Guidance on minimizing the use of firefighting foam and other related equipment containing any PFAS.</toc-entry></toc></subsection></section> <section id="H6689A60995A14E6CA5F6C15A9873260D"><enum>2.</enum><header>Designation as hazardous substances</header> <subsection id="H0BD323E9AA6C4A02B865EA89658B0F72"><enum>(a)</enum><header>Designation</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall designate perfluorooctanoic acid and its salts, and perfluoroactanesulfonic acid and its salts, as hazardous substances under section 102(a) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9602">42 U.S.C. 9602(a)</external-xref>).</text></subsection>
<subsection id="H9A1C6A3D452C4F7CBF1D828DF946EEAB"><enum>(b)</enum><header>Deadline for additional determinations</header><text display-inline="yes-display-inline">Not later than 5 years after the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall determine whether to designate all perfluoroalkyl and polyfluoroalkyl substances, other than those perfluoroalkyl and polyfluoroalkyl substances designated pursuant to subsection (a), as hazardous substances under section 102(a) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9602">42 U.S.C. 9602(a)</external-xref>) individually or in groups.</text></subsection></section> <section id="H87D73B28A6CA46FAAC32B70BA390A66E" commented="no" display-inline="no-display-inline"><enum>3.</enum><header>Testing of perfluoroalkyl and polyfluoroalkyl substances</header> <subsection id="H6E9075DB767C44549565A2302E005E43"><enum>(a)</enum><header>Testing requirements</header><text display-inline="yes-display-inline">Section 4(a) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2603">15 U.S.C. 2603(a)</external-xref>) is amended by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="H6B4555E4D0B54AE8B6E53C3719EAEDD7" style="OLC">
<paragraph id="HB72612378383489E92F42C6E727CC083" commented="no"><enum>(5)</enum><header>Perfluoroalkyl and polyfluoroalkyl substances rule</header>
<subparagraph id="H0B4790A6211F48B7B34EABF8D61BE765" commented="no"><enum>(A)</enum><header>Rule</header><text>Notwithstanding paragraphs (1) through (3), the Administrator shall, by rule, require that comprehensive toxicity testing be conducted on all chemical substances that are perfluoroalkyl or polyfluoroalkyl substances.</text></subparagraph> <subparagraph id="H8A0A82442FD449CAAD7E1C1137809243" commented="no"><enum>(B)</enum><header>Requirements</header><text display-inline="yes-display-inline">In issuing a rule under subparagraph (A), the Administrator—</text>
<clause id="H4BD25A49792846B8B9FFC8D0908E6601" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">may establish categories of perfluoroalkyl and polyfluoroalkyl substances based on hazard characteristics or chemical properties;</text></clause> <clause id="HB8462D5C6FFA42B8AC5D1B11BD10674B" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">shall require the development of information relating to perfluoroalkyl and polyfluoroalkyl substances that the Administrator determines is likely to be useful in evaluating the hazard and risk posed by such substances in land, air, and water (including drinking water), as well as in products; and</text></clause>
<clause id="H6A35A7C20840400A8AF1D1753E6B9806" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">may allow for varied or tiered testing requirements based on hazard characteristics or chemical properties of perfluoroalkyl and polyfluoroalkyl substances or categories of perfluoroalkyl and polyfluoroalkyl substances.</text></clause></subparagraph> <subparagraph id="H39113A99AD904F4DB6E7C601A0105A7D" commented="no"><enum>(C)</enum><header>Deadlines</header><text display-inline="yes-display-inline">The Administrator shall issue—</text>
<clause id="HAAFFD39A0FC3497C9E8FE0D8ECC57F79" commented="no"><enum>(i)</enum><text>a proposed rule under subparagraph (A) not later than 6 months after the date of enactment of this paragraph; and</text></clause> <clause id="H9EFBEF3D31E443F990C2779DD84A02AA" commented="no"><enum>(ii)</enum><text>a final rule under subparagraph (A) not later than 2 years after the date of enactment of this paragraph.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HA62B2948039C4839A495F0518D875607"><enum>(b)</enum><header>Persons subject to rule</header><text>Section 4(b)(3) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2603">15 U.S.C. 2603(b)(3)</external-xref>) is amended—</text> <paragraph id="HE5610215D87D41CBB657EF048DD768FF" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>subparagraph (B) or (C)</quote> and inserting <quote>subparagraph (B), (C), or (D)</quote>; and</text></paragraph>
<paragraph id="HA7704D0DA9D34EF28908DBF28AE20C3B" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HA02C6DD65C54415E887C2E216013E9EA" style="OLC"> <subparagraph id="HADAB538F7DE8487DA7BE487C4266086E" indent="up2" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">A rule under subsection (a)(5) shall require the development of information by any person who manufactures or processes, or intends to manufacture or process, a chemical substance that is a perfluoroalkyl or polyfluoroalkyl substance.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H3A1EBBF375E749CFB56CE67BFC9BC63F" commented="no"><enum>(c)</enum><header>Perfluoroalkyl and polyfluoroalkyl substances</header><text display-inline="yes-display-inline">Section 4 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2603">15 U.S.C. 2603</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H41DCEF3669C542AAB220C22F54CE4F8A" style="OLC"> <subsection id="HB1BCC3D280F44C08B4E266706BFBC635" commented="no"><enum>(i)</enum><header>Perfluoroalkyl and polyfluoroalkyl substances</header> <paragraph id="HFF95C25D6E8C46C59E6C3D7D758D495F" commented="no"><enum>(1)</enum><header>Testing requirement rule</header> <subparagraph id="H6A55B4DF9FB24D539E27AB3D9BD4BA8A" commented="no"><enum>(A)</enum><header>Protocols and methodologies</header><text display-inline="yes-display-inline">In determining the protocols and methodologies to be included pursuant to subsection (b)(1) in a rule under subsection (a)(5), the Administrator shall allow for protocols and methodologies that test chemical substances that are perfluoroalkyl and polyfluoroalkyl substances as a class.</text></subparagraph>
<subparagraph id="H17905115F3484D0A8D74A11E3B250E2B" commented="no"><enum>(B)</enum><header>Period</header><text display-inline="yes-display-inline">In determining the period to be included pursuant to subsection (b)(1) in a rule under subsection (a)(5), the Administrator shall ensure that the period is as short as possible while allowing for completion of the required testing.</text></subparagraph></paragraph> <paragraph id="HDA47E33DFD1B487FB7697CE4BFF89404" commented="no"><enum>(2)</enum><header>Exemptions</header><text>In carrying out subsection (c) with respect to a chemical substance that is a perfluoroalkyl or polyfluoroalkyl substance, the Administrator—</text>
<subparagraph id="H860815ACC49B4369AE5722C7969E67BC" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">may only determine under subsection (c)(2) that information would be duplicative if the chemical substance with respect to which the application for exemption is submitted is in the same category, as established under subsection (a)(5)(B)(i), as a chemical substance for which information has been submitted to the Administrator in accordance with a rule, order, or consent agreement under subsection (a) or for which information is being developed pursuant to such a rule, order, or consent agreement; and</text></subparagraph> <subparagraph id="H41D5F0A4758F47D4B85DF319AE2CC17D" commented="no"><enum>(B)</enum><text>shall publish a list of all such chemical substances for which an exemption under subsection (c) is granted.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="HA836B1B7AC7649E1A590D3403E9639AF" section-type="subsequent-section" commented="no"><enum>4.</enum><header>Manufacturing and processing notices for perfluoroalkyl and polyfluoroalkyl substances</header><text display-inline="no-display-inline">Section 5 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2604">15 U.S.C. 2604</external-xref>) is amended—</text> <paragraph id="H4F39170A69CC497488EE51B05A1E3737" commented="no"><enum>(1)</enum><text>in subsection (h), by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="H1C363D4BC1E2481E8CCBFADC62E65F99" style="OLC">
<paragraph id="H2E91ED78419A4B5D98E8170C4560C6B7" indent="up1" commented="no"><enum>(7)</enum><text display-inline="yes-display-inline">This subsection does not apply to any chemical substance that is a perfluoroalkyl or polyfluoroalkyl substance.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H6D20AFB46BC140DA9B6522E01826E495" commented="no"><enum>(2)</enum><text>by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="H44BC30EC87F04E9AA59C8D185B35E294" style="OLC">
<subsection id="H4A3AE0D2D4C94D1CB615B218B8ACF32F" commented="no"><enum>(j)</enum><header>Perfluoroalkyl and polyfluoroalkyl substances</header>
