A BILL
To amend the Public Health Service Act to prohibit transplant centers
from discriminating against an individual seeking an organ on the basis
of whether the individual is vaccinated against COVID-19, and for other
purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Stop Arduous Vaccine Enforcement Act
of 2022'' or the ``SAVE Act of 2022''.
SEC. 2. NO DISCRIMINATION IN ORGAN TRANSPLANTATION ON BASIS OF COVID-19
VACCINATION STATUS.
Section 372(b)(2) of the Public Health Service Act (42 U.S.C.
274(b)(2)) is amended--
(1) in subparagraph (N), by striking ``and'' at the end;
(2) in subparagraph (O), by striking the period at the end
and inserting ``, and''; and
(3) by adding at the end the following new subparagraph:
``(P) prohibit a transplant center from treating an
individual as ineligible to donate or receive an organ, assigns
a lower priority to an individual to receive an organ, or
otherwise discriminates against an individual seeking to donate
or receive an organ, on the basis of whether the individual is
vaccinated (partially or fully) against COVID-19.''.
