A BILL
To amend title III of the Public Health Service Act to include
territorial disproportionate share hospitals as covered entities under
the 340B drug discount program.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Equitable Access to 340B Act''.
SEC. 2. INCLUDING TERRITORIAL DISPROPORTIONATE SHARE HOSPITALS AS
COVERED ENTITIES UNDER THE 340B DRUG DISCOUNT PROGRAM.
Section 340B of the Public Health Service Act (42 U.S.C. 256b) is
amended--
(1) in subsection (a)(4), by adding at the end the
following new subparagraph:
``(P) An entity that is a territorial
disproportionate share hospital (as defined in
subsection (b)(3)) and meets the requirements of
clauses (i) and (ii) of subparagraph (L).''; and
(2) in subsection (b), by adding at the end the following
new paragraph:
``(3) Territorial disproportionate share hospital.--The
term `territorial disproportionate share hospital' means a
hospital that meets the requirements of a Medicaid deemed
disproportionate share hospital (as described in section
1923(b)(1) of the Social Security Act) and is located in the
Northern Mariana Islands, Guam, American Samoa, or the Virgin
Islands.''.
