 <section changed="deleted" committee-id="SSJU00" id="idE366250C11FA42C7AA5108D5C7537701" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Young Victims from Sexual Abuse Act of 2017</short-title></quote>.</text> </section><section changed="deleted" committee-id="SSJU00" id="idEA3F7571C09F44DB849F01EC48B54A1E" reported-display-style="strikethrough" section-type="subsequent-section"><enum>2.</enum><header>Required reporting of child and sexual abuse at facilities under the jurisdiction of amateur sports organizations recognized by the United States Olympic Committee</header> <subsection id="idA854FF2D92BA43559B7CD5CB187C7ED0"><enum>(a)</enum><header>Reporting requirement</header><text>Section 226 of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13031">42 U.S.C. 13031</external-xref>) is amended—</text>
 <paragraph id="id08F84C758E64429A9333E943DAC43136"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="id5A4DFF7C81544B2BA43FDF9BFC12EB9F"><enum>(A)</enum><text>by striking <quote>A person who</quote> and inserting the following:</text>

 <paragraph id="id88DDE492D06848EA8B9E2628F59B82CA"><enum>(2)</enum><header>Individuals at covered facilities</header><text>A covered individual who, while engaged in any activity sanctioned by a covered facility, learns of facts that give reason to suspect that a child has suffered an incident of child abuse, including sexual abuse, shall as soon as possible make a report of the suspected abuse to the agency designated by the Attorney General under subsection (d).</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="idC00A4A95F58D4E47BB89B562E5FDA19B"><enum>(2)</enum><text>in subsection (b), in the matter preceding paragraph (1), by striking <quote>subsection (a)</quote> and inserting <quote>subsection (a)(1)</quote>;</text> </paragraph><paragraph id="idF34EB26B44ED400BA7DD72C47E9CA299"><enum>(3)</enum><text>in subsection (c)—</text>
 <subparagraph id="idE5BD736722E7405B8E71DBAB7892FF8E"><enum>(A)</enum><text>in paragraph (7), by striking <quote>and</quote> at the end;</text> </subparagraph><subparagraph id="id76A2578345D2431CBEBD1E0D8EEDE61E"><enum>(B)</enum><text>in paragraph (8), by striking the period at the end and inserting a semicolon; and</text>

 </paragraph><paragraph id="idCCE48F69AF894C78800170BF20566666"><enum>(10)</enum><text>the term <term>covered individual</term> means an adult who is authorized by a covered facility or by a national governing body to interact with a minor or amateur athlete at the covered facility or at any event sanctioned by the covered facility; and</text>
 </paragraph><paragraph id="idE99242A0327C41FB9C54463724DF8A77"><enum>(11)</enum><text>the term <term>national governing body</term> has the meaning given the term in section 220501(b) of title 36, United States Code.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph id="iddacaf6474e7545a399f2c6845f5389f0"><enum>(4)</enum><text>in subsection (d), in the first sentence, by inserting <quote>and for all covered facilities</quote> after <quote>reside</quote>;</text>
 </paragraph><paragraph id="id4A5B24F1E2674E498CD38BD70D2F2B66"><enum>(5)</enum><text>in subsection (f), in the first sentence—</text> <subparagraph id="id198A33C7B45647D9B71A1453B6136735"><enum>(A)</enum><text>by striking <quote>and on all</quote> and inserting <quote>on all</quote>; and</text>
 </subparagraph><subparagraph id="id1A986F0CE3E046BB8A4BA57EFFD09A98"><enum>(B)</enum><text>by inserting <quote>and for all covered facilities,</quote> after <quote>lands,</quote>; and</text> </subparagraph></paragraph><paragraph id="idC500233764144361A2CA3CEC327F535F"><enum>(6)</enum><text>in subsection (h), by inserting <quote>and all covered individuals,</quote> after <quote>facilities,</quote>.</text>
 </paragraph></subsection><subsection id="idDDA94C3B3DB146859D0DDEA62A449CE2"><enum>(b)</enum><header>Penalty for failure To report</header><text>Section 2258 of title 18, United States Code, is amended—</text> <paragraph id="id2D08197040A548CE8F4800C1557C7826"><enum>(1)</enum><text>by inserting <quote>or while engaged in a professional capacity or activity at a covered facility as described in subsection (a)(2) of such section 226</quote> after <quote>facility</quote>; and</text>