<paragraph id="H71A4EAC30E554B4BB6E1D14640B0D385" commented="no"><enum>(1)</enum><header>Determination</header><text>For a period of 5 years beginning on the date of enactment of this subsection, any chemical substance that is a perfluoroalkyl or polyfluoroalkyl substance for which a notice is submitted under subsection (a) shall be deemed to have been determined by the Administrator to present an unreasonable risk of injury to health or the environment under paragraph (3)(A) of such subsection.</text></paragraph> <paragraph id="H464CFA5A8CC74CE6A5F1246080AA81C5" commented="no"><enum>(2)</enum><header>Order</header><text display-inline="yes-display-inline">Notwithstanding subsection (a)(3)(A), for a chemical substance described in paragraph (1) of this subsection, the Administrator shall issue an order under subsection (f)(3) to prohibit the manufacture, processing, and distribution in commerce of such chemical substance.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section commented="no" display-inline="no-display-inline" id="HF6DCD0A197A340C28AA2F0D86C57B85B" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">National primary drinking water regulations for PFAS</header><text display-inline="no-display-inline">Section 1412(b) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-1">42 U.S.C. 300g–1(b)</external-xref>) is amended by adding at the end the following:</text> <quoted-block act-name="" display-inline="no-display-inline" id="H5AFC2BF578A7441B8C23F94865A98897" style="OLC"> <paragraph id="H5852250CF980499F86FE381981BF90C3" commented="no" display-inline="no-display-inline"><enum>(16)</enum><header display-inline="yes-display-inline">Perfluoroalkyl and polyfluoroalkyl substances</header> <subparagraph id="H85D6038ED84D4D229E8B1A8EF7D10E36" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this paragraph, the Administrator shall, after notice and opportunity for public comment, promulgate a national primary drinking water regulation for perfluoroalkyl and polyfluoroalkyl substances, which shall, at a minimum, include standards for—</text>
<clause id="HC5E448314F56407682FF247B8D9EC83C" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">perfluorooctanoic acid (commonly referred to as <quote>PFOA</quote>); and</text></clause> <clause id="H21039495FBAD412397518EAA6C1926E9" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">perfluorooctane sulfonic acid (commonly referred to as <quote>PFOS</quote>).</text></clause></subparagraph>
<subparagraph id="H05BC0708ED9F44F1AF50FBBF816DD849" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Alternative procedures</header>
<clause id="HCBDE7A9C7CA84822939C03CDE88B2C37" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the validation by the Administrator of an equally effective quality control and testing procedure to ensure compliance with the national primary drinking water regulation promulgated under subparagraph (A) to measure the levels described in clause (ii) or other methods to detect and monitor perfluoroalkyl and polyfluoroalkyl substances in drinking water, the Administrator shall add the procedure or method as an alternative to the quality control and testing procedure described in such national primary drinking water regulation by publishing the procedure or method in the Federal Register in accordance with section 1401(1)(D).</text></clause> <clause id="HC39D0BA5C99F42E79C5EDF0206093FB4" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Levels described</header><text display-inline="yes-display-inline">The levels referred to in clause (i) are—</text>
<subclause id="HC08CD9F2A1D14D7DA7CD239C21106CED" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">the level of a perfluoroalkyl or polyfluoroalkyl substance;</text></subclause> <subclause id="H9E5C59B729A94266A8CE66D0688E495E" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">the total levels of perfluoroalkyl and polyfluoroalkyl substances; and</text></subclause>
<subclause id="H47B32A1EC76C4AF2809F0531E5657F99" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">the total levels of organic fluorine.</text></subclause></clause></subparagraph> <subparagraph id="H50746BFEB74F46D7BD32ED4A6BA12B0F" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The Administrator may include a perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances on—</text>
<clause id="H073EAFEEA5C04BE3AE6E9A05841F33A3" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the list of contaminants for consideration of regulation under paragraph (1)(B)(i), in accordance with such paragraph; and</text></clause> <clause id="HB0DAA8F8FF1D44ED8B34CB792AB52797" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the list of unregulated contaminants to be monitored under section 1445(a)(2)(B)(i), in accordance with such section.</text></clause></subparagraph>
<subparagraph id="H68672076A3A74D22B379EFC4BC464569" commented="no" display-inline="no-display-inline"><enum>(D)</enum><header display-inline="yes-display-inline">Monitoring</header><text display-inline="yes-display-inline">When establishing monitoring requirements for public water systems as part of a national primary drinking water regulation under subparagraph (A) or subparagraph (G)(ii), the Administrator shall tailor the monitoring requirements for public water systems that do not detect or are reliably and consistently below the maximum contaminant level (as defined in section 1418(b)(2)(B)) for the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances subject to the national primary drinking water regulation.</text></subparagraph> <subparagraph id="H8306434B67B74B2CAF59F2347D938D3E" commented="no"><enum>(E)</enum><header>Health protection</header><text display-inline="yes-display-inline">The national primary drinking water regulation promulgated under subparagraph (A) shall be protective of the health of subpopulations at greater risk, as described in section 1458.</text></subparagraph>
<subparagraph id="HCE5219163D8D486D8D6238FA3E24CFE2" commented="no" display-inline="no-display-inline"><enum>(F)</enum><header display-inline="yes-display-inline">Health risk reduction and cost analysis</header><text display-inline="yes-display-inline">In meeting the requirements of paragraph (3)(C), the Administrator may rely on information available to the Administrator with respect to 1 or more specific perfluoroalkyl or polyfluoroalkyl substances to extrapolate reasoned conclusions regarding the health risks and effects of a class of perfluoroalkyl or polyfluoroalkyl substances of which the specific perfluoroalkyl or polyfluoroalkyl substances are a part.</text></subparagraph> <subparagraph id="H3F77BC113CE84473906CDFECE4AD4049" commented="no" display-inline="no-display-inline"><enum>(G)</enum><header display-inline="yes-display-inline">Regulation of additional substances</header> <clause id="HC6DFC7FFC4D84984B3A8CA3B92327DB8" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">Determination</header><text display-inline="yes-display-inline">The Administrator shall make a determination under paragraph (1)(A), using the criteria described in clauses (i) through (iii) of that paragraph, whether to include a perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances in the national primary drinking water regulation under subparagraph (A) not later than 18 months after the later of—</text>
<subclause id="HE63E06F59D984813AC548E79FC5D1769" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">the date on which the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances is listed on the list of contaminants for consideration of regulation under paragraph (1)(B)(i); and</text></subclause> <subclause id="H8F42C4F07DDA47E1A29F983E2F653FC9" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">the date on which—</text>
<item id="H55DFE09623B543CD97C20DAF795963AB" commented="no" display-inline="no-display-inline"><enum>(aa)</enum><text display-inline="yes-display-inline">the Administrator has received the results of monitoring under section 1445(a)(2)(B) for the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances; or</text></item> <item id="H50BCD3A0D73C4F0797183F61662A01C3" commented="no" display-inline="no-display-inline"><enum>(bb)</enum><text display-inline="yes-display-inline">the Administrator has received reliable water data or water monitoring surveys for the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances from a Federal or State agency that the Administrator determines to be of a quality sufficient to make a determination under paragraph (1)(A).</text></item></subclause></clause>
<clause id="H29011A9E172F448AA4528AF7E1FE82BF" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Primary drinking water regulations</header>
<subclause id="H822AC01DF8D14814971E2EDE43306323" commented="no" display-inline="no-display-inline"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For each perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances that the Administrator determines to regulate under clause (i), the Administrator—</text> <item id="HCF1612EB920F4053A2AC8BAE2BDBD6E3" commented="no" display-inline="no-display-inline"><enum>(aa)</enum><text display-inline="yes-display-inline">not later than 18 months after the date on which the Administrator makes the determination, shall propose a national primary drinking water regulation for the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances; and</text></item>
<item id="HADEEBA749893442684531372D18CCE26" commented="no" display-inline="no-display-inline"><enum>(bb)</enum><text display-inline="yes-display-inline">may publish the proposed national primary drinking water regulation described in item (aa) concurrently with the publication of the determination to regulate the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances.</text></item></subclause> <subclause id="H1173F86C49024300891DAE7E2D083DBB" commented="no" display-inline="no-display-inline"><enum>(II)</enum><header display-inline="yes-display-inline">Deadline</header> <item id="H38B70074AF054012AF646065CF3516F7" commented="no" display-inline="no-display-inline"><enum>(aa)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the Administrator publishes a proposed national primary drinking water regulation under clause (i)(I) and subject to item (bb), the Administrator shall take final action on the proposed national primary drinking water regulation.</text></item>
