A BILL
To expand the eligibility of veterans for hospital care and medical
services provided by non-Department of Veterans Affairs medical
providers under the Veterans Choice Program.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Veterans Health Flexibility Act''.
SEC. 2. EXPANSION OF ELIGIBILITY FOR NON-DEPARTMENT OF VETERANS AFFAIRS
MEDICAL CARE UNDER VETERANS COMMUNITY CARE PROGRAM.
Section 1703 of title 38, United States Code, is amended--
(1) by striking subsection (d) and inserting the following
new subsection (d):
``(d) Conditions Under Which Care Is Required To Be Furnished
Through Non-Department Providers.--Subject to the availability of
appropriations, the Secretary shall furnish hospital care, medical
services, or extended care services to a covered veteran through health
care providers specified in subsection (c), if the covered veteran
notifies the Secretary that the veteran desires to receive care through
the Veterans Community Care Program.'';
(2) by striking subsection (e);
(3) by redesignating subsections (f) through (o) as
subsections (e) through (n), respectively;
(4) in subsection (e), as so redesignated by striking ``or
(e)''; and
(5) in subsection (l)(2), as so redesignated--
(A) in subparagraph (A), by striking ``subsection
(i)'' and inserting ``subsection (h)'';
(B) by striking subparagraph (B); and
(C) by redesignating subparagraphs (C) and (D) as
subparagraphs (B) and (C), respectively.
