A BILL
To amend the Protecting Access to Medicare Act of 2014 to clarify the
meaning of psychiatric rehabilitation services under demonstration
programs to improve community mental health services, and for other
purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Certified Community Behavioral
Health Clinic Expansion Act of 2024''.
SEC. 2. CLARIFYING PSYCHIATRIC REHABILITATION SERVICES UNDER
DEMONSTRATION PROGRAMS TO IMPROVE COMMUNITY MENTAL HEALTH
SERVICES.
(a) Psychosocial Rehabilitation Services.--
(1) Care coordination.--Section 223(a)(2)(C) of the
Protecting Access to Medicare Act of 2014 (42 U.S.C. 1396a
note) is amended--
(A) in the matter preceding clause (i), by
inserting ``psychosocial,'' after ``chronic,'';
(B) by redesignating clauses (iv) and (v) as
clauses (v) and (vi), respectively;
(C) by inserting after clause (iii) the following:
``(iv) Clubhouses located within the same
metropolitan statistical area as the certified
community behavioral health clinic, if any such
clubhouses exist.''; and
(D) by adding at the end the following:
``(vii) Housing and residential
programs.''.
(2) Scope of services for certification.--Section
223(a)(2)(D) of the Protecting Access to Medicare Act of 2014
(42 U.S.C. 1396a note) is amended--
(A) by amending clause (iii) to read as follows:
``(iii) Patient-centered treatment planning
or similar processes, including--
``(I) risk assessment and crisis
planning;
``(II) programs that are respectful
of the person's autonomy to choose the
services they prefer and are provided
equitably; and
``(III) equity-based and
noncompulsory programmatic practices in
which persons are invited to support
each other and participate in decision-
making around community activities and
services.'';
(B) by redesignating clause (viii) as clause (ix);
and
(C) by striking clause (vii) and inserting the
following:
``(vii) Supporting self-management,
including in--
``(I) managing the person's
finances, medications, and self-care;
and
``(II) using community resources.
``(viii) Psychiatric rehabilitation
services, and psychosocial rehabilitation
services, that--
``(I) restore, rehabilitate, and
support daily functioning, skills
development, self-esteem, and agency to
improve self-management of the negative
effects of psychiatric and emotional
symptoms; and
``(II) include formalized
activities, peer supports, and
counselor services, and family supports
to help individuals develop resilience
to changes in psychiatric symptoms and
stressors of all kinds to prevent
crisis and promote functioning and
stability.''.
(3) Quality and other reporting.--Subparagraph (E) of
section 223(a)(2) of the Protecting Access to Medicare Act of
2014 (42 U.S.C. 1396a note) is amended to read as follows:
``(E) Quality and other reporting.--Reporting of--
``(i) encounter data;
``(ii) clinical outcomes data;
``(iii) quality data;
``(iv) patient-reported outcome measures
that assess people's loneliness, quality of
life, thriving, and other outcomes of recovery;
and
``(v) such other data as the Secretary
requires.''.
(b) Definitions.--Section 223(e) of the Protecting Access to
Medicare Act of 2014 (42 U.S.C. 1396a note) is amended--
(1) by redesignating paragraphs (1), (2), (3), and (4) as
paragraphs (2), (3), (4), and (5), respectively;
(2) by inserting before paragraph (2) (as so redesignated)
the following:
``(1) Clubhouse.--The term `clubhouse' means a therapeutic
social environment that--
``(A) is accredited, or is in the process of
becoming accredited, by a recognized body or bodies
approved by the Secretary for purposes of this
paragraph;
``(B) addresses psychosocial deficits and social
drivers of health;
``(C) uses a therapeutic approach that emphasizes
purposeful work, engagement, relationship development,
and mutual support for people with serious mental
illness;
``(D) uses blended leadership of professional
mental health staff and individuals with lived
experience to create and manage the therapeutic
community and its services in a nonclinical setting;
``(E) offers members a community-based
rehabilitative environment that both addresses often-
unmet psychosocial needs of people living with serious
mental illness and provides structures that offer
support in natural, community environments;
``(F) offers support services for employment,
education, health care, housing, and more to broadly
address health-related social care needs;
``(G) is an essential part of the continuum of care
and works in tandem with other medical and behavioral
health services;
``(H) relies on the restorative power of work and
work-mediated relationships to build a firm foundation
for growth and individual achievement for members;
``(I) emphasizes strengths-based teamwork and
opportunities to contribute to operations through a
work-ordered day; and
``(J) offers naturalistic social and community-
based recreational opportunities to contribute to a
member's path and success in recovery.''.
(c) Implementation Timeline.--Not later than 1 year after the date
of enactment of this Act, the Secretary of Health and Human Services
shall publish revised criteria under subsection (a) of section 223 of
the Protecting Access to Medicare Act of 2014 (42 U.S.C. 1396a note)
for a clinic to be certified by a State as a certified community
behavioral health clinic for purposes of participating in a
demonstration program conducted under subsection (d) of such section.
