A BILL
To amend title III of the Public Health Service Act to prohibit the
Organ Procurement and Transplantation Network from requesting the
vaccination status of an individual with respect to COVID-19 for the
national list of individuals who need organs, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Respecting the Rights of Organ Donor
Recipients Act of 2022''.
SEC. 2. PROHIBITION FROM REQUESTING THE VACCINATION STATUS OF ORGAN
RECIPIENTS WITH RESPECT TO COVID-19.
(a) In General.--Section 372(b) of the Public Health Service Act
(42 U.S.C. 274(b)) is amended by inserting after paragraph (3) the
following:
``(4) Prohibition.--Members of the Organ Procurement and
Transplantation Network shall not request the vaccination
status of an individual with respect to the virus that causes
COVID-19--
``(A) when considering an individual for the
national list of individuals who need organs under
paragraph (2)(A)(i); or
``(B) as a requirement for receiving an organ
transplant under any criteria, standards, or
regulations developed pursuant to this subsection.''.
(b) Technical Amendment.--Section 372(b)(2) of the Public Health
Service Act (42 U.S.C. 274(b)(2)) is amended in the margin by moving
subparagraphs (M), (N), and (O) 2 ems to the left.
