                                 A BILL


 
To amend title X of the Public Health Service Act to prohibit requiring 
a recipient or subrecipient of funds to provide referrals for abortion, 
                        and for other purposes.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``States Choose Life Act of 2023''.

SEC. 2. NO REQUIREMENT UNDER TITLE X TO PROVIDE REFERRALS FOR ABORTION.

    (a) In General.--Title X of the Public Health Service Act (300 et 
seq.) is amended by adding at the end the following:

``SEC. 1009. NO REQUIREMENT TO PROVIDE REFERRALS FOR ABORTION.

    ``The Secretary shall not require, as a condition on receipt of 
funds under this title, that any recipient or subrecipient of such 
funds provide--
            ``(1) referrals for pregnancy termination; or
            ``(2) information or counseling on options for pregnancy 
        termination that are unlawful in the State where the family 
        planning services are being provided.''.
    (b) Regulations.--Not later than 60 days after the date of 
enactment of this Act, the Secretary of Health and Human Services shall 
promulgate a final regulation revising section 59.5(a)(5) of title 42, 
Code of Federal Regulations, and making such other changes to 
regulations as may be necessary, to carry out section 1009 of the 
Public Health Service Act, as added by subsection (a).