 </paragraph><paragraph id="idBD564F3C917842D6845BD8B7676DFBC0"><enum>(2)</enum><text>by striking <quote>not more than 1 year</quote> and inserting <quote>not more than 3 years</quote>.</text> </paragraph></subsection></section><section changed="deleted" committee-id="SSJU00" id="id09EE90A97A644DC5AB64DCB6A9878E53" reported-display-style="strikethrough" section-type="subsequent-section"><enum>3.</enum><header>Civil remedy for personal injuries</header><text display-inline="no-display-inline">Section 2255 of title 18, United States Code, is amended—</text>
 <paragraph id="idA515C2C1798E4A0DAE27F5A5AC9D6F8C"><enum>(1)</enum><text>by striking subsection (a) and inserting the following:</text> <quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="idB560A1B607CB423E996C03D9EBC147E2" reported-display-style="strikethrough" style="OLC"> <subsection id="idCFAB3B55943742ACB2F77DAED9F75F2C"><enum>(a)</enum><header>In general</header><text>Any person who, while a minor, was a victim of a violation of section 1589, 1590, 1591, 2241(c), 2242, 2243, 2251, 2251A, 2252, 2252A, 2260, 2421, 2422, or 2423 of this title and who suffers personal injury as a result of such violation, regardless of whether the injury occurred while such person was a minor, may sue in any appropriate United States District Court and shall recover the actual damages such person sustains or liquidated damages in the amount of $150,000, and the cost of the action, including reasonable attorney’s fees and other litigation costs reasonably incurred. The court may also award punitive damages and such other preliminary and equitable relief as the court determines to be appropriate.</text></subsection><after-quoted-block>; </after-quoted-block></quoted-block>
 </paragraph><paragraph id="id1603C3D848A2422E98710B5AE7BC33D3"><enum>(2)</enum><text>in subsection (b), by striking <quote>filed within</quote> and all that follows through the end and inserting the following:</text> <quoted-block changed="deleted" committee-id="SSJU00" display-inline="yes-display-inline" id="idC19A17660060453B8295FF52C3FBD2E2" reported-display-style="strikethrough" style="OLC"> <text>filed—</text><paragraph id="idd26a055e1c374a5d8ec8cd2e24efa3be"><enum>(1)</enum><text>not later than 10 years after the date on which the plaintiff discovers the later of—</text> <subparagraph id="id252f011cdee24d03be43dbf2de355f93"><enum>(A)</enum><text>the violation that forms the basis for the claim; or</text>
 </subparagraph><subparagraph id="id4789aeb5b7404707b08daf83db8fd092"><enum>(B)</enum><text>the injury that forms the basis for the claim; or</text> </subparagraph></paragraph><paragraph id="id1407bdf6d9a544959cd9a6a2ce5ab056"><enum>(2)</enum><text>in the case of a person under a legal disability, not later than 10 years after the date on which the disability ends.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id67a3ea6686fa4e9dbb9159c12019c43e"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="id71bb85e33eb748aa91473e54a3189fde" reported-display-style="strikethrough" style="OLC"> <subsection id="id5ca5a3a239a947a09e86658faf540afa"><enum>(c)</enum><header>Venue; Service of process</header> <paragraph id="id5EBA619EEDA742B2994702B656262A45"><enum>(1)</enum><header>Venue</header><text>Any action brought under subsection (a) may be brought in the district court of the United States that meets applicable requirements relating to venue under section 1391 of title 28.</text>
 </paragraph><paragraph id="idE2DDE4BD78A14AA0B64A443F8428CC5F"><enum>(2)</enum><header>Service of process</header><text>In an action brought under subsection (a), process may be served in any district in which the defendant—</text>
 <subparagraph id="id60378507FABA4569A671AF9DD8448261"><enum>(A)</enum><text>is an inhabitant; or</text> </subparagraph><subparagraph id="id506825A73AF346ABB1DBA6712BAE1339"><enum>(B)</enum><text>may be found.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section changed="deleted" committee-id="SSJU00" id="idC1A3F946BDFB4D85A642CE08B6F8E2FA" reported-display-style="strikethrough" section-type="subsequent-section"><enum>4.</enum><header>Expansion of authorities and duties of amateur sports organizations recognized by the United States
