A BILL
To amend title 38, United States Code, to require the Secretary of
Veterans Affairs to furnish memorial headstones and markers for
eligible spouses and dependent children of veterans whose remains are
unavailable, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. ELIGIBILITY FOR DEPARTMENT OF VETERANS AFFAIRS MEMORIAL
HEADSTONES AND MARKERS OF VETERANS' SPOUSES AND DEPENDENT
CHILDREN WHOSE REMAINS ARE UNAVAILABLE.
Section 2306(b)(2) of title 38, United States Code, is amended--
(1) in subparagraph (B), by striking ``An individual who
dies on or after November 11, 1998, who is the'' and inserting
``The'';
(2) in subparagraph (C), by striking ``An individual who
dies on or after November 11, 1998, who is an'' and inserting
``An''; and
(3) by adding at the end the following new paragraph:
``(6) In the case of an eligible individual described in
paragraph (2)(B) or (C), the Secretary may furnish a marker
under paragraph (1) by--
``(A) affixing the individual's name, dates of
birth and death, and relationship to the veteran to an
existing marker for the veteran; or
``(B) if necessary, by furnishing a suitable
replacement marker for the veteran that includes such
individual's name, dates of birth and death, and
relationship to the veteran.
``(7) For the purpose of expediting the provision of a
marker under paragraph (1) for an eligible individual described
in paragraph (2)(B) or (C), the Secretary may accept, but may
not require, funds contributed by a survivor of the veteran or
eligible person.''.
