A BILL
To amend title 18, United States Code, to improve firearm destruction
practices, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Destroy Zombie Guns Act''.
SEC. 2. SAFE FIREARM DESTRUCTION.
(a) In General.--Section 922 of title 18, United States Code is
amended by adding at the end the following:
``(aa) It shall be unlawful for any person engaged in the business
of destroying firearms, while destroying or aiding in the destruction
of a firearm that has been shipped or transported in interstate or
foreign commerce, to not destroy every component of the firearm.''.
(b) Definition of ``Engaged in the Business'' as Applied to a
Destroyer of Firearms.--Section 921(a)(21) of such title is amended--
(1) by striking ``and'' at the end of subparagraph (E);
(2) by striking the period at the end of paragraph (F) and
inserting ``; and''; and
(3) by adding at the end the following:
``(G) as applied to a destroyer of firearms, a person who
devotes time, attention, and labor to the destruction of
firearms or firearm components as a regular course of trade or
business to predominantly earn a profit through services
rendered to facilitate the destruction of a firearm or firearm
components.''.
(c) Penalties.--Section 924(a) of such title is amended by adding
at the end the following:
``(9)(A) Any person who violates section 922(aa) shall be fined
under this title, imprisoned for not more than 2 years, or both, in
addition to any penalty imposed on the person under paragraph (2) of
this subsection.
``(B) In addition to any penalty imposed under subparagraph (A) of
this paragraph on a licensee under this chapter, the Attorney General
may, after notice and opportunity for a hearing, suspend the license
issued to the licensee in the case of the first violation of section
922(aa), or, in the case of any subsequent violation, shall immediately
revoke the license.''.