			 Olympic Committee to prevent the abuse of minor and amateur athletes</header>
 <subsection id="idD0F50C7332CE4315B3E2EEA664613CF8"><enum>(a)</enum><header>Expansion of authorities</header><text display-inline="yes-display-inline">Section 220523(a) of title 36, United States Code, is amended—</text> <paragraph id="id7551C9DCF6EA464F9698F8F57397E14C"><enum>(1)</enum><text>in paragraph (6), by striking <quote>; and</quote> and inserting a semicolon;</text>
 </paragraph><paragraph id="id392C6DDEDA4143DBA198BDB07220FB2A"><enum>(2)</enum><text>in paragraph (7), by striking the period and inserting <quote>; and</quote>; and</text> </paragraph><paragraph id="idA5C1EEBE3E514A398231B09AD574EB04"><enum>(3)</enum><text>by adding at the end the following:</text>
					<quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="id83E748150BE042E989535913972A886A" reported-display-style="strikethrough" style="OLC">
 <paragraph id="id08352A883A6E4E7CB481E06A6C5A3EF4"><enum>(8)</enum><text>develop training, oversight practices, policies, and procedures to prevent the abuse, including physical abuse and sexual abuse, of any minor or amateur athlete by any adult.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id0F3EDEC6EDDD4EB5B267EB31332C92F2"><enum>(b)</enum><header>Additional duties</header><text>Section 220524 of such title is amended—</text> <paragraph id="id17EB702B53674FA6AB7FFA6E4DDC529D"><enum>(1)</enum><text>in paragraph (8), by striking <quote>; and</quote> and inserting a semicolon;</text>
 </paragraph><paragraph id="idF48DC2B0A20B48B2B2952CCCEF9D8C07"><enum>(2)</enum><text>in paragraph (9), by striking the period and inserting a semicolon; and</text> </paragraph><paragraph id="idFF4AC5FE2BAD46019FDE8F3360A8FE7D"><enum>(3)</enum><text>by adding at the end the following:</text>
					<quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="idEEFA67C907F14771AA8B86B93ACF2E7F" reported-display-style="strikethrough" style="OLC">
 <paragraph id="id1431b283cd654607b725848b9637726c"><enum>(10)</enum><text>develop and enforce policies, mechanisms, and procedures to prevent the abuse, including physical abuse and sexual abuse, of any minor or amateur athlete, including—</text>
 <subparagraph id="id1495a9c9c6044c8bb07143a6c82fdf08"><enum>(A)</enum><text>requiring all members of the national governing body or a facility under the jurisdiction of the national governing body and adults authorized by such members to interact with minor or amateur athletes, to immediately report all allegations of sexual abuse to law enforcement authorities and other appropriate authorities whenever such members or adults learn of facts leading them to reasonably suspect that a minor or amateur athlete has suffered an incident of sexual abuse;</text>
 </subparagraph><subparagraph id="id9dbf7f8f75234d81b387f5c9d8f7661c"><enum>(B)</enum><text>establishing a mechanism, approved by a trained expert on child abuse, that allows a complainant to easily report an incident of sexual abuse committed by a member or adult described in subparagraph (A) to interact with a minor or amateur athlete, to the national governing body or another authority;</text>
 </subparagraph><subparagraph id="id12887cad4ddc44fa9db2813beb5d9756"><enum>(C)</enum><text>procedures to ensure that each amateur athlete who is a minor is prevented from being in a one-on-one situation with an adult (who is not the minor's legal guardian) at a facility under the jurisdiction of the national governing body without being in an observable and interruptible distance from another adult; and</text>
 </subparagraph><subparagraph id="id0eee2182cae844e28cb3ea4f34f28de0"><enum>(D)</enum><text>oversight procedures, including regular and random audits conducted by subject matter experts unaffiliated with the national governing body, of all members and adults described in subparagraph (A) to ensure that policies and procedures developed under this paragraph are followed correctly and that consistent training is offered and given to all members regarding prevention of sexual abuse; and</text>
 </subparagraph></paragraph><paragraph id="idF43CB2A2D1224644B871AFD4AFDF1C47"><enum>(11)</enum><text>in the case of a national governing body with jurisdiction over more than one athletic facility, establish a mechanism by which—</text>
