A BILL
To direct the Administrator of the Environmental Protection Agency to
ensure the completion of a marginal well study by the Secretary of
Energy so as to inform the development of certain rules under the Clean
Air Act, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Science-Based Emissions Standards
Act of 2021''.
SEC. 2. ENSURING COMPLETION OF MARGINAL WELL STUDY PRIOR TO REPLACEMENT
METHANE RULES.
(a) In General.--The Administrator of the Environmental Protection
Agency may not finalize any rule to amend the new source performance
standards under section 111 of the Clean Air Act (42 U.S.C. 7411)
(including the regulations thereunder, including subpart OOOOa of part
60 of title 40, Code of Federal Regulations), to reduce methane
emissions from new and modified oil and natural gas facilities until
the Secretary of Energy--
(1) completes and publishes the results of the study titled
``Quantification of Methane Emissions from Marginal (Small
Producing) Oil and Gas Wells'' (project number DE-FE0031702);
and
(2) provides a period of at least 90 days for public
comment on the application of the results of such study to
inform such rule.
(b) Consideration of Marginal Well Study.--In finalizing any rule
described in subsection (a), the Administrator of the Environmental
Protection Agency shall take into consideration the results of such
study.
