 other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="H78764476690D411282F4EDD28F179257" style="OLC"><section id="H063309F0BBE849A1A4B1FE34860386D0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Civil Rights Cold Case Records Collection Act of 2018</short-title></quote>.</text></section><section id="HE1EF5A99BAF946D7882711E1DB3F1723"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H17B7909A355749929DFF02F17369624E"><enum>(1)</enum><text>All Government records related to civil rights cold cases shall be preserved for historical and Governmental purposes.</text></paragraph><paragraph id="H31859BC2159E49F3ADE14BB6936F76F4"><enum>(2)</enum><text>All Government records concerning civil rights cold cases shall carry a presumption of immediate disclosure, and all records shall be eventually disclosed to enable the public to become fully informed about the history surrounding the cases.</text></paragraph><paragraph id="H832DC24C91A54862A18494461DA885AA"><enum>(3)</enum><text>Legislation is necessary to create an enforceable, independent, and accountable process for the public disclosure of such records.</text></paragraph><paragraph id="H409D729F497A41A3A04568A570C58D28"><enum>(4)</enum><text>Legislation is necessary because congressional records related to civil rights cold cases would not otherwise be subject to public disclosure.</text></paragraph><paragraph id="HD24EFB4227AF4C2F801D93EB819B9747"><enum>(5)</enum><text>Legislation is necessary because section 552 of title 5, United States Code (commonly known as the Freedom of Information Act), as implemented by the executive branch, has prevented the timely and adequate public disclosure of records relating to civil rights cold cases.</text></paragraph><paragraph id="HB47A38E4EBE34C2B88369E04FB05D3C2"><enum>(6)</enum><text>Legislation is necessary because Executive Order 13526 (75 Fed. Reg. 707; relating to classified national security information) has not resulted in the timely and adequate public disclosure of records relating to civil rights cold cases.</text></paragraph><paragraph id="H9CC6DE1AFD6B424AA1EE1873BAACCB29"><enum>(7)</enum><text>Most of the records related to the civil rights cold cases are almost 50 years old and only in the rarest cases is there any legitimate need for continued protection of such records.</text></paragraph></section><section id="H1ACE92A2B83D4D41A565A3315F94AE85"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HEF931092475347909C4750F03E1B460E"><enum>(1)</enum><header>Archivist</header><text>The term <quote>Archivist</quote> means the Archivist of the United States.</text></paragraph><paragraph id="H198ED44231CC4C83843DD36147B1AB0B"><enum>(2)</enum><header>Civil rights cold case</header><text>The term <quote>civil rights cold case</quote> means any unsolved case—</text><subparagraph id="ide6ae0884fea04a3fbb4452e9742dabec"><enum>(A)</enum><text>arising out of events which occurred during the period beginning on January 1, 1940 and ending on December 31, 1979; and</text></subparagraph><subparagraph id="id15BA8D1325C1454A87FB850BE4368F65"><enum>(B)</enum><text>related to—</text><clause id="HFCBB507B6CB441839984B706DB24B845"><enum>(i)</enum><text>section 241 of title 18, United States Code (relating to conspiracy against rights);</text></clause><clause id="HA9FFCA9B73BE49FDA5944843332C2908"><enum>(ii)</enum><text>section 242 of title 18, United States Code (relating to deprivation of rights under color of law);</text></clause><clause id="H529888ABF8EF4B5A88198B9FA9C0D5B2"><enum>(iii)</enum><text>section 245 of title 18, United States Code (relating to federally protected activities);</text></clause><clause id="H875C228770474B998CC1E4309FB465AE"><enum>(iv)</enum><text>sections 1581 and 1584 of title 18, United States Code (relating to peonage and involuntary servitude);</text></clause><clause id="H1E502F9C04A24C3CB93CE5C2B369B4BF"><enum>(v)</enum><text>section 901 of the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3631">42 U.S.C. 3631</external-xref>); or</text></clause><clause commented="no" id="H5DC069F9368247D982389E73C00B4CB5"><enum>(vi)</enum><text>any other Federal law that was—</text><subclause commented="no" id="HC229CC9E4A5443958536429EEBBB9D37"><enum>(I)</enum><text>in effect on or before December 31, 1979; and</text></subclause><subclause commented="no" id="H6C123CB11973476ABC29017F74A99459"><enum>(II)</enum><text>enforced by the criminal section of the Civil Rights Division of the Department of Justice before the date of enactment of this Act.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" id="HD7274CAA015F4702AD06BF8B4CC62FBE"><enum>(3)</enum><header>Civil rights cold case record</header><text>The term <quote>civil rights cold case record</quote> means a record that—</text><subparagraph commented="no" id="id5003F45A7FBA45FCA7182C4D9B12D7FF"><enum>(A)</enum><text>is related to a civil rights cold case; and</text></subparagraph><subparagraph commented="no" id="idDCABAAB14B34476E873C355DB3F5B0A2"><enum>(B)</enum><text>was created or made available for use by, obtained by, or otherwise came into the possession of—</text><clause commented="no" id="H9D0E9ED6FFA44EBEAAA52182DA3AC2DC"><enum>(i)</enum><text>the Library of Congress;</text></clause><clause commented="no" id="H2AEBDCD98B7B4983B980ED0A0562E2ED"><enum>(ii)</enum><text>the National Archives and Records Administration;</text></clause><clause commented="no" id="HD2CBC61389274BE2A9D36F17D29A13F8"><enum>(iii)</enum><text>any executive agency;</text></clause><clause commented="no" id="H9F70C6A2640F4D0D9E8C134256387B41"><enum>(iv)</enum><text>any independent agency;</text></clause><clause commented="no" id="H08C9737C015049AAA80873253AB13576"><enum>(v)</enum><text>any other entity of the Federal Government; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HFDCB4E44325A4DA385EAB188AEF13005"><enum>(vi)</enum><text>any State or local government, or component thereof, that provided support or assistance or performed work in connection with a Federal inquiry into a civil rights cold case.</text></clause></subparagraph></paragraph><paragraph id="HEC1BB52DFB39400B96787E2A4452EE5D"><enum>(4)</enum><header>Collection</header><text>The term <quote>Collection</quote> means the Civil Rights Cold Cases Collection established under section 4.</text></paragraph><paragraph id="HB12AB1683A434E7692D3507B6AE3449E"><enum>(5)</enum><header>Executive agency</header><text>The term <quote>executive agency</quote> means an agency, as defined in subsection 552(f) of title 5, United States Code.</text></paragraph><paragraph id="H95E127FA6B224FC399C041D9BC46B73A"><enum>(6)</enum><header>Government office</header><text>The term <quote>Government office</quote> means any office of the Federal Government that has possession or control of 1 or more civil rights cold case records.</text></paragraph><paragraph id="HD31BC77448AF4FCBB6314B03397D01AE"><enum>(7)</enum><header>Government official</header><text>The term <quote>Government official</quote> means any officer or employee of the United States, including elected and appointed officials.