                                 A BILL


 
    To amend title 18, United States Code, to provide for enhanced 
                 penalties for partial birth abortions.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Partial Birth Abortion Is Murder 
Act''.

SEC. 2. INCREASED PENALTY.

    Section 1531(a) of title 18, United States Code, is amended by 
striking ``Any physician who, in or affecting interstate or foreign 
commerce, knowingly performs a partial-birth abortion and thereby kills 
a human fetus shall be fined under this title or imprisoned not more 
than 2 years, or both.'' and inserting the following: ``Any physician 
who, in or affecting interstate or foreign commerce, knowingly performs 
a partial-birth abortion and thereby kills a human fetus shall be 
imprisoned for any term of years or for life (but in no event for not 
less than 5 years), may in addition be fined under this title, and 
shall not be eligible for supervised release.''.
