To amend title 49, United States Code, to exempt ticket agents that are 
small businesses from the requirement to provide refunds for cancelled 
  or significantly delayed or changed flights, and for other purposes.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Flight Refund Fairness Act''.

SEC. 2. REFUNDS FOR CANCELLED OR SIGNIFICANTLY DELAYED OR CHANGED 
              FLIGHTS.

    Section 42305(e) of title 49, United States Code, is amended by 
adding at the end the following:
            ``(4) Special rule for small businesses.-- This subsection 
        shall not apply to a ticket agent that is a small business (as 
        determined by the Administrator of the Small Business 
        Administration).''.
