		<official-title>To amend title 38, United States Code, to expand health care and benefits from the Department of
			 Veterans Affairs for military sexual trauma, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Servicemembers and Veterans Empowerment and Support Act of 2017</short-title></quote>.</text>
		</section><section id="idC66BFB70684B46D591E8B6A648112006"><enum>2.</enum><header>Expansion of coverage by the Department of Veterans Affairs of	counseling and treatment for sexual
			 trauma</header>
 <subsection id="id15D1AFACE909462497A20D420DF3C818"><enum>(a)</enum><header>Coverage of cyber harassment of a sexual nature</header><text display-inline="yes-display-inline">Paragraph (1) of section 1720D(a) of title 38, United States Code, is amended by inserting <quote>cyber harassment of a sexual nature,</quote> after <quote>battery of a sexual nature,</quote>.</text> </subsection><subsection id="idF89830E99B2C4C3BBA0A279BFFA00CE6"><enum>(b)</enum><header>Expansion of availability for members of the Armed Forces</header><text display-inline="yes-display-inline">Paragraph (2)(A) of such section is amended—</text>
 <paragraph id="id1FF8902C33EA4E7B8B944BAC6BA8EABD"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>on active duty</quote>; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id234A570170C94BA9B73A7164148BA7B6"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>that was suffered by the member while serving on active duty, active duty for training, or inactive duty training</quote> before the period at the end.</text>
				</paragraph></subsection></section><section id="H1784BD1BF01D4FA09DEF9DEE2A55D936"><enum>3.</enum><header>Standard of proof for
			 service-connection of mental health conditions related to military sexual
			 trauma</header>
			<subsection id="H790B5262CE47424AA6DF86DF34858153"><enum>(a)</enum><header>Standard of
 proof</header><text display-inline="yes-display-inline">Section 1154 of title 38, United States Code, is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H4DD1D02912364CB6AB8E6759BF233C36" style="USC">
 <subsection id="H12A8E1A6FF1F45E7B705C16137DC9AEC"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HF3BD4959B0274717A87A153D076A7A94"><enum>(1)</enum><text display-inline="yes-display-inline">In the case of any veteran who claims that a covered mental health condition was incurred in or aggravated by military sexual trauma during active military, naval, or air service, the Secretary shall accept as sufficient proof of service-connection a diagnosis of such mental health condition by a mental health professional together with satisfactory lay or other evidence of such trauma and an opinion by the mental health professional that such covered mental health condition is related to such military sexual trauma, if consistent with the circumstances, conditions, or hardships of such service, notwithstanding the fact that there is no official record of such incurrence or aggravation in such service, and, to that end, shall resolve every reasonable doubt in favor of the veteran. Service-connection of such covered mental health condition may be rebutted by clear and convincing evidence to the contrary. The reasons for granting or denying service-connection in each case shall be recorded in full.</text>
 </paragraph><paragraph id="H44ED1ACBF7D44E5E9C085DAED4433AE9" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In this subsection:</text> <subparagraph id="H69D7AF048339469A967D6AAEDDD70168"><enum>(A)</enum><text display-inline="yes-display-inline">The term <term>covered mental health condition</term> means post-traumatic stress disorder, anxiety, depression, or other mental health diagnosis described in the current version of the Diagnostic and Statistical Manual of Mental Disorders published by the American Psychiatric Association that the Secretary determines to be related to military sexual trauma.</text>
 </subparagraph><subparagraph id="HD16C0160FB4D450B82CA12CD51AC31B4"><enum>(B)</enum><text display-inline="yes-display-inline">The term <term>military sexual trauma</term> means, with respect to a veteran, a physical assault of a sexual nature, battery of a sexual nature, cyber harassment of a sexual nature, or sexual harassment which occurred during active military, naval, or air service.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id2219B466059A4CF49850DC70F7E25513"><enum>(b)</enum><header>Use of	evidence in evaluating disability claims involving military sexual trauma</header>
