 To amend title XI of the Social Security Act to exclude expenditures 
 attributable to a State medicaid fraud control unit from the payment 
   limits under Medicaid for Guam, the Northern Mariana Islands, and 
                            American Samoa.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Medicaid Accountability Act of 
2023''.

SEC. 2. EXCLUSION OF EXPENDITURES ATTRIBUTABLE TO STATE MEDICAID FRAUD 
              CONTROL UNIT FROM PAYMENT LIMITS.

    Section 1108(g)(4)(A) of the Social Security Act (42 U.S.C. 
1308(g)(4)(A)) is amended by inserting ``and with respect to fiscal 
years beginning on or after the date of the enactment of the Medicaid 
Accountability Act of 2023, if Guam, the Northern Mariana Islands, or 
American Samoa qualify for a payment under section 1903(a)(6) for a 
calendar quarter of such fiscal year,'' before ``the payment shall not 
be taken into account''.
