			 decisions regarding claims for benefits under the laws administered by the
			 Secretary of Veterans Affairs, and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="id6928DB805B6D4994ADCC0D22363ABB31" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Department of Veterans Affairs Appeals Modernization Act of 2017</short-title></quote>.</text> </section><section id="idade4d02e7b5a4803b03e4b3cb7dd1a8c"><enum>2.</enum><header>Reform of rights and processes relating to appeals of decisions regarding claims for benefits under laws administered by Secretary of Veterans Affairs</header> <subsection id="ide2b8665f9e6b4af883cab46799ced662"><enum>(a)</enum><header>Definitions</header><text>Section 101 of title 38, United States Code, is amended by adding at the end the following new paragraphs:</text>
				<quoted-block display-inline="no-display-inline" id="ide051e7cced7b4cf8b5447e7c38ad0ac2" style="OLC">
 <paragraph id="idb34c54aee3844c6fbc377cb21b986f31"><enum>(34)</enum><text>The term <term>agency of original jurisdiction</term> means the activity which entered the original determination with regard to a claim for benefits under laws administered by the Secretary.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5A426ACC7E4D44229EF43ED5105CB251"><enum>(35)</enum><text display-inline="yes-display-inline">The term <term>relevant evidence</term> means evidence that tends to prove or disprove a matter in issue.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="id4647625fb8ef413dab6ee5cfaa3c2ca4"><enum>(b)</enum><header>Notice regarding claims</header><text>Section 5103(a) of such title is amended—</text>
 <paragraph id="ide1f46d961b454a3e9c90923383c85ec9"><enum>(1)</enum><text>in paragraph (1), in the first sentence, by striking <quote>The</quote> and inserting <quote>Except as provided in paragraph (3), the</quote>;</text> </paragraph><paragraph id="idA04BCCF413B840E8854F3410B5BE1095"><enum>(2)</enum><text>in paragraph (2)(B)(i) by striking <quote>, a claim for reopening a prior decision on a claim, or a claim for an increase in benefits;</quote> and inserting <quote>or a supplemental claim;</quote>; and</text>
 </paragraph><paragraph id="id8d12c6f9040640ad9c75f8c890453948"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="idc69cac61f6c74c9ca64cca9d11f3074c" style="OLC"> <paragraph id="id1a61d2f8151342bfacbe0f63ea18c630" indent="up1"><enum>(3)</enum><text>The requirement to provide notice under paragraph (1) shall not apply with respect to a supplemental claim that is filed within the timeframe set forth in subparagraphs (B) and (D) of section 5110(a)(2) of this title.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="ida7777cc0f4ed4f07bd19330296b698ef"><enum>(c)</enum><header>Modification of rule regarding disallowed claims</header><text>Section 5103A(f) of such title is amended—</text> <paragraph id="idDCCE2BCDAA2045DCBABFB71BF19FAF6F"><enum>(1)</enum><text>by striking <quote>reopen</quote> and inserting <quote>readjudicate</quote>; and</text>
 </paragraph><paragraph id="id160C0D84FB1A4EDFB0F9F5162658FBBF"><enum>(2)</enum><text>by striking <quote>material</quote> and inserting <quote>relevant</quote>.</text> </paragraph></subsection><subsection id="id372DC720D2174413A12A51358DB4360D"><enum>(d)</enum><header>Modification of duty To assist claimants</header><text>Section 5103A of such title is amended—</text>
 <paragraph id="idF6636B0E82D54C66817EBDB9A6D1005D"><enum>(1)</enum><text>by redesignating subsections (e) through (g) as subsections (g) through (i), respectively; and</text> </paragraph><paragraph id="id16B66F360F2147159C77E205C7C56E0B"><enum>(2)</enum><text>by inserting after subsection (d) the following new subsections:</text>
					<quoted-block display-inline="no-display-inline" id="id90CEE4C67908482C8ACE268CE46316E0" style="USC">
 <subsection id="id848ae6652e2b4d49aa6d07bdcffbfef1"><enum>(e)</enum><header>Applicability of duty To assist</header><paragraph commented="no" display-inline="yes-display-inline" id="id196B9AB3BE0149D9B933DAAA750CC4BB"><enum>(1)</enum><text>The Secretary’s duty to assist under this section shall apply only to a claim, or supplemental claim, for a benefit under a law administered by the Secretary until the time that a claimant is provided notice of the agency of original jurisdiction’s decision with respect to such claim, or supplemental claim, under section 5104 of this title.</text>
 </paragraph><paragraph id="id7B77FDEE11B242F69ED3F1B23DE6457F" indent="up1"><enum>(2)</enum><text>The Secretary’s duty to assist under this section shall not apply to higher-level review by the agency of original jurisdiction, pursuant to section 5104B of this title, or to review on appeal by the Board of Veterans’ Appeals.</text>
 </paragraph></subsection><subsection id="id328a8d58ad704601b27b26200305373a"><enum>(f)</enum><header>Correction of duty To assist errors</header><paragraph commented="no" display-inline="yes-display-inline" id="id6B3C8A4B17F843779963BB07CDA1D554"><enum>(1)</enum><text>If, during review of the agency of original jurisdiction decision under section 5104B of this title, the higher-level reviewer identifies an error on the part of the agency of original jurisdiction to satisfy its duties under this section, and that error occurred prior to the agency of original jurisdiction decision being reviewed, unless the claim can be granted in full, the higher-level reviewer shall return the claim for correction of such error and readjudication.</text>