 <paragraph id="id6D659EA335C546F994A29B6FBA4270DF"><enum>(1)</enum><header>In general</header><text>Subchapter VI of chapter 11 of such title is amended by adding at the end the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="idC1CF7E6D6EBB44E0B8C4F57D96139764" style="USC">
						<section id="id2F39479FF62240CE9B63110089BB76B8"><enum>1164.</enum><header>Evaluation of claims involving military sexual trauma</header>
							<subsection id="id82D49E639CCB41049EFC7728B173FB48"><enum>(a)</enum><header>Nonmilitary sources of evidence</header><paragraph commented="no" display-inline="yes-display-inline" id="id7475FBCB204843E19BA81D8F45BC5BFF"><enum>(1)</enum>
 <text>In carrying out section 1154(c) of this title, the Secretary shall ensure that if a claim for compensation under this chapter is received by the Secretary for post-traumatic stress disorder based on a physical assault of a sexual nature, battery of a sexual nature, cyber harassment of a sexual nature, or sexual harassment experienced by a veteran during active military, naval, or air service, evidence from sources other than official records of the Department of Defense regarding the veteran's service may corroborate the veteran’s account of the assault, battery, or harassment.</text>
 </paragraph><paragraph id="id8A790D0D5E0341B6BF65A3C960ABD281" indent="up1"><enum>(2)</enum><text>Examples of evidence described in paragraph (1) include the following:</text> <subparagraph id="id7E7F8CF963A640D4A8BAEAADC0F38F22"><enum>(A)</enum><text>Records from law enforcement authorities, rape crisis centers, mental health counseling centers, hospitals, and physicians.</text>
 </subparagraph><subparagraph id="idAAF11EA2D0C2404BADA23F98E7A8CAB8"><enum>(B)</enum><text>Pregnancy tests and tests for sexually transmitted diseases.</text> </subparagraph><subparagraph id="id81D01466148641F68D823EE0750828AC"><enum>(C)</enum><text>Statements from family members, roommates, other members of the Armed Forces or veterans, and clergy.</text>
									</subparagraph></paragraph></subsection><subsection id="idE6CE0A0DB74A410B83BA642869248CFC"><enum>(b)</enum><header>Behavior changes corroborating evidence</header><paragraph commented="no" display-inline="yes-display-inline" id="id21DEBA4B2EC7469EA260E63471122182"><enum>(1)</enum>
 <text>In carrying out section 1154(c) of this title, the Secretary shall ensure that evidence of a behavior change following an assault, battery, or harassment described in subsection (a)(1) is one type of relevant evidence that may be found in sources described in such subsection.</text>
 </paragraph><paragraph id="id86EF81136DC846CE8113F045CDA375A9" indent="up1"><enum>(2)</enum><text>Examples of behavior changes that may be relevant evidence of an assault, battery, or harassment described in subsection (a)(1) include the following:</text>
 <subparagraph id="idF6B4A08CF80A46C99400B672229566DC"><enum>(A)</enum><text>A request for a transfer to another military duty assignment.</text> </subparagraph><subparagraph id="id2B34B46473AD4439BF7B95A17B063E0D"><enum>(B)</enum><text>Deterioration in work performance.</text>
 </subparagraph><subparagraph id="idD8B41D81BF2D4BAF862712052617C034"><enum>(C)</enum><text>Substance abuse.</text> </subparagraph><subparagraph id="id2CE9A42DF2884BAF8BA5E705E03BA0D3"><enum>(D)</enum><text>Episodes of depression, panic attacks, or anxiety without an identifiable cause.</text>
 </subparagraph><subparagraph id="id24EA1ED66422469DB6A3F36175C75678"><enum>(E)</enum><text>Unexplained economic or social behavior changes.</text> </subparagraph></paragraph></subsection><subsection id="id32C305206CC8495882573FAF67A879EA"><enum>(c)</enum><header>Notice and opportunity To supply evidence</header><text>The Secretary may not deny a claim of a veteran for compensation under this chapter for a post-traumatic stress disorder that is based on an assault, battery, or harassment described in subsection (a)(1) without first—</text>
 <paragraph id="id7914214469DE4D70A7DA461D935F04B6"><enum>(1)</enum><text>advising the veteran that evidence described in subsections (a) and (b) may constitute credible corroborating evidence of the assault, battery, or harassment; and</text>