<item id="H453746482D994AD996686F6B21A8B73C" commented="no" display-inline="no-display-inline"><enum>(bb)</enum><header display-inline="yes-display-inline">Extension</header><text display-inline="yes-display-inline">The Administrator, on publication of notice in the Federal Register, may extend the deadline under item (aa) by not more than 6 months.</text></item></subclause></clause></subparagraph> <subparagraph id="HFA971007CD864706A95939FA56F44751"><enum>(H)</enum><header>Health advisory</header><text display-inline="yes-display-inline"></text>
<clause id="H85C7A75433474061AD5854AD0271EC66" commented="no"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), the Administrator shall publish a health advisory under paragraph (1)(F) for a perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances not subject to a national primary drinking water regulation not later than 1 year after the later of— </text> <subclause id="H4FAF5C009303486F861D1BC94E67AA32" commented="no"><enum>(I)</enum><text>the date on which the Administrator finalizes a toxicity value for the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances; and</text></subclause>
<subclause id="HBA2B1F8E016748BF9CC80D9302F4E73C" commented="no"><enum>(II)</enum><text>the date on which the Administrator validates an effective quality control and testing procedure for the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances.</text></subclause></clause> <clause id="H428A9EADFA62409DBB3F5518CCCAE351"><enum>(ii)</enum><header>Waiver</header><text>The Administrator may waive the requirements of clause (i) with respect to a perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl and polyfluoroalkyl substances if the Administrator determines that there is a substantial likelihood that the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances will not occur in drinking water with sufficient frequency to justify the publication of a health advisory, and publishes such determination, including the information and analysis used, and basis for, such determination, in the Federal Register.</text></clause></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></section>
<section commented="no" display-inline="no-display-inline" id="H47DE5AC6F9DB4491B654A110DD68A0D3" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Monitoring and detection</header>
<subsection commented="no" display-inline="no-display-inline" id="HFD8225B41ADE4A4D9B964311A837CC31"><enum>(a)</enum><header display-inline="yes-display-inline">Monitoring program for unregulated contaminants</header>
<paragraph commented="no" display-inline="no-display-inline" id="HD03A195CE81C406C85D4B907F887F01C"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator of the Environmental Protection Agency shall include each substance described in paragraph (2) in the fifth publication of the list of unregulated contaminants to be monitored under section 1445(a)(2)(B)(i) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-4">42 U.S.C. 300j–4(a)(2)(B)(i)</external-xref>).</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HD0565F9FA9F94F798CB7FF661FF3FC66"><enum>(2)</enum><header display-inline="yes-display-inline">Substances described</header><text display-inline="yes-display-inline">The substances referred to in paragraph (1) are perfluoroalkyl and polyfluoroalkyl substances and classes of perfluoroalkyl and polyfluoroalkyl substances—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H968C960E5FB0493F936F03358FB7A053"><enum>(A)</enum><text display-inline="yes-display-inline">for which a method to measure the level in drinking water has been validated by the Administrator of the Environmental Protection Agency; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H65388B46E7F44569B995204A7E9A46E1"><enum>(B)</enum><text display-inline="yes-display-inline">that are not subject to a national primary drinking water regulation under subparagraph (A) or (G)(ii) of paragraph (16) of section 1412(b) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-1">42 U.S.C. 300g–1(b)</external-xref>).</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H3F097745738146E59811DADD6291BFA0"><enum>(3)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">The perfluoroalkyl and polyfluoroalkyl substances and classes of perfluoroalkyl and polyfluoroalkyl substances included in the list of unregulated contaminants to be monitored under section 1445(a)(2)(B)(i) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-4">42 U.S.C. 300j–4(a)(2)(B)(i)</external-xref>) under paragraph (1) shall not count towards the limit of 30 unregulated contaminants to be monitored by public water systems under that section.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H4EE602088A594699A45AF9D7F9C1FBB1"><enum>(b)</enum><header display-inline="yes-display-inline">Applicability</header> <paragraph commented="no" display-inline="no-display-inline" id="H5E273C2E1B3E40B4BDA0EB9D855BEF31"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator of the Environmental Protection Agency shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H7E4602D3CEA9484D834770DB6A0C7A92"><enum>(A)</enum><text display-inline="yes-display-inline">require public water systems serving more than 10,000 persons to monitor for the substances described in subsection (a)(2);</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H4853DDABBA344A88B12EBA1CE79E5130"><enum>(B)</enum><text display-inline="yes-display-inline">subject to paragraph (2) and the availability of appropriations, require public water systems serving not fewer than 3,300 and not more than 10,000 persons to monitor for the substances described in subsection (a)(2); and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H56433E7BC3AB4F06B9B76F1D7E3912EB"><enum>(C)</enum><text display-inline="yes-display-inline">subject to paragraph (2) and the availability of appropriations, ensure that only a representative sample of public water systems serving fewer than 3,300 persons are required to monitor for the substances described in subsection (a)(2).</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HF2EA171AD4F8424AADA2318E2691C3A8"><enum>(2)</enum><header display-inline="yes-display-inline">Requirement</header><text display-inline="yes-display-inline">If the Administrator of the Environmental Protection Agency determines that there is not sufficient laboratory capacity to carry out the monitoring required under subparagraphs (B) and (C) of paragraph (1), the Administrator may waive the monitoring requirements in those subparagraphs.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HC6748CFCB4F0498FA101C2F6C7AA9EB7"><enum>(3)</enum><header display-inline="yes-display-inline">Funds</header><text display-inline="yes-display-inline">The Administrator of the Environmental Protection Agency shall pay the reasonable cost of such testing and laboratory analysis as is necessary to carry out the monitoring required under subparagraphs (B) and (C) of paragraph (1) using—</text> <subparagraph id="HAA099005D74041E892CCD82E4581E3F3" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">funds made available pursuant to subsection (a)(2)(H) or subsection (j)(5) of section 1445 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-4">42 U.S.C. 300j–4</external-xref>); or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H2B9C1CF77C5B4402B3129D01834A5A21"><enum>(B)</enum><text display-inline="yes-display-inline">any other funds made available for that purpose.</text></subparagraph></paragraph></subsection></section> <section commented="no" display-inline="no-display-inline" id="H15C4F29D6F5C4368BF70D13C4A78C40D" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Enforcement</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, the Administrator of the Environmental Protection Agency may not impose financial penalties for the violation of a national primary drinking water regulation (as defined in section 1401 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref>)) with respect to a perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances for which a national primary drinking water regulation has been promulgated under clause (i) or (vi) of subparagraph (D) of section 1412(b)(2) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-1">42 U.S.C. 300g–1(b)(2)</external-xref>) earlier than the date that is 5 years after the date on which the Administrator promulgates the national primary drinking water regulation.</text></section>
<section commented="no" display-inline="no-display-inline" id="H1C6720E89ACD416C83326AF00092D950" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Drinking water state revolving funds</header><text display-inline="no-display-inline">Section 1452 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="HAE35F671BBB4486D8360324F2610ACDF"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(2), by adding at the end the following:</text>

<subparagraph commented="no" display-inline="no-display-inline" id="H9B17F308BAB34D1B9F774E4AFC4D204D"><enum>(G)</enum><header display-inline="yes-display-inline">Emerging contaminants</header>