 <subparagraph id="idFC05BC3FF86F42E982632E94AAE87D2D"><enum>(A)</enum><text>the national governing body can—</text> <clause id="idDB1ECFEC578B42678ED4906EFE5C2BBA"><enum>(i)</enum><text>receive a report from one of such facilities regarding a case in which an adult authorized by the facility to interact with a minor or amateur athlete at such facility is expelled from or leaves such facility for sexual misconduct, including because of a mere allegation of sexual misconduct; and</text>
 </clause><clause id="id2707CB19A0EC4430A7B80F7FE63FFD93"><enum>(ii)</enum><text>share a report received under subparagraph (A) with each of the other athletic facilities under the jurisdiction of the national governing body; and</text>
 </clause></subparagraph><subparagraph id="id672C3938051A402C99469281AA7EBEEA"><enum>(B)</enum><text>an athletic facility under the jurisdiction of the national governing body can—</text> <clause id="id4BC265F232164980B3004F75B00FF728"><enum>(i)</enum><text>review the reports received by the national governing body under subparagraph (A)(i) to assess any allegations of sexual misconduct made in such reports; and</text>
 </clause><clause id="id246D241F275B4380BF2AF0489E38D69C"><enum>(ii)</enum><text>withhold providing to an adult who is the subject of an allegation of sexual misconduct in a report reviewed under clause (i) authority to interact with a minor or amateur athlete at such facility until such time as the facility determines that there is no risk to a minor or amateur athlete at such facility.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id4A5FF7F65ADA42C19AE9B17E4671F23E"><enum>(c)</enum><header>Rule of construction</header><text>Section 220522 of such title is amended by adding at the end the following:</text> <quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="id12CFD22633CB4F5791D8A889CB96FFF3" reported-display-style="strikethrough" style="OLC"> <subsection id="ida1819c7bc9bc4619a3f712d9e6ec86ad"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in paragraph (a) shall be construed to limit the ability of a national governing body to develop a policy or procedure to prevent an individual who is the subject of an allegation of sexual misconduct from interacting with a minor or amateur athlete until such time as the national governing body, or any person under the jurisdiction of the national governing body, determines that there is no risk to the minor or amateur athlete by allowing the individual to interact with the minor or amateur athlete.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body>

 <paragraph id="ide65cf1d1-0dc5-4e0d-a4a2-8621fe7f7ff9"><enum>(2)</enum><header>Covered individuals</header><text>A covered individual who learns of facts that give reason to suspect that a child has suffered an incident of child abuse, including sexual abuse, shall as soon as possible make a report of the suspected abuse to the agency designated by the Attorney General under subsection (d).</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="id4a581e20-01bc-4e33-8efc-0b6575602423"><enum>(2)</enum><text>in subsection (b), in the matter preceding paragraph (1), by striking <quote>subsection (a)</quote> and inserting <quote>subsection (a)(1)</quote>;</text> </paragraph><paragraph id="id7f684a26-16af-4fca-b763-7771a50d2715"><enum>(3)</enum><text>in subsection (c)—</text>

 </subparagraph><subparagraph id="idfd56ad6c-6f32-41f5-9bf3-aa2d3fbae213"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id5797a123-6e3f-473f-ab64-50252b39297f" reported-display-style="italic" style="OLC"> <paragraph id="id5f9139e3-5f39-4aff-b7c9-a5644a006361"><enum>(9)</enum><text>the term <term>covered individual</term> means an adult who is authorized by a national governing body or a member of a national governing body to interact with a minor or amateur athlete at an amateur sports organization facility or at any event sanctioned by a national governing body or a member of a national governing body;</text>
