the ordinary course of the contact without additional questioning in accordance with this Act, and whether removal proceedings were subsequently initiated against the individual;</text>
 </paragraph><paragraph id="ida26af599d46241f9bb099b3b92c9cf26"><enum>(9)</enum><text>whether a body-worn camera or any other video or audio recording exists that recorded the stop or detention;</text>
 </paragraph><paragraph id="id8A8909A5E04345859F44BA3C30A00336"><enum>(10)</enum><text>whether force was used by the law enforcement official and, if so, the type of force, justification for using force, and whether the use of force resulted in injury or death;</text>
 </paragraph><paragraph id="id2fad6b993d3742d887c0be5fad37a232"><enum>(11)</enum><text>whether any complaint was made by the individual subject to the contact, and if so—</text> <subparagraph id="id352A0EDCF0B34C8D999BC33BA188AB1D"><enum>(A)</enum><text>which oversight components within or outside of the Department of Homeland Security investigated the complaint;</text>
 </subparagraph><subparagraph id="id320217E6662948C386D2C150B3221D2A"><enum>(B)</enum><text>how long the investigation lasted;</text> </subparagraph><subparagraph id="id198DA235C58245788B3B9A69101D13A0"><enum>(C)</enum><text>a description of the methods of investigation used; and</text>
 </subparagraph><subparagraph id="ida7eeb2c7674146c197ac93aae3459825"><enum>(D)</enum><text>the badge number of the law enforcement official involved in the complaint;</text> </subparagraph></paragraph><paragraph id="id41f89416a2af4872afb85b6e8b897d98"><enum>(12)</enum><text>if the contact was initiated by a State or local law enforcement agency—</text>
 <subparagraph id="idBA1E006D900646E398A9F035AF0E5ECF"><enum>(A)</enum><text>the reason for involvement of a Federal law enforcement official;</text>
 </subparagraph><subparagraph id="idAA23D698D0304CE4A485A001ED259E99"><enum>(B)</enum><text>the duration of the contact prior to contact with any Federal law enforcement official;</text>
 </subparagraph><subparagraph id="id0333BABDDA07404CA28B5578A727AD4E"><enum>(C)</enum><text>the method by which a Federal law enforcement official was informed of the stop; and</text>
 </subparagraph><subparagraph id="idD18FB314B7C54333880A56A7BDE92436"><enum>(D)</enum><text>whether the individual was being held by State or local officials on State criminal charges at the time of such contact;</text>
 </subparagraph></paragraph><paragraph id="idAE30818A7B0746C1BAB52A9DEA4227DC"><enum>(13)</enum><text>if the contact was initiated by a State or local law enforcement agency of a State, whether such agency was acting pursuant to—</text>
 <subparagraph id="idAA591ECD40FF4B0FA6DF1F0EDF1BC831"><enum>(A)</enum><text>an agreement entered into under section 287(g) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1357">8 U.S.C. 1357(g)</external-xref>);</text>
 </subparagraph><subparagraph id="id834E0C53AECD4C709EDA829E4033AA98"><enum>(B)</enum><text>authorization under title IV of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1401">19 U.S.C. 1401</external-xref> et seq.); or</text>
 </subparagraph><subparagraph id="id0CF7BC020C1840A1AAB48F8F11639D78"><enum>(C)</enum><text>pursuant to any other agreement with the Department of Homeland Security, including any Federal grant program;</text>
 </subparagraph></paragraph><paragraph id="id895D08A8CAB441BCBE02AB632FA5EB40"><enum>(14)</enum><text>if the contact involved an individual whose primary language of communication is not English, the means of communication used;</text>
 </paragraph><paragraph id="idB5707B2DC76243E5990F8D91B7403830"><enum>(15)</enum><text>if the contact occurred at a location proximate to a place of worship or religious ceremony, school or education-related place or event, courthouse or other civic building providing services accessible to the public, hospital, medical treatment, or health care facility, at a public demonstration, or an attorney's office, including a public defender or legal aid office; and</text>
 </paragraph><paragraph id="idEBD5A597A419462E9C0727C22A6360B7"><enum>(16)</enum><text>if the contact occurred at a location described in paragraph (15), why that location was chosen and any supervisory approval that was sought to carry out the contact at the location.</text>
 </paragraph></subsection><subsection id="id0e73c16c98824d9b9d55b7f83de22f26"><enum>(b)</enum><header>Requirement for U.S. Customs and Border Protection data collection regarding checkpoints</header><text>The Commissioner of U.S. Customs and Border Protection shall collect data on—</text> <paragraph id="id41D77E0792B249398A9F73810E4363F7"><enum>(1)</enum><text>the number of permanent and temporary checkpoints utilized by officers of U.S. Customs and Border Protection;</text>
 </paragraph><paragraph id="id5363C0F28D7E4DABBA725EBBEC3FBE67"><enum>(2)</enum><text>the location of each such checkpoint;</text> </paragraph><paragraph id="id667CE35E105C4E81805C231547984ED8"><enum>(3)</enum><text>the dates on which a temporary checkpoint was used; and</text>
 </paragraph><paragraph id="idC8571B30799B480B8816C3EB5E601614"><enum>(4)</enum><text>a description of each such checkpoint, including the presence of any other law enforcement agencies and the use of law enforcement resources, such as canines and surveillance technologies, including license plate readers.</text>