 </paragraph><paragraph id="id84FA979DED364D43B37722A9BD597E0E"><enum>(2)</enum><text>allowing the veteran an opportunity to furnish such corroborating evidence or advise the Secretary of potential sources of such evidence.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idEB3707F3359645C89B6E7343E90834F8"><enum>(d)</enum><header>Review of evidence</header><text>In reviewing a claim for compensation described in subsection (a)(1), for any evidence received with such claim that is described in subsection (a) or (b), the Secretary may submit such evidence to such medical or mental health professional as the Secretary considers appropriate, including clinical and counseling experts employed by the Department, to obtain a credible opinion as to whether the evidence indicates that an assault, battery, or harassment described in subsection (a)(1) occurred.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id6A0B92F363864066AB0B5BA980B002FB"><enum>(e)</enum><header>Point of contact</header><text>The Secretary shall ensure that each document provided to a veteran relating to a claim for compensation described in subsection (a)(1) includes contact information for an appropriate point of contact with the Department.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id57772954BDC04843A1ECCBBD57D4191D"><enum>(2)</enum><header>Clerical
 amendment</header><text>The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text>
					<quoted-block display-inline="no-display-inline" id="id608A6BC2360D43E3BEB5073165750E3E" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">1164. Evaluation of claims involving military sexual trauma.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HAF017F52D9A94C0BA876B989D7C343EC"><enum>(c)</enum><header>Annual
			 reports</header>
				<paragraph id="H2288A7CD61EE409C8092B2E365E6F465"><enum>(1)</enum><header>In
 general</header><text>Subchapter VI of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/11">chapter 11</external-xref> of title 38, United States Code, as amended by subsection (b), is further amended by adding at the end the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="H0075CFC106F146A09E20D280B5D1EA72" style="USC">
						<section id="H5A0F4306FF73402B8CCCEA700574271A"><enum>1165.</enum><header>Reports on
				claims for disabilities incurred or aggravated by military sexual
				trauma</header>
 <subsection id="H1F2A2DE2C4D34C6980CA83B50E9B0B25"><enum>(a)</enum><header>Reports</header><text display-inline="yes-display-inline">Not later than March 1, 2018, and not less frequently than once each year thereafter through 2027, the Secretary shall submit to Congress a report on covered claims submitted during the previous fiscal year to identify and track the consistency of decisions across regional offices.</text>
 </subsection><subsection id="HE1C7042BE1A0473FAF4229291D050304"><enum>(b)</enum><header>Elements</header><text display-inline="yes-display-inline">Each report under subsection (a) shall include the following:</text>
 <paragraph id="H1FF64536C0914ECEB654E18E455CB21E"><enum>(1)</enum><text display-inline="yes-display-inline">The number of covered claims submitted to or considered by the Secretary during the fiscal year covered by the report.</text>
 </paragraph><paragraph id="H0EFA80F6C87743658E40FF12312ADFC9"><enum>(2)</enum><text>Of the covered claims listed under paragraph (1), the number and percentage of such claims—</text>
 <subparagraph id="HC5F9292D9C544E2BA7292A387880F47D"><enum>(A)</enum><text display-inline="yes-display-inline">submitted by each sex;</text> </subparagraph><subparagraph id="H0742F0378A824A098FE21F6B631177C9"><enum>(B)</enum><text display-inline="yes-display-inline">that were approved, including the number and percentage of such approved claims submitted by each sex; and</text>
 </subparagraph><subparagraph id="HA5629D34C1C942A291390D6781099215"><enum>(C)</enum><text display-inline="yes-display-inline">that were denied, including the number and percentage of such denied claims submitted by each sex.</text>
 </subparagraph></paragraph><paragraph id="HEF4DF87146654704A6DB5C174DBFE49E"><enum>(3)</enum><text display-inline="yes-display-inline">Of the covered claims listed under paragraph (1) that were approved, the number and percentage, disaggregated by sex, of claims assigned to each rating percentage.</text>
 </paragraph><paragraph id="H735BA4E2F91044C3B2E7219D28AC0E8A"><enum>(4)</enum><text>Of the covered claims listed under paragraph (1) that were denied—</text>
 <subparagraph id="HED0B879E9E6A4EB69008720B6676C218"><enum>(A)</enum><text>the three most common reasons given by the Secretary under section 5104(b)(1) of this title for such denials; and</text>