<clause commented="no" display-inline="no-display-inline" id="H3F7BF95B74654B15ADFB155538F60E0A"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law and subject to clause (ii), amounts deposited under subsection (t) in a State loan fund established under this section may only be used to provide grants for the purpose of addressing emerging contaminants, with a focus on perfluoroalkyl and polyfluoroalkyl substances.</text></clause> <clause commented="no" display-inline="no-display-inline" id="H6F948FD324BC436D9728D0385CDE3681"><enum>(ii)</enum><header display-inline="yes-display-inline">Requirements</header> <subclause commented="no" display-inline="no-display-inline" id="H0C7AC75975CA456EB8941C2F2E8733F2"><enum>(I)</enum><header display-inline="yes-display-inline">Small and disadvantaged communities</header><text display-inline="yes-display-inline">Not less than 25 percent of the amounts described in clause (i) shall be used to provide grants to—</text>
<item commented="no" display-inline="no-display-inline" id="H4D84B6E395DB417EADBC5C79A03C0E86"><enum>(aa)</enum><text display-inline="yes-display-inline">disadvantaged communities (as defined in subsection (d)(3)); or</text></item> <item commented="no" display-inline="no-display-inline" id="H9BA0DB60BDF549F78CB1C91B04CD2B2E"><enum>(bb)</enum><text display-inline="yes-display-inline">public water systems serving fewer than 25,000 persons.</text></item></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H49B70FED89B54C3EB391BF2CA7340EBE"><enum>(II)</enum><header display-inline="yes-display-inline">Priorities</header><text display-inline="yes-display-inline">In selecting the recipient of a grant using amounts described in clause (i), a State shall use the priorities described in subsection (b)(3)(A).</text></subclause></clause> <clause commented="no" display-inline="no-display-inline" id="H510E7BB075784A15ABBCC32549C2B7E2"><enum>(iii)</enum><header display-inline="yes-display-inline">No increased bonding authority</header><text display-inline="yes-display-inline">The amounts deposited in the State loan fund of a State under subsection (t) may not be used as a source of payment of, or security for (directly or indirectly), in whole or in part, any obligation the interest on which is exempt from the tax imposed under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H26BFC7EC50DF4FA9B14B3D0EFF61C0F1"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (m)(1), in the matter preceding subparagraph (A), by striking <quote>this section</quote> and inserting <quote>this section, except for subsections (a)(2)(G) and (t)</quote>; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HBE6BA39360CA45648A62954BE2890ED6"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

<subsection commented="no" display-inline="no-display-inline" id="H2834CF26F6894E9AB4E91084C2FAFA41"><enum>(t)</enum><header display-inline="yes-display-inline">Emerging contaminants</header>
<paragraph commented="no" display-inline="no-display-inline" id="HF7E0D958539F46A9A2CF4F1847BE9C99"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Amounts made available under this subsection shall be allotted to a State as if allotted under subsection (a)(1)(D) as a capitalization grant, for deposit into the State loan fund of the State, for the purposes described in subsection (a)(2)(G).</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H25E9770766B0495F91FFAB0DBCCAB1A8"><enum>(2)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this subsection $100,000,000 for each of fiscal years 2020 through 2024, to remain available until expended.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section commented="no" display-inline="no-display-inline" id="H4620B2B079F049D091D4023CE3C28969" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Additions to toxics release inventory</header>
<subsection commented="no" display-inline="no-display-inline" id="H05F5BE6353B04877B895E4D727EE7CB7"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of toxics release inventory</header><text display-inline="yes-display-inline">In this section, the term <term>toxics release inventory</term> means the list of toxic chemicals subject to the requirements of section 313(c) of the Emergency Planning and Community Right-To-Know Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/11023">42 U.S.C. 11023(c)</external-xref>).</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="H7C44F8AF87014F538F96669F1249CB71"><enum>(b)</enum><header display-inline="yes-display-inline">Immediate inclusion</header> <paragraph commented="no" display-inline="no-display-inline" id="H5051F44B2BB740E794E7210209689886"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subsection (e), beginning January 1 of the calendar year following the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall deem the following chemicals to be included in the toxics release inventory:</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H55A69B0EE789409E944907DD740356D0"><enum>(A)</enum><text display-inline="yes-display-inline">Perfluorooctanoic acid (commonly referred to as <quote>PFOA</quote>) (Chemical Abstracts Service No. 335–67–1).</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HDA1FFAA941F54C71904F3285EACC15EE"><enum>(B)</enum><text display-inline="yes-display-inline">The salts associated with the chemical described in subparagraph (A) (Chemical Abstracts Service Nos. 3825–26–1, 335–95–5, and 68141–02–6).</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H030B65716B124274B07915ED787ECB6E"><enum>(C)</enum><text display-inline="yes-display-inline">Perfluorooctane sulfonic acid (commonly referred to as <quote>PFOS</quote>) (Chemical Abstracts Service No. 1763–23–1).</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H1C1BA7305DE249A5B137FBFE06F7DED0"><enum>(D)</enum><text display-inline="yes-display-inline">The salts associated with the chemical described in subparagraph (C) (Chemical Abstracts Service Nos. 2795–39–3, 29457–72–5, 56773–42–3, 29081–56–9, and 70225–14–8).</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H634D3C256FC147DEBC0A168F3FE4E87C"><enum>(E)</enum><text display-inline="yes-display-inline">A perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances that is—</text> <clause commented="no" display-inline="no-display-inline" id="HC62BC8AB25F74D7C9947C9D8C8DC6E77"><enum>(i)</enum><text display-inline="yes-display-inline">listed as an active chemical substance in the February 2019 update to the inventory under section 8(b)(1) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2607">15 U.S.C. 2607(b)(1)</external-xref>); and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HFCA828B510F44ED889B71C4E2394F0FA"><enum>(ii)</enum><text display-inline="yes-display-inline">on the date of enactment of this Act, subject to the provisions of—</text> <subclause commented="no" display-inline="no-display-inline" id="HA038824BBCA6416A91E34D5461437342"><enum>(I)</enum><text display-inline="yes-display-inline">section 721.9582 of title 40, Code of Federal Regulations; or</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H2D5F39312AE14735B86B94067F422D86"><enum>(II)</enum><text display-inline="yes-display-inline">section 721.10536 of title 40, Code of Federal Regulations.</text></subclause></clause></subparagraph> <subparagraph id="HE97AD96B33504A95A0F3C5A50D68AF1F" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">Hexafluoropropylene oxide dimer acid (commonly referred to as <quote>GenX</quote>) (Chemical Abstracts Service No. 13252–13–6).</text></subparagraph>
<subparagraph id="HBE0F697EA36A45F7AD2EF1AB7528BC83" commented="no"><enum>(G)</enum><text>The compound associated with the chemical described in subparagraph (F) identified by Chemical Abstracts Service No. 62037–80–3.</text></subparagraph> <subparagraph id="H519738857257470A9CECD284501DD41D" commented="no"><enum>(H)</enum><text display-inline="yes-display-inline">Perfluorononanoic acid (commonly referred to as <quote>PFNA</quote>) (Chemical Abstracts Service No. 375–95–1). </text></subparagraph>
<subparagraph id="H14363A2F7B2747B294E33A2D1816BA64" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">Perfluorohexanesulfonic acid (commonly referred to as <quote>PFHxS</quote>) (Chemical Abstracts Service No. 355–46–4).</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H22EB443184A541A983F40B0FE307BE67"><enum>(2)</enum><header display-inline="yes-display-inline">Threshold for reporting</header> <subparagraph commented="no" display-inline="no-display-inline" id="H8DBD8538EFBA4205836A334D1B1C306D"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the threshold for reporting the chemicals described in paragraph (1) under section 313 of the Emergency Planning and Community Right-To-Know Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/11023">42 U.S.C. 11023</external-xref>) is 100 pounds.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H241BC55C9FE9405F9FBB8F09470F1067"><enum>(B)</enum><header display-inline="yes-display-inline">Revisions</header><text display-inline="yes-display-inline">Not later than 5 years after the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall—</text> <clause commented="no" display-inline="no-display-inline" id="H41ADB5C6691642749059087055BDA062"><enum>(i)</enum><text display-inline="yes-display-inline">determine whether revision of the threshold under subparagraph (A) is warranted for any chemical described in paragraph (1); and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HD20E88343ECC473E9B935988C5C0EBD9"><enum>(ii)</enum><text display-inline="yes-display-inline">if the Administrator determines a revision to be warranted under clause (i), initiate a revision under section 313(f)(2) of the Emergency Planning and Community Right-To-Know Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/11023">42 U.S.C. 11023(f)(2)</external-xref>).</text></clause></subparagraph></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H5EF7FB580B6C49BFB60B5E8C52F50780"><enum>(c)</enum><header display-inline="yes-display-inline">Inclusion following assessment</header> <paragraph commented="no" display-inline="no-display-inline" id="H6A5044D5AFFC4BFAADAD1F84B6AB79A1"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header> <subparagraph id="H2E621D0C2952468ABDF800480D6C15AD"><enum>(A)</enum><header>Date of inclusion</header><text display-inline="yes-display-inline">Subject to subsection (e), notwithstanding section 313 of the Emergency Planning and Community Right-To-Know Act of 1986, the Administrator of the Environmental Protection Agency shall deem a perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances not described in subsection (b)(1) to be included in the toxics release inventory beginning January 1 of the calendar year after any of the following dates:</text>
