A BILL
To amend the Federal Insecticide, Fungicide, and Rodenticide Act to
prohibit new labeling changes on use of registered pesticides without
notice, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Farmers Deserve Notification Act''.
SEC. 2. NO NEW RESTRICTIONS OF REGISTERED PESTICIDES WITHOUT NOTICE.
Section 6(a) of the Federal Insecticide, Fungicide, and Rodenticide
Act (7 U.S.C. 136d(a)) is amended by adding at the end the following:
``(3) Notice required.--
``(A) In general.--The Administrator shall not
cancel, suspend or restrict the use of any pesticide
registered under this Act without providing, through
publication in the Federal Register, advance notice of
such cancellation, suspension, or restriction at least
270 days before such cancellation, suspension, or
restriction is to take effect.
``(B) Nonapplicability.--The 270-day notification
period specified in subparagraph (A) shall not be
required with respect to a pesticide if a majority of
the Scientific Advisory Panel established under section
25(d)(1) votes to not require such notification period
with respect to such pesticide.''.