 </subparagraph><subparagraph id="HFFCEB99F5E9041D490FED9E6EC0F0801"><enum>(B)</enum><text>the number of denials that were based on the failure of a veteran to report for a medical examination.</text>
 </subparagraph></paragraph><paragraph id="H3D2DAE4180294548B9616D63591F91A1"><enum>(5)</enum><text>The number of covered claims that, as of the end of the fiscal year covered by the report, are pending and, separately, the number of such claims on appeal.</text>
 </paragraph><paragraph id="H1732C086327D4DB2B86F2139CA23846A"><enum>(6)</enum><text>For the fiscal year covered by the report, the average number of days that covered claims take to complete, beginning on the date on which the claim is submitted.</text>
 </paragraph><paragraph id="H41FE1A0138C74520A838D253526ED3F9"><enum>(7)</enum><text>A description of the training that the Secretary provides to employees of the Veterans Benefits Administration specifically with respect to covered claims, including the frequency, length, and content of such training.</text>
 </paragraph></subsection><subsection id="H5CB6C016708C45C8806B6C9F0F98FA68"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph display-inline="no-display-inline" id="H2F941B2B162841F19D63AD3C221FA0E5"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>covered claims</term> means claims for disability compensation submitted to the Secretary based on a covered mental health condition alleged to have been incurred or aggravated by military sexual trauma.</text>
 </paragraph><paragraph id="HF896DB37B0FB4CB2BBCA9887C822E12F"><enum>(2)</enum><text>The terms <term>covered mental health condition</term> and <term>military sexual trauma</term> have the meanings given such terms in section 1154(c)(3) of this title.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HBE215298409148E29405929E6D018A9B"><enum>(2)</enum><header>Clerical
 amendment</header><text>The table of sections at the beginning of such chapter, as amended by subsection (b), is further amended by adding at the end the following new item:</text>
					<quoted-block display-inline="no-display-inline" id="HB197001E269245F7945FA9CBD189418A" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">1165. Reports on claims for
				disabilities incurred or aggravated by military sexual
				trauma.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE01522AD7ADD4A45B268AD3ABDBBB9EA"><enum>(d)</enum><header>Effective
 date</header><text display-inline="yes-display-inline">Subsection (c) of section 1154 of title 38, United States Code, as added by subsection (a), shall apply with respect to any claim for disability compensation under laws administered by the Secretary of Veterans Affairs for which no final decision has been made before the date of the enactment of this Act.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="idEEDA5360602B43E98E170ADBD5174E2F"><enum>4.</enum><header>Information for members of the Armed Forces regarding availability of services
			 at Vet Centers</header>
 <subsection commented="no" display-inline="no-display-inline" id="id9932E0F5909846C4AACD0EC75CE5B6A8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Defense shall inform members of the Armed Forces, using mechanisms available to the Secretary, of the eligibility of such members for services at Vet Centers.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id550A9C11A2EC4CED854FF04638E12947"><enum>(b)</enum><header>Information from Sexual Assault Response Coordinators</header><text>The Secretary shall ensure that Sexual Assault Response Coordinators of the Department of Defense advise members of the Armed Forces who report instances of military sexual trauma regarding the eligibility of such members for services at Vet Centers.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id95022A5EBE1B4FB2B01BBDAC3BC6E7D2"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="id585A8E6F73854CB2980EF80E36ED16CD"><enum>(1)</enum><header>Military sexual trauma</header><text>The term <term>military sexual trauma</term> means psychological trauma described in section 1720D(a)(1) of title 38, United States Code.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7CCB522DF94B419EB306601907714C30"><enum>(2)</enum><header>Vet Center</header><text>The term <term>Vet Center</term> has the meaning given that term in section 1712A(h) of such title.</text> </paragraph></subsection></section></legis-body> </bill>