 </paragraph><paragraph id="idCE11CB71E1CA43A8ABC051BD7B05AD82"><enum>(10)</enum><text>the term <term>event</term> includes travel, practice, competition, and health or medical treatment;</text> </paragraph><paragraph id="ida39a7ddc-1503-4c7c-bea4-55d1380a40fe"><enum>(11)</enum><text>the terms <term>amateur athlete</term>, <term>amateur sports organization</term>, and <term>national governing body</term> have the meanings given the terms in section 220501(b) of title 36, United States Code; and</text>
 </paragraph><paragraph id="id9715845E361B43F787885E354B2C7560"><enum>(12)</enum><text>the term <term>as soon as possible</term> means within a 24-hour period.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph id="id78e386d0-ca80-452f-980e-94abf2e707c3"><enum>(4)</enum><text>in subsection (d), in the first sentence, by inserting <quote>and for all covered individuals</quote> after <quote>reside</quote>;</text>
 </paragraph><paragraph id="id92ae034b-ffad-4d4d-8c1e-9ce50770a120"><enum>(5)</enum><text>in subsection (f), in the first sentence—</text> <subparagraph id="id9bb2b1fb-221d-496a-a373-cfdfa8aa955c"><enum>(A)</enum><text>by striking <quote>and on all</quote> and inserting <quote>on all</quote>; and</text>

 </paragraph><paragraph id="idA330742D973045E192D56D1DE3A8973A"><enum>(7)</enum><text>by adding at the end the following:</text> <quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id25CAFCF9B18344C99E7F539C90F61052" reported-display-style="italic" style="OLC"> <subsection id="idCF709C93DC8848C7B03E113C053270B0"><enum>(i)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to require a victim of child abuse to self-report the abuse.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="idA3204EE20D3C43E1B1EC4A5D2202B512"><enum>(b)</enum><header>Penalty for failure to report</header><text>Section 2258 of title 18, United States Code, is amended—</text> <paragraph id="id95918854-e513-4354-b7f4-6052db7f48ca"><enum>(1)</enum><text>by inserting <quote>or a covered individual as described in subsection (a)(2) of such section 226 who,</quote> after <quote>facility, </quote>; and</text>
 </paragraph><paragraph id="id523a0ce6-73e9-426f-9943-b65e0ef3b04c"><enum>(2)</enum><text>by striking <quote>not more than 1 year</quote> and inserting <quote>not more than 3 years</quote>.</text> </paragraph></subsection></section><section changed="added" committee-id="SSJU00" id="id2b53cdf2-f576-4508-9080-689d6e957932" reported-display-style="italic" section-type="subsequent-section"><enum>3.</enum><header>Civil remedy for personal injuries</header><text display-inline="no-display-inline">Section 2255 of title 18, United States Code, is amended—</text>
 <paragraph id="id4f162ba4-236d-49a8-8925-5aa387bdf33d"><enum>(1)</enum><text>by striking subsection (a) and inserting the following:</text> <quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id93a8c493-34b1-47f2-9d72-b45e21f45868" reported-display-style="italic" style="OLC"> <subsection id="id77f0372e-f4d8-4287-bc67-270671cba1b3"><enum>(a)</enum><header>In general</header><text>Any person who, while a minor, was a victim of a violation of section 1589, 1590, 1591, 2241(c), 2242, 2243, 2251, 2251A, 2252, 2252A, 2260, 2421, 2422, or 2423 of this title and who suffers personal injury as a result of such violation, regardless of whether the injury occurred while such person was a minor, may sue in any appropriate United States District Court and shall recover the actual damages such person sustains or liquidated damages in the amount of $150,000, and the cost of the action, including reasonable attorney’s fees and other litigation costs reasonably incurred. The court may also award punitive damages and such other preliminary and equitable relief as the court determines to be appropriate.</text></subsection><after-quoted-block>; </after-quoted-block></quoted-block>
 </paragraph><paragraph id="id89dec239-f932-43fe-a077-22537344cbeb"><enum>(2)</enum><text>in subsection (b), by striking <quote>filed within</quote> and all that follows through the end and inserting the following:</text> <quoted-block changed="added" committee-id="SSJU00" display-inline="yes-display-inline" id="idf44bacd8-282b-4ca5-8222-31af350f0855" reported-display-style="italic" style="OLC"> <text>filed—</text><paragraph id="idf9bb2a6b-66ae-40e3-b1a0-823497cccfc9"><enum>(1)</enum><text>not later than 10 years after the date on which the plaintiff discovers the later of—</text> <subparagraph id="idecc8e7ec-ebd7-4efb-9007-af1ff0c32ad5"><enum>(A)</enum><text>the violation that forms the basis for the claim; or</text>
