A BILL
To amend section 3706 of title 10, United States Code, to eliminate the
submission of cost and pricing data after agreeing on the contract
price as a defense to contract price adjustments for defective cost and
pricing data, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Best Price for Our Military Act of
2024''.
SEC. 2. ELIMINATION OF LATE COST AND PRICING DATA SUBMISSION DEFENSE.
Section 3706(c) of title 10, United States Code, is amended--
(1) in paragraph (3) by striking ``or'' at the end;
(2) in paragraph (4) by striking the period and inserting
``; or''; and
(3) by adding at the end the following:
``(5) the cost or pricing data were submitted by the prime
contractor or subcontractor after the date of agreement on the
price of the contract (or price of the modification) or, if
applicable consistent with subsection (a)(2), such other date
agreed upon between the parties.''.
