A BILL
To modify the Iran Nuclear Weapons Capability and Terrorism Monitoring
Act of 2022.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Iranian Enrichment Monitoring Act of
2023''.
SEC. 2. DEFINITIONS.
In this Act:
(1) Appropriate congressional committees.--The term
``appropriate congressional committees'' means--
(A) the Committee on Armed Services, the Committee
on Foreign Relations, the Select Committee on
Intelligence, the Committee on Appropriations, and the
Committee on Energy and Natural Resources of the
Senate; and
(B) the Committee on Armed Services, the Committee
on Foreign Affairs, the Permanent Select Committee on
Intelligence, the Committee on Appropriations, and the
Committee on Energy and Commerce of the House of
Representatives.
(2) Congressional leadership.--The term ``congressional
leadership'' means--
(A) the majority leader of the Senate;
(B) the minority leader of the Senate;
(C) the Speaker of the House of Representatives;
and
(D) the minority leader of the House of
Representatives.
(3) Significant enrichment activity.--The term
``significant enrichment activity'' means--
(A) any enrichment of any amount of uranium-235 to
a purity percentage that is 5 percent higher than the
purity percentage indicated in the prior notification
to Congress under section 3(a); or
(B) any enrichment of uranium-235 in a quantity
exceeding 10 kilograms.
SEC. 3. NOTIFICATION TO CONGRESS.
(a) In General.--Not later than 48 hours after the Director of
National Intelligence determines that the Islamic Republic of Iran has
produced or possesses any amount of uranium-235 enriched to greater
than 60 percent purity, the Director of National Intelligence shall
submit to the appropriate congressional committees and congressional
leadership a notification of such determination.
(b) Classified Notice to Members of Congress.--Not later than 24
hours after the submission of the notification under subsection (a),
the Director of National Intelligence shall submit to Congress a 1-page
document with respect to the determination, which shall be--
(1) made available to any member of the Senate or the House
of Representatives; and
(2) classified at the Top Secret/Sensitive Compartmented
Information level.
(c) Subsequent Notifications.--If the Director of National
Intelligence determines that the Islamic Republic of Iran has engaged
in significant enrichment activity subsequent to the submission of a
notification under subsection (a), the Director of National
Intelligence shall submit to the appropriate congressional committees
and congressional leadership--
(1) not later than 48 hours after making a determination
that such significant enrichment activity has occurred, a
notification of the determination; and
(2) not later than 24 hours after the submission of the
notification under paragraph (1), a 1-page document with
respect to the determination.
