A BILL
To prohibit the Secretary of Homeland Security or the Secretary of
State, as applicable, from approving any application for or issuing a
nonimmigrant or immigrant visa to nationals of Palestine.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Safeguarding Americans From
Extremism Act of 2023'' or the ``SAFE Act of 2023''.
SEC. 2. PROHIBITION ON ISSUING CERTAIN VISAS TO NATIONALS OF PALESTINE.
(a) Temporary Protected Status.--The Secretary of Homeland Security
may not grant a covered alien temporary protected status in the United
States pursuant to section 244 of the Immigration and Nationality Act
(8 U.S.C. 1254a).
(b) Immigrant and Nonimmigrant Visas.--
(1) In general.--The Secretary of Homeland Security and the
Secretary of State may not approve any application for or issue
a nonimmigrant or immigrant visa, as applicable, to a covered
alien.
(2) Revocation.--The Secretary of Homeland Security shall
revoke any nonimmigrant or immigrant visa issued to a covered
alien on or after October 1, 2023.
(c) Asylum.--
(1) In general.--The Secretary of Homeland Security or the
Attorney General may not grant asylum to a covered alien who
has applied for asylum in accordance with section 208 of the
Immigration and Nationality Act (8 U.S.C. 1158).
(2) Revocation.--The Secretary of Homeland Security shall
revoke a covered alien's status as an asylee if such status was
applied for on or after October 1, 2023.
(d) Refugee Status.--
(1) In general.--The Secretary of Homeland Security may not
grant admission as a refugee to a covered alien.
(2) Revocation.--The Secretary of Homeland Security shall
revoke a covered alien's status as a refugee if such status was
applied for on or after October 1, 2023.
(e) Parole.--
(1) In general.--The Secretary of Homeland Security may not
parole into the United States a covered alien.
(2) Revocation.--The Secretary of Homeland Security shall
revoke a covered alien's parole if such alien was paroled into
the United States on or after October 1, 2023.
(f) Inadmissibility.--A covered alien shall be inadmissible to the
United States.
(g) Removal.--Beginning on the date of the enactment of this Act,
the Secretary of Homeland Security, in coordination with the Director
of U.S. Immigration and Customs Enforcement and the Director of U.S.
Citizenship and Immigration Services, shall promptly identify covered
aliens who do not have lawful status under the immigration laws (as
such term is defined in section 101 of the Immigration and Nationality
Act (8 U.S.C. 1101)) and take such steps as necessary to remove such
aliens.
(h) Covered Alien Defined.--In this section, the term ``covered
alien'' means an alien who is a holder of a passport or other travel
document issued by the Palestinian Authority.
