Energy and Commerce, and in addition to the Committee on Ways and
Means, for a period to be subsequently determined by the Speaker, in
each case for consideration of such provisions as fall within the
jurisdiction of the committee concerned

A BILL
To amend title XVIII of the Social Security Act to prohibit the
Secretary of Health and Human Services from selecting certain
activities relating to the development of anti-racism plans as clinical
practice improvement activities under the Medicare program.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Preventing Racism in Medicare Act of
2024''.
SEC. 2. PROHIBITING THE SECRETARY OF HEALTH AND HUMAN SERVICES FROM
SELECTING CERTAIN ACTIVITIES RELATING TO THE DEVELOPMENT
OF ANTI-RACISM PLANS AS CLINICAL PRACTICE IMPROVEMENT
ACTIVITIES UNDER THE MEDICARE PROGRAM.
Section 1848(q)(2)(C)(v)(III) of the Social Security Act (42 U.S.C.
1395w-4(q)(2)(C)(v)(III)) is amended by adding at the end the following
new sentence: ``Such term does not include any activity consisting of
the development of an anti-racism plan (as described in the rule
entitled `Medicare Program; CY 2022 Payment Policies Under the
Physician Fee Schedule and Other Changes to Part B Payment Policies;
Medicare Shared Savings Program Requirements; Provider Enrollment
Regulation Updates; and Provider and Supplier Prepayment and Post-
Payment Medical Review Requirements' published on November 19, 2021 (86
Fed. Reg. 65969 et seq.)) or any substantially similar activity.''.