<clause id="H35514FCCF0C447D0B97CA4C956E60AD0" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">Final toxicity value</header><text display-inline="yes-display-inline">The date on which the Administrator finalizes a toxicity value for the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances.</text></clause> <clause id="HC844CC69EA6348C4B0770692E37A67D9" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Significant new use rule</header><text display-inline="yes-display-inline">The date on which the Administrator makes a covered determination for the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances.</text></clause>
<clause id="H3D40D989F72F474A85A477C6A7905ADF" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><header display-inline="yes-display-inline">Addition to existing significant new use rule</header><text display-inline="yes-display-inline">The date on which the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances is added to a list of substances covered by a covered determination.</text></clause> <clause id="H4DA08F6E3DF64A43880BA64828CF7B98" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><header display-inline="yes-display-inline">Addition as active chemical substance</header><text display-inline="yes-display-inline">The date on which the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances to which a covered determination applies is—</text>
<subclause id="HCF89F98F997242EF820964B8BD45A5F1" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">added to the list published under paragraph (1) of section 8(b) of the Toxic Substances Control Act and designated as an active chemical substance under paragraph (5)(A) of such section; or</text></subclause> <subclause id="H51D0A40D5B064DE598EFEF371E95CD8C" commented="no"><enum>(II)</enum><text>designated as an active chemical substance on such list under paragraph (5)(B) of such section.</text></subclause></clause></subparagraph>
<subparagraph id="HD11F6A4A60DD485A992DBDEB17BD3FD5" commented="no"><enum>(B)</enum><header>Covered determination</header><text display-inline="yes-display-inline">For purposes of this paragraph, a covered determination is a determination made, by rule, under section 5(a)(2) of the Toxic Substances Control Act that a use of a perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances is a significant new use (except such a determination made in connection with a determination described in section 5(a)(3)(B) or section 5(a)(3)(C) of such Act).</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HA0D7F8B43265401B9C1A0D0364645815"><enum>(2)</enum><header display-inline="yes-display-inline">Threshold for reporting</header> <subparagraph commented="no" display-inline="no-display-inline" id="HE162D14CA355425BB33FC8EED359901D"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), notwithstanding subsection (f)(1) of section 313 of the Emergency Planning and Community Right-To-Know Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/11023">42 U.S.C. 11023</external-xref>), the threshold for reporting under such section 313 the substances and classes of substances included in the toxics release inventory under paragraph (1) is 100 pounds.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H00049C6EB02441B1A4501B2771AD0164"><enum>(B)</enum><header display-inline="yes-display-inline">Revisions</header><text display-inline="yes-display-inline">Not later than 5 years after the date on which a perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances is included in the toxics release inventory under paragraph (1), the Administrator of the Environmental Protection Agency shall—</text> <clause commented="no" display-inline="no-display-inline" id="HED6AD154B481437A9EB5442447FEE738"><enum>(i)</enum><text display-inline="yes-display-inline">determine whether revision of the threshold under subparagraph (A) is warranted for the substance or class of substances; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H2AA28760A448478AB62D1AE275E880A4"><enum>(ii)</enum><text display-inline="yes-display-inline">if the Administrator determines a revision to be warranted under clause (i), initiate a revision under section 313(f)(2) of the Emergency Planning and Community Right-To-Know Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/11023">42 U.S.C. 11023(f)(2)</external-xref>).</text></clause></subparagraph></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H981255DAACC744A89AF0106C9402D4AA"><enum>(d)</enum><header display-inline="yes-display-inline">Inclusion following determination</header> <paragraph commented="no" display-inline="no-display-inline" id="HD33728301E3643FB946B4A447C6F5DD0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall determine whether the substances and classes of substances described in paragraph (2) meet any one of the criteria described in section 313(d)(2) of the Emergency Planning and Community Right-To-Know Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/11023">42 U.S.C. 11023(d)(2)</external-xref>) for inclusion in the toxics release inventory.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H3AD439BF8000498394236AC45305AEF0"><enum>(2)</enum><header display-inline="yes-display-inline">Substances described</header><text display-inline="yes-display-inline">The substances and classes of substances referred to in paragraph (1) are perfluoroalkyl and polyfluoroalkyl substances and classes of perfluoroalkyl and polyfluoroalkyl substances not described in subsection (b)(1), including—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H0C16378788964C8A987B5D988DE9D9E2"><enum>(A)</enum><text display-inline="yes-display-inline">perfluoro[(2-pentafluoroethoxy-ethoxy)acetic acid] ammonium salt (Chemical Abstracts Service No. 908020–52–0);</text></subparagraph>

<subparagraph id="HA47712425E1A4565B4DE02147E83AB08" commented="no"><enum>(L)</enum><text display-inline="yes-display-inline">the compound associated with the chemical described in subsection (b)(1)(F) identified by Chemical Abstracts Service No. 2062–98–8;</text></subparagraph> <subparagraph id="H9400AF26481445CDBB9CD0DE6BE7CA0F"><enum>(M)</enum><text display-inline="yes-display-inline">perfluoroheptanoic acid (commonly referred to as <quote>PFHpA</quote>) (Chemical Abstracts Service No. 375–85–9);</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H85E85234D78A435EB548AE057AAFAB45"><enum>(N)</enum><text display-inline="yes-display-inline">each perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances for which a method to measure levels in drinking water has been validated by the Administrator; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H6FD497759FB9472DBADDF5FA3A182630"><enum>(O)</enum><text display-inline="yes-display-inline">a perfluoroalkyl and polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances other than the chemicals described in subparagraphs (A) through (N) that is used to manufacture fluorinated polymers, as determined by the Administrator.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H0AB22815811442E0982830C108615A83"><enum>(3)</enum><header display-inline="yes-display-inline">Addition to toxics release inventory</header><text display-inline="yes-display-inline">Subject to subsection (e), if the Administrator determines under paragraph (1) that a substance or a class of substances described in paragraph (2) meets any one of the criteria described in section 313(d)(2) of the Emergency Planning and Community Right-To-Know Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/11023">42 U.S.C. 11023(d)(2)</external-xref>), the Administrator shall revise the toxics release inventory in accordance with such section 313(d) to include that substance or class of substances not later than 2 years after the date on which the Administrator makes the determination.