 </paragraph><paragraph id="id97B6EFEA65D342DFB53E9FFA426F7070" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id3A6766F28B1648E5B3A8167EF3E2F6BB"><enum>(A)</enum><text>If the Board of Veterans’ Appeals, during review on appeal of an agency of original jurisdiction decision, identifies an error on the part of the agency of original jurisdiction to satisfy its duties under this section, and that error occurred prior to the agency of original jurisdiction decision on appeal, unless the claim can be granted in full, the Board shall remand the claim to the agency of original jurisdiction for correction of such error and readjudication.</text>
 </subparagraph><subparagraph id="id384E27BCCF4947DBA2E3FFA8B93E0949" indent="up1"><enum>(B)</enum><text>Remand for correction of such error may include directing the agency of original jurisdiction to obtain an advisory medical opinion under section 5109 of this title.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id29240665C5E5425DB1FA057CE10B3AB8"><enum>(e)</enum><header>Decisions and notices of decisions</header><text>Subsection (b) of section 5104 of such title is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="id04EF845D3F554AB2BA49C95A82F6BE6F" style="OLC"> <subsection id="id6bb6af5b89b24122a42fb29958b759ac"><enum>(b)</enum><text>In any case where the Secretary denies a benefit sought, the notice required by subsection (a) shall also include all of the following:</text>
 <paragraph id="ideb38ac4036c644288110f78960f4148f"><enum>(1)</enum><text>Identification of the issues adjudicated.</text> </paragraph><paragraph id="id46dc97bc48c544bcb8d54faad83f3b04"><enum>(2)</enum><text>A summary of the evidence considered by the Secretary.</text>
 </paragraph><paragraph id="id855137c5daad483e99afef5ba4a281aa"><enum>(3)</enum><text>A summary of the applicable laws and regulations.</text> </paragraph><paragraph id="ida6ce19698f324c6da7ad28183e089910"><enum>(4)</enum><text>Identification of findings favorable to the claimant.</text>
 </paragraph><paragraph id="idb680b18f5c794acfa19c272e351fc5f0"><enum>(5)</enum><text>Identification of elements not satisfied leading to the denial.</text> </paragraph><paragraph id="id06d185108cb649b999b972e7a4870afb"><enum>(6)</enum><text>An explanation of how to obtain or access evidence used in making the decision.</text>
 </paragraph><paragraph id="id3ff392df6d5049749a29295f7d80c3e2"><enum>(7)</enum><text>If applicable, identification of the criteria that must be satisfied to grant service connection or the next higher level of compensation.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ida91dbec099bf447aa96aff953d2b4fff"><enum>(f)</enum><header>Binding nature of favorable findings</header>
 <paragraph id="id3598BA0564AB404FB016A516FB9B675B"><enum>(1)</enum><header>In general</header><text>Chapter 51 of such title is amended inserting after section 5104 the following new section:</text> <quoted-block display-inline="no-display-inline" id="idd3bf44a01bff4ca5a69764370235cd5e" style="USC"> <section id="id3eaddd42fea443f8922c0281bfe9ce54"><enum>5104A.</enum><header>Binding nature of favorable findings</header><text display-inline="no-display-inline">Any finding favorable to the claimant as described in section 5104(b)(4) of this title shall be binding on all subsequent adjudicators within the Department, unless clear and convincing evidence is shown to the contrary to rebut such favorable finding.</text></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="idDBE3B1BCC1B64B40831906DA49468C57"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 51 of such title is amended by inserting after the item relating to section 5104 the following new item:</text>
					<quoted-block display-inline="no-display-inline" id="idCDD5C0667DC24239AF572BBD7E674D07" style="OLC"><toc><toc-entry bold="off" level="section">5104A. Binding nature of favorable findings.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idD037995CAF2547EE8E6CDF48F6413C53"><enum>(g)</enum><header>Higher-Level review by agency of original jurisdiction</header>
 <paragraph id="id6E61418735B64E7E989D735EE07E5363"><enum>(1)</enum><header>In general</header><text>Chapter 51 of such title, as amended by subsection (f), is further amended by inserting after section 5104A, as added by such subsection, the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="ida3344f2e97584272a9af15401f0b1685" style="USC">
						<section id="id4256371162724d07b581f1828d74011b"><enum>5104B.</enum><header>Higher-level review by the agency of original jurisdiction</header>
 <subsection id="id006f8a20ecaa478f942128af13e7f089"><enum>(a)</enum><header>In general</header><text>A claimant may request a review of the decision of the agency of original jurisdiction by a higher-level adjudicator within the agency of original jurisdiction.</text>
