    To prohibit the Secretary of Housing and Urban Development from 
   finalizing, implementing, or enforcing the proposed rule entitled 
   ``Affirmatively Furthering Fair Housing'', which was published on 
                           February 9, 2023.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Flexibility in Housing Act of 
2024''.

SEC. 2. APPLICATION OF CERTAIN RULES BY THE SECRETARY OF HOUSING AND 
              URBAN DEVELOPMENT.

    (a) Prohibition.--The Secretary of Housing and Urban Development 
may not finalize, implement, or enforce the proposed rule entitled 
``Affirmatively Furthering Fair Housing'', which was published on 
February 9, 2023, nor may such rule be reissued in substantially the 
same form, and a new rule that is substantially the same as such a rule 
may not be issued, unless the reissued or new rule is specifically 
authorized by a law enacted thereafter.
    (b) Reinstatement.--The final rule of the Department of Housing and 
Urban Development entitled, ``Preserving Community and Neighborhood 
Choice'' (85 Fed Reg 47899, August 7, 2020) shall have the full force 
and effect of law.
