A BILL
Making continuing appropriations for the Armed Forces and certain
Federal civilian personnel in the event of a Government shutdown during
fiscal year 2024, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Funding A Secure America Act''.
SEC. 2. CONTINUING APPROPRIATIONS FOR MEMBERS OF THE ARMED FORCES.
(a) In General.--There are hereby appropriated for fiscal year
2024, out of any money in the Treasury not otherwise appropriated, for
any period during which interim or full-year appropriations for fiscal
year 2024 are not in effect--
(1) such sums as are necessary to provide pay and
allowances to members of the Armed Forces (as defined in
section 101(a)(4) of title 10, United States Code), including
reserve components thereof, who perform active service during
such period;
(2) such sums as are necessary to provide pay and
allowances to the civilian personnel of the Department of
Defense (and the Department of Homeland Security in the case of
the Coast Guard) whom the Secretary concerned determines are
providing support to members of the Armed Forces described in
paragraph (1); and
(3) such sums as are necessary to provide pay and
allowances to contractors of the Department of Defense (and the
Department of Homeland Security in the case of the Coast Guard)
whom the Secretary concerned determines are providing support
to members of the Armed Forces described in paragraph (1).
(b) Secretary Concerned Defined.--In this section, the term
``Secretary concerned'' means--
(1) the Secretary of Defense with respect to matters
concerning the Department of Defense; and
(2) the Secretary of Homeland Security with respect to
matters concerning the Coast Guard.
SEC. 3. CONTINUING APPROPRIATIONS FOR CBP, ICE, TSA, AIR TRAFFIC
CONTROLLERS, AND DEPARTMENT OF VETERANS AFFAIRS
PERSONNEL.
(a) Employees.--There are hereby appropriated for fiscal year 2024,
out of any money in the Treasury not otherwise appropriated, for any
period during which interim or full-year appropriations for fiscal year
2024 are not in effect, such sums as are necessary for the salaries and
expenses of--
(1) U.S. Customs and Border Protection agents and officers
who are performing mission critical functions at United States
Southwest, Northern, and maritime border ports of entry, and
between such ports of entry, including preventing entry of
terrorists, terrorists weapons, illegal aliens, illicit drugs,
and other illegal contraband;
(2) U.S. Immigration and Customs Enforcement officers and
agents who conduct--
(A) immigration enforcement, including detaining
and removing aliens (as defined in section 101 of the
Immigration and Nationality Act); and
(B) investigations of criminal operations and
organizations, including--
(i) the illegal trade of contraband such as
goods, weapons, and drugs; and
(ii) the smuggling and trafficking of
people;
(3) any officer or employee of the Transportation Security
Administration engaged in law enforcement or security
functions, including the Federal Air Marshal Service,
operations support, and security operations office;
(4) any air traffic controller (as that term is defined in
section 8331 of title 5, United States Code); and
(5) any officer or employee of the Department of Veterans
Affairs--
(A) who is employed at--
(i) the Board of Veteran's Appeals;
(ii) a medical facility of the Department;
(iii) a contact center of the Department;
(iv) the toll-free hotline for veterans
provided by the Secretary under section
1720F(h) of title 38, United States Code; or
(v) regional office of the Department; or
(B) whose official duties involve the processing
and delivery of benefits under the laws administered by
the Secretary of Veterans Affairs, including burial
benefits.
(b) Contractors.--There are hereby appropriated for fiscal year
2024, out of any money in the Treasury not otherwise appropriated, for
any period during which interim or full-year appropriations for fiscal
year 2024 are not in effect, such sums as are necessary to provide pay
and allowances to contractors of each agency under subparagraph (3),
(4), or (5) of subsection (a) whom the head of such agency determines
are providing support to employees of the agency described under any
such paragraph.
SEC. 4. TERMINATION.
Appropriations and funds made available and authority granted
pursuant to this Act shall be available until whichever of the
following first occurs:
(1) The enactment into law of an appropriation (including a
continuing appropriation) for any purpose for which amounts are
made available in section 2 or 3.
(2) The enactment into law of the applicable regular or
continuing appropriations resolution or other Act without any
appropriation for such purpose.
(3) October 1, 2024.