 </subsection><subsection id="id8559de6a9d7a4b12812878e440b3493f"><enum>(b)</enum><header>Time and manner of request</header><paragraph commented="no" display-inline="yes-display-inline" id="idEA88438EC554410A8C2BCD26365B0A0C"><enum>(1)</enum><text>A request for higher-level review by the agency of original jurisdiction shall be—</text> <subparagraph id="id932721EFB60441CF9A3842EB26F6BD0F" indent="up1"><enum>(A)</enum><text>in writing in such form as the Secretary may prescribe; and</text>
 </subparagraph><subparagraph id="idAA1C914B91BA49E9A28148706E3508A0" indent="up1"><enum>(B)</enum><text>made within one year of the notice of the agency of original jurisdiction’s decision.</text>
 </subparagraph></paragraph><paragraph id="id7C1994C41A9A48F4B28E6AA80B618613" indent="up1"><enum>(2)</enum><text>Such request may specifically indicate whether such review is requested by a higher-level adjudicator at the same office within the agency of original jurisdiction or by an adjudicator at a different office of the agency of original jurisdiction.</text>
 </paragraph></subsection><subsection id="id418888922cc8489ba2e4936832ba11e4"><enum>(c)</enum><header>Decision</header><text>Notice of a higher-level review decision under this section shall be provided in writing.</text> </subsection><subsection id="idb8050cf76ec7453c9b4613acd9805f73"><enum>(d)</enum><header>Evidentiary record for review</header><text>The evidentiary record before the higher-level reviewer shall be limited to the evidence of record in the agency of original jurisdiction decision being reviewed.</text>
 </subsection><subsection id="id586CAA4067DF49A68CF8388894BF6E6B"><enum>(e)</enum><header>De novo review</header><text>A review of the decision of the agency of original jurisdiction by a higher-level adjudicator within the agency of original jurisdiction shall be de novo.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id0CD88DC4DEA14392AA78116E48061692"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 51 of such title, as amended by subsection (f), is further amended by inserting after the item relating to section 5104A, as added by such subsection, the following new item:</text>
					<quoted-block display-inline="no-display-inline" id="id5754F0E60AD743AB9BB632C1828D69F6" style="OLC"><toc><toc-entry bold="off" level="section">5104B. Higher-level review by the agency of original jurisdiction.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id8EC77FA890164E34B7FD35BF4C6DE8A7"><enum>(h)</enum><header>Options following decision by agency of original jurisdiction</header>
 <paragraph id="idE16A1C86A7E14E65B69091F1D1B8709E"><enum>(1)</enum><header>In general</header><text>Chapter 51 of such title, as amended by subsection (g), is further amended by inserting after section 5104B, as added by such subsection, the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="id1D15E21307814FE3A7649620B49E6237" style="USC">
						<section id="ida268147341b644c392dc915a22359a10"><enum>5104C.</enum><header>Options following decision by agency of original jurisdiction</header>
 <subsection id="id1a2db51f5dc44a96b9ab26ccbd00d664"><enum>(a)</enum><header>Within one year of decision</header><paragraph commented="no" display-inline="yes-display-inline" id="id8FE39937897F4094962352F74BD7F136"><enum>(1)</enum><text>Subject to paragraph (2), in any case in which the Secretary denies a claim, the claimant may take any of the following actions on or before the date that is one year after the date on which the agency of original jurisdiction issues a decision with respect to that claim:</text>
 <subparagraph id="iddcb364cf7e9347359fcfcca75341e460" indent="up1"><enum>(A)</enum><text>File a request for higher-level review under section 5104B of this title.</text> </subparagraph><subparagraph id="id78357d6508f84735a62c749bf845fff3" indent="up1"><enum>(B)</enum><text>File a supplemental claim under section 5108 of this title.</text>
 </subparagraph><subparagraph id="id9cf247698d0c4c9b968ac162ae1f6353" indent="up1"><enum>(C)</enum><text>File a notice of disagreement under section 7105 of this title.</text> </subparagraph></paragraph><paragraph id="idb21ed2a54a8e4ea58032d878ad616bca" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idF6C7DE470A844C41B729B6874FD53F07"><enum>(A)</enum><text>Once a claimant takes an action set forth in paragraph (1), the claimant may not take another action set forth in that paragraph with respect to such claim until—</text>
 <clause id="id8051A41518C941CEACB1BDE9A6C7F88A" indent="up1"><enum>(i)</enum><text>the higher-level review, supplemental claim, or appeal in connection with the notice of disagreement is adjudicated; or</text>
 </clause><clause id="idD5D4C8F2CEE447A6A9F9339663DFB896" indent="up1"><enum>(ii)</enum><text>the request for higher-level review, supplemental claim, or notice of disagreement is withdrawn.</text> </clause></subparagraph><subparagraph id="idaad781a80763464eb198ed0640979b3b" indent="up1"><enum>(B)</enum><text>Nothing in this subsection shall prohibit a claimant from taking any of the actions set forth in paragraph (1) in succession with respect to a claim.</text>
 </subparagraph><subparagraph id="id66b1e45b01e549e1926c21a955f90437" indent="up1"><enum>(C)</enum><text>Nothing in this subsection shall prohibit a claimant from taking different actions set forth in paragraph (1) with respect to different claims.</text>
