A BILL
To amend title 10, United States Code, to eliminate the eligibility age
for retired pay for non-regular service in the Armed Forces.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. ELIMINATION OF ELIGIBILITY AGE FOR RETIRED PAY FOR NON-
REGULAR SERVICE IN THE ARMED FORCES.
(a) Elimination.--Section 12731 of title 10, United States Code, is
amended--
(1) in subsection (a), by striking paragraph (1) and
redesignating paragraphs (2) through (4) as paragraphs (1)
through (3), respectively; and
(2) by striking subsection (f).
(b) Technical Amendments.--
(1) Section heading.--The heading of such section is
amended by striking ``Age and service'' and inserting
``Service''.
(2) Table of sections.--The table of sections at the
beginning of chapter 1223 of such title is amended by striking
the item relating to section 12731 and inserting the following:
``12731. Service requirements.''.
(c) Conforming Amendments.--Such title is further amended--
(1) in section 2641b--
(A) in subsection (c)(3), by striking ``,
including'' and all that follows through ``chapter 1223
of this title''; and
(B) in subsection (e), by striking paragraph (3)
and redesignating paragraphs (4) through (6) as
paragraphs (3) through (5), respectively;
(2) in section 12731b(a), by striking ``subsection (a)(2)''
and inserting ``subsection (a)(1)'';
(3) in section 12738(a), by striking ``section
12731(a)(2)'' and inserting ``section 12731(a)(1)''; and
(4) in section 12741--
(A) in subsection (a), by striking ``paragraph (4)
of section 12731(a)'' and inserting ``paragraph (3) of
section 12731(a)''; and
(B) by striking subsection (d) and inserting the
following:
``(d) Effective Date of Election.--An election made by a person
under subsection (a) shall be effective on the first day of the first
month that begins after the date on which the Secretary concerned
receives the election in accordance with this section.''.