</text></paragraph><paragraph id="HFDCC60E3EA6A4F649B33CE7B3A861BD4"><enum>(8)</enum><header>National Archives</header><text>The term <quote>National Archives</quote> means the National Archives and Records Administration and all components thereof, including Presidential archival depositories established under section 2112 of title 44, United States Code.</text></paragraph><paragraph id="H2F5EB6AF850A4EC38CF325711C1EF8E3"><enum>(9)</enum><header>Official investigation</header><text>The term <quote>official investigation</quote> means the reviews of civil rights cold cases conducted by any entity of the Federal Government either independently, at the request of any Presidential commission or congressional committee, or at the request of any Government official.</text></paragraph><paragraph id="H34BC0596AD2A469D8519CF00739F8D96"><enum>(10)</enum><header>Originating body</header><text>The term <quote>originating body</quote> means the executive agency, Government commission, congressional committee, or other Governmental entity that created a record or particular information within a record.</text></paragraph><paragraph id="H2114AEDF716C48C78424FA60EBAF191E"><enum>(11)</enum><header>Public interest</header><text>The term <quote>public interest</quote> means the compelling interest in the prompt public disclosure of civil rights cold case records for historical and Governmental purposes and for the purpose of fully informing the people of the United States about the history surrounding all civil rights cold cases in the United States.</text></paragraph><paragraph commented="no" id="H093740429D7B44C19BC7BB7F51BDA64A"><enum>(12)</enum><header>Record</header><text>The term <term>record</term> has the meaning given the term in section 3301 of title 44, United States Code.</text></paragraph><paragraph id="H59AF1EAB2EEB40CE9CB313D28D892D54"><enum>(13)</enum><header>Review board</header><text>The term <quote>Review Board</quote> means the Civil Rights Cold Case Records Review Board established under section 6.</text></paragraph></section><section id="HF2D66DC63D5D46F19FFDB98764AFB88B"><enum>4.</enum><header>Civil rights cold case records collection at the national archives and record administration</header><subsection id="H46E040EA0BAE448FA4D32ECC6457BE6B"><enum>(a)</enum><header>In general</header><paragraph id="H682CE0AC4A594FEC98E8CDBCA26BFEC8"><enum>(1)</enum><header>Establishment of the civil rights cold case records collection</header><text>Not later than 60 days after the date of enactment of this Act, the Archivist shall—</text><subparagraph id="H0851E106A4C747D387CF8165E1231C6D"><enum>(A)</enum><text>commence establishing a collection of civil rights cold case records to be known as the <quote>Civil Rights Cold Case Records Collection</quote> that ensures the physical integrity and original provenance of all records in the Collection; and</text></subparagraph><subparagraph id="HD9D53E00E7DD418696F159827620352F"><enum>(B)</enum><text>commence preparing and publishing the subject guidebook and index to the Collection; and</text></subparagraph><subparagraph id="idD81048271C354332905F1C1D3576466D"><enum>(C)</enum><text>establish criteria for Government offices to follow when transmitting copies of civil rights cold case records to the Archivist, to include required metadata.</text></subparagraph></paragraph><paragraph id="HCA8CA8B86D6C4282B75562062B9F85BA"><enum>(2)</enum><header>Contents of collection</header><text>The Collection shall include—</text><subparagraph id="HD49EB661136E45D1947EA3C51DEE288D"><enum>(A)</enum><text>a copy of each civil rights cold case record—</text><clause id="idFEDFEAE4CA0E4B528D126265404B3352"><enum>(i)</enum><text>that has not been transmitted to the Archivist, which shall be transmitted by the entity described in section 3(3) in possession of the civil rights cold case record to the Archivist in accordance with section 2107 of title 44, United States Code; or</text></clause><clause id="H9C04E6E6C5DE419C89150E7440F80D41"><enum>(ii)</enum><text>that has been transmitted to the Archivist or disclosed to the public in an unredacted form before the date of the enactment of this Act;</text></clause><clause id="H8CAE7C803E0B4BFC838FA36E558B4797"><enum>(iii)</enum><text>that is required to be transmitted to the Archivist; or</text></clause><clause id="H863B2478BAC0483DBD036DC201F07B1E"><enum>(iv)</enum><text>the disclosure of which is postponed under this Act; and</text></clause></subparagraph><subparagraph id="H274A3CBA8CC14EA896962E14FE80295E"><enum>(B)</enum><text>all Review Board records, as required under this Act.</text></subparagraph></paragraph></subsection><subsection id="HA62AF3A889914DF796224E35CE03BDBD"><enum>(b)</enum><header>Disclosure of records</header><text>All civil rights cold case records transmitted to the Archivist for disclosure to the public—</text><paragraph id="id4363838A545C4A1D9BB2F75A90454AF8"><enum>(1)</enum><text>shall be included in the Collection;</text></paragraph><paragraph id="id0895AF7B7BBC4F08BABAAF45F13A0124"><enum>(2)</enum><text>not later than 60 days after the transmission of the record to the Archivist, shall be available to the public for inspection and copying at the National Archives; and</text></paragraph><paragraph id="idCFE7FF00CE9747AB8794964F89CAAEC2"><enum>(3)</enum><text>shall be prioritized for digitization by the National Archives.</text></paragraph></subsection><subsection id="HB9226449316A4233B5E01C4040DD3E2E"><enum>(c)</enum><header>Fees for copying</header><text>The Archivist shall—</text><paragraph id="HE20398D416AD49B9A603AE33688B0BE7"><enum>(1)</enum><text>use efficient electronic means when possible;</text></paragraph><paragraph id="H51DF2E0411CF4792803BB9A57CE1697B"><enum>(2)</enum><text>charge fees for copying civil rights cold case records; and</text></paragraph><paragraph id="H12B578D90FE641B1BC2C7290A35FBCBD"><enum>(3)</enum><text>grant waivers of such fees pursuant to the standard established under section 552(a)(4) of title 5, United States Code.</text></paragraph></subsection><subsection id="id8238dd576433417e93b8340cf1515d32"><enum>(d)</enum><header>Additional requirements</header><text>The Archivist shall ensure the security of civil rights cold case records in the Collection for which disclosure is postponed.</text></subsection><subsection id="H18B697C1C42D4CA2A9A7D7FB37753C6A"><enum>(e)</enum><header>Transmission to the national archives</header><text>Each Government office shall, in accordance with the criteria established by the Archivist under subsection (a)(1)(C)—</text><paragraph id="H68AE3D3702954A12A9321FD9ACDB2C80"><enum>(1)</enum><text>not later than 300 days after the date of the enactment of this Act, transmit to the Archivist, for the Archivist to make available to the public in accordance with subsection (b), a copy of each civil rights cold case record that can be publicly disclosed, including any such record that is publicly available on the date of enactment of this Act, without any redaction, adjustment, or withholding under the standards of this Act; and</text></paragraph><paragraph id="H4CEE3031A2B643CE916F444D47BCDA6F"><enum>(2)</enum><text>transmit to the Archivist upon approval for postponement by the Review Board or upon completion of other action authorized by this Act, a copy of each civil rights cold case record for which public disclosure has been postponed, in whole or in part, under the standards of this Act, to become part of the protected Collection.