A BILL
To amend title 23, United States Code, to withhold Federal highway
funding from a State that prohibits the sale of motor vehicles that are
not a zero-emission vehicles, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Options for Ownership Act''.
SEC. 2. ZERO-EMISSION VEHICLES.
(a) In General.--Chapter 1 of title 23, United States Code, is
amended by adding at the end the following:
``Sec. 177. Zero-emission vehicles
``(a) Withholding of Funds for Noncompliance.--
``(1) In general.--The Secretary shall withhold 15 percent
of the amount required to be apportioned to any State under
section 104 on the first day of each fiscal year in which the
sale of a motor vehicle in such State that is not a zero-
emission vehicle is prohibited.
``(2) Exception.--This subsection shall not apply to any
State that imposes a fee on motor vehicles that is comparable
in revenue to a gasoline tax.
``(b) Effect of Withheld Funds.--
``(1) Funds not available to noncomplying state.--No funds
withheld under this section from apportionment to any State
shall be available for apportionment to such State.
``(2) Reapportionment of withheld funds.--Any funds that
are withheld from apportionment to any State under this section
shall be reapportioned to the other States.
``(c) Zero-Emission Vehicle.--In this section, the term `zero-
emission vehicle' means a vehicle that produces zero exhaust emissions
of any air pollutant for which a national ambient air quality standard
has been promulgated under section 109 of the Clean Air Act (42 U.S.C.
7409) under any and all possible operational modes and conditions.''.
(b) Clerical Amendment.--The analysis for chapter 1 of title 23,
United States Code, is amended by adding at the end the following:
``177. Zero-emission vehicles.''.
