To amend title 49, United States Code, to clarify that noise abatement 
   and lead abatement are not unjust discrimination for purposes of 
   project approval for certain airport improvement program project 
                   approvals, and for other purposes.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. PROJECT GRANT APPLICATION APPROVAL.

    Section 47107 of title 49, United States Code, is amended by adding 
at the end the following:
    ``(x) Clarification on Unjust Discrimination.--The Secretary may 
not consider noise abatement or lead abatement measures to be unjust 
discrimination for purposes of interpreting assurances for grant 
applications, operation, or development of an airport under this 
chapter.''.