 </paragraph></subsection><subsection id="id2a8caf932fef4943bcf3508a591ccd3a"><enum>(c)</enum><header>Rulemaking</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security, in consultation with stakeholders, including research, civil and human rights organizations, shall promulgate regulations relating to the collection and reporting of data required under subsections (a) and (b), which shall—</text>
 <paragraph id="id50EE58967D7E48678BCF342A4F7A34CE"><enum>(1)</enum><text>specify all data to be reported; and</text> </paragraph><paragraph id="idE894BFC85C704C31B7F2841863A9719E"><enum>(2)</enum><text>provide standards, definitions, and technical specifications to ensure uniform reporting.</text>
				</paragraph></subsection><subsection id="idD754432EEC074668BA7B519111EE65E5"><enum>(d)</enum><header>Compilation of data</header>
 <paragraph id="id8e08aaf13a954899864f3eaf9c1aa3fd"><enum>(1)</enum><header>Department of Homeland Security law enforcement officials</header><text>The Secretary of Homeland Security shall compile—</text> <subparagraph id="idCFB644715BB743A2AF5778C7221EC3C8"><enum>(A)</enum><text>the data collected under subsection (a) by U.S. Immigration and Customs Enforcement officers and U.S. Customs and Border Protection officers;</text>
 </subparagraph><subparagraph id="id77134D6416BA4A4184406132794A2A46"><enum>(B)</enum><text>the data collected under subsection (b) by the Commissioner of U.S. Customs and Border Protection; and</text>
 </subparagraph><subparagraph id="idDEFBA4F2F7CC455095C3A6B8ED900722"><enum>(C)</enum><text>an analysis for all incidents investigated by the Department of Homeland Security’s Office of Inspector General, U.S. Customs and Border Protection’s Office of Professional Responsibility, or U.S. Immigration and Customs Enforcement’s Office of Professional Responsibility to determine whether the data required to be collected under this Act were properly recorded and, if not, the corrective measures that were or will be taken.</text>
 </subparagraph></paragraph><paragraph id="id18161f440e5b4423a30c1b411a1bfa4b"><enum>(2)</enum><header>Other law enforcement officials</header><text>The head of each agency, department, or other entity that employs law enforcement officials other than officers referred to in paragraph (1) shall—</text>
 <subparagraph id="idaa790e02c300459db02751c1e522cc54"><enum>(A)</enum><text>compile the data collected by such law enforcement officials pursuant to subsection (a); and</text> </subparagraph><subparagraph id="id74c9d16846134b918ee8756a5e468d65"><enum>(B)</enum><text>submit the compiled data to the Secretary of Homeland Security.</text>
 </subparagraph></paragraph></subsection><subsection id="id86947be6ae9947ffb4c538d8fd8f906e"><enum>(e)</enum><header>Use of data</header><text>The Secretary of Homeland Security shall consider the data compiled under subsection (d) in making policy and program decisions.</text>
 </subsection><subsection id="idF7A9946649884DC89D84FC2FC1C7C7AB"><enum>(f)</enum><header>Audit and report</header><text>Not later than 1 year after the effective date of the regulations promulgated under subsection (c), the Comptroller General of the United States shall—</text>
 <paragraph id="idB96FC5A393714CB5AD340B488E247227"><enum>(1)</enum><text>conduct an audit of the data compiled under subsection (d) to determine whether law enforcement officials are complying with the data collection requirements under subsection (a); and</text>
 </paragraph><paragraph id="id2D2D6A2CE90544728B533C58A3308D04"><enum>(2)</enum><text>submit a report to Congress that contains a summary of the findings of such audit.</text> </paragraph></subsection></section><section id="idd8b9c415cf744933a4d06116249f0a32"><enum>4.</enum><header>Annual report</header> <subsection id="id843ea5e154f3483cb72453217674d9cd"><enum>(a)</enum><header>Requirement</header><text>Not later than 1 year after the effective date of this Act, and annually thereafter, the Secretary of Homeland Security shall submit a report to Congress on the data compiled under section 3(d), including all such data for the previous year.</text>
 </subsection><subsection id="idd35d5a69b34f458b847b832bc8275d71"><enum>(b)</enum><header>Availability</header><text>Each report submitted under subsection (a) shall be made available to the public, except for particular data if the Secretary—</text>
 <paragraph id="id53733918F79A4D8392F3DDEF583F3C70"><enum>(1)</enum><text>explicitly invokes an exemption contained in paragraphs (1) through (9) of section 552(b) of title 5, United States Code; and</text>
 </paragraph><paragraph id="id1E8664E9775A422FBF90DE3730D86446"><enum>(2)</enum><text>provides a written explanation for the exemption’s applicability.</text> </paragraph></subsection><subsection id="id6D23ECE1A6294915A1BE596411D9A7D8"><enum>(c)</enum><header>Privacy</header><text>The Secretary may not report unique personal identifying information of persons stopped, searched, or subjected to a property seizure, for purposes of this section.</text>
 </subsection><subsection id="idF2BFEC8E45984210B3546DDE52385186"><enum>(d)</enum><header>Publication</header><text>The data compiled under section 3(d) shall be made available to the public to the extent the release of such data is permissible under Federal law.</text>