 </subparagraph></paragraph></subsection><subsection id="iddc8d78be3f4542148c79cc5274d128b8"><enum>(b)</enum><header>More than one year after decision</header><text>In any case in which the Secretary denies a claim and more than one year has passed since the date on which the agency of original jurisdiction issues a decision with respect to that claim, the claimant may file a supplemental claim under section 5108 of this title.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id36F2FB9B062B4957A86E95B7D3E09A95"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 51 of such title, as amended by subsection (g), is further amended by inserting after the item relating to section 5104B, as added by such subsection, the following new item:</text>
					<quoted-block display-inline="no-display-inline" id="idD0D5F1F111AC4F5F944B1A7FB2B611E1" style="OLC"><toc><toc-entry bold="off" level="section">5104C. Options following decision by agency of original jurisdiction.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idb0c8937bf63a4f9e87da4b354cd38871"><enum>(i)</enum><header>Supplemental claims</header>
 <paragraph id="id81C7FEA61B9A4A23AE8B77EAB7F17550"><enum>(1)</enum><header>In general</header><text>Section 5108 of such title is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="id62dafa535bd741d1858e36990e0b0e35" style="USC"> <section id="idb7b580932786495495f923af8f7cc5d7"><enum>5108.</enum><header>Supplemental claims</header><text display-inline="no-display-inline">If new and relevant evidence is presented or secured with respect to a supplemental claim, the Secretary shall readjudicate the claim taking into consideration any evidence added to the record prior to the former disposition of the claim.</text></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id5C043DABA9514231825BE5F5FEB5463C"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 51 of such title is amended by striking the item relating to section 5108 and inserting the following new item:</text>
					<quoted-block display-inline="no-display-inline" id="id4094FCBDEF9F4FF98135078BEE11365A" style="OLC"><toc><toc-entry bold="off" level="section">5108. Supplemental claims.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="idf54e24df58a14c6dad2658ebf7e0b0ce"><enum>(j)</enum><header>Remand To obtain advisory medical opinion</header><text>Section 5109 of such title is amended by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="id4d42d491b19d47b581eeca608ffd5d2e" style="OLC"> <subsection id="idab57dced1aa244bcbb50bd6b63605ed4"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id778C38729C5F4AC98872C95A0FD052DF"><enum>(1)</enum><text>The Board of Veterans’ Appeals may remand a claim to direct the agency of original jurisdiction to obtain an advisory medical opinion under this section to correct an error on the part of the agency of original jurisdiction to satisfy its duties under section 5103A of this title when such error occurred prior to the agency of original jurisdiction decision on appeal.</text>
 </paragraph><paragraph id="idF2D57554FE0C4C2099A07361C480AB4D" indent="up1"><enum>(2)</enum><text>The Board’s remand instructions shall include the questions to be posed to the independent medical expert providing the advisory medical opinion.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="idB5AD0F2F926A47019147B631B68CE2B6"><enum>(k)</enum><header>Restatement of requirement for expedited treatment of remanded claims</header><text>Section 5109B of such title is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="idebfb980be7074263a9b318e507c7de90" style="USC"> <section id="id6776DE7DD9F548109E687227E36B950C"><enum>5109B.</enum><header>Expedited treatment of remanded claims</header><text display-inline="no-display-inline">The Secretary shall take such actions as may be necessary to provide for the expeditious treatment by the agency of original jurisdiction of any claim that is remanded by the Board of Veterans' Appeals.</text></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id54aedb0e3f2246c8ad8cac5a90b555b2"><enum>(l)</enum><header>Effective dates of awards</header><text>Section 5110 of title 38, United States Code, is amended—</text> <paragraph id="id7e8d1eaeaf944ad8a6f2389ae8422b3c"><enum>(1)</enum><text>by amending subsection (a) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="ida81ad26a6f964f41b212f67ff995972d" style="OLC">
 <subsection id="idee3029a335e8454b98183809f0b4f8f2"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id7D9DCF646C664912AE1F82ADBB2E0CAD"><enum>(1)</enum><text>Unless specifically provided otherwise in this chapter, the effective date of an award based on an initial claim, or a supplemental claim, of compensation, dependency and indemnity compensation, or pension, shall be fixed in accordance with the facts found, but shall not be earlier than the date of receipt of application therefor.</text>
 </paragraph><paragraph id="id2421FBBF548249E5A780A5CC584B2CBD" indent="up1"><enum>(2)</enum><text>For purposes of determining the effective date of an award under this section, the date of application shall be considered the date of the filing of the initial application for a benefit if the claim is continuously pursued by filing any of the following, either alone or in succession:</text>
