			 mental and behavioral health care to certain individuals discharged or
			 released from the active military, naval, or air service under conditions
			 other than honorable, and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" id="HC9D695256D434810AC44594A575A06BB" style="OLC">
 <section id="H225DD23D04FA4D6795049D28821F75C5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Honor Our Commitment Act of 2017</short-title></quote>.</text> </section><section id="H0B9A78030D1E4995BE30958EAF150830"><enum>2.</enum><header>Access to Department of Veterans Affairs mental and behavioral health care for certain individuals discharged or released from the active military, naval, or air service under conditions other than honorable</header> <subsection id="H682FD29D0DB94CD285250318D8CA8831"><enum>(a)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/1712C">section 1712C</external-xref> the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H874C0B53D8FC47A1A8B8D8288863705F" style="USC">
					<section id="HAE5986DB19B141D79257079918A40D3C"><enum>1712D.</enum><header>Mental and behavioral health care for certain individuals discharged or released from the active
			 military, naval, or air service under conditions other than honorable</header>
 <subsection id="H0DBA5A5DF9984F979F3515F33F9085E9"><enum>(a)</enum><header>In general</header><text>Notwithstanding section 5303(a) of this title and subject to subsection (c), the Secretary shall furnish to an eligible individual covered mental and behavioral health care.</text>
 </subsection><subsection id="H098E3FACD8B54AFE864D160799A7D7C7"><enum>(b)</enum><header>Eligible individuals</header><text>For purposes of this section, an eligible individual is any of the following:</text> <paragraph id="H27DAADE2DD4E4F1098BBC4EB218C95D2"><enum>(1)</enum><text>An individual who—</text>
 <subparagraph id="H3C930F1CB5E74E179BA5D80129288DBD"><enum>(A)</enum><text display-inline="yes-display-inline">served in the active military, naval, or air service for a period of more than 180 days and was deployed in a theater of combat operations, in support of a contingency operation, or in an area at a time during which hostilities are occurring in that area, for a period of more than 30 days during such service;</text>
 </subparagraph><subparagraph id="H2B55A8DBBCA447B1B1A2295DD7E0D969"><enum>(B)</enum><text>was discharged or released from such service by reason of committing a covered offense; and</text> </subparagraph><subparagraph id="HABD4D4E57D294441889D477FA052E6B6"><enum>(C)</enum><text>was diagnosed by a qualified mental health care provider with a mental or behavioral health condition before committing the covered offense.</text>
 </subparagraph></paragraph><paragraph id="H69A17DEF21AF467AB0476ED3ACDC6D43"><enum>(2)</enum><text display-inline="yes-display-inline">An individual who—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H4DE8C0583B0E4278B730BF218AF4DAAF"><enum>(A)</enum><text display-inline="yes-display-inline">served in the active military, naval, or air service for a period of more than 180 days and was deployed in a theater of combat operations, in support of a contingency operation, or in an area at a time during which hostilities are occurring in that area, for a period of more than 30 days during such service;</text>
 </subparagraph><subparagraph id="H760F3BED2EB649E184B68B703BC65D36"><enum>(B)</enum><text display-inline="yes-display-inline">was discharged or released from such service by reason of committing a covered offense;</text> </subparagraph><subparagraph id="HFAFBB75E5AD74321834742E064D3591A"><enum>(C)</enum><text>is diagnosed with a mental or behavioral health condition after committing such covered offense but before the expiration of the five-year period beginning on the later of—</text>
 <clause id="idBADB7B518EB1429D9442C55CF1218482"><enum>(i)</enum><text>the date of the enactment of the <short-title>Honor Our Commitment Act of 2017</short-title>; or</text> </clause><clause id="id558911FFFFE94E75AC07BB19F9FABB58"><enum>(ii)</enum><text>the date on which the individual is discharged or released from such service;</text>
 </clause></subparagraph><subparagraph id="HE3123DEA286B45488E385FD4E6766E4C"><enum>(D)</enum><text>submits to the Secretary—</text> <clause id="H448FFDF6DFD34FD89A2E7D4FC5D3952D"><enum>(i)</enum><text>a certification from a qualified mental health care provider that the provider believes such condition may have led the individual to commit such offense; and</text>
 </clause><clause id="H3C5085CFAA6C4E7585278E935675B408"><enum>(ii)</enum><text>the Certificate of Release or Discharge from Active Duty (DD Form 214) of the individual; and</text> </clause></subparagraph><subparagraph id="H148C06670A5F423B8EE1B4C08B4AC2F7"><enum>(E)</enum><text>is determined by the Secretary pursuant to subsection (c) to have had a mental or behavioral health condition at the time the individual committed the covered offense that contributed to the commission of the offense.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" id="H682F28B0B3664F3C9B67040E4CE24354"><enum>(c)</enum><header>Determination by Secretary</header><paragraph commented="no" display-inline="yes-display-inline" id="HD032AB2A8CC44E9C9A06571C007C1880"><enum>(1)</enum><text>Not later than 90 days after receiving the information submitted under subsection (b)(2)(D) with respect to an individual, the Secretary shall determine whether, at the time of committing the covered offense, the individual had a mental or behavioral health condition that contributed to the commission of the offense.</text>
 </paragraph><paragraph commented="no" id="H3C80540EB9D54E6F83C9B336B9413916" indent="up1"><enum>(2)</enum><text>If the Secretary does not make a determination under paragraph (1) with respect to a mental or behavioral health condition of an individual before the end of the 90-day period beginning on the date of the submittal of the information described in subsection (b)(2)(D), the condition is deemed to be a mental or behavioral health condition that contributed to the commission of the offense until such time as the Secretary makes the determination.</text>