</text></paragraph></subsection><subsection id="H7C2E7EE1CF224CDFBB1894E02AFB7E9C"><enum>(f)</enum><header>Periodic review of postponed civil rights cold case records</header><paragraph id="HFDF5147178AA46F1A8F6234CE6198435"><enum>(1)</enum><header>In general</header><text>Each civil rights cold case record that is redacted or for which public disclosure is postponed shall be reviewed not later than December 31 each year by the entity submitting the record and the Archivist, consistent with the recommendations of the Review Board under section 8(c)(3)(B).</text></paragraph><paragraph id="H4F4D20FFA3A14D43BF7240761B7129F7"><enum>(2)</enum><header>Requirements of periodic review</header><text>The periodic review under paragraph (1) shall—</text><subparagraph id="HED2C063CF83F4558ABAE5D6EAAD030AD"><enum>(A)</enum><text>address the public disclosure of additional civil rights cold case records in the Collection under the standards of this Act; and</text></subparagraph><subparagraph id="H41586250AB734D95A9D4289A4AA99380"><enum>(B)</enum><text>serve to declassify classified information, with the presumption of providing public disclosure.</text></subparagraph></paragraph><paragraph id="H33F16E3F085D4153957A4DE4FA58EB2E"><enum>(3)</enum><header>Unclassified written description</header><text>Any civil rights cold case record for which postponement of public disclosure is continued shall include an unclassified written description of the reason for such continued postponement, which shall be provided to the Archivist and made available on a publicly accessible website upon the determination to continue the postponement.</text></paragraph><paragraph commented="no" id="HEDAA8BD724DD4A6CB533E2941CD6ADDE"><enum>(4)</enum><header>Full disclosure of civil rights cold case record required</header><subparagraph commented="no" id="id639B5534065C4AB68E3E087F530F5173"><enum>(A)</enum><header>In general</header><text>Each civil rights cold case record that is not publicly disclosed in full as of the date on which the Review Board terminates under section 6(n) shall be publicly disclosed in full and available in the Collection not later than 25 years after the date of enactment of this Act unless—</text><clause commented="no" id="HEAB552449D7E4E859AE29FF11C0FACEC"><enum>(i)</enum><text>the head of the originating body, an executive agency, or other Government office recommends in writing that continued postponement is made necessary by an identifiable harm to military defense, law enforcement, intelligence operations, or the conduct of foreign relations that is of such gravity that it outweighs the public interest in disclosure;</text></clause><clause commented="no" id="idB54D7A71652040BB87DCD1BD6A0F5B9B"><enum>(ii)</enum><text>the written recommendation described in clause (i)—</text><subclause commented="no" id="idC664654B32EA450C834409738C9BF82C"><enum>(I)</enum><text>is provided to the Archivist not later than 180 days before the date that is 25 years after the date of enactment of this Act; and</text></subclause><subclause id="id08f7e50565e045d283daf95528ed94e6"><enum>(II)</enum><text>includes—</text><item id="id720917F3ACAE44A8A644EF8C026C7827"><enum>(aa)</enum><text>a justification of the recommendation to postpone disclosure; and</text></item><item commented="no" display-inline="no-display-inline" id="ida795ad8af1f8400baa7b67ff8bbe091c"><enum>(bb)</enum><text>a recommended specified time at which or a specified occurrence following which the material may be appropriately disclosed to the public under this Act; and</text></item></subclause></clause><clause commented="no" id="id6E09F239A8154E24A3A5656EF9CC90B3"><enum>(iii)</enum><text>the Archivist agrees with the written recommendation described in clause (i).</text></clause></subparagraph><subparagraph commented="no" id="id6298B6190F63477488A00D0E88EF0850"><enum>(B)</enum><header>Notification</header><text>If the Archivist does not agree with the recommendation described in subparagraph (A)(1), the Archivist shall notify the head of the originating body, executive agency, or other Government office making the recommendation not later than 90 days before the date that is 25 years after the date of enactment of this Act.</text></subparagraph></paragraph></subsection><subsection id="HB4F77E651DD3429DA5A7968E4C471F92"><enum>(g)</enum><header>Digitization of records</header><text>Each executive agency shall make text searchable documents available to the Review Board pursuant to standards established under section 552(a)(3) of title 5, United States Code.</text></subsection></section><section commented="no" id="H3E7F60DFA7A541E2AF13CAEC687309BC"><enum>5.</enum><header>Grounds for postponement of public disclosure of records</header><text display-inline="no-display-inline">Disclosure of civil rights cold case records or particular information within a civil rights cold case record to the public may be postponed subject to the limitations of this Act if there is clear and convincing evidence of any of the following:</text><paragraph commented="no" id="H2553459D44B945CB8D2DECD7047F3E7D"><enum>(1)</enum><text>The threat to the military defense, law enforcement, intelligence operations, or the conduct of domestic affairs of the United States posed by the public disclosure of the civil rights cold case record is of such gravity that the disclosure outweighs the public interest and would reveal information described in paragraphs (1) through (9) of section 3.3(b) of Executive Order 13526 (75 Fed. Reg. 707; relating to classified national security information).</text></paragraph><paragraph commented="no" id="H395B414ED98C4917B145672A72B626AC"><enum>(2)</enum><text>The public disclosure of the civil rights cold case record would reveal the name or identity of a living individual who provided confidential information to the United States and would pose a substantial risk of harm to that individual.</text></paragraph><paragraph commented="no" id="HDC82FDB8D12240E9AB987115298B69E3"><enum>(3)</enum><text>The public disclosure of the civil rights cold case record could reasonably be expected to constitute an unwarranted invasion of personal privacy, and that invasion of privacy is so substantial that the protection of privacy outweighs the public interest.</text></paragraph><paragraph commented="no" id="HFEB826C1FAEE4B16868F867BE5623C4C"><enum>(4)</enum><text>The public disclosure of the civil rights cold case record would compromise the existence of an understanding of confidentiality currently requiring protection between a Government agent and a cooperating individual or group and public disclosure would be so harmful that the understanding of confidentiality outweighs the public interest.</text></paragraph></section><section id="H37150EC7A150404783E0755503D5C500"><enum>6.</enum><header>Establishment and powers of the civil rights cold case records review board</header><subsection id="HB192FB296B2F4C40968E9BFDC3BB136E"><enum>(a)</enum><header>Establishment</header><text>There is established, as an independent agency, a board to be known as the Civil Rights Cold Case Records Review Board.