from requiring COVID-19 vaccination as a condition of eligibility for
benefits or assistance under the Medicare, Medicaid, or CHIP programs.

Mr. Scott of Florida introduced the following bill; which was read
twice and referred to the Committee on Finance

A BILL
To prohibit the Secretary of Health and Human Services, any officer or
employee of the Department of Health and Human Services, and States
from requiring COVID-19 vaccination as a condition of eligibility for
benefits or assistance under the Medicare, Medicaid, or CHIP programs.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. PROHIBITION ON REQUIRING COVID-19 VACCINATION AS A CONDITION
OF ELIGIBILITY FOR BENEFITS OR ASSISTANCE UNDER THE
MEDICARE, MEDICAID, OR CHIP PROGRAMS.
Neither the Secretary of Health and Human Services nor any officer
or employee of the Department of Health and Human Services (or, if
applicable, the chief executive officer of a State or any officer or
employee of a State or a State Medicaid or CHIP agency) shall establish
or enforce any requirement that an individual receive a COVID-19
vaccine as a condition of the individual receiving benefits or
assistance under any of the following programs:
(1) The Medicare program under title XVIII of the Social
Security Act (42 U.S.C. 1395 et seq.).
(2) The Medicaid program under title XIX of the Social
Security Act (42 U.S.C. 1396 et seq.).
(3) The Children's Health Insurance Program under title XXI
of the Social Security Act (42 U.S.C. 1397aa et seq.).