 </subparagraph><subparagraph id="idd8d8dfbf-bd73-4089-9da5-1872a3522f82"><enum>(B)</enum><text>the injury that forms the basis for the claim; or</text> </subparagraph></paragraph><paragraph id="idb8140942-9b5a-4506-8499-9002b666dd8d"><enum>(2)</enum><text>not later than 10 years after the date on which a legal disability ends.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id16e78be0-917a-43c7-a67e-d2982815124f"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id14b471e2-a148-4a80-b8be-80dc537f658e" reported-display-style="italic" style="OLC"> <subsection id="id38d10e40-3b13-4293-846e-18945fc5fb63"><enum>(c)</enum><header>Venue; Service of process</header> <paragraph id="id77975ee4-cd57-42f8-b290-89eef4fba0b5"><enum>(1)</enum><header>Venue</header><text>Any action brought under subsection (a) may be brought in the district court of the United States that meets applicable requirements relating to venue under section 1391 of title 28.</text>
 </paragraph><paragraph id="id44dc2b93-0b72-49e6-8208-f34f62f2461b"><enum>(2)</enum><header>Service of process</header><text>In an action brought under subsection (a), process may be served in any district in which the defendant—</text>
 <subparagraph id="id9669c81f-b823-4341-8bf9-ac99b70118ed"><enum>(A)</enum><text>is an inhabitant; or</text> </subparagraph><subparagraph id="id53720cee-6795-41a0-8d5b-c5f5e72770b4"><enum>(B)</enum><text>may be found.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section changed="added" committee-id="SSJU00" id="id2d6c3d01-458e-433f-9208-682320786c70" reported-display-style="italic" section-type="subsequent-section"><enum>4.</enum><header>Expansion of authorities and duties of national governing bodies recognized by the United States
			 Olympic Committee to prevent the abuse of minor and amateur athletes</header>
 <subsection id="idb54081f1-615d-464c-a769-c99057a4f756"><enum>(a)</enum><header>Expansion of authorities</header><text display-inline="yes-display-inline">Section 220523(a) of title 36, United States Code, is amended—</text> <paragraph id="ida3fb1e92-a570-4c36-b1a5-87a6ef565fa1"><enum>(1)</enum><text>in paragraph (6), by striking <quote>; and</quote> and inserting a semicolon;</text>
 </paragraph><paragraph id="id82805143-6666-4db0-8b72-b64d31d3e32b"><enum>(2)</enum><text>in paragraph (7), by striking the period and inserting <quote>; and</quote>; and</text> </paragraph><paragraph id="id170a38ae-2e54-4a0c-be64-b13833487631"><enum>(3)</enum><text>by adding at the end the following:</text>
					<quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id549c11a8-8b99-4c6f-93de-242958b1826f" reported-display-style="italic" style="OLC">
 <paragraph id="id5f784762-b79e-48b4-9830-27ae612de767"><enum>(8)</enum><text>develop training, oversight practices, policies, and procedures to prevent the abuse, including physical abuse and sexual abuse, of any minor or amateur athlete by any adult.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="idb90bf886-c1dd-4be7-a74f-aafd1bc3b703"><enum>(b)</enum><header>Additional duties</header><text>Section 220524 of title 36, United States Code, is amended—</text> <paragraph id="id6E3CA31538FC47449F8F062F658A43F7"><enum>(1)</enum><text>by inserting <quote>(a) <header-in-text level="subsection" style="USC">In general</header-in-text>.—</quote> before <quote>For the sport</quote>;</text>
 </paragraph><paragraph id="id6ec96678-3de7-41ae-8eb5-63bc7eb164d6"><enum>(2)</enum><text>in paragraph (8), by striking <quote>; and</quote> and inserting a semicolon;</text> </paragraph><paragraph id="id91541fb1-a9dd-480e-9a82-194ec27843c1"><enum>(3)</enum><text>in paragraph (9), by striking the period and inserting a semicolon; and</text>
 </paragraph><paragraph id="id0e31f352-8dc7-4030-81af-ee12c6f4319b"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id0f61ab2a-f828-44af-941b-903f6d5dfc22" reported-display-style="italic" style="OLC"> <paragraph id="id8c9bc4aa-eef7-4979-9cca-db3175434725"><enum>(10)</enum><text>develop and enforce policies, mechanisms, and procedures to prevent the abuse, including physical abuse and sexual abuse, of any minor or amateur athlete, including—</text>