</text></subsection><subsection commented="no" id="H52FB170206064FD0B6B30FE7702736A2"><enum>(b)</enum><header>Appointment</header><paragraph commented="no" id="idB2AA600D43DE43478FE7932AFBDAD1B6"><enum>(1)</enum><header>In general</header><text>The President shall appoint, by and with the advice and consent of the Senate, 5 individuals to serve as members of the Review Board to ensure and facilitate the review, transmission to the Archivist, and public disclosure of civil rights cold case records.</text></paragraph><paragraph commented="no" id="H62012DCBF7A0475E842FE6C62D6974BF"><enum>(2)</enum><header>Initial appointment</header><subparagraph commented="no" id="idA0420638F7AD4248A6F2593E175B0E99"><enum>(A)</enum><header>In general</header><text>Initial appointments to the Review Board shall, so far as practicable, be made not later than 60 days after the enactment of this Act.</text></subparagraph><subparagraph commented="no" id="HC1F3BDFF94DE442EBC30EE9ABE2D9ED2"><enum>(B)</enum><header>Recommendations</header><text>In making appointments to the Review Board, the President shall consider any individuals recommended by the American Historical Association, the Organization of American Historians, the Society of American Archivists, and the American Bar Association.</text></subparagraph><subparagraph commented="no" id="H278C70CF6B2D4166B76EA64611C1D650"><enum>(C)</enum><header>Extension</header><text>If an organization described in subparagraph (B) does not recommend at least 2 nominees meeting the qualifications stated in paragraph (3) within 60 days after the date of enactment of this Act, the deadline under subparagraph (A) shall be extended until the earlier of 60 days after the date on which such recommendations are made or 120 days after the date of enactment of this Act.</text></subparagraph><subparagraph commented="no" id="HF1B2FCD0B0C64E05BA3488F80AD429FE"><enum>(D)</enum><header>Additional recommendations</header><text>The President may request that any organization described in subparagraph (B) submit additional recommended nominees.</text></subparagraph></paragraph><paragraph commented="no" id="H0873B16E44734E55BAF3AD6205479BC7"><enum>(3)</enum><header>Qualifications</header><text>Individuals nominated to the Review Board shall—</text><subparagraph commented="no" id="H24477A06A14B4169B5A660CD58131630"><enum>(A)</enum><text>not have had any previous involvement with any official investigation or inquiry conducted by the Federal Government, or any State or local government, relating to any civil rights cold case;</text></subparagraph><subparagraph commented="no" id="H8213A275D4DD43B4BC47E6338C7B89E3"><enum>(B)</enum><text>be distinguished individuals of high national professional reputation in their respective fields who are capable of exercising the independent and objective judgment necessary to fulfill their role in ensuring and facilitating the review, transmission to the public, and public disclosure of files related to civil rights cold cases and who possess an appreciation of the value of such material to the public, scholars, and government; and</text></subparagraph><subparagraph commented="no" id="H35BCFFBA5C084DE5B83A561084C3F28A"><enum>(C)</enum><text>include at least 1 professional historian and 1 attorney.</text></subparagraph></paragraph></subsection><subsection commented="no" id="HED2352418AC9486785B8ADA9B367B08D"><enum>(c)</enum><header>Security clearances</header><text>All Review Board nominees shall be processed for the necessary security clearances in an accelerated manner by the appropriate Federal agencies and subject to the standard procedures for granting such clearances.</text></subsection><subsection id="HAF8AFCAF5B4448768684F8EFFEDC1962"><enum>(d)</enum><header>Vacancy</header><text>A vacancy on the Review Board shall be filled in the same manner as the original appointment within 60 days of the occurrence of the vacancy.</text></subsection><subsection id="H5E39B9B2337B4D95850B6D6D22ABC1AA"><enum>(e)</enum><header>Chairperson</header><text>The members of the Review Board shall elect 1 of the members as chairperson.</text></subsection><subsection id="HFE636F690C594E54AC4334E88B183759"><enum>(f)</enum><header>Removal of review board member</header><paragraph id="HE2E986D57BE74527B04A3FA3A64C9399"><enum>(1)</enum><header>In general</header><text>No member of the Review Board shall be removed from office, other than—</text><subparagraph id="H40C775BD13D04A2EA3DC50B4E0F34608"><enum>(A)</enum><text>by impeachment and conviction; or</text></subparagraph><subparagraph id="H3E348605A8604640BB6ABD4C2939BA5C"><enum>(B)</enum><text>by the action of the President for inefficiency, neglect of duty, malfeasance in office, physical disability, mental incapacity, or any other condition that substantially impairs the performance of the member’s duties.</text></subparagraph></paragraph><paragraph id="HFFB90464FA1843518644DC7B60265C38"><enum>(2)</enum><header>Report</header><subparagraph id="id041B2835AA6D43C5AD13D0C731FCECA6"><enum>(A)</enum><header>In general</header><text>If a member of the Review Board is removed from office, and that removal is by the President, not later than 10 days after the removal, the President shall submit to the Committee on Oversight and Government Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report specifying the facts found and the grounds for the removal.</text></subparagraph><subparagraph id="H77282B9CBC80490E8B3F75F807F766C4"><enum>(B)</enum><header>Publication</header><text>The President shall publish in the Federal Register a report submitted under subparagraph (A), except that the President may, if necessary to protect the rights of a person named in the report or to prevent undue interference with any pending prosecution, postpone or refrain from publishing any or all of the report until the completion of such pending cases or pursuant to privacy protection requirements in law.</text></subparagraph></paragraph><paragraph id="HA2599196286F4361AF9B243A69989412"><enum>(3)</enum><header>Judicial review</header><subparagraph id="id5E63003B62AD4E54935BC397EF83C170"><enum>(A)</enum><header>In general</header><text>A member of the Review Board removed from office may obtain judicial review of the removal in a civil action commenced in the United States District Court for the District of Columbia.</text></subparagraph><subparagraph id="HA720A386DC5E4237955696C0200292EA"><enum>(B)</enum><header>Relief</header><text>The member may be reinstated or granted other appropriate relief by order of the court.</text></subparagraph></paragraph></subsection><subsection id="H94EB891877274B4D99CA5A7E6F768B08"><enum>(g)</enum><header>Compensation of members</header><paragraph id="H74732CF7AA334F81A81260EC429F1C4C"><enum>(1)</enum><header>In general</header><text>A member of the Review Board shall be compensated at a rate equal to the daily equivalent of the annual rate of basic pay prescribed for level IV of the Executive Schedule under section 5315 of title 5, United States Code, for each day (including travel time) during which the member is engaged in the performance of the duties of the Review Board.