 To amend title 18, United States Code, to punish the criminal offense 
             of guardianship fraud, and for other purposes.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Guardians Aren't Above Prosecution 
Act of 2021''.

SEC. 2. GUARDIANSHIP FRAUD.

    (a) In General.--Chapter 47 of title 18, United States Code, is 
amended by adding at the end the following:
``Sec. 1041. Rule of construction relating to guardianship fraud
    ``Nothing in this chapter may be construed to provide that a person 
designated under the law of any State as the guardian or conservator of 
another shall not be subject to the provisions of this chapter.''.
    (b) Clerical Amendment.--The table of sections for such chapter is 
amended by adding at the end the following:

``1041. Rule of construction relating to guardianship fraud.''.