 <subparagraph id="idb64c6e9fdb1c4d929b2c80674442ded1"><enum>(A)</enum><text>requiring all adults authorized by a national governing body or a member of a national governing body to interact with a minor or amateur athlete at an amateur sports organization facility or at any event sanctioned by a national governing body or a member of a national governing body, to report facts that give reason to suspect child abuse, including sexual abuse, as required by relevant Federal or State law, to law enforcement authorities and other appropriate authorities, including an entity designated by the corporation to investigate and resolve such allegations;</text>
 </subparagraph><subparagraph id="ide8506d996755429db2c371c55cc250f5"><enum>(B)</enum><text>establishing a mechanism, approved by a trained expert on child abuse, that allows an individual to easily report an incident of child abuse as described in subparagraph (A) to the national governing body or another authority, including an entity designated by the corporation;</text>
 </subparagraph><subparagraph id="id6d56298f8fc34dbeb5426ba09c1dbea6"><enum>(C)</enum><text>procedures to ensure that each amateur athlete who is a minor is prevented from being in a one-on-one situation with an adult (who is not the minor’s legal guardian) at an amateur sports organization facility, at any event sanctioned by a national governing body, or any event sanctioned by a member of a national governing body, without being observable or interruptible by another adult; and</text>
 </subparagraph><subparagraph id="idca07086029f9478d961feaa9b925a65d"><enum>(D)</enum><text>oversight procedures, including regular and random audits, not to exceed once a year, conducted by subject matter experts unaffiliated with the national governing body, of all members and adults described in subparagraph (A) to ensure that policies and procedures developed under this paragraph are followed correctly and that consistent training is offered and given to all members regarding the prevention of child abuse; and</text>
 </subparagraph></paragraph><paragraph id="ida9e3ab6a9fb04a42939aeb3ad412924b"><enum>(11)</enum><text>in the case of a national governing body with jurisdiction over more than one amateur sports organization facility or event, establish a mechanism by which—</text>
 <subparagraph id="idb444bd72-44bf-47e6-a62c-cd0a6412bbe7"><enum>(A)</enum><text>the national governing body can—</text> <clause id="id275ad7b89d0c49d3a7b6d045caac6548"><enum>(i)</enum><text>receive a report of suspected sexual misconduct by an adult authorized by a national governing body or a member of a national governing body to interact with a minor or amateur athlete at an amateur sports organization facility or at any event sanctioned by a national governing body or a member of a national governing body; and</text>
 </clause><clause id="id604fa6a1d64b45ff9681b49506f4405d"><enum>(ii)</enum><text>confidentially share a report received under clause (i) with each of the other amateur sports organizations, facilities, or members under the jurisdiction of the national governing body; and</text>
 </clause></subparagraph><subparagraph id="idfcc0d47041ff439da52bfa1a22f5245b"><enum>(B)</enum><text>an amateur sports organization, facility, or member under the jurisdiction of the national governing body can—</text>
 <clause id="id77fc720b-b4f6-4aa3-919c-e70fc6b1a58d"><enum>(i)</enum><text>review the reports received by the national governing body under subparagraph (A)(i) to assess any allegations of sexual misconduct made in such reports; and</text>
 </clause><clause id="id886fb4f1-d96c-492d-aa7d-53bf8e8816fb"><enum>(ii)</enum><text>withhold providing to an adult who is the subject of an allegation of sexual misconduct in a report reviewed under clause (i) authority to interact with a minor or amateur athlete at such organization, facility, or event until the resolution of such allegation.</text>
								</clause></subparagraph></paragraph><subsection id="id8533E6D4E6FF43CF938A5C9F2DE2EC49"><enum>(b)</enum><header>Limited liability for the United States Olympic Committee, national governing bodies, and an entity