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="HE1F633F2DFE549D48AC79AB3D1C99CDB"><enum>(e)</enum><header display-inline="yes-display-inline">Confidential business information</header> <paragraph commented="no" display-inline="no-display-inline" id="HF36B8C65DE4E4654B21C5AE6C1F2C8BF"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Prior to including on the toxics release inventory pursuant to subsection (b)(1), (c)(1), or (d)(3) any perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances the chemical identity of which is subject to a claim of a person of protection from disclosure under subsection (a) of section 552 of title 5, United States Code, pursuant to subsection (b)(4) of that section, the Administrator of the Environmental Protection Agency shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H4C43640E5C8B4CD3AD619A91E2A0FCDB"><enum>(A)</enum><text display-inline="yes-display-inline">review any such claim of protection from disclosure; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H58EBCFAB64334B5BA58215CAE27F4578"><enum>(B)</enum><text display-inline="yes-display-inline">require that person to reassert and substantiate or resubstantiate that claim in accordance with section 14(f) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2613">15 U.S.C. 2613(f)</external-xref>).</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HA253C4D41DD24ED6BF915F7C2A4CA977"><enum>(2)</enum><header display-inline="yes-display-inline">Nondisclosure of protection information</header><text display-inline="yes-display-inline">If the Administrator determines that the chemical identity of a perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances qualifies for protection from disclosure pursuant to paragraph (1), the Administrator shall include the substance or class of substances, as applicable, on the toxics release inventory in a manner that does not disclose the protected information.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H57F4AE7B68F24925870241754059A848"><enum>(f)</enum><header display-inline="yes-display-inline">Emergency Planning and Community Right-To-Know Act of 1986</header><text display-inline="yes-display-inline">Section 313(c) of the Emergency Planning and Community Right-To-Know Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/11023">42 U.S.C. 11023(c)</external-xref>) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H0B5CFB40F8124A5580CBF4C1BE4D76F5"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the period at the end and inserting <quote>; and</quote>;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HD15D2B6994F341DBA5673D429EA72C4C"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>are those chemicals</quote> and inserting the following: “are—</text>
<quoted-block display-inline="no-display-inline" id="HFE2F6AB73CA745AC97954F77754AC047" style="OLC">
<paragraph commented="no" display-inline="no-display-inline" id="H8C7AC7B541C34DC4BA5F5CC8399D436D"><enum>(1)</enum><text display-inline="yes-display-inline">the chemicals</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H68016816F6334163A9BECDF1EC3502B4"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

<paragraph commented="no" display-inline="no-display-inline" id="HA7C4C4512D964DE4AF9A556A4D6D3E06"><enum>(2)</enum><text display-inline="yes-display-inline">the chemicals included on such list under subsections (b)(1), (c)(1), and (d)(3) of section 9 of the PFAS Action Act of 2019.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> <section id="H87D7061BE22A45ABA41CB7C8F28E135F" commented="no"><enum>10.</enum><header>PFAS data call</header><text display-inline="no-display-inline">Section 8(a) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2607">15 U.S.C. 2607(a)</external-xref>) is amended by adding at the end the following:</text>

<paragraph commented="no" display-inline="no-display-inline" id="H4922C7163A024A0E9547E7341DCB1E70"><enum>(7)</enum><header display-inline="yes-display-inline">PFAS data</header><text display-inline="yes-display-inline">Not later than January 1, 2023, the Administrator shall promulgate a rule in accordance with this subsection requiring each person who has manufactured a chemical substance that is a perfluoroalkyl or polyfluoroalkyl substance in any year since January 1, 2011, to submit to the Administrator a report that includes, for each year since January 1, 2011, the information described in subparagraphs (A) through (G) of paragraph (2).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section commented="no" display-inline="no-display-inline" id="H61231781E9F14DB79A19AC55C4A9B884" section-type="subsequent-section"><enum>11.</enum><header display-inline="yes-display-inline">Significant new use rule for long-chain PFAS</header><text display-inline="no-display-inline">Not later than June 22, 2020, the Administrator of the Environmental Protection Agency shall take final action on the proposed rule entitled <quote>Long-Chain Perfluoroalkyl Carboxylate and Perfluoroalkyl Sulfonate Chemical Substances; Significant New Use Rule</quote> (80 Fed. Reg. 2885 (January 21, 2015)).</text></section>
<section commented="no" display-inline="no-display-inline" id="H11D9A328907F4BA585374BA78D256D3A" section-type="subsequent-section"><enum>12.</enum><header display-inline="yes-display-inline">PFAS destruction and disposal guidance</header>
<subsection commented="no" display-inline="no-display-inline" id="HA67A22EA08984494B8661455B56D400C"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall publish interim guidance on the destruction and disposal of perfluoroalkyl and polyfluoroalkyl substances and materials containing perfluoroalkyl and polyfluoroalkyl substances, including—</text> <paragraph commented="no" display-inline="no-display-inline" id="H3225F470550B4AAFAC2C543A5FAFC697"><enum>(1)</enum><text display-inline="yes-display-inline">soil and biosolids;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H22312859E3EB44FC994EB62A81103558"><enum>(2)</enum><text display-inline="yes-display-inline">textiles treated with perfluoroalkyl and polyfluoroalkyl substances;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HD5D2FE3A1C134310902D79722E3C87A0"><enum>(3)</enum><text display-inline="yes-display-inline">spent filters, membranes, resins, granular carbon, and other waste from water treatment; </text></paragraph>
<paragraph id="H9A8A46C69FEF4335A1B341508E14B32F"><enum>(4)</enum><text display-inline="yes-display-inline">landfill leachate containing perfluoroalkyl and polyfluoroalkyl substances; and</text></paragraph> <paragraph id="H3731D75696DB46B8A4464775A7B63E8B"><enum>(5)</enum><text>solid, liquid, or gas waste streams containing perfluoroalkyl and polyfluoroalkyl substances from facilities manufacturing or using perfluoroalkyl and polyfluoroalkyl substances.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HA69D9F43E0E1431CAAB849DD3AFD0CED"><enum>(b)</enum><header display-inline="yes-display-inline">Considerations; inclusions</header><text display-inline="yes-display-inline">The interim guidance under subsection (a) shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="H3488B9118E8A46D1B45B420EC055A7DC"><enum>(1)</enum><text display-inline="yes-display-inline">take into consideration—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H320E3EA1A7FD4E97B66B9D16EE11DD43"><enum>(A)</enum><text display-inline="yes-display-inline">the potential for releases of perfluoroalkyl and polyfluoroalkyl substances during destruction or disposal, including through volatilization, air dispersion, or leachate; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HC749E279505D4E6DA40BBB487A50E630"><enum>(B)</enum><text display-inline="yes-display-inline">potentially vulnerable populations living near likely destruction or disposal sites; and</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HDE2AC87DADB64264A1F7BE07C5DC0388"><enum>(2)</enum><text display-inline="yes-display-inline">provide guidance on testing and monitoring air, effluent, and soil near potential destruction or disposal sites for releases described in paragraph (1)(A).</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H6C286F80C9B84F139AEEEB79E5E90114"><enum>(c)</enum><header display-inline="yes-display-inline">Revisions</header><text display-inline="yes-display-inline">The Administrator shall publish revisions to the interim guidance under subsection (a) as the Administrator determines to be appropriate, but not less frequently than once every 3 years.</text></subsection></section>
<section id="HFB7EAF4F2DD3426CAA60F2557E4C565A"><enum>13.</enum><header>Establishment of PFAS infrastructure grant program</header><text display-inline="no-display-inline">Part E of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j">42 U.S.C. 300j</external-xref> et seq.) is amended by adding at the end the following new section:</text> <quoted-block id="H02374DFE190C4B7395A5BE498975C441" style="OLC"> <section id="H69397FD9521046EB8D8C8CDF67F6D345"><enum>1459E.</enum><header>Assistance for community water systems affected by PFAS</header> <subsection id="HA607E0B2596E4D849BEE5167DA4725A4"><enum>(a)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this section, the Administrator shall establish a program to award grants to affected community water systems to pay for capital costs associated with the implementation of eligible treatment technologies.</text></subsection>
<subsection id="HC80BFBDF122F4472B525FE15C1B8C5AE"><enum>(b)</enum><header>Applications</header>
<paragraph id="H7BF8F53BB3C74EF893FD1BF3DFD88FA7"><enum>(1)</enum><header>Guidance</header><text>Not later than 12 months after the date of enactment of this section, the Administrator shall publish guidance describing the form and timing for community water systems to apply for grants under this section.</text></paragraph> <paragraph id="HA60F7A48A9584AAF9BEC1D9CF6FACD20"><enum>(2)</enum><header>Required information</header><text>The Administrator shall require a community water system applying for a grant under this section to submit—</text>