</text></paragraph><paragraph id="H6ED254499FA24EA3B92A8AB293A57811"><enum>(2)</enum><header>Travel expenses</header><text>A member of the Review Board shall be allowed reasonable travel expenses, including per diem in lieu of subsistence, at rates for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from the member’s home or regular place of business in the performance of services for the Review Board.</text></paragraph></subsection><subsection id="H9B03045CDEAF438CA6EC960F8FE6D767"><enum>(h)</enum><header>Duties of the review board</header><paragraph id="H1954382D05424DDA8449EA7E35C3A490"><enum>(1)</enum><header>In general</header><text>The Review Board shall consider and render decisions on a determination by a Government office to seek to postpone the disclosure of civil rights cold case records.</text></paragraph><paragraph id="H3C0269D0314741B7806930113652B23A"><enum>(2)</enum><header>Decisions</header><text>In carrying out paragraph (1), the Review Board shall consider and render decisions—</text><subparagraph id="H9F07DAED71D048AF940400CF88F82171"><enum>(A)</enum><text>whether a record constitutes a civil rights cold case record; and</text></subparagraph><subparagraph id="H5CA6E77DCA734687A99C91EE67E69725"><enum>(B)</enum><text>whether a civil rights cold case record or particular information in a record qualifies for postponement of disclosure under this Act.</text></subparagraph></paragraph></subsection><subsection id="H07F518159533498188CF3DAA217AEA89"><enum>(i)</enum><header>Powers</header><paragraph id="id2BF0DBD93F6D435EBB050BD7727A9A01"><enum>(1)</enum><header>In general</header><text>The Review Board shall have the authority to act in a manner prescribed under this Act including the authority to—</text><subparagraph id="H84E009FE3B8940C3BC32230345DC3065"><enum>(A)</enum><text>obtain access to civil rights cold case records that have been identified and organized by a Government office;</text></subparagraph><subparagraph id="H042ACA306C21428C9229E2625580A80E"><enum>(B)</enum><text>direct a Government office to make available to the Review Board, and if necessary investigate the facts surrounding, additional information, records, or testimony from individuals, which the Review Board has reason to believe is required to fulfill its functions and responsibilities under this Act;</text></subparagraph><subparagraph id="HA4FDB8BB39434F9487796B71E9AEA5B7"><enum>(C)</enum><text>subpoena private persons to compel testimony, records, and other information relevant to its responsibilities under this Act;</text></subparagraph><subparagraph id="H8B5EC66ADEBF4696A8459E6D24DC7CA4"><enum>(D)</enum><text>require any Government office to account in writing for the destruction of any records relating to civil rights cold cases;</text></subparagraph><subparagraph id="HF1664632FDA44BC097E168F9C50810C3"><enum>(E)</enum><text>receive information from the public regarding the identification and public disclosure of civil rights cold case records; and</text></subparagraph><subparagraph id="H8C1FE18C8F044EFDB4775189F62C644B"><enum>(F)</enum><text>hold hearings, administer oaths, and subpoena witnesses and documents.</text></subparagraph></paragraph><paragraph id="id96E70F8721BF41AC96D4139C59736EC3"><enum>(2)</enum><header>Enforcement of subpoenas</header><text>Any subpoena issued under this subsection may be enforced by any appropriate Federal court acting pursuant to a lawful request of the Review Board.</text></paragraph></subsection><subsection id="H59AD105581C24890BC605F532ABA12F9"><enum>(j)</enum><header>Witness immunity</header><text>The Review Board shall be considered to be an agency of the United States for purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/601">chapter 601</external-xref> of title 18, United States Code.</text></subsection><subsection id="H79EBEA4C820C409EBBA196E3DD3D4CDB"><enum>(k)</enum><header>Oversight</header><paragraph id="id4DC1ABCD3A744491BEC6666CEDCA6DA5"><enum>(1)</enum><header>In general</header><text>The Committee on Oversight and Government Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate shall have continuing oversight jurisdiction with respect to the official conduct of the Review Board and the disposition of postponed records after termination of the Review Board, and shall have access to any records held or created by the Review Board.</text></paragraph><paragraph id="idF0199147016145BDAA06BB37E870640C"><enum>(2)</enum><header>Cooperation of Review Board</header><text>The Review Board shall have a duty to cooperate with the exercised of the oversight jurisdiction described in paragraph (1).</text></paragraph></subsection><subsection id="H117CF890056441669D564B4A3F1E7B6B"><enum>(l)</enum><header>Support services</header><text>The Administrator of General Services shall provide administrative services for the Review Board on a reimbursable basis.</text></subsection><subsection id="H88B681CFB1BB40D49F99155D4A5DF693"><enum>(m)</enum><header>Interpretive Regulations</header><text>The Review Board may issue interpretive regulations.</text></subsection><subsection id="H649CF6247C3E4AB29C04C005C64B5092"><enum>(n)</enum><header>Termination</header><paragraph id="HA0FB25FD6AB043A19E7BB9BAA3CE3F8E"><enum>(1)</enum><header>In general</header><text>The Review Board shall terminate not later than 3 years after the enactment of this Act, except that the Review Board may, by majority vote, extend its term for an additional 1-year period if the Review Board has not completed its work within that 3-year period.</text></paragraph><paragraph id="H37306E959E674D6C9804184B393CDC73"><enum>(2)</enum><header>Reports</header><text>Before its termination, the Review Board shall submit reports to the President and the Congress, including a complete and accurate accounting of expenditures during its existence, and shall complete all other reporting requirements under this Act.</text></paragraph><paragraph commented="no" id="H8C62BE8E32EF40E5A00DBC3DC2C7DC78"><enum>(3)</enum><header>Transfer of records</header><subparagraph commented="no" id="id13F393C02C99464E8AA265BC90EB470E"><enum>(A)</enum><header>In general</header><text>Upon termination, the Review Board shall transfer all of its records to the Archivist for inclusion in the Collection.</text></subparagraph><subparagraph commented="no" id="idB17A7C60440E4610A946EA596787CE1C"><enum>(B)</enum><header>Preservation of records</header><text>The records of the Review Board shall not be destroyed, except that the Archivist may destroy routine administrative records covered by a general records schedule following notification in the Federal Register and after considering comments.</text></subparagraph></paragraph></subsection></section><section id="H86B38A6786594D8BB2F09684FB09778A"><enum>7.</enum><header>Review Board personnel</header><subsection id="H8F34CA4D185B45C5A1B29A71F2134172"><enum>(a)</enum><header>Chief of staff</header><paragraph id="HB85C65D8D4BD4E52B62CEF8F15492904"><enum>(1)</enum><header>Appointment</header><text>Not later than 45 days after the initial meeting of the Review Board, and without regard to political affiliation, the Review Board shall appoint an individual to the position of Chief of Staff of the Review Board.