   Guest, Mr. Collins, and Mr. Williams of New York) introduced the 
following bill; which was referred to the Committee on Armed Services, 
 and in addition to the Committee on the Judiciary, for a period to be 
subsequently determined by the Speaker, in each case for consideration 
  of such provisions as fall within the jurisdiction of the committee 
                               concerned

                                 A BILL


 
    To authorize the National Guard to take such actions as may be 
 necessary to repel persons attempting to enter the United States from 
        Mexico who are carrying weapons, and for other purposes.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Defend Our Borders From Armed 
Invaders Act''.

SEC. 2. AUTHORITY OF NATIONAL GUARD TO REPEL PERSONS ATTEMPTING TO 
              ENTER THE UNITED STATES FROM MEXICO WHO ARE CARRYING 
              WEAPONS.

    (a) Authority.--Section 502(f)(2) of title 32, United States Code, 
is amended by adding at the end the following new subparagraph:
            ``(C) Notwithstanding section 1385 of title 18, such 
        actions as may be necessary to repel any person who is--
                    ``(i) attempting to enter the United States by land 
                across the border between the United States and Mexico; 
                and
                    ``(ii) clearly carrying a weapon.''.
