 To bring parity to the collection of housing data with respect to key 
demographics not currently captured in Federal data sets and thereby to 
 enhance accountability and transparency in the evaluation of housing 
             and housing programs, and for other purposes.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Parity, Accountability, and 
Transparency in Housing Data Act of 2022'' or the ``PATH Data Act of 
2022''.

SEC. 2. ANNUAL SURVEYS ON HOUSING DISCRIMINATION.

    (a) Annual Surveys.--The Secretary of Housing and Urban Development 
shall conduct such surveys, on an annual basis, as necessary to 
determine the levels of discrimination in housing practices throughout 
the United States on the basis of protected classes under the Fair 
Housing Act (42 U.S.C. 3601 et seq.), including single, partnered, and 
married persons' sexual orientation or gender identity (in this section 
referred to as ``SOGI''), or both.
    (b) Collection of Data.--Data shall be collected in a manner to 
identify the intersectionalities of protected characteristics under the 
Fair Housing Act identified by survey participants with other protected 
characteristics, as well as age (disaggregated in increments of 5 years 
of age).
    (c) Reports.--Not later than June 1 of each calendar year, the 
Secretary shall submit a report to the Congress, and make such report 
publicly available on a website of the Department of Housing and Urban 
Development, setting forth the findings of the Secretary, with respect 
to levels of discrimination occurring in the preceding calendar year, 
as determined by the surveys conducted for such preceding year.
    (d) Definitions.--For purposes of this section, the following 
definitions shall apply:
            (1) Gender identity.--The term ``gender identity'' means, 
        with respect to an individual, such individual's sense of being 
        male, female, transgender, or another gender, as distinct from 
        the individual's sex assigned at birth.
            (2) Sexual orientation.--The term ``sexual orientation'' 
        means, with respect to an individual, how such individual 
        identifies in terms of their emotional, romantic, or sexual 
        attractions, and includes identification as straight, 
        heterosexual, gay, lesbian, or bisexual, among other 
        identifications.

SEC. 3. COLLECTION OF DATA.

    The Department of Housing and Urban Development Act is amended by 
inserting after section 12 (42 U.S.C. 3537a) the following new section:

``SEC. 13. COLLECTION OF DEMOGRAPHIC DATA.

    ``(a) Collection by HUD.--Whenever the Secretary collects any 
demographic data, whether under or pursuant to any program, survey, 
study, form, or other activity, including the Rental/Homebuyer/
Homeowner Rehab Set-Up Report form for the HOME Program under title II 
of the Cranston-Gonzalez National Affordable Housing Act (42 U.S.C. 
12721 et seq.), the American Healthy Homes Survey conducted by the 
Office of Healthy Homes and Lead Hazard Control, and any forms involved 
in the programs for rental assistance under section 8 of the United 
States Housing Act of 1937 (42 U.S.C. 1437f), the Secretary shall 
collect and make available, to the same extent that demographic data is 
collected and made available, information regarding sexual orientation 
and gender identity of the same individuals about which demographic 
data is collected.
    ``(b) Collection by Recipients and Grantees.--The Secretary shall 
require that any recipient or sub-recipient of assistance within the 
jurisdiction of the Department (as such term is defined in section 
102(m) of the Department of Housing and Urban Development Reform Act of 
1989 (42 U.S.C. 3545(m))), including any State or agency or office 
thereof, unit of local government or agency or office thereof, public 
housing agency, non-profit or for-profit organization, and any other 
official or entity, that collects any demographic data under, pursuant 
to, or in connection with any project, program, initiative, survey, 
study, form, or other activity conducted with such assistance, such 
recipient shall collect and make available, to the same extent that 
demographic data is collected and made available, information regarding 
sexual orientation and gender identity of the same individuals about 
which demographic data is collected.
    ``(c) Definitions.--For purposes of this section, the following 
definitions shall apply:
            ``(1) Demographic data.--The term `demographic data' means 
        information about the race or ethnicity, sex, and age of a 
        program or survey participant or population.
            ``(2) Gender identity.--The term `gender identity' means, 
        with respect to an individual, such individual's sense of being 
        male, female, transgender, or another gender, as distinct from 
        the individual's sex assigned at birth.
            ``(3) Sexual orientation.--The term `sexual orientation' 
        means, with respect to an individual, how such individual 
        identifies in terms of their emotional, romantic, or sexual 
        attractions, and includes identification as straight, 
        heterosexual, gay, lesbian, or bisexual, among other 
        identifications.''.

SEC. 4. OUTREACH AND EDUCATION.

    The Secretary of Housing and Urban Development shall develop and 
implement a program to promote the new forms developed for reporting of 
information pursuant to section 2 of this Act and section 13 of the 
Department of Housing and Urban Development Act (as added by the 
amendment made by section 3 of this Act) to prospective recipients of 
the forms.