 <subparagraph id="idE4EFDC389C464D66B999DFBBED34D0E6"><enum>(A)</enum><text>A request for higher-level review under section 5104B of this title on or before the date that is one year after the date on which the agency of original jurisdiction issues a decision.</text>
 </subparagraph><subparagraph id="idE88D357C552540789D732F1EF5D0AC8E"><enum>(B)</enum><text>A supplemental claim under section 5108 of this title on or before the date that is one year after the date on which the agency of original jurisdiction issues a decision.</text>
 </subparagraph><subparagraph id="id355B8354C3BE40AFA4CE568AF5260604"><enum>(C)</enum><text>A notice of disagreement on or before the date that is one year after the date on which the agency of original jurisdiction issues a decision.</text>
 </subparagraph><subparagraph id="idB39FBD3D2FC640F8886A30CA76C8469F"><enum>(D)</enum><text>A supplemental claim under section 5108 of this title on or before the date that is one year after the date on which the Board of Veterans’ Appeals issues a decision.</text>
 </subparagraph></paragraph><paragraph id="id740FF225ED91434FBD45A6C1A0F053D8" indent="up1"><enum>(3)</enum><text>Except as otherwise provided in this section, for supplemental claims received more than one year after the date on which the agency of original jurisdiction issued a decision or the Board of Veterans’ Appeals issued a decision, the effective date shall be fixed in accordance with the facts found, but shall not be earlier than the date of receipt of the supplemental claim.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id5267514175f943f1a2d121cce2b0d590"><enum>(2)</enum><text>in subsection (i), in the first sentence—</text> <subparagraph id="id4fb49c786f7a40bb97b66eb1a078e4ae"><enum>(A)</enum><text>by striking <quote>reopened</quote> and inserting <quote>readjudicated</quote>;</text>
 </subparagraph><subparagraph id="id96d2dc6f4ac04062b3feec81bf0801b7"><enum>(B)</enum><text>by striking <quote>material</quote> and inserting <quote>relevant</quote>; and</text> </subparagraph><subparagraph id="idca0d63830340456aaf17f25831517ddf"><enum>(C)</enum><text>by striking <quote>reopening</quote> and inserting <quote>readjudication</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="idb85f6fc0d2b2424abcc4e3ef9c7c26f8"><enum>(m)</enum><header>Definition of award or increased award for purposes of provisions relating to commencement of
 period of payment</header><text>Section 5111(d)(1) of such title is amended by striking <quote>or reopened award</quote> and inserting <quote>award or award based on a supplemental claim</quote>.</text> </subsection><subsection id="id7bca30ffb9e14273a53b072d46cc5ce8"><enum>(n)</enum><header>Modification on limitation on fees allowable for representation</header><text>Section 5904(c) of such title is amended, in paragraphs (1) and (2), by striking <quote>notice of disagreement is filed</quote> both places it appears and inserting <quote>claimant is provided notice of the agency of original jurisdiction’s initial decision under section 5104 of this title</quote>.</text>
			</subsection><subsection id="id881c569a3d2046caa355225aef922fa7"><enum>(o)</enum><header>Clarification of Board of Veterans' Appeals referral requirements after order for reconsideration
			 of
 decisions</header><text>Section 7103(b)(1) of title 38, United States Code, is amended by striking <quote>heard</quote> both places it appears and inserting <quote>decided</quote>.</text> </subsection><subsection id="id05dbf6d643f04929bcaf3d7cb183b3e9"><enum>(p)</enum><header>Conforming amendment relating to readjudication</header><text>Section 7104(b) of such title is amended by striking <quote>reopened</quote> and inserting <quote>readjudicated</quote>.</text>
			</subsection><subsection id="id511814638022426ca2814d1c744f8f6d"><enum>(q)</enum><header>Modification of procedures for appeals to Board of Veterans' Appeals</header>
 <paragraph id="id55651390A330488DAD8C5B45890C9A97"><enum>(1)</enum><header>In general</header><text>Section 7105 of title 38, United States Code, is amended—</text> <subparagraph id="id88cb6f91cafe44f2a2c2a949e862faaf"><enum>(A)</enum><text>in subsection (a)—</text>
 <clause id="id53f01ca753ab41dc97f2d4a20a0dd646"><enum>(i)</enum><text>by striking the first sentence and inserting <quote>Appellate review shall be initiated by the filing of a notice of disagreement in the form prescribed by the Secretary.</quote>; and</text>
 </clause><clause id="idc212d9c166644d07a990772171347eee"><enum>(ii)</enum><text>by striking <quote>hearing and</quote>;</text> </clause></subparagraph><subparagraph id="id9f6b137137ea46cb9ce2ea135a76a7b2"><enum>(B)</enum><text>by amending subsection (b) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="idaa5cf354c3794077b09a533437ad8ea7" style="OLC">
 <subsection id="ideacb4297a2db41639745fc51ffd88663"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id0547B5AD8001403D897452D81AB155E5"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id66A57E3B18F84B78A07B254FDAFBAD07"><enum>(A)</enum><text>Except in the case of simultaneously contested claims, notice of disagreement shall be filed within one year from the date of the mailing of notice of the decision of the agency of original jurisdiction pursuant to section 5104, 5104B, or 5108 of this title.</text>
