A BILL
To provide that the public health emergency declared with respect to
COVID-19 shall terminate on the date on which the Secretary of Health
and Human Services approves, or authorizes emergency use of, a drug
intended to treat COVID-19.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Pandemic Cessation Act''.
SEC. 2. TERMINATION OF COVID-19 PUBLIC HEALTH EMERGENCY.
(a) In General.--The public health emergency declared pursuant to
section 319 of the Public Health Service Act (42 U.S.C. 247d) on
January 31, 2020, with respect to COVID-19, and any renewal thereof,
shall terminate on the first date after the date of enactment of this
Act on which the Secretary of Health and Human Services--
(1) grants approval under section 505 of the Federal Food,
Drug, and Cosmetic Act (21 U.S.C. 355) to an application with
respect to a new drug intended to treat COVID-19; or
(2) authorizes emergency use under section 564 of such Act
(21 U.S.C. 360bbb-3) with respect to a drug intended to treat
COVID-19.
(b) Definition.--In this section, the terms ``drug'' and ``new
drug'' have the meanings given such terms in section 201 of the Federal
Food, Drug, and Cosmetic Act (21 U.S.C. 321).