			 designated by the United States Olympic Committee to investigate and
			 resolve sexual misconduct allegations</header>
 <paragraph id="id617FBCB168F1453BAF2545F4766F7A5C"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraphs (2) and (3), no civil or criminal action may be brought in any Federal or State court against the United States Olympic Committee, a national governing body, or an amateur sports organization, facility, or event under the jurisdiction of a national governing body, or an entity designated by the United States Olympic Committee to investigate and resolve sexual misconduct allegations described in subsection (a)(11), including any director, officer, employee, or agent of such entity, if the action arises from the execution of the responsibilities or functions described in subsection (a)(11).</text>
 </paragraph><paragraph id="idA4F9D7A52FFF4525A858E76D325B6ECE"><enum>(2)</enum><header>Intentional, reckless, or other misconduct</header><text>Paragraph (1) shall not apply to a civil or criminal action if the United States Olympic Committee, a national governing body, an amateur sports organization, facility, or event under the jurisdiction of a national governing body, or an entity designated by the United States Olympic Committee to investigate and resolve sexual misconduct allegations described in subsection (a)(11), or a director, officer, employee, or agent of such entity—</text>
 <subparagraph id="id4A7426D07A234F938DC1AD505574D5F8"><enum>(A)</enum><text>engaged in intentional misconduct; or</text> </subparagraph><subparagraph id="idF63EF22FDB89484AA3C4F9769459EA5C"><enum>(B)</enum><text>acted or failed to act—</text>
 <clause id="idCF1FF9B6D96643F2B9F2FDE14E420612"><enum>(i)</enum><text>with actual malice;</text> </clause><clause id="idE527BC17916B4C84A1B636FFC4D35D4E"><enum>(ii)</enum><text>with reckless disregard for a risk of causing injury; or</text>
 </clause><clause id="id5d32332664e34318a01444361c363843"><enum>(iii)</enum><text>for a purpose unrelated to the performance of any responsibility or function described in subsection (a)(11).</text>
 </clause></subparagraph></paragraph><paragraph id="idDDBBD8E7BBE04BC8BAFC03BDAA2483F0"><enum>(3)</enum><header>Ordinary business activities</header><text>Paragraph (1) shall not apply to any act or omission relating to an ordinary business activity, including general administration or operations, the use of motor vehicles, or personnel management.</text>
 </paragraph><paragraph id="id2E5BA0504AA9452990C6CF40DD5F081B"><enum>(4)</enum><header>Limited effect</header><text>Nothing in this section shall apply to any act or omission arising out of any responsibility or function not described in subsection (a)(11).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id932f42a5-c14e-4766-bc39-7018f5c5f451"><enum>(c)</enum><header>Rule of construction</header><text>Section 220522 of title 36, United States Code, is amended by adding at the end the following:</text> <quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id371f5c85-36f9-4712-a53e-e920aa2d9cca" reported-display-style="italic" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="id0c130acc-9dcf-46fd-94a7-25facf8e11f9"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in subsection (a) shall be construed to limit the ability of a national governing body to develop a policy or procedure to prevent an individual who is the subject of an allegation of sexual misconduct from interacting with a minor or amateur athlete until such time as the national governing body or an entity with applicable jurisdiction resolves such allegation.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id791BBF07426E4938B3A9DF1DD749F578"><enum>(d)</enum><header>Review of recognition of amateur sports organizations as national governing bodies</header><text>Section 220521(d) of title 36, United States Code, is amended by striking <quote>may</quote> each place it appears and inserting <quote>shall</quote>.</text></subsection></section></legis-body><endorsement><action-date>June 8, 2017</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