 </subparagraph><subparagraph id="id2F41ACE54519459AB811F3AABC7926FA" indent="up2"><enum>(B)</enum><text>A notice of disagreement postmarked before the expiration of the 1-year period shall be accepted as timely filed.</text>
 </subparagraph><subparagraph id="id00C610D8005D4BABA7E557A4FA25FFE1" indent="up2"><enum>(C)</enum><text>A question as to timeliness or adequacy of the notice of disagreement shall be decided by the Board.</text>
 </subparagraph></paragraph><paragraph id="idE1A6359CCEF44F4480DF77DF2D0B476C" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id372D16C0845B4F67B47D068B8C8C3718"><enum>(A)</enum><text>Notices of disagreement shall be in writing, shall set out specific allegations of error of fact or law, and may be filed by the claimant, the claimant's legal guardian, or such accredited representative, attorney, or authorized agent as may be selected by the claimant or legal guardian.</text>
 </subparagraph><subparagraph id="idE8EF2698F98D466CA65DBCF043F3CB94" indent="up1"><enum>(B)</enum><text>Not more than one recognized organization, attorney, or agent may be recognized at any one time in the prosecution of a claim.</text>
 </subparagraph><subparagraph id="id6CA63E285B124078BA600E22ED761BA6" indent="up1"><enum>(C)</enum><text>Notices of disagreement shall be filed with the Board.</text>
 </subparagraph></paragraph><paragraph id="id997D6C9DD3894E5EBE9A0648C6961B3F" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id480D3758A5EF4B028C2DE5BC41B7A222"><enum>(A)</enum><text>The notice of disagreement shall indicate whether the claimant requests—</text> <clause id="id25E000068452443F83FF698FEFBF1922" indent="up1"><enum>(i)</enum><text>a hearing before the Board;</text>
 </clause><clause id="idBCE95794247242FC8B6B2F45A6502FD7" indent="up1"><enum>(ii)</enum><text>an opportunity to submit additional evidence without a hearing before the Board; or</text> </clause><clause id="id505192A5074E44AC8A2904886E002F3E" indent="up1"><enum>(iii)</enum><text>a review by the Board without a hearing or submission of additional evidence.</text>
 </clause></subparagraph><subparagraph id="idEC0549F71C624FFAB3B27CB65BC335B6" indent="up1"><enum>(B)</enum><text>If the claimant does not expressly request a hearing before the Board in the notice of disagreement, no hearing before the Board shall be held.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="iddf4d54573f9747cc8cc8c44d9de0cb85"><enum>(C)</enum><text>by amending subsection (c) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="id5e4f227f4fdd424ea5cedbee3b39b265" style="OLC"> <subsection id="id19334ce2e38a4d4d9524affe43a05929"><enum>(c)</enum><text>If no notice of disagreement is filed in accordance with this chapter within the prescribed period, the action or decision of the agency of original jurisdiction shall become final and the claim shall not thereafter be readjudicated or allowed, except as may otherwise be provided by section 5104B or 5108 of this title or such regulations as are consistent with this title.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="id6a008cccddf24a638703c8163a96fbbd"><enum>(D)</enum><text>by striking subsection (d) and inserting the following new subsection (d):</text> <quoted-block display-inline="no-display-inline" id="id5002A67F1DC144EDB06A4A2508B58564" style="OLC"> <subsection id="idC2CAB2032B9D432AB887ACA1E32B6273"><enum>(d)</enum><text>The Board of Veterans’ Appeals may dismiss any appeal which fails to allege specific error of fact or law in the decision being appealed.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="idcad08131c4a840a28622a9e64aa19898"><enum>(E)</enum><text>by striking subsection (e); and</text> </subparagraph><subparagraph id="id05AE427C0A8C45748A8751AAE4B42EF0"><enum>(F)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="USC">notice of disagreement and</header-in-text></quote>.</text>
 </subparagraph></paragraph><paragraph id="id20026D0D1885454E8DA921B5E456F6C4"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 71 of such title is amended by striking the item relating to section 7105 and inserting the following new item:</text>

 <subsection id="id5d017f85a04e48c094f68a8e917fb834"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idF042B5B948CE41CE8FF9F570C5ADD9EB"><enum>(1)</enum><text>The substance of the notice of disagreement shall be communicated to the other party or parties in interest and a period of thirty days shall be allowed for filing a brief or argument in response thereto.</text>
 </paragraph><paragraph id="idABF4C8C60B304292869291D4B2692D5A" indent="up1"><enum>(2)</enum><text>Such notice shall be forwarded to the last known address of record of the parties concerned, and such action shall constitute sufficient evidence of notice.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id58af3b4bcb214d41a976fbaf181acd99"><enum>(s)</enum><header>Repeal of procedures for administrative appeals</header>
 <paragraph id="id3102909BBD7B46E284DAE34DFFA48E36"><enum>(1)</enum><header>In general</header><text>Chapter 71 of such title is amended by striking section 7106.</text> </paragraph><paragraph id="id9C608C2AA2814A818149124D97D6304C"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 71 of such title is amended by striking the item relating to section 7106.</text>