</text></paragraph><paragraph id="H51CF8EA01F5C434B85299670013B46B7"><enum>(2)</enum><header>Requirements</header><text>The individual appointed as Chief of Staff—</text><subparagraph id="H65B8B6DCCA7546288596BF7CA1367CAA"><enum>(A)</enum><text>shall be a citizen of the United States of integrity and impartiality who is a distinguished professional; and</text></subparagraph><subparagraph id="HB69DDDC88706489083AFB1D76EEDF139"><enum>(B)</enum><text>shall have had no previous involvement with any official investigation or inquiry relating to civil rights cold cases.</text></subparagraph></paragraph><paragraph id="HEDAFBD860DA648739CEDDF66A19B6111"><enum>(3)</enum><header>Candidate to have clearances</header><text>A candidate for Chief of Staff shall be granted the necessary security clearances in an accelerated manner subject to the standard procedures for granting such clearances.</text></paragraph><paragraph id="H895CAFFE56F6428595F0B08CA54C7984"><enum>(4)</enum><header>Approval contingent on prior clearance</header><text>A candidate shall qualify for the necessary security clearance prior to being appointed by the Review Board.</text></paragraph><paragraph id="H69C88783DF1A45649B588471775F4A0A"><enum>(5)</enum><header>Duties</header><text>The Chief of Staff shall—</text><subparagraph id="HB1F3AB34998841CA81527533FF0BAB09"><enum>(A)</enum><text>serve as principal liaison to Government offices;</text></subparagraph><subparagraph id="HFBFF50B2771A429CAAF9DCDBC24B8A44"><enum>(B)</enum><text>be responsible for the administration and coordination of the Review Board’s review of records;</text></subparagraph><subparagraph id="H927BF2B19B8241B88779701A72A5B2EB"><enum>(C)</enum><text>be responsible for the administration of all official activities conducted by the Review Board; and</text></subparagraph><subparagraph id="HF8ABD5333AD5419D8E99DB9778418589"><enum>(D)</enum><text>have no authority to decide or determine whether any record shall be disclosed to the public or postponed for disclosure.</text></subparagraph></paragraph><paragraph id="HA6B7E0ECE6FC41E0B8D968739851D5BC"><enum>(6)</enum><header>Removal</header><text>The Chief of Staff shall not be removed except upon a majority vote of the Review Board to remove the Chief of Staff for cause on the grounds of inefficiency, neglect of duty, malfeasance in office, physical disability, mental incapacity, or any other condition that substantially impairs the performance of the responsibilities of the Chief of Staff or the employees of the Review Board.</text></paragraph></subsection><subsection id="H8A3082635E4B4D709131DD9635E8BF1F"><enum>(b)</enum><header>Staff</header><paragraph id="H9F977704181946AA808773A48906343B"><enum>(1)</enum><header>Additional personnel</header><text>The Review Board may, in accordance with the civil service laws but without regard to civil service laws and regulations for appointments in the competitive service under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code, appoint and terminate additional employees as are necessary to enable the Review Board and its Chief of Staff to perform its duties.</text></paragraph><paragraph id="HEC07395F8EF342398A2C9F9920188368"><enum>(2)</enum><header>Requirements</header><text>An individual appointed as an employee of the Review Board—</text><subparagraph id="HE91A7549E50E40D5805F24512F97E6C1"><enum>(A)</enum><text>shall be a private citizen of integrity and impartiality; and</text></subparagraph><subparagraph id="H0E62CC17A9EF4A72A86C1AC9F23DB311"><enum>(B)</enum><text>shall have had no previous involvement with any official investigation or inquiry relating to the civil rights cold cases.</text></subparagraph></paragraph><paragraph id="H32B75ECDC5B247C8AC8D0FBC5CA006B6"><enum>(3)</enum><header>Nominations</header><text>Before making an appointment pursuant to paragraph (1), the Review Board shall consider individuals recommended by the American Historical Association, the Organization of American Historians, the Society of American Archivists, and the American Bar Association.</text></paragraph><paragraph id="H91A5783089C9463D9971E6377DE7AC64"><enum>(4)</enum><header>Security Clearances</header><text>A candidate shall qualify for the necessary security clearance prior to being appointed by the Review Board.</text></paragraph></subsection><subsection id="H034053ABEB3A4F2BB5E8BD2543629273"><enum>(c)</enum><header>Compensation</header><text>The Review Board shall fix the compensation of the Chief of Staff and other employees in accordance with title 5, United States Code, except that the rate of pay for the Chief of Staff and other employees may not exceed the rate payable for level V of the Executive Schedule under section 5316 of that title.</text></subsection><subsection id="H5C1303A686D542E1B5A3B99C7095CCC1"><enum>(d)</enum><header>Advisory committees</header><text>The Review Board may create advisory committees to assist in fulfilling the responsibilities of the Review Board under this Act.</text></subsection></section><section id="H5C2600BFC92F489D8B88D3ABD188338F"><enum>8.</enum><header>Review of records by the Review Board</header><subsection id="H1F10B633D0F6416084115350A91B7ADB"><enum>(a)</enum><header>Custody of records reviewed by the board</header><text>Pending the outcome of the Review Board’s review activity, a Government office shall retain custody of a civil rights cold case records for purposes of preservation, security, and efficiency, unless—</text><paragraph id="H793E9C0E1D1E4E128F25B9D8EB951236"><enum>(1)</enum><text>the Review Board requires the physical transfer of records for reasons of conducting an independent and impartial review; or</text></paragraph><paragraph id="H6F3A71D5902741C29B188CAFEFD33FB6"><enum>(2)</enum><text>such transfer is necessary for an administrative hearing or other official Review Board function.</text></paragraph></subsection><subsection id="H4EFEB1D045104F718F0DCBD5DE997A7F"><enum>(b)</enum><header>Startup requirements</header><text>The Review Board shall—</text><paragraph id="H40F198231CA14A59A0C73CA80D7A6065"><enum>(1)</enum><text>not later than 90 days after the date on which all members of the Review Board are appointed, publish a schedule for review of all civil rights cold case records in the Federal Register; and</text></paragraph><paragraph id="HC86017CF7DE9474C8040DB5F78565613"><enum>(2)</enum><text>not later than 180 days after the enactment of this Act, begin its review of civil rights cold case records under this Act.</text></paragraph></subsection><subsection id="HD2A689337C3C48399577E816434A8BB5"><enum>(c)</enum><header>Determination of the review board</header><paragraph id="H747B50983DD5465B8D7F5D4CE0AEBFC1"><enum>(1)</enum><header>In general</header><text>The Review Board shall direct that copies of all civil rights cold case records be transmitted to the Archivist and disclosed to the public in the Collection in the absence of clear and convincing evidence that—</text><subparagraph id="HE8200D200FE84CE5B5F96722C185C5DB"><enum>(A)</enum><text>a Government record is not a civil rights cold case record; or</text></subparagraph><subparagraph id="H78877DBC75694F4781DD0244C8EB6771"><enum>(B)</enum><text>a Government record or particular information within a civil rights cold case record qualifies for postponement of public disclosure under this Act.