the following bill; which was referred to the Committee on Energy and
Commerce, and in addition to the Committees on Education and Labor, and
Ways and Means, for a period to be subsequently determined by the
Speaker, in each case for consideration of such provisions as fall
within the jurisdiction of the committee concerned

A BILL
To clarify the applicability of certain parity provisions to mental
health and substance use disorder telehealth benefits.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Telemental Health Parity Act of
2022''.
SEC. 2. CLARIFYING THE APPLICABILITY OF CERTAIN PARITY PROVISIONS TO
MENTAL HEALTH AND SUBSTANCE USE DISORDER TELEHEALTH
BENEFITS.
The provisions of sections 2726 of the Public Health Service Act
(42 U.S.C. 300gg-26), 712 of the Employee Retirement Income Security
Act of 1974 (29 U.S.C. 1185a), and 9812 of the Internal Revenue Code of
1986 shall apply to benefits for mental health or substance use
disorder services furnished via telehealth in the same manner as such
provisions apply to benefits for mental health or substance use
disorder services that are furnished in-person.
