Committee on Energy and Commerce, and in addition to the Committee on
Ways and Means, for a period to be subsequently determined by the
Speaker, in each case for consideration of such provisions as fall
within the jurisdiction of the committee concerned

A BILL
To direct the Secretary of Health and Human Services to revise
regulations to remove the requirement under the Medicare program that
an ambulatory surgical center shall report the COVID-19 vaccination
status of health care personnel.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Protecting Healthcare Employee
Privacy Act''.
SEC. 2. REMOVING COVID-19 VACCINATION STATUS REPORTING REQUIREMENT FOR
AMBULATORY SURGICAL CENTERS.
Not later than 45 days after the date of the enactment of this Act,
the Secretary of Health and Human Services shall revise sections
416.300 through 416.330 of title 42, Code of Federal Regulations (or
any successor regulations) to remove the requirement under the Medicare
program that an ambulatory surgical center shall report the COVID-19
vaccination status of health care personnel.