</text></subparagraph></paragraph><paragraph id="H6DDA53D9872C42ECB0F1E8059DA29F0A"><enum>(2)</enum><header>Postponement</header><text>In approving postponement of public disclosure of a civil rights cold case record, the Review Board shall work to—</text><subparagraph id="H58947F6F0FA545BF982A00F3E75334D0"><enum>(A)</enum><text>provide for the disclosure of segregable parts, substitutes, or summaries of such a record; and</text></subparagraph><subparagraph id="H70A383C1C5394167ABFF5A1D351DC071"><enum>(B)</enum><text>determine, in consultation with the originating body and consistent with the standards for postponement under this Act, which of the following alternative forms of disclosure shall be made by the originating body:</text><clause id="HAC88F0DCE46945C09B4BE519FAE17C0E"><enum>(i)</enum><text>Any reasonably segregable particular information in a civil rights cold case record.</text></clause><clause id="H4FFFE314D3AC4F5D8D19400B66D4748F"><enum>(ii)</enum><text>A substitute record for that information which is postponed.</text></clause><clause id="HE4C927E7EBFE4C209E5CF4587D34881E"><enum>(iii)</enum><text>A summary of a civil rights cold case record.</text></clause></subparagraph></paragraph><paragraph id="H77F684D7E9524FCAAE6906EC301ADD0B"><enum>(3)</enum><header>Report</header><text>With respect to each civil rights cold case record or particular information in civil rights cold case records the public disclosure of which is postponed under section 5, or for which only substitutions or summaries have been disclosed to the public, the Review Board shall create and transmit to the Archivist a report containing—</text><subparagraph id="HD09B8921A004480F83F21D927323BF8B"><enum>(A)</enum><text>a description of actions by the Review Board, the originating body, the President, or any Government office (including a justification of any such action to postpone disclosure of any record or part of any record) and of any official proceedings conducted by the Review Board with regard to specific civil rights cold case records; and</text></subparagraph><subparagraph id="HA9506C42AF1F4059B41FE98D8BA3F367"><enum>(B)</enum><text>a statement, based on a review of the proceedings and in conformity with the decisions reflected therein, designating a recommended specified time at which or a specified occurrence following which the material may be appropriately disclosed to the public under this Act.</text></subparagraph></paragraph><paragraph id="H587A8FEA1FA74DCBBC9B7D009133752A"><enum>(4)</enum><header>Notice</header><text>Not later than 14 days after the Review Board makes a determination that a civil rights cold case record shall be publicly disclosed in the Collection or postponed for disclosure and held in the protected Collection, the Review Board shall notify the head of the originating body of its determination and publish a copy of the determination in the Federal Register.</text></paragraph><paragraph id="H100DAD6343C7400E9A615C166FF43635"><enum>(5)</enum><header>Other notice</header><text>Contemporaneous notice shall be made to the President of Review Board determinations regarding executive branch civil rights cold case records, and to the oversight committees designated in this Act in the case of legislative branch records. Such notice shall contain a written unclassified justification for public disclosure or postponement of disclosure, including an explanation of the application of any standards under section 5.</text></paragraph></subsection><subsection id="HD8E4B23EF20749A087E569AA3CCE59D3"><enum>(d)</enum><header>Presidential authority over review board determination</header><paragraph id="H2852F4FE010C466483568C17959EFD74"><enum>(1)</enum><header>Public disclosure or postponement of disclosure</header><text>After the Review Board has made a formal determination concerning the public disclosure or postponement of disclosure of an executive branch civil rights cold case record or information contained in a civil rights cold case record, obtained or developed solely within the executive branch, the President shall have the sole and nondelegable authority to require the disclosure or postponement of such record or information under the standards set forth in section 5, and the President shall provide the Review Board with an unclassified written certification specifying the President’s decision within 30 days after the Review Board’s determination and notice to the executive agency as required under this Act, stating the justification for the President’s decision, including the applicable grounds for postponement under section 5.</text></paragraph><paragraph id="H8F409DAEFF5749838E263C73D91DEFEA"><enum>(2)</enum><header>Periodic review</header><text>Any executive branch civil rights cold case record for which public disclosure is postponed by the President shall be subject to the requirements of periodic review and declassification of classified information and public disclosure in the Collection set forth in section 4.</text></paragraph><paragraph id="H575191149152484CA3CE9377883D1C93"><enum>(3)</enum><header>Record of presidential postponement</header><text>The Review Board shall, upon its receipt, publish in the Federal Register a copy of any unclassified written certification, statement, and other materials transmitted by or on behalf of the President with regard to postponement of the public disclosure of civil rights cold case records.</text></paragraph></subsection><subsection id="H5F324342290A45499F5C388A5F7C634E"><enum>(e)</enum><header>Notice to the public</header><text>On each day that is on or after the date that is 60 days after the Review Board first approves the postponement of disclosure of a civil rights cold case record, the Review Board shall publish on a publicly available website a notice that summarizes the postponements approved by the Review Board or initiated by the President, including a description of the subject, originating agency, length or other physical description, and each ground for postponement that is relied upon.</text></subsection><subsection id="HC81ACCF608A34CC7939C7C4A9E2E7A0B"><enum>(f)</enum><header>Reports by the review board</header><paragraph id="H78EF81077B044159A9B0971C53CCD2D0"><enum>(1)</enum><header>In general</header><text>The Review Board shall report its activities to the Speaker of the House of Representatives, the Minority Leader of the House of Representatives, the Committee on Oversight and Government Reform of the House of Representatives, the Majority Leader of the Senate, the Minority Leader of the Senate, the Committee on Homeland Security and Governmental Affairs of the Senate, the President, the Archivist, and the head of any Government office whose records have been the subject of Review Board activity.</text></paragraph><paragraph id="H9A46A11C2ECC4001A47EB5C5F7710ED0"><enum>(2)</enum><header>Deadlines</header><text>Not later than 1 year after the date of enactment of this Act, and every year thereafter until termination of the Review Board, the Review Board shall issue a report under paragraph (1).