<subparagraph id="HFE62282DC9C2476EA5AE2BD161DE410A"><enum>(A)</enum><text>information showing the presence of PFAS in water of the community water system; and</text></subparagraph> <subparagraph id="HA1A107B9B4EB4E0A859D8F11DEC946EF"><enum>(B)</enum><text>a certification that the treatment technology in use by the community water system at the time of application is not sufficient to remove all detectable amounts of PFAS.</text></subparagraph></paragraph></subsection>
<subsection id="H5FA77351A99C44E6A5F81F3F571CEF66"><enum>(c)</enum><header>List of eligible treatment technologies</header><text>Not later than 150 days after the date of enactment of this section, and every two years thereafter, the Administrator shall publish a list of treatment technologies that the Administrator determines are effective at removing all detectable amounts of PFAS from drinking water.</text></subsection> <subsection id="H3B301B3A799745619668C2135B478D34"><enum>(d)</enum><header>Priority for funding</header><text>In awarding grants under this section, the Administrator shall prioritize affected community water systems that—</text>
<paragraph id="HA3ECE94FD5CF4386A10A873C50A2FC1A"><enum>(1)</enum><text>serve a disadvantaged community;</text></paragraph> <paragraph id="H476CC44BF80F4928A2027FB241A0B427"><enum>(2)</enum><text>will provide at least a 10-percent cost share for the cost of implementing an eligible treatment technology; or</text></paragraph>
<paragraph id="H89CD21BE9D904878B5B23F808F0B389E"><enum>(3)</enum><text>demonstrate the capacity to maintain the eligible treatment technology to be implemented using the grant.</text></paragraph></subsection> <subsection id="H47A19D6A26B6462989F2F4856854628E"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section not more than $100,000,000 for each of fiscal years 2020 through 2021.</text></subsection>
<subsection id="HEFD54C96C6C74619891C5162F4FFD601"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HC3181678A44845229C95FF7DAAE97AAD"><enum>(1)</enum><header>Affected community water system</header><text>The term <quote>affected community water system</quote> means a community water system that is affected by the presence of PFAS in the water in the community water system.</text></paragraph>
<paragraph id="HCB1206DB57874C46BB76F3F382BCA16B"><enum>(2)</enum><header>Disadvantaged community</header><text>The term <quote>disadvantaged community</quote> has the meaning given that term in section 1452.</text></paragraph> <paragraph id="H9F7D503C4C9A4CE7B4A53DCF624DFA46"><enum>(3)</enum><header>Eligible treatment technology</header><text>The term <quote>eligible treatment technology</quote> means a treatment technology included on the list published under subsection (c).</text></paragraph>
<paragraph id="H039CDBE58AA74A26AB90C086F185A227"><enum>(4)</enum><header>PFAS</header><text display-inline="yes-display-inline">The term <quote>PFAS</quote> means a perfluoroalkyl or polyfluoroalkyl substance with at least one fully fluorinated carbon atom.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HE56B85D6CA0247E09D0B55F5A87643FE" section-type="subsequent-section"><enum>14.</enum><header>Cooperative agreements with States for removal and remedial actions to address drinking, surface, and ground water and soil contamination from PFAS</header> <subsection id="H439B3F46FC3A46288A92E0693CAC7FB5"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="HD6C53931A9AE4C7BA6DF8E34B0E3CBBD"><enum>(1)</enum><header>Federal facility</header>
<subparagraph id="HCF244F75D6D6424B9B8CFFB242F588B4"><enum>(A)</enum><header>In general</header><text>The term <term>Federal facility</term> means a facility (as defined in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>)) that is owned or operated by the Federal Government.</text></subparagraph> <subparagraph id="HB5E6C0CDAF9D458CBE97FF762AE5C202"><enum>(B)</enum><header>Inclusion</header><text>The term <term>Federal facility</term> includes—</text>
<clause id="H930B46A3EACE4968ADD809674B305B04"><enum>(i)</enum><text>a facility or site—</text> <subclause id="HE3F13420B7F94C7AA4F7911B719D9300"><enum>(I)</enum><text>owned by, leased to, or otherwise possessed by the United States; or</text></subclause>
<subclause id="H67672A23C8E44EA59AC7647D2A9DE8D4"><enum>(II)</enum><text>under the jurisdiction of the Secretary of Defense;</text></subclause></clause> <clause id="H2AEE0839E6AE4356923158AFB6EA4796"><enum>(ii)</enum><text>a facility or site that, at the time of the actions leading to contamination or suspected contamination of drinking water, surface water, or groundwater or land surface or subsurface strata from a perfluorinated compound, was—</text>
<subclause id="H70B0B7DC13F34CE69642076977525591"><enum>(I)</enum><text>owned by, leased to, or otherwise possessed by the United States; or</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="HEF62ECB0B66F4ED68455EC51843743ED"><enum>(II)</enum><text>under the jurisdiction of the Secretary of Defense; and</text></subclause></clause>
<clause id="H514EC467A5CD463285C10F57B5894144"><enum>(iii)</enum><text>land owned and operated by a State when the land is used for training the National Guard pursuant to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/32/5">chapter 5</external-xref> of title 32, United States Code, with funds provided by the Secretary of Defense or the Secretary of a military department, even though that land is not under the jurisdiction of the Secretary of Defense.</text></clause></subparagraph></paragraph> <paragraph id="HF093FFD4145D457EA3C34CD62CB5AC5C"><enum>(2)</enum><header>Fully fluorinated carbon atom</header><text>The term <term>fully fluorinated carbon atom</term> means a carbon atom on which all the hydrogen substituents have been replaced by fluorine.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H70B2D25BDF6B40E1B137A72A5B7CCD3D"><enum>(3)</enum><header display-inline="yes-display-inline">Perfluorinated compound</header><text display-inline="yes-display-inline">The term <term>perfluorinated compound</term> means a perfluoroalkyl substance or a polyfluoroalkyl substance (or <quote>PFAS</quote>) that is manmade with at least 1 fully fluorinated carbon atom.</text></paragraph> <paragraph id="H0B12F193A4E34E30B39DBF134CAD8AF7"><enum>(4)</enum><header>State</header><text>The term <term>State</term> has the meaning given the term in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>).</text></paragraph></subsection>
<subsection id="HD87D897D53864BE4864B0128EEB58040"><enum>(b)</enum><header>Cooperative agreement</header>
<paragraph id="HF3847F261D204F6FAD00562A490FD5FD"><enum>(1)</enum><header>In general</header><text>On request by the Governor or chief executive of a State, a Federal department or agency shall work expeditiously to finalize a cooperative agreement for, or to amend an existing cooperative agreement to address, testing, monitoring, removal, and remedial actions to address contamination or suspected contamination of drinking water, surface water, or groundwater or land surface or subsurface strata from a perfluorinated compound originating from a Federal facility.</text></paragraph> <paragraph id="H3302E1B9527141B687F6CCBE84CB9DEA"><enum>(2)</enum><header>Minimum standards</header><text>A cooperative agreement finalized or amended under paragraph (1) shall require the area subject to the cooperative agreement to meet or exceed the most stringent of the following standards for perfluorinated compounds in any environmental media:</text>
<subparagraph id="H10A1B81F139442CB90327C0AD1728F3A"><enum>(A)</enum><text>An enforceable State standard, in effect in that State, for drinking water, surface water, or groundwater or land surface or subsurface strata, as required under section 121(d) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9621">42 U.S.C. 9621(d)</external-xref>).</text></subparagraph> <subparagraph id="H9B21C8C0A1E942308D7C9CD3E83A3A8A"><enum>(B)</enum><text>A health advisory under section 1412(b)(1)(F) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-1">42 U.S.C. 300g–1(b)(1)(F)</external-xref>).</text></subparagraph>
<subparagraph id="H5A5DCB5DB4624FE9B9C007B8E143EA2D"><enum>(C)</enum><text>Any Federal standard, requirement, criterion, or limit, including a standard, requirement, criterion, or limit issued under—</text> <clause id="H5B3A5A03A8C14C81BB88B53C5D8A0B68"><enum>(i)</enum><text>the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2601">15 U.S.C. 2601</external-xref> et seq.);</text></clause>
<clause id="H3517E17DF2C54125A882D3294D357670"><enum>(ii)</enum><text>the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref> et seq.);</text></clause> <clause id="HACFB48E26DC64433B41A54BE498A647B"><enum>(iii)</enum><text>the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401</external-xref> et seq.);</text></clause>
<clause id="HCC55BFFB7DCC498485AD58AEB43EBDE7"><enum>(iv)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251</external-xref> et seq.);</text></clause> <clause id="H9C316B43A3E64357A22B454AA4B8D467"><enum>(v)</enum><text>the Marine Protection, Research, and Sanctuaries Act of 1972 (commonly known as the <quote>Ocean Dumping Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/33/1401">33 U.S.C. 1401</external-xref> et seq.); or</text></clause>