 </paragraph></subsection><subsection id="id39639902faa94cc883ccfc322fff86dd"><enum>(t)</enum><header>Modifications relating to appeals: dockets; hearings</header><text>Section 7107 of such title is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="id7d40e58646e04e2dae4c8155124e764c" style="USC"> <section id="id4a83e469042f4e85a43a33a805378b8c"><enum>7107.</enum><header>Appeals: dockets; hearings</header> <subsection id="idA6403F80C2AF4B899911095E56DAE653"><enum>(a)</enum><header>Dockets</header><paragraph commented="no" display-inline="yes-display-inline" id="id0454072F76F241B8A9BFEE91258F8FF9"><enum>(1)</enum><text>The Board shall maintain two separate dockets as follows:</text>
 <subparagraph id="idB16711BF27BC4C2FB00593977D5A4D77" indent="up1"><enum>(A)</enum><text>A non-hearing option docket shall be maintained for cases in which no Board hearing is requested and no additional evidence will be submitted.</text>
 </subparagraph><subparagraph id="idE0CF52D1AB814AC7A71B3AEBF51D69E1" indent="up1"><enum>(B)</enum><text>A separate and distinct hearing option docket shall be maintained for cases in which a Board hearing is requested in the notice of disagreement or in which no Board hearing is requested, but the appellant requests, in the notice of disagreement, an opportunity to submit additional evidence.</text>
 </subparagraph></paragraph><paragraph id="idCF0B024542314E049684160A3B917A29" indent="up1"><enum>(2)</enum><text>Except as provided in subsection (b), each case before the Board will be decided in regular order according to its respective place on the Board’s non-hearing option docket or the hearing option docket.</text>
 </paragraph></subsection><subsection id="id19EAFC18EFF6451C9993069398071ECD"><enum>(b)</enum><header>Advancement on the docket</header><paragraph commented="no" display-inline="yes-display-inline" id="id3E6A37C635684B7DA236A7698E1983FF"><enum>(1)</enum><text>A case on either the Board’s non-hearing option docket or hearing option docket may, for cause shown, be advanced on motion for earlier consideration and determination.</text>
 </paragraph><paragraph id="id168846535E564750946129A5C0539C73" indent="up1"><enum>(2)</enum><text>Any such motion shall set forth succinctly the grounds upon which the motion is based.</text>
 </paragraph><paragraph id="id52B87B66B17045AB93F9F790E0F6C373" indent="up1"><enum>(3)</enum><text>Such a motion may be granted only—</text> <subparagraph id="id01C8C4E9C7E841E4B0080745A422E3AF"><enum>(A)</enum><text>if the case involves interpretation of law of general application affecting other claims;</text>
 </subparagraph><subparagraph id="id1F7DC3042783417B9D536FF9455E3B1B"><enum>(B)</enum><text>if the appellant is seriously ill or is under severe financial hardship; or</text> </subparagraph><subparagraph id="idC939735CF1DF4F61AA535267E69BB346"><enum>(C)</enum><text>for other sufficient cause shown.</text>
 </subparagraph></paragraph></subsection><subsection id="id7522654AF533458D806B55A3CF444AAC"><enum>(c)</enum><header>Manner and scheduling of hearings for cases on board hearing option docket</header><paragraph commented="no" display-inline="yes-display-inline" id="idC594BC67D69841AB8B3EDAB12DB47EDC"><enum>(1)</enum><text>For cases on the Board hearing option docket in which a hearing is requested in the notice of disagreement, the Board shall notify the appellant whether a Board hearing will be held—</text>
 <subparagraph id="idE915E7D3845241639672D9957B8E7D66" indent="up1"><enum>(A)</enum><text>at its principal location, or</text> </subparagraph><subparagraph id="idABD026A1E45E499A9D919BFF7B99B81A" indent="up1"><enum>(B)</enum><text>by picture and voice transmission at a facility of the Department where the Secretary has provided suitable facilities and equipment to conduct such hearings.</text>
 </subparagraph></paragraph><paragraph id="id355E433F9A8D40DB8B97E31CDA13BF15" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id1E6EAE75C7E34139BB2CC9D691FFE938"><enum>(A)</enum><text>Upon notification of a Board hearing at the Board’s principal location as described in subparagraph (A) of paragraph (1), the appellant may alternatively request a hearing as described in subparagraph (B) of such paragraph. If so requested, the Board shall grant such request.</text>
 </subparagraph><subparagraph id="idA636DB43E698431A985064549BA47638" indent="up1"><enum>(B)</enum><text>Upon notification of a Board hearing by picture and voice transmission as described in subparagraph (B) of paragraph (1), the appellant may alternatively request a hearing as described in subparagraph (A) of such paragraph. If so requested, the Board shall grant such request.</text>
 </subparagraph></paragraph></subsection><subsection id="idf7fec18187594b6bbf0a0887363361a3"><enum>(d)</enum><header>Screening of cases</header><text>Nothing in this section shall be construed to preclude the screening of cases for purposes of—</text> <paragraph id="id9882af037092431c9cad041582919133"><enum>(1)</enum><text>determining the adequacy of the record for decisional purposes; or</text>
