A BILL
To amend the National Defense Authorization Act for Fiscal Year 2013 to
add whistleblower protections to certain modified contracts, and for
other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Ensuring Access to Whistleblower
Protections Act''.
SEC. 2. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT CONTRACTS.
Section 828(b)(3) of the National Defense Authorization Act for
Fiscal Year 2013 (Public Law 112-239; 126 Stat. 1841) is amended--
(1) by striking ``At the time'' and inserting the
following:
``(A) In general.--At the time''; and
(2) by adding at the end the following new subparagraph:
``(B) Department of housing and urban development
contracts.--
``(i) In general.--At the time of any
covered modification to a contract that the
Secretary of Housing and Urban Development has
awarded before the date that is 180 days after
the date of the enactment of this Act, the
Secretary of Housing and Urban Development
shall make best efforts to include in the
contract a contract clause providing for the
applicability of the amendments made by this
section to the contract.
``(ii) Covered modification defined.--In
this subparagraph, the term `covered
modification' means any modification, including
a modification relating to--
``(I) a contract option year;
``(II) a contract extension;
``(III) a contract renewal;
``(IV) a review for approval of or
execution of an annual contributions
contract;
``(V) a substantial deviation;
``(VI) a significant amendment; or
``(VII) an annual cost or rent
adjustment.''.