</text></paragraph><paragraph id="H4DAAFE24263B445689EE2A36DC41A145"><enum>(3)</enum><header>Contents</header><text>Each report under paragraph (1) shall include the following information:</text><subparagraph id="H280EC40F1B424555A7139DFD1F924CA5"><enum>(A)</enum><text>A financial report of the expenses for all official activities and requirements of the Review Board and its employees.</text></subparagraph><subparagraph id="H2F754587A93E4BC1AB02F5244BC17E6F"><enum>(B)</enum><text>The progress made on review, transmission to the Archivist, and public disclosure of civil rights cold case records.</text></subparagraph><subparagraph id="H4724599C1528448699B169F33781339D"><enum>(C)</enum><text>The estimated time and volume of civil rights cold case records involved in the completion of the Review Board’s performance under this Act.</text></subparagraph><subparagraph id="H7829D0C947B84B8F9680BA56BACE787C"><enum>(D)</enum><text>Any special problems, including requests and the level of cooperation of Government offices, with regard to the ability of the Review Board to operate as required by this Act.</text></subparagraph><subparagraph id="H2AFDCC642965444B952ED0F0E46A63B2"><enum>(E)</enum><text>A record of review activities, including a record of postponement decisions by the Review Board or other related actions authorized by this Act, and a record of the volume of records reviewed and postponed.</text></subparagraph><subparagraph id="H9F7E050F1EAE4103B46448F57AA2B561"><enum>(F)</enum><text>Recommendations and requests to Congress for additional authorization.</text></subparagraph><subparagraph id="H0191DA3682474DF983D0BA257F52CB0F"><enum>(G)</enum><text>An appendix containing copies of reports of postponed records to the Archivist required under section subsection (c)(3) made since the date of the preceding report under this subsection.</text></subparagraph></paragraph><paragraph id="HC7A3B97F833A4ECB9A30008B8098FC38"><enum>(4)</enum><header>Notice of termination</header><text>Not later than 90 days before terminating, the Review Board shall provide written notice to the President and the Congress of its intention to terminate its operations at a specified date.</text></paragraph></subsection></section><section id="H55AAD358D1D24789A37687A917067FDC"><enum>9.</enum><header>Disclosure of other information and additional study</header><subsection id="H290E185365FD47A590F2A5049C8E8752"><enum>(a)</enum><header>Materials under the seal of the court</header><paragraph id="H2492F72C1CE441F6BD783381DB6A5D5A"><enum>(1)</enum><header>In general</header><text>The Review Board may request the Attorney General to petition any court in the United States or abroad to release any information relevant to civil rights cold cases that is held under seal of court.</text></paragraph><paragraph id="H6C14E08BAEB549449F2A6C5F1C1BF16A"><enum>(2)</enum><header>Grand jury materials</header><subparagraph id="idC2BEAAE215CC449BBB43BD7FBDD1DD2C"><enum>(A)</enum><header>In general</header><text>The Review Board may request the Attorney General to petition any court in the United States to release any information relevant to civil rights cold cases that is held under the injunction of secrecy of a grand jury.</text></subparagraph><subparagraph id="H66D319E11A0F4FA1AEA03F283D6F79FB"><enum>(B)</enum><header>Particularized need</header><text>A request for disclosure of civil rights cold case records under this Act shall be deemed to constitute a showing of particularized need under rule 6 of the Federal Rules of Criminal Procedure.</text></subparagraph></paragraph><paragraph id="HAB22C1D9CEEA48CC9E058A50B877FE94"><enum>(3)</enum><header>Deadline</header><text>The Attorney General shall comply with any request that is subject to this subsection within 45 days.</text></paragraph></subsection><subsection id="HB0F7331D0F0346DD9BEAFD479A3E84F5"><enum>(b)</enum><header>Cooperation with agencies</header><text>It is the sense of Congress that—</text><paragraph id="H06B565E48C154BD09E3AF40FC50E66D6"><enum>(1)</enum><text>the Attorney General should assist the Review Board in good faith to unseal any records that the Review Board determines to be relevant and held under the seal by a court or under the injunction of secrecy of a grand jury; and</text></paragraph><paragraph id="H03CDF003D4494DD18DD3A42E54B6A987"><enum>(2)</enum><text>all departments and agencies of the United States Government should cooperate in full with the Review Board to seek the disclosure of all information relevant to civil rights cold cases consistent with the public interest.</text></paragraph></subsection></section><section id="HB30D1BF657754964AD2735E16036B00C"><enum>10.</enum><header>Rules of construction</header><subsection id="H88E5B1FC6A6E4028A6A23C86BF4EDADC"><enum>(a)</enum><header>Precedence over other law</header><text>When this Act requires transmission of a record to the Archivist or public disclosure, it shall take precedence over any other law (except <external-xref legal-doc="usc" parsable-cite="usc/26/6103">section 6103</external-xref> of the Internal Revenue Code of 1986), judicial decisions construing such law, or common law doctrine that would otherwise prohibit such transmission or disclosure with the exception of deeds governing access to or transfer or release of gifts and donations of records to the United States Government.</text></subsection><subsection id="HCB5B6BF5543543B0AAA296408CD4E856"><enum>(b)</enum><header>Freedom of Information Act</header><text>Nothing in this Act shall be construed to eliminate or limit any right to file any requests with any executive agency or seek judicial review of the decisions under section 552 of title 5, United States Code.</text></subsection><subsection id="HF7727FA1A4AB4CDB936307A94EB391C0"><enum>(c)</enum><header>Judicial review</header><text>Nothing in this Act shall be construed to preclude judicial review, under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5, United States Code, of final actions taken or required to be taken under this Act.</text></subsection><subsection id="HF666404F9864441BABE23191FD466BF9"><enum>(d)</enum><header>Existing authority</header><text>Nothing in this Act revokes or limits the existing authority of the President, any executive agency, the Senate, the House of Representatives, or any other entity of the Government to publicly disclose records in its possession.</text></subsection></section><section id="HBDAA8607061040ED87C92F8B57B2D85E"><enum>11.</enum><header>Authorization of appropriations</header><subsection id="H08A6B258827745EC9FE6A2F340B309B3"><enum>(a)</enum><header>In general</header><text>There are authorized to be appropriated such sums as are necessary to carry out this Act, to remain available until expended.</text></subsection><subsection id="H6D0BADD2BE2140EA89092D91C1503324"><enum>(b)</enum><header>Interim provisions</header><text>Until such time as funds are appropriated pursuant to subsection (a), the President shall use such sums as are available for discretionary use to carry out this Act.</text></subsection></section></legis-body></bill>