 </paragraph><paragraph id="id94f0b2fe9bcc45c883a4acb33a484e02"><enum>(2)</enum><text>the development, or attempted development, of a record found to be inadequate for decisional purposes.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idd33107db79d44ca7b55dc7956915150f"><enum>(u)</enum><header>Repeal of certain authority for independent medical opinions</header>
 <paragraph id="idB7039259C09F49A086369771FEA294BA"><enum>(1)</enum><header>In general</header><text>Section 7109 of such title is hereby repealed.</text> </paragraph><paragraph id="id1EF0FDC85DC74A86AB5FAD797A5EE09A"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 71 of such title is amended by striking the item relating to section 7109.</text>
 </paragraph></subsection><subsection id="idbfedfacc70ad470fa472d0fda83b2f20"><enum>(v)</enum><header>Clarification of procedures for review of decisions on grounds of clear and unmistakable error</header><text>Section 7111(e) of title 38, United States Code, is amended by striking <quote>, without referral to any adjudicative or hearing official acting on behalf of the Secretary</quote>.</text> </subsection><subsection id="id8112a8d4c8084c5baa65c4c4e67f3baf"><enum>(w)</enum><header>Evidentiary record before Board of Veterans' Appeals</header> <paragraph id="id806BDF3F1A3F43D5A1CD77DB6456A52E"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/71">Chapter 71</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text>

						<section id="id56bc750b5bdc4716b7815b3f18f49125"><enum>7113.</enum><header>Evidentiary record before the Board of Veterans' Appeals</header>
 <subsection id="ided7c1379c98a48e3bd271818d1efd651"><enum>(a)</enum><header>Non-Hearing option docket</header><text>For cases in which a hearing before the Board of Veterans' Appeals is not requested in the notice of disagreement, the evidentiary record before the Board shall be limited to the evidence of record at the time of the decision of the agency of original jurisdiction on appeal.</text>
 </subsection><subsection id="idf4853efeb6c6447f940adf11232b4d3d"><enum>(b)</enum><header>Hearing option docket</header><paragraph commented="no" display-inline="yes-display-inline" id="id308A897A6DFC4C2A9C12A6D0A8FE5E01"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idD205AF42F1C948E5A4F8CCF977A02DED"><enum>(A)</enum><text>Except as provided in subparagraph (B) of this paragraph, for cases on the hearing option docket in which a hearing is requested in the notice of disagreement, the evidentiary record before the Board shall be limited to the evidence of record at the time of the decision of the agency of original jurisdiction on appeal.</text>
 </subparagraph><subparagraph id="id7F65AF70E02441BEA4C5604EFAA590FF" indent="up2"><enum>(B)</enum><text>The evidentiary record before the Board for cases on the hearing option docket in which a hearing is requested, shall include each of the following, which the Board shall consider in the first instance:</text>
 <clause id="id7024ee64beef49e0afaef81b9a8c54ee"><enum>(i)</enum><text>Evidence submitted by the appellant and his or her representative, if any, at the Board hearing.</text> </clause><clause id="id437c2c341400432aa0267e3093135f47"><enum>(ii)</enum><text>Evidence submitted by the appellant and his or her representative, if any, within 90 days following the Board hearing.</text>
 </clause></subparagraph></paragraph><paragraph id="id7152dd2b488f4d8b8fa8f77723dc08a2" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id3EE7A2A26620412381E59057DAA40F37"><enum>(A)</enum><text>Except as provided in subparagraph (B) of this paragraph, for cases on the hearing option docket in which a hearing is not requested in the notice of disagreement, the evidentiary record before the Board shall be limited to the evidence considered by the agency of original jurisdiction in the decision on appeal.</text>
 </subparagraph><subparagraph id="idA905752624644A03A48E73E79382D632" indent="up1"><enum>(B)</enum><text>The evidentiary record before the Board for cases on the hearing option docket in which a hearing is not requested, shall include each of the following, which the Board shall consider in the first instance:</text>
 <clause id="id9a7b6549d20b438fb9c282514a1a37ea"><enum>(i)</enum><text>Evidence submitted by the appellant and his or her representative, if any, with the notice of disagreement.</text>
 </clause><clause id="id8e92f5f5b69a4716a8e0026eb6cb2d19"><enum>(ii)</enum><text>Evidence submitted by the appellant and his or her representative, if any, within 90 days following receipt of the notice of disagreement.</text></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id63FFCED1FDE64E208E7E0951F8387ECC"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 71 of such title is amended by inserting after the item relating to section 7112 the following new item:</text>

 </paragraph></subsection><subsection id="id9867D9D2A67A49D897E08F4484733086"><enum>(x)</enum><header>Applicability</header><text>The amendments made by this Act shall apply to all claims for which notice of a decision under section 5104 of title 38, United States Code, is provided by the Secretary on or after the date that is 540 days after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
