A BILL
To establish a new pilot program that would test coverage of outpatient
observation services furnished outside a hospital under the Acute
Hospital Care at Home initiative.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``At Home Observation and Medical
Evaluation Services Act of 2024'' or the ``At HOME Services Act of
2024''.
SEC. 2. PILOT PROGRAM TO INCLUDE OBSERVATION SERVICES IN THE ACUTE
HOSPITAL CARE AT HOME INITIATIVE.
(a) In General.--Not later than 1 year after the date of enactment
of this Act and subject to subsection (b), the Secretary of Health and
Human Services in coordination with the Centers for Medicare and
Medicaid Services shall establish a pilot program to test expanding the
Acute Hospital Care at Home initiative described in section 1866G of
the Social Security Act (42 U.S.C. 1395cc-7) to allow a hospital to
furnish outpatient observation services to an individual at home in
accordance with such requirements as the Secretary shall specify.
(b) Required Notification.--Notwithstanding any other provision of
law, the Secretary may not waive the requirements of section
1866(a)(1)(Y) of the Social Security Act (42 U.S.C. 1395cc(a)(1)(Y))
for hospitals participating in the pilot program.