 </paragraph></subsection><subsection commented="no" id="id154DE2AF68EF4B66B08DEAA8790A94B1"><enum>(d)</enum><header>Initial mental health screening</header><paragraph commented="no" display-inline="yes-display-inline" id="id767DD2EE500244119CE925CAFA73D8A7"><enum>(1)</enum><text>The Secretary may furnish to each individual described in paragraph (2) an initial mental health screening not later than the later of—</text>
 <subparagraph commented="no" id="id87DCA10D368D42928F00B61ACDAC07EF" indent="up1"><enum>(A)</enum><text>five years after the date of the enactment of the <short-title>Honor Our Commitment Act of 2017</short-title>; or</text> </subparagraph><subparagraph commented="no" id="id7C7F11A04773492EA6399BF982325F06" indent="up1"><enum>(B)</enum><text>five years after the date on which the individual was discharged or released from the active military, naval, or air service.</text>
 </subparagraph></paragraph><paragraph commented="no" id="id33F4308F66A5436E993FA27D9807B89A" indent="up1"><enum>(2)</enum><text>Individuals described in this paragraph are the following:</text> <subparagraph commented="no" id="id57478B5F98D449519D34FCFE9041A9AD"><enum>(A)</enum><text>Eligible individuals described in subsection (b)(1).</text>
 </subparagraph><subparagraph commented="no" id="id6ACDC2AB2C3F446C80A4FBCB0D661008"><enum>(B)</enum><text>Individuals described in subparagraphs (A), (B), and (C) of subsection (b)(2).</text> </subparagraph></paragraph><paragraph commented="no" id="idD9DC1548BF224E8F9F1644CF0F08BBDE" indent="up1"><enum>(3)</enum><text>The mental health screening provided to an individual under paragraph (1) shall be at no cost to the individual.</text>
 </paragraph></subsection><subsection commented="no" id="id42E93B7B91954303BE4554C1F824824C"><enum>(e)</enum><header>Notification of eligibility</header><text>The Secretary shall notify each eligible individual described in subsection (b)(1) about the eligibility of the individual for covered mental and behavioral health care under this section not later than the later of—</text>
 <paragraph commented="no" id="idA657EC986C704D01B0C2DD4D416BD41E"><enum>(1)</enum><text>180 days after the date of the enactment of the <short-title>Honor Our Commitment Act of 2017</short-title>; or</text> </paragraph><paragraph commented="no" id="idAE0790B90BC34BF9BC3B5F2D4AEC6602"><enum>(2)</enum><text>180 days after the date on which the individual was discharged or released from the active military, naval, or air service.</text>
 </paragraph></subsection><subsection id="id6b2d33b9c5c74d8bae26fe142942a184"><enum>(f)</enum><header>Annual report</header><text>Not less frequently than annually, the Secretary shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report that includes, with respect to the year preceding the submittal of the report, the following:</text>
 <paragraph id="idC659331CF268449E98EEA16B97453559"><enum>(1)</enum><text>The number of eligible individuals who were furnished covered mental and behavioral health care under this section.</text>
 </paragraph><paragraph id="id226F5F8FB24E4AA08721D13F67E9EA3D"><enum>(2)</enum><text>The number of individuals who the Secretary determined under subsection (c) did not have a mental or behavioral health condition at the time of committing a covered offense that contributed to the commission of the offense.</text>
 </paragraph><paragraph id="idB183CDAACEC74716B2C969C261C0A313"><enum>(3)</enum><text>The number of individuals who requested an initial mental health screening under subsection (d).</text> </paragraph><paragraph id="idF69702C9FD6D42C48C77CE78D7E807D1"><enum>(4)</enum><text>The number of individuals who were furnished an initial mental health screening under subsection (d).</text>
 </paragraph></subsection><subsection id="H1651738707E34A728187B6BB382918BB"><enum>(g)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H5DB356A7DBB4476CB54A63F1DC807C7E"><enum>(1)</enum><text>The term <term>covered mental and behavioral health care</term> means the same types of medical services furnished by the Department to individuals with service-connected mental or behavioral health conditions to treat such conditions.</text>
 </paragraph><paragraph id="H52464FF3A3734DADA7AFC7A32A745CB8"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>covered offense</term> means an offense for which an individual is discharged or separated from the active military, naval, or air service under conditions other than honorable but not a dishonorable discharge or a discharge by court-martial.</text>
 </paragraph><paragraph id="H147F97A7AADF4A26964EA57B378E91AB"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>qualified mental health care provider</term> means a licensed or certified health care provider whose scope of practice includes diagnosing mental or behavioral health conditions and includes physicians, psychologists, psychiatric nurse practitioners, physician assistants, clinical social workers, and licensed professional counselors.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HFBD72B022CB345C194385C62959A9C4A"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 17 of such title is amended by inserting after the item relating to section 1712C the following new item:</text>
				<quoted-block id="H89D204CA2C464CEC8783FFBE0F622BE8" style="USC"><toc><toc-entry idref="HAE5986DB19B141D79257079918A40D3C" level="section">1712D. Mental and behavioral health care for certain individuals discharged or released from the
			 active military, naval, or air service under conditions other than
			 honorable.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H6A32FD47E8F249D794F5A555B1C90DEA"><enum>(c)</enum><header>Effective date</header><text>Section 1712D of title 38, United States Code, as added by subsection (a), shall take effect on the date that is 120 days after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