<clause id="H839F2F724E4443D0B3CB997456C19287"><enum>(vi)</enum><text>the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901</external-xref> et seq.).</text></clause></subparagraph></paragraph> <paragraph id="H18084BCE6129462686DB7483625C5F73"><enum>(3)</enum><header>Other authority</header><text>In addition to the requirements for a cooperative agreement under paragraph (1), when otherwise authorized to expend funds for the purpose of addressing ground or surface water contaminated by a perfluorinated compound, the head of a Federal department or agency may, to expend those funds, enter into a grant agreement, cooperative agreement, or contract with—</text>
<subparagraph id="HDB98A5568FC042F5B5A30B74E002820B"><enum>(A)</enum><text>the local water authority with jurisdiction over the contamination site, including—</text> <clause id="HD05C99B4EC2B48A9A012411115202C39"><enum>(i)</enum><text>a public water system (as defined in section 1401 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref>)); and</text></clause>
<clause id="H3302F0C1B53A4C929018C445FB3EF55D"><enum>(ii)</enum><text>a publicly owned treatment works (as defined in section 212 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1292">33 U.S.C. 1292</external-xref>)); or</text></clause></subparagraph> <subparagraph id="H57680C0E7150469681B63327172BE97F"><enum>(B)</enum><text>a State, local, or Tribal government.</text></subparagraph></paragraph></subsection>
<subsection id="H0325FD0012DD4DFE9C0683FD0A358813"><enum>(c)</enum><header>Notification requirement</header>
<paragraph id="H1DBF2EEC43E54224A0F63A697B1F7653"><enum>(1)</enum><header>Definition of appropriate congressional committees</header><text>In this subsection, the term <term>appropriate congressional committees</term> means—</text> <subparagraph id="HB0B72F74E67146FB91DC1DD6777A2892"><enum>(A)</enum><text>the Committee on Environment and Public Works of the Senate;</text></subparagraph>
<subparagraph id="HCD58DFCC5C4C4C798E9A30C1D651C8FB"><enum>(B)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H6F057E37EDFE4D888CF202356C1B5446"><enum>(C)</enum><text>the Committee on Energy and Commerce of the House of Representatives; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H2717CA5C45A64FD99064022DB048D26C"><enum>(D)</enum><text>the Committee on Oversight and Reform of the House of Representatives.</text></subparagraph></paragraph> <paragraph id="HE79D7125770E44638F434421EF316DE7"><enum>(2)</enum><header>Report</header> <subparagraph id="HCE4FD2D0A7B842E99FFAB1FF15B3D892"><enum>(A)</enum><header>In general</header><text>If a cooperative agreement is not finalized or amended under subsection (b) by the date that is 1 year after the date on which a request by the Governor or chief executive of a State was made, the President shall submit a report described in subparagraph (B) to—</text>
<clause id="HA2DD553F225B4B5C8F150344A18345A8"><enum>(i)</enum><text>the appropriate congressional committees;</text></clause> <clause id="HB447A5F89D934F3FBF2AC36488D94F99"><enum>(ii)</enum><text>each Senator from the State affected by the perfluorinated compound contamination; and</text></clause>
<clause id="H9CF5299EDD674DFAA81D9DD2D3CD7067"><enum>(iii)</enum><text>each member of Congress that represents a district affected by the perfluorinated compound contamination.</text></clause></subparagraph> <subparagraph id="H0557E129B9F14A899E9CE12F093A97A4"><enum>(B)</enum><header>Report described</header><text>The report referred to in subparagraph (A) shall include—</text>
<clause id="H1FDE41C8A236499EA7F2156442E59F0A"><enum>(i)</enum><text>a detailed explanation of why a cooperative agreement has not been finalized or amended, as applicable; and</text></clause> <clause id="H0F25A0CB8EDA451D8DC3ED143BFC9D71"><enum>(ii)</enum><text>a projected timeline for finalizing or amending a cooperative agreement, as applicable.</text></clause></subparagraph></paragraph></subsection></section>
<section id="H7D31290A82764A38AB5CD8A0C817B48D"><enum>15.</enum><header>Listing of perfluoroalkyl and polyfluoroalkyl substances as hazardous air pollutants</header>
<subsection id="H7470C34AE90146B5AA1AB060394D343C"><enum>(a)</enum><header>Listing</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall issue a final rule adding as a class all perfluoroalkyl and polyfluoroalkyl substances with at least one fully fluorinated carbon atom to the list of hazardous air pollutants under section 112(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412(b)</external-xref>).</text></subsection> <subsection id="HC30152C9B53A4D0A9F8AC709092E545E"><enum>(b)</enum><header>Sources categories</header><text display-inline="yes-display-inline">Not later than 365 days after the final rule is issued pursuant to subsection (a), the Administrator of the Environmental Protection Agency shall revise the list under section 112(c)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412(c)(1)</external-xref>) to include categories and subcategories of major sources and area sources of perfluoroalkyl and polyfluoroalkyl substances listed pursuant to such final rule.</text></subsection></section>
<section id="H96815F7EF3AB496183CAC906E1FE7A30"><enum>16.</enum><header>Prohibition on waste incineration of PFAS</header><text display-inline="no-display-inline">Section 3004 of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6924">42 U.S.C. 6924</external-xref>) is amended by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="H5CD905CD085E46449745D5ED6BF5F6AD" style="OLC"> <subsection id="H231705D0DF7540F4B030ED6E05ABF096"><enum>(z)</enum><header>PFAS wastes</header> <paragraph id="HFD085378A5AA47329BEF2E38DB9CE378"><enum>(1)</enum><header>Firefighting foam</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this subsection, the Administrator shall promulgate regulations requiring that when materials containing perfluoroalkyl and polyfluoroalkyl substances or aqueous film forming foam are disposed—</text>
<subparagraph id="H989E011C44E547529DAC90C4D1DDF02B"><enum>(A)</enum><text display-inline="yes-display-inline">all incineration is conducted in a manner that eliminates perfluoroalkyl and polyfluoroalkyl substances while also minimizing perfluoroalkyl and polyfluoroalkyl substances emitted into the air to the extent feasible; </text></subparagraph> <subparagraph id="H912A1C65AAD14D0AA3E88A081D7F7435"><enum>(B)</enum><text>all incineration is conducted in accordance with the requirements of the Clean Air Act, including controlling hydrogen fluoride; </text></subparagraph>
<subparagraph id="HCEE2CFBEB76941E7B6A1C54CB904FC72"><enum>(C)</enum><text display-inline="yes-display-inline">any materials containing perfluoroalkyl and polyfluoroalkyl substances that are designated for disposal are stored in accordance with the requirement under part 264 of title 40, Code of Federal Regulations; and </text></subparagraph> <subparagraph id="H882B440E98934F88BD55EC5CC6F76D52"><enum>(D)</enum><text>all incineration is conducted at a facility that has been permitted to receive waste regulated under this subtitle.</text></subparagraph></paragraph>
<paragraph id="H7B6FBA43D437477EAA5529C922186685"><enum>(2)</enum><header>Penalties</header><text display-inline="yes-display-inline">For purposes of section 3008(d), a waste subject to a prohibition under this subsection shall be considered a hazardous waste identified or listed under this subtitle.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HAE0C89A6D96C46FE98B616326402D325" commented="no"><enum>17.</enum><header>Label for pots, pans, and cooking utensils</header> <subsection id="HA9BF46CF3A134175B6CB3F7EE9F53CC7" commented="no"><enum>(a)</enum><header>Label for pots, pans, and cooking utensils</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall—</text>
<paragraph id="H99CF59FA0F6648CEBCAC1C26BAF6D7FF" commented="no"><enum>(1)</enum><text>revise the Safer Choice Standard of the Safer Choice Program to identify the requirements for a pot, pan, or cooking utensil to meet in order to be labeled with a Safer Choice label, including a requirement that any such pot, pan, or cooking utensil does not contain any PFAS; or</text></paragraph> <paragraph id="H6F1FABD792B04EDC9B00CB3FEAC5CD1F" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">establish voluntary label available to be used by any manufacturer of any pot, pan, or cooking utensil that the Administrator has reviewed and found does not contain any PFAS.</text></paragraph></subsection>
<subsection id="H38F557259F6748289F3913762425D6D7" commented="no"><enum>(b)</enum><header>Definition</header><text>In this section, the term <term>PFAS</term> means a perfluoroalkyl or polyfluoroalkyl substance with at least one fully fluorinated carbon atom.</text></subsection></section> <section id="H23F33C22DAF54E2D84BC99B1129D34CD" commented="no"><enum>18.</enum><header>Guidance on minimizing the use of firefighting foam and other related equipment containing any PFAS</header> <subsection id="HF3B129B5188445EF948A15C097A70564" commented="no"><enum>(a)</enum><header>Guidance</header><text display-inline="yes-display-inline">Not later than one year after the date of enactment of this Act, the Administrator of the Environmental Protection Agency, in consultation with the head of the U.S. Fire Administration and other relevant Federal departments or agencies, shall issue guidance on minimizing the use of firefighting foam and other related equipment containing any PFAS by firefighters, police officers, paramedics, emergency medical technicians, and other first responders, in order to minimize the risk to such firefighters, police officers, paramedics, emergency medical technicians, and other first responders, and the environment, without jeopardizing firefighting efforts.</text></subsection